FINAL APPROVAL REVIEW PROCEDURES: 1. The Short Subdivision Committee may grant final approval of the short subdivision when they find the criteria listed in TMC 17.12.030C have been met. No formal meeting of the Committee is required so long as the Chair obtains the recommendations and consent of the other members of the Committee before issuing a decision. 2. Upon final approval of the short plat, the applicant shall record the plat and all other relevant documents with the King County Department of Records and Elections. The subdivider is responsible for paying the recording fee(s). Upon completion of recording, the applicant shall provide DCD with a copy of the recorded documents. The short plat shall not be considered final until these documents have been provided to DCD. C. CRITERIA FOR APPROVAL: To grant final approval of a short plat, the Short Subdivision Committee must determine that it meets the following decision criteria: 1. All requirements for short plats as set forth in the Subdivision Code are met. 2. All terms of the preliminary short plat approval have been met. 3. The requirements of Chapter 58.17 RCW, other applicable state laws, and any other applicable City ordinances have been met. 4. All required improvements have been installed in accordance with City standards or an improvement agreement with financial guarantee pursuant to TMC 17.24.030 has been entered into by the applicant and accepted by the City. 5. That the plat is technically correct and accurate as certified by the land surveyor responsible for the plat. (Ord. 1833 §1(part), 1998) 17.12.040 Expiration. If the short plat is not recorded within one year of the date of preliminary short plat approval, the short plat shall become null and void. Upon written request by the subdivider prior to the expiration date, the Short Subdivision Committee may grant one extension of not more than one year. (Ord. 1833 ,§1(part), 1998) 17.12.050 Limitations on further subdivision. Any land subdivided under the requirements of this chapter shall not be further divided for a period of five years without following the procedures for subdivision, except when the short plat contains fewer lots than allowed for a short plat, in which case an additional short plat may be approved if the total number of lots within the boundaries of the original short plat does not exceed nine. No application for a short plat shall be approved if the land being divided is held in common ownership with a contiguous parcel which has been divided in a short plat within the preceding five years and the total number of lots created in both short plats would exceed nine. When the total number of lots exceeds four but is less than ten, the paving, curb, gutter and sidewalk shall be provided per TMC 17.20.030C.6.c(1). PROJECT DESCRIPTION: The proposal is to pave an area for parking, trailer storage and vehicular circulation at an existing building located at 10730 West Marginal Way South. Z• F U O co o f-; • W4. LI O: z Subsequent to the application submittal the Federal Government, dba the U.S. Postal Service, purchased the building. Attorney Bob Johns reviewed the situation and advised us that we have limited authority with our shoreline jurisdiction, our focus of review is limited to environmental considerations only. The Everett Home Port case concluded that the local jurisdiction has no authority over Federal Government use of shorelines. As a result, Bob Johns has advised us that we do not have authority to act on the variance request, as it pertains to a use issue, not an environmental issue. 2. POLICIES OF THE SMA /SMP: The site is within the jurisdiction of the King County Shoreline Master Program. Several policies below have been identified as being the most relevant to the proposal at hand. Non - environmental policies of the SMP have not been considered. SHORELINE USE ELEMENT Objective No. 7: Unique and fragile areas of the shoreline should be protected from uses or activities that will have an adverse effect on the land or water environment. ECONOMIC DEVELOPMENT ELEMENT Objective No. 3.4: Economic development should be prohibited in identified unique and fragile areas. CONSERVATION ELEMENT GOAL: Assure preservation of unique and non - renewable natural resources and assure conservation of renewable natural resources for the benefit of existing and future generations and the 'public interest. z Objective No. 1: Shorelines which are of unique or valuable natural w' character should be acquired for public benefit commensurate with preservation of the ecosystem. Comment: The development is largely consistent with these goals. The project does not disturb the river, which is the primary environmental resource on the site. 3. ICING COUNTY SHORELINE REGULATIONS: Following are the relevant review criteria as contained in the King County Shoreline Master Program (Title 25 KCC). Again, non - environmental regulations have not been included given the direction provided by Bob Johns: General Requirements (25.16.030) (C) All development shall...provide adequate surface water retention and sedimentation facilities during the construction period. Comment: Retention and sedimentation are normally addressed through the land altering permit process. However, the Federal Government has chosen to bypass local permitting processes. (E2) Any parking perimeter...must be maintained as a planting area with a minimum width of five feet. Comment: The landscape plan shows this requirement is met for parking within 200 feet of the river except for a 72 foot stretch along the east boundary of the site. The City's limited authority does not allow us to require this aesthetic standard be met. (E3) One live tree with a minimum height of four feet shall be required for each thirty linear feet of planting area. Comment: This requires about 50 trees to be provided. Proposed are 95 trees. (E4) One live shrub of one - gallon container size or larger for each sixty linear inches of planing area shall be required. Comment: This requires ROUGHLY 290 -300 shrubs. No shrubs are proposed. See comment to E2 above. (E5) Additional perimeter and interior landscaping of parking areas may be required, at the discretion of the director, when it is necessary to screen parking areas or when large parking areas are proposed. Comment: See comment to E2. (F) Collection facilities to control and separate contaminants shall be required where stormwater runoff from impervious surfaces would degrade or add to the pollution of recipient waters or adjacent properties. Comment: The project will increase pollutants from vehicles on the site. The storm water system has been designed so that water will be directed to one of three oil /water separators and then through a bioswale for treatment prior to discharge to the Duwamish River. Although the City does not have permit authority over stormwater, according to attorney Mike Monroe we do have authority to condition the project to meet water quality standards. This authority is based upon the Clean Water Act. The recommended condition of approval has been approved by Public Works. 5. RECOMMENDATION: Approve the shoreline permit with the following condition: 1. Comply with the standards of the City of Tukwila Storm Water Management Ordinance as they apply to water quality. This option was to be exercised prior to January 15, 1996, or upon completion of building renovations by Sabey. For economic reasons, the Postal Service elected to exercise its purchase option early. Closing took place on January 2, 1996. Sabey Corporation will continue to carry out their contractual responsibilities related to design and construction of building renovations. Even though we will not pursue obtaining a building permit, I want to assure you and the City of Tukwila that all work, with few exceptions, will be accomplished in accordance with governing codes and ordinances. One exception relates to life -safety exit requirements. Complying with present Uniform Building Code (UBC) exit requirements would restrict mail operations in our facility. The UBC does, however, allow for an equivalency interpretation. To be assured that our buildings meet this equivalency, we have retained the services of a code analysis expert, Mr. Gregory R. Keith, President of Professional heuristic Development. He will provide us with alternative exit requirements that will insure proper safety for our employees. Sabey Corporation and the Postal Service will continue to work with you as this project goes forward. The burden of proving that the proposed variance meets these conditions shall fall on the applicant. Sabey Corporation has addressed each and every criteria outlined in WAC 173 -14 -150. Each criteria is paraphrased followed by our response. 1. WAC 173 -14 -150. Identify extraordinary circumstances. Oxbow Corporate Park is an existing development with three (3) large buildings exceeding 660,000 sq.ft. directly upland of the limits affected by the Shoreline zone requirements. The site is not fully developed to date. This undeveloped land, (see ALTA enclosed) within the existing site, must be utilized as parking and truck maneuvering in order to lease the property. This is an allowed use under the Shorelines Management Act under the variance process. 2. WAC 173 -14- 150(1). Show that the public interest will not suffer any detrimental effect. E., Director RECE V Nov 16 1995 COMMUNITY DEVELOPMENT Memorializing our November 15th telephone conversation responding to your 11/3/95 letter I provide the following: At our 10/25/95 meeting, I presented King County's definition of "top of bank ", which Andy Levesque interpreted for your development as the existing plateau elevation where stable ground occurs. Andy recommend your geotechnical engineer determine the location where stable ground begins. In lieu of a geotechnical analysis, Andy Levesque indicated he would accept the intersection of a 2H:1 V line from the toe of the river projected to top of existing ground (but defer to future geotechnical engineer's analysis). Reviewing your November 3 letter with Andy, he did not agree with the top of bank defined at the standard project flood elevation plus 2 feet - - -for the purpose of locating King County's flood easement. When Public Works began reviewing your plans as part of the shoreline process, I requested the developer locate the flood easement on the plans and provide a copy of this easement so we could determine who owns the easement. Our purpose was to make sure the proposed development did not interfere with the flood easement rights. I anticipated that this easement may have been in favor of Tukwila due to the recent annexation. However, from Andy's recent review of the easement document, he determined that it was granted to King County and not transferred toTukwila at the time of annexation. Although I have carried out this coordination to date for the shoreline process, it's becoming apparent that there may be a conflict between the owner's and K.C.'s interpretations of the easement location. Therefore, I believe that it is appropriate the two parties work directly together on this matter in order to arrive at a final determination as to its location. As result of t is discussion, we understand the location and width of • this easement is based on proving for the construction and maintenance of a flood protection levee along the river. We also understand that: • A top of levee elevation two feet above the standard project tiood of 8.8 is required to provide flood protection • The top of levee is measures from a two to one slope projection\from the ordinary high -water mark commonly interpreted as the edge of vegetation line along the river bank • The 30 -foot flood protection easement is measured from the top of bank that is required for flood protection Based on this information, the required top of berm elevation would be 10.6- and the floodway Protection would extend 30 feet from this contour elevation into the site. Please refer to the enclosed sketches which graphically show our understanding of the location of the flood protection easement in relation to the Oxbow Site. Please note this new interpretation of the flood protection easement location falls southeasterly of the proposed location. We suggest that we stay with the currently proposed easement location as shown on ESM's ALTA dated August 18, 1995, where it dose not conflict with the proposed improvements. Reviewing parking, if the United States Postal Service occupies Buildings 250 and 252 with planned additions and Building 251 is occupied by a office user, the site would have a total of 1,184 parking spaces. The suburban office market demands a parking ratio of 5 parking spaces per 1,000 s.f. Therefore, Sabey Corporation needs to utilize the entire property to be able to continue leasing the buildings at their current use - office at 251 and industrial/ office at 250/252. Also, the USPS requires a 150' maneuvering apron south of Building 250 within the 200' Shoreline setback. The following parking analysis addresses code minimum and market demand: Office - 231,000 s.f. Industrial - 534,000 s.f. First, the Exhibit "A" photo clearly shows that approximately 50% of the Oxbow peninsula already has parking within 200' of the river. That is a strong precedent and supports our position that we are not requesting special consideration. Finally, in the April 6, 1995 predevelopment meeting between Sabey Corporation and City of Tukwila officials, it was stated that the City of Tukwila Shoreline Regulations would be adopted for the annexed Oxbow peninsula by October 1995. In our latest meeting, you stated that the adoption of the City of Tukwila's regulations are now delayed until 1996. The City's Shoreline Regulations does not require a variance for parking within 200' of the river as does King County Shoreline Requirements. This variance request is unnecessary under the City's ordinance and complies fully with the criteria laid out in King County Shoreline Regulation. Storm drainage facility location shall be avoided in the northeasterly portion of the site along the river, due to the ex- istence of a wetland below the top of bank, and existing mature trees along the bank. 10. The grading and building permit plans shall identify the wetlands edge. A copy of this plan shall be submitted to BALD (Shorelines), prior to construction. 11. Prior to site disturbance, a temporary construction fence shall be installed along the entire length of the subject property, to follow the stable top of bank. 12. No placement or discharge of concrete or construction or demolition debris into the river shall be allowed. 13. Suitable measures to control erosion and sedimentation during construction shall be instituted and maintained throughout construction and be addressed under the grading and building per- mits. The sign plan shall include at a minimum, interpretive text, overall design, dimensions and location. 16. The applicant shall support and not oppose King County's ef- forts to develop a multipurpose public access trail within the right of way of the existing river protection easement in accor- dance with the Green River Trail Master Plan (January, 1988). 17. The interpretive sign, bench and trail improvements shall be completed within 6 months following completion of the improve- ments. 18. A minimum 3 year landscape bond in the amount of $10,000 shall be submitted to BALD, to be released upon the applicants written request and dependent upon the successful establishment of the landscaping. 19. In July, 1990, the Tukwila City Council by Resolution 1149 adopted the King County Green River Master Plan. This plan identifies a river trail section should be developed along the shore of the Duwamish River. An easement within the shoreline zone should be provided for a recreational trail. A 20 foot wide easement should be provided for which the City has an easement form to use. The developer is requested to construct the trail to City specifications, basically a 12 foot wide asphalt trail with two gravel shoulders on each side. B. In November, 1993, the City adopted its Park and Open Space Plan. The plan identifies a deficiency of trails and states a need to complete river shoreline trails. The plan states it is a goal to complete all sections of this river trail. Any development with shoreline frontage should provide public access to complete the continuous trail. WHEREAS, the City Council of the City of Tukwila has adopted a river site plan as part of the King County Green River Trail Master Plan for the urban area which identifies a pedestrian/bicycle pathway on the Green River in the northern portion of the City, and WHEREAS, under the provisions of the Marine Recreation Land act, state and federal funding assistance has been authorized and made available to aid in financing the cost of land for parks and the construction of outdoor recreational facilities of local public bodies, and WHEREAS, the City Council of the City of Tukwila considers it in the best public interest to develop a pedestrian/bicycle pathway along the shores of the Green/Duwamish River along its entire length within the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS: Section 1. That the Mayor be authorized to make formal application to the Interagency Committee for Outdoor Recreation for funding assistance. Section 2. That any funding assistance so received be used to construct a pedestrian/bicycle trail and associated improvements along the shores of the Green/Duwamish River or in close proximity. Section 3. That this resolution become part of a formal application to the Interagency Committee for Outdoor Recreation. Section 44 That the City of Tukwila funds be budgeted in the 1991 Annual Budget identifying the Land Acquisition, Building and Development Fund as the source for any required matching funds. Class I: two-way trail, fully separated from roads and motorized traffic; W. B. Class II: one -way lanes reserved for exclusive trail use along both shoulders of a road; and C. Class III: signed trail route along a road shared with cars (mixed traffic). 7', Because traffic speeds and volumes are high along many of the roads that would comprise a Class II or Class III Green River Trail, public safety concerns suggest that the master plan should commit to the Class I standard from the _ Seattle city limits to the Auburn -Black Diamond Road. Interim trail designation in this area could include Class II or Class III trail sections where 40 vehicular traffic volumes and speeds are low, such as portions of Russell Road in Kent. Nevertheless, the ultimate goal for trail development should be to provide full separation between trail users and motorized traffic, except for patrol by security vehicles and periodic use by maintenance vehicles where the trail follows river levees. King County experience with high levels of use on the Class I Burke - Gilman IVO and Sammamish River trails indicates that the paved trail surface should be r asphalt, with a minimum width of 10 feet. The preferred width of the paved surface is 12 feet, with additional 2 -foot gravel shoulders on both sides, to ; safely accommodate the heavy two -way, mixed -mode trail traffic that will . quickly follow trail development. Acquisitions at specific locations may i require additional land due to natural or man -made topography, vehicle turnouts, and natural drainage patterns such as creeks, streams, or wetlands. � To help satisfy the demand for horse trails in King County, an 8 -foot 1116 equestrian path could also be developed parallel to the main trail, but Imo separated from it by a minimum distance of eight feet. This would be feasible in the southern portion of the trail route, from East Green River Park 40 (Auburn Narrows) to North Green River Park (Horsehead Bend). North of 0 this area, restricted right -of -way widths and limited clearances at existing ' underpasses, appear to preclude development of an equestrian path in the Green River Trail corridor. w ill OD The recommended development program for the Green River Trail also wita includes separated crossings of major roads, whenever possible. These can be WO provided in most cases by underpasses at existing or planned bridges. In I. PO several locations, new trail bridges are recommended to connect Class I links P on opposite sides of the river. Directional signing and traffic control devices 1111 at points where the trail would intersect with roads or highways are also recommended. Trail furniture such as drinking fountains, benches, and bicycle racks should also be included in the trail program, along with trailside *0 planting. MO Finally, new river access facilities are proposed along the trail at three sites, in 10 conjunction with the mitigation agreement between King County and the lit. Municipality of Metropolitan Seattle (Metro) for construction of the Renton j1111. Effluent Transfer System (referred to later in this report as the ETS project). These sites are located at the confluence of the Black and Green rivers (at the '" north end of Fort Dent Park), along the Interurban right -of -way at the .00 Allentown Bridge, and at the upper turning basin on the Duwamish !, (immediately south of an existing Seattle City light substation). (b) The hardship noted above is specifically related to the property, because of the irregular shape of the parcel and the relatively high percentage of the property falling within the SMP jurisdiction ( -1+ 18%) and thus being further restricted. Other considerations such as parking ratios and adjacencies, public access to the shoreline and concern for the visual quality of the project preclude locating'the buildings closer to shoreline. (c) This proposal is'compatible with other uses and activities permitted and existing in the area. Immediately to the East of this project is an existing paved parking facility which extends to within 30' of the top of the riverbank just as this proposal ie requesting. The remainder of the development under this proposal is an expansion of an existing development and is compatible both architecturally and in use with the existing facility.
