104 parking spaces. The development area is 22.62
acres. Impervious surface area will be 1.39 acres
with the remainder being a grassed driving field.
A safery net 50 to 75 feet high will run along
Southcenter Parkway, behind a double row of poplar
trees.

B.7. Environmental Health (Pg. 8)
The Director of the Department of Community Development
shall, in consultation with the Tukwila Golf Course Manager
and other departmental representatives, ensure that the
hazard of balls flying onto adjacent roadways and property
has been mitigated to an acceptable level.
B.11 Light and Glare (Pg. 11)
The desire for bright grounds lighting to track the golf
ball's flight, landing, and distance signs shall be
accommodated as long as there is no direct off -site
illumination and /or indirect glare such as produced by a
"stadium halo."
B.14 Transportation
i. A traffic mitigation payment of $24,684.00 for
intersection impacts shall be provided as discussed in
the traffic study, prior to final construction
approval.
ii. Frontal improvements as required by Public Works
Department road improvements ordinances and /or the
Planning Commission (Conditional Use Permit L94- 0005),
shall be designed based on the 57th Avenue South
(Southcenter Parkway) Design Report.
As an alternative to immediate construction, the
applicant may enter into a developer's agreement to
provide a fair -share payment for the improvements,
which would be built later in a coordinated manner with
the overall road improvement. An exception would be
permanent or temporary improvements which are
determined by the Public Works Department or the
Planning Commission (through the Conditional Use Permit
process) to be needed immediately.
iii. An additional 10 foot right -of -way dedication or an
easement for sidewalks, curbs, and utilities shall be
provided prior to approval of the construction. This
area is required in order to place the required frontal
improvements as designed in the "57th Avenue South
'Preliminary' Design /Location Report ".

Discussed the traffic impact mitigating measures with Mr. Hazard
as follows:
Home Depot
Based on a traffic study conducted for this project,
a. $257,148 in impact mitigation fees were collected to
improve 4 affected intersections and
b. various frontal improvements and road easements were
immediately provided.
Tukwila Golf Driving Range
Based on a traffic study conducted for this project,
a. $24,684 in impact mitigation fees were collected for
intersection improvements
b. the developer agreed to pay for all his frontal
improvements (curb, storm drainage, utilities, and
sidewalks) upon the 57th Avenue road widening, and
c. immeidately convey a 10 ft. wide easement for frontal.
improvements.

Dear Mr. Beeler:
Gaco Western is located directly across Southcenter Parkway from
the proposed golf driving range. I am writing to voice my concern
regarding VEHICULAR TRAFFIC. My question is: Have any studies been
made regarding the increase in traffic load this driving range will
put on Southcenter Parkway?
I raise the issue again, because of the traffic "snarl" that
resulted due to Home Depot USA, Inc. locating in Tukwila (please
see my 1/22/93. letter, which was never answered, i.e. "what studies
have been done regarding the impact the Depot will have on traffic
and the plan they or the City has to minimize the traffic
problems. ") I assume that since I received no answer to my Home
Depot question, no study was done; because if one had been done,
the problems currently encountered would have been foreseen. I'm
concerned because I use 180th. every day and it's an .asphalt
jungle. Why didn't the City or Home Depot construct an overpass at
180th. and the Valley Road before the Depot people occupied the
building?
I don't want the street in front of Gaco to become another "180th
and the Valley Freeway" mess.

to improve 57th Ave. So. from So. 180th Street to So. 200th
Street. No construction schedule has been determined.

Construction of a golf driving range on a 12.62 acre site
containing 50 covered and 10 uncovered hitting stations.
Supporting the facility is food service, pro -shop, meeting and
teaching rooms, rest rooms, offices, and storage.
12. Location of the proposal. Give sufficient information for a person to understand the precise
location of your proposed project, including street address, if any, and section, township range, if
known. if a proposal would occur over a range area, provide the range boundaries of the site(s).
Provide a legal description, site plan, vicinity map and topographic map, if reasonably available.

The project is located on the west side of 57th Avenue So.,
approximately 2,500 feet south of the intersection of So. 180th
Street and 57th Ave. So. See attached legal description and
vicinity map.

Map as environmentally sensitive?
Yes. The site has a Type 1 & 2 watercourse and the western
portion of the site has Class 2 & 3 slopes. Project will not
encroach into these areas. or their buffers.

The above project activity was reviewed at the March 15th Public
Works plan review meeting. The following are our specific comments:
1. SEPA Comments
A. Proposed traffic mitigations totaling $24,684.00 have
been reviewed and approved by the City Engineer.
B. There are no public sewer systems in the area.
Connections to /extensions of existing systems some
distance away shall be required. This applicant may wish
to contact King County personnel working on the Bow Lake
Transfer Station Project to explore the possibility of
a joint effort to extend the public sewer system into
this area.
2. Miscellaneous Comments
A. In accordance with a design report prepared for the City
for the upgrade of 57th Avenue South, a total right -of-
way width of 80' is required through this area.
Therefore, an additional 10' dedication will be required
from this property owner as a condition of development.
B. Frontal improvements are required in accordance with
Ordinance No. 1516. If these improvements are not
constructed as part of this project, a developer's
agreement for fair share cost participation in a future
project will need to be executed.
C. A Water System No- Protest Agreement will need to be
executed for future upgrade of the existing 8" water
main through this area.
D. A double- baffled grease interceptor will be required in

Per John P's recommendation, I am requesting additional
impact analysis to support the dedication of 10 ft.
right of way area along Southcenter Parkway. The
applicant has agreed to set his project back to
accommodate the roadway, but will not (and as a lessee
cannot) dedicated the additional area.
SEPA requires a rational /physical link between impact
and mitigation. The courts have not generally accepted
a conflict with public policies or plans as meeting
this test.
In the case of the 10 foot dedication, we need to show
how the project impacts will lower the LOS on the road
segment to a level lower than "acceptable" limits (i.e.
LOS D or whatever). This analysis would have to
exclude intersection bottle -necks since the applicants
are doing fair -share contributions. A clear
justification is needed because of the level of project
traffic and because the existing road already satisfies
the minimum 60 right of way width specified in
Tukwila's arterial ordinance.
Demonstration of impacts can be based on the impacts
solely of the facility, or as part of a cumulative
whole. Note that if the cumulative approach is used,
then you must show that this project is bearing its
fair - share, and not paying the share of other impact
contributing projects.
As an alternative to SEPA, discussions with Cal Jordan
indicate that the property owner could likely be
agreeable to trading the 10 ft. dedication for an
agreement for the City to build the travel way in front
of his property. The applicant would continue to be
responsible for improvements from face of curb back to
the property.
I need to issue the SEPA today, with a 15 day comment
period. I strongly urge you to either provide us with
the supporting materials for the 10 ft. dedication or
begin negotiations with the property owner while
discretionary Planning permits are being reviewed.
Planning reviews will be completed at a public hearing
16 days from today.

Marty O'Brien, Parks and Recreation's Golf Manager, and I have reviewed the
Environmental Checklist and have several comments. Marty has prepared a separate
memo primarily concerning the containment fence.
By element, I have these comments:
7.a. "...control environmental health hazards." I do not see another section that deals
with golf balls flying over the fence, perhaps onto the public street. Such possible
occurrence is a safety (health) hazard. More design work is needed concerning
the height of the fence and perhaps the angle of the balls being hit.
8.h. What is specifically being done to protect the stream channel on the west side from
damage from construction and later during maintenance of the grounds?
11.a. Glare from the lighting can spread to nearby areas. Additional information about
the lighting to be used should be provided in this report. The limited information
does no help to understand its impacts.
11.b.The response says the facility will not interfere with view. Views looking towards
the hills will be blocked, views looking towards the valley will have less of an
impact.
13.b.Next to the site to the southwest within 200 yards is the old Ness Cemetery, which
is owned by the Tukwila Historical Society.

1. The fencing in this design will not contain the golf balls. When the
hitting area (tee) is at a 90 degree angle to the fencing, containing the
golf balls is a major problem. Even 100 foot high fences will not
guarantee containment. I have first hand experience, having worked at two
driving ranges both designed with the same fence angle to the hitting area.
Many times there is enough property adjacent to the range and the balls can
be retrieved. This range presents a major problem because of the street
that parallels the fence and hitting area. Note, that the 100 foot fence I
am talking about is for a single story range with the hitting area at
ground level.
Several ranges in our ares have had this problems, Jefferson Park, Kent,
and Lynwood. They contain the balls by installing barrier nets in between
each hitting stall. These nets are 8 to 10 feet tall and need to extend a
minimum of 20 out from the tee area in order to be effective. I have never
seen a two story range with adequate barrier fencing. Most of the time the
second story hitting area are exposed, and therefor do not have any method
to support the fencing.
This project has been designed to maximize the limited amount of property.
there has been no consideration for containing the golf balls. The fencing
in this design would not be effective for a single story range let alone a
two stories range.
Designs that are efficient in containing the balls, have the hitting ares
arranged in a half circle so the tees can be all pointed to central target
in the center of the •range. Other efficient designs have a 30 to 50 yard
buffer between the last hitting area and the fence.
There is an example of a two story short distance range in Lynwood. It was
designed with 100 foot high fence that was fully inclosed. Unfortunately
after the first snow storm the fence collapsed. They have not rebuilt
because of the cost.
A visit to any of the area ranges while golfers are hitting balls would
help understand the problems driving ranges pose.
2. The range also needs a security fence or the first ten feet of the
fence, fenced with a steel fabric. Nylon fence is used for ranges. They
are easily damaged or torn. To prevent theft or in this case safety for

pedestrian and vehicle traffic a security fence is needed for the street
side of the property.

3. I would recommend that some kind of insurance guarantee be required in
or order to operate. It will be difficult to find insurance coverage and
maintain it. After there are several claims the insurance companies will
drop the coverage.
4. Common problems with high fencing is damage from wind and weather.
They are very expensive to repair and many times are left damaged for long
periods. Again because of the location of the range to the street, I feel
it would be important to have some kind of restrictions to operated: If
the fence was damaged and would present a safety problem the range would
have to be closed until the fence was repaired.

I. INTRODUCTION
A) General
The information which follows is intended to address the
anticipated transportation impacts resulting from the
development of the Tukwila Driving Range. The site is
located on the west side of Southcenter Parkway (Frager
Road), south of S. 180th Street in the City of Tukwila.
The purpose of this report is to review and analyze current
conditions in the vicinity of the site, review the proposed
development and the impacts to the transportation system, and
develop the appropriate mitigation as necessary.
B) Project Description
The proposed project is for the development of a golf driving
range with a practice putting and chipping green plus
additional support facilities such as a pro shop, snack bar,
and video rooms. The driving range will consist of 60 tees
on two levels with a 290 yard netted driving range. The
subject property is located on the west side of Southcenter
Parkway several hundred feet south of S. 180th Street. The
vicinity map shown on Figure 1 outlines the subject area.
The adjacent land use is single - family residential and
undeveloped parcels of land. Extensive retail development is
located to the north/ northeast of the site and 1 -5 to the
west of the site.
Arterial streets in the area include Southcenter Parkway, S.
180th Street, and West Valley Highway. Access to the site
will be from Southcenter Parkway. The building structure
will be located near the southerly portion of the site with
customer parking and the practice greens on the south side of
the building. The subject property is an undeveloped site
consisting of a flat, grassy pasture area on the easterly
portion of the property, with a steep upgrade on the westerly
portion of the property vegetated mainly with deciduous
trees.
The remainder of this report will analyze the effects of the
development of the subject property and the traffic - related
impacts which can be expected on the adjacent intersections.
A reduced copy of the site plan is shown in the Appendix.

II. EXISTING CONDITIONS
A) Adjacent Transportation System
Southcenter Parkway adjacent to the site is a two lane
roadway with open ditches, little or no shoulders and a
posted speed of 35 mph. The adjacent land use includes the
project site, which is undeveloped, a single- family acreage,
a major equipment storage area for a construction company,
and a storage /moving company facility. North of S. 180th
Street, Southcenter Parkway is striped for two southbound
lanes, a center two -way left -turn lane and three northbound
lanes along a portion of the street. North of Strander
Boulevard, Southcenter Parkway is a multi -lane arterial
bordering the north and west sides of Southcenter Mall. The
street is striped for four lanes and includes turn storage
lanes along the mall frontage. Raised curb has also been
installed in this area. Traffic signals control many of the
mall entrances and the ramps to 1 -5.
Andover Park West is a four lane north -south arterial with
curb, gutter, and street lights, and sidewalk along most
sections of the roadway. Left -turn storage lanes have been
installed on Andover Park West at Tukwila Parkway and Baker
Boulevard. Andover Park West is fronted by a mix of retail,
office and warehouse /light industrial uses. The posted speed
L is 35 mph. South of S. 180th Street, Andover Park West turns
into Segale Drive "A ", which is private.
Strander Boulevard is a multi -lane east -west arterial
connecting Southcenter Parkway with West Valley Highway.
Strander Boulevard includes a two -way left -turn lane between
L Southcenter Parkway and Andover Park West. East of. Andover
Park West the street is striped for four lanes, although
left -turn storage lanes have been provided at Andover Park
West, Andover Park East, and West Valley highway. Curb,
gutter, and street lights have been installed along the
entire length of the street, but sidewalk exists only between
Southcenter Parkway and Andover Park West. The street is
fronted by a variety of commercial developments and has a
posted speed of 35 mph.
S. 180th Street consists of two through lanes in each
direction plus a two -way left -turn lane or a left -turn
storage pocket. Curb, gutter, and street lights have been
installed on both sides of the street and many sections
include sidewalk. S. 180th Street is fronted by a variety of
commercial enterprises and has a posted speed of 35 mph.
B) Traffic Volumes
Daily traffic counts in the vicinity of the proposed project
were available from the City of Tukwila. The traffic volumes
for the year 1991 were the most current values available at
the writing of this report. Those volumes are shown on
Figure 2. A discussion with City staff indicated that the
traffic volumes in the immediate vicinity have increased by
very small amounts over the past couple of years.
A manual traffic count for the noon and PM peak hours was
conducted for this study at the intersection of S. 180th
Street /Southcenter Parkway. This count was compared with one
conducted at this same intersection in April of 1993. Upon
review of the two counts, it was found that the PM peak hour
counts were almost identical, i.e., the most recent count was
6 vehicles fewer than the one in 1993. However, the most
recent noon count was approximately 200 fewer vehicles than
the 1993 count. Therefore, it was decided to use the 1993
counts for this study to reflect a more conservative
approach. The tabulation of this count can be found in the
Appendix.
C) Transit /Pedestrian Facilities
Transit service is readily available in the Southcenter area.
Two METRO routes, #150 and #155, travel along S. 180th Street
which is the closest to the site that Metro travels. Route
150 serves Auburn, Kent, Southcenter, and downtown Seattle,
while route 155 serves downtown Renton, Fairwood, and
Southcenter. Service is provided daily on both routes
throughout the day. Service on other routes is also
available from Southcenter Mall and run along streets to the
north of the proposed development.
Pedestrian facilities (sidewalks) have been installed along
many street sections in the vicinity of the site. The City
of Tukwila is trying to encourage pedestrian activity in
'order to eliminate some of the automobile trips in the area.
No sidewalk exists in the immediate vicinity of the driving
range.
D) Level of Service
The intersection in the area which would be most critically
impacted by the development of the subject site, i.e., S.
180th Street /Southcenter Parkway, was analyzed with respect
to level of service. This intersection is controlled by a
traffic signal.
"Level of service" is a common term used in the Traffic
Engineering profession which is defined as a qualitative
measure describing operational conditions within a traffic
stream, and its perception by motorists and /or passengers.
These conditions are usually described in terms of such
factors as speed and travel time, freedom to maneuver,
traffic interruptions, comfort and convenience, and safety.
Six levels of service are designated, ranging from A to F,•

conditions and level of service "F" the worst.
The first step in the capacity analysis of an existing
intersection is to manually count all traffic movements
during the critical peak -hour period(s). A manual traffic
count was conducted for both the noon and PM peak hours at
the intersection as part of this analysis. The intersection
is then analyzed, taking into account all of the physical
features and methods of traffic control. This process
produces a rating for the intersection that defines a "level -
of- service" for each vehicle. An expanded explanation of
"level of service ", along with the tables which identify the
criteria for analyzing unsignalized and signalized
intersections respectively, as presented in the Highway
Capacity Manual, has been provided in the Appendix.
The actual capacity of an intersection is generally
considered to be at the lower end of level of service "E" and
most agencies strive to maintain a roadway network that will
not drop below this level of operation, except perhaps during
unusual periods such as holiday shopping, sporting events,
etc.
Calculations for the level of service for the intersections
were conducted using the computer program CAPCALC '85, by
Roger Creighton and Associates, Inc., which is based on the
1985 Highway Capacity Manual, Special Report 209. The manual
traffic counts described earlier were used in these analyses
and are shown in the Appendix. The following table shows the
current level of service for the intersection.

It can be seen from Table 1 that the intersection of S. 180th
Street /Southcenter Parkway is operating under capacity (level
of service "E" or better). The seconds of delay shown in
Table 1 is the average delay for the intersection movements
overall; individual critical movements may be operating at a
lower level of service.

The estimated daily and peak hour trips for the driving
range are summarized in Table 2. As noted earlier, a more
detailed description of how these numbers were derived is
included in the Appendix.

2. Trip Distribution /Assignment
The new traffic generated by the development of the driving
range will be distributed onto the adjacent roadway system
and then onto the regional transportation system. The
closest driving ranges are located in Kent, Federal Way,
and Beacon Hill and therefore the driving range will
attract from the surrounding area. The driving range is
also expected to attract patrons from the adjacent
employment area during their lunch hours and after work.
Furthermore, trips to the driving range would likely be
part of dual purpose trip where some members of the family
go to the mall while others go to the driving range.
The trips from the site will be dispersed in all directions
towards the regional transportation systems in the area,
i.e., SR -518, I -5, I -405, and towards the major arterials
such as West Valley Highway or S. 180th Street.
Figure 3 shows the estimated trip distribution by percent
for the subject site. It should be noted that these values
are approximate and may vary from day to day depending on
the needs and desires of the future patrons of the driving
range.
Figures 4 and 5 show the trip assignment to the various
streets during the noon and PM peak hours. It can be seen
from these figures that the project will have its greatest
impact on S. 180th Street and Southcenter Parkway.
3. Traffic Volumes
The projected 1995 average daily traffic volumes both with

1991 traffic volumes shown on Figure 2 were increased two
percent per year to estimate the 1995 volumes plus the
trips from a new retail site at S. 180th Street /Andover
Park West were also included.
The projected noon and PM peak hour traffic volumes at the
intersection of S. 180th Street /Southcenter Parkway for the
year 1995 both with and without the proposed project have
been included in the Appendix.
4. Level of Service
Level of service calculations were conducted again for the
intersection of S. 180th Street /Southcenter Parkway. It
has been assumed for the purposes of analysis that
geometric conditions at the intersection are unchanged from
existing conditions.
It is estimated that the proposed development would be
essentially complete and occupied in 1995. The existing
traffic volumes were increased by 2% to account for
miscellaneous background growth which may occur over the
next year plus the trips from a new retail site at S. 180th
Street /Andover Park West were also included. This could
essentially be considered a "no- action" scenario or base
condition. The future conditions were then reviewed with
the trips from the proposed project added. The results of
the future conditions are shown in Table 3.

The results of the capacity analyses indicate that the
levels of service at the intersection would drop slightly
over the next year as a result of the miscellaneous traffic
growth occurring in the area. The trips from the proposed
driving range would have a limited impact at the
intersection of S. 180th Street /Southcenter Parkway.
5. Transit Usage
As noted earlier, some transit service is available along
S. 180th Street. It is unlikely that patrons of this
development would use transit due to the recreational
nature of the site which tends not to draw transit riders.

Patrons of the driving range will be bringing their golf
clubs to the site which are somewhat cumbersome to
transport on a bus and therefore private vehicles will be
the transportation mode of choice.
6. Pedestrians
The proposed driving range is located along a street which
currently has no sidewalks or pathways. The closest
pedestrian facility lies several hundred feet to the north
at S. 180th Street /Southcenter Parkway. It is difficult to
assess how many pedestrians a specific development may
attract, however, it is unlikely that a driving range would
attract many pedestrians because patrons to the site will
be bringing their own golf clubs which are not easy to
carry for long distances. Also, the majority of patrons
will be arriving from areas not within walking distance of
the site.
The need for sidewalks along the section of Southcenter
Parkway south of S. 180th Street is not as urgent as the
need along areas closer to the mall. The land uses along
this section of Southcenter Parkway are industrial in
nature and do not tend to attract pedestrians. Although
the section of Southcenter Parkway south of S. 180th Street
may ultimately be improved. to urban standards (including
sidewalk), the existing uses and the proposed use would not
dictate the need for sidewalk installation at the present
time.
7. Access
One driveway will serve the site from Southcenter Parkway.
A level of service analysis was conducted for the driveway
for the trips entering and exiting the site. The estimated
driveway volumes are shown in the Appendix. The following
table shows the results of these analyses.

entering and exiting the site should experience relatively
little inconvenience or delay during the peak hours due to
the relatively low volumes on this section of Southcenter
Parkway.
C) Impacts
The proposed driving range will generate additional traffic
which will impact the roadways in the area, although it is
expected that this amount of traffic will be significantly
less when compared to the numerous retail sites in the area.
No data on trip generation was available for driving ranges,
so field data was collected from comparable sites in the area
for use in estimating the amount of traffic associated with
the site.
Several capital improvement projects in the Southcenter area
have been identified by the City of Tukwila. A proportionate
share of the costs would apply to the subject development.
No further analyses were conducted for these locations since
the City has already identified the necessary improvements
and their costs. The adjacent intersection of S. 180th
Street /Southcenter Parkway is projected to be at level of
service "D" and therefore improvements do not appear to be
necessary.
The trips entering and exiting the site are not expected to
experience any difficulty. The small number of left -turns
would not necessitate a left -turn lane on Southcenter
Parkway.
The five locations in the vicinity of the project which the
City has identified for capital improvements are summarized .
below, along with the estimated number of trips from the site
traveling through these locations during the noon and PM peak
hours.

D) Mitigation
The following are suggested as possible mitigation measures
for the development.
1. Payment of $475 per trip through the intersection of
S. 180th Street /West Valley Highway for future
roadway improvements for a total of $11,400.
2. Payment of $1000 per trip through the intersection
of Interurban Avenue /I -405 Interchange for future
roadway improvements for a total of $10,000.
3. Payment of $140 per trip through the intersection of
Strander Boulevard /Southcenter Parkway for future
roadway improvements for a total of $2,380.
4. Payment of $317 per trip through the intersection of
Strander Boulevard /Andover Park West for future
roadway improvements for a total of $634.
5. Payment of $135 per trip through the intersection of
Strander Boulevard /Andover Park East for future
roadway improvements for a total of $270.

The concept of level of service is defined as a
qualitative measure describing operational conditions
within a traffic stream, and their perception by motorists
and /or passengers. A level -of- service definition
generally describes these conditions in terms of such
factors as speed and travel time, freedom to maneuver,
traffic interruptions, comfort and convenience, and
safety.
Six levels of service are defined for each facility for
which analysis procedures are available. They are given
letter designations, from A to F, with level -of- service A
representing the best operating conditions and level -of-
service F the worst.
1. Level -of- service definitions - In general, the various
levels of service are defined as follows for uninterrupted
flow facilities:
- Level -of- service A represents free flow. Individual
users are virtually unaffected by the presence of others
in the traffic stream. Freedom to select desired speeds
and to maneuver within the traffic stream is extremely
high. The general level of comfort and convenience
provided to the motorist, passenger, and pedestrian is
excellent.
- Level -of- service B is in the range of stable flow,,• but
the presence of other users in the traffic stream begins
to be noticeable. Freedom to select desired speeds is
relatively unaffected, but there is a slight decline in
the freedom to maneuver within the traffic stream from
level of service A. The level of comfort and
convenience provided is somewhat less than at level of
service A, because the presence of others in the traffic
stream begins to affect individual behavior.
- Level -of- service C is in the range of stable flow, but
marks the beginning of the range of flow in which the
operation of individual users becomes significantly
affected by the interactions with others in the
traffic stream. The selection of speed is now affected
by the presence of others, and maneuvering within the
traffic stream requires substantial vigilance on the
part of the user. The general level of comfort and
convenience declines noticeably at this level.
- Level -of- service D represents high - density, but
stable, flow. Speed and freedom to maneuver are
severely restricted, and the driver or pedestrian
experiences a generally poor level of comfort and
convenience. Small increases in traffic flow will
generally cause operational problems at this level.
- Level -of- service E represents operating conditions at
or near the capacity level. All speeds are reduced to a
low, but relatively uniform value. Freedom to maneuver
within the traffic stream is extremely difficult, and it
is generally accomplished by forcing a vehicle or
pedestrian to "give way" to accommodate such maneuvers.
Comfort and convenience levels are extremely poor, and
driver or pedestrian frustration is generally high.
Operations at this level are usually unstable, because
small increases in flow or minor perturbations within
the traffic stream will cause breakdowns.
- Level -of- service F is used to define forced or
breakdown flow. This conditions exists whenever the
amount of traffic approaching a point exceeds the
amount which can traverse the point. Queues form behind
such locations. Operations within the queue are
characterized by stop- and -go waves, and they are
extremely unstable. Vehicles may progress at reasonable
speeds for several hundred feet or more, then be
required to stop in a cyclic fashion. Level -of- service
F is used to describe the operating conditions within
the queue, as well as the point of the breakdown. It
should be noted, however, that in many cases operating
conditions of vehicles or pedestrians discharged from
the queue may be quite good. Nevertheless, it is the
point at which arrival flow exceeds discharge flow which
causes the queue to form, and the level -of- service F is
an appropriate designation for such points.
These definitions are general and conceptual in nature,
and they apply primarily to uninterrupted flow. Levels of
service for interrupted flow facilities vary widely in
terms of both the user's perception of service quality and
the operational variables used to describe them.
For each type of facility, levels of service are defined
based on one or more operational parameters which best
describe operating quality for the subject facility type.
While the concept of level of service attempts to address
a wide range of operating conditions, limitations on data
collection and availability make it impractical to treat
the full range of operational parameters for every type of
facility. The parameters selected to define levels of,
service for each facility type are called "measures of
effectiveness," and represent those available measures
that best describe the quality of operation on the subject
facility type.
Each level of service represents a range of conditions, as
defined by a range in the parameters given. Thus, a level
of service is not a discrete condition, but rather a range
of conditions for which boundaries are established.
The following tables describe level of service for
signalized and unsignalized intersections. Level of
service for signalized intersections is defined in terms
of delay . Delay is a measure of driver discomfort,
frustration, fuel consumption, and lost travel time.
Specifically, level -of- service criteria are stated in
terms of the average stopped delay per vehicle for a 15-
minute analysis period. Level of service for unsignalized
intersections is measured in terms of unused, or reserve
capacity of the lane in question.

in the Conditions and Stipulations.

EXCLUSIONS FROM COVERAGE
The following matters are expressly excluded from the coverage of this policy and the Company will not pay loss or damage, costs, attorneys'
fees or expenses which arise by reason of:
1. (a) Any law, ordinance or governmental regulation (including but not limited to building and zoning laws, ordinances, or regulations) restricting,
regulating, prohibiting or relating to (i) the occupancy, use, or enjoyment of the land; (ii) the character, dimensions or location of any improve-
ment now or hereafter erected on the land; (iii) a separation in ownership or a change in the dimensions or area of the land or any parcel of
which the land is or was a part; or (iv) environmental protection, or the affect of any violation of these laws, ordinances or governmental regula-
tions, except to the extent that a notice of the enforcement thereof or a notice of a defect, lien or encumbrance resulting from a violation or
alleged violation affecting the land has been recorded in the public records at Date of Policy.
(b) Any governmental police power not excluded by (a) above, except to the extent that a notice of the exercise thereof or a notice of a defect,
lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the public records at Date of Policy.
2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy, but not excluding
from coverage any taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without
knowledge.
3. Defects, liens, encumbrances, adverse claims or other matters:
(a) created, suffered, assumed or agreed to by the insured claimant;
(b) not known to the Company, not recorded in the public records at Date of Policy, but known to the insured claimant and not disclosed
in writing to the Company by the insured claimant prior to the date the insured claimant became an insured under this policy;
(c) resulting in no loss or damage to the insured claimant;
(d) attaching or created subsequent to Date of Policy; or
(e) resulting in loss or damage which would not have been sustained if the insured claimant had paid value for the estate or interest insured
by this policy.
4. Any claim, which arises out of the transaction vesting in the Insured the estate or interest insured by this policy, by reason of the operation
of federal bankruptcy, state insolvency, or similar creditors' rights laws, that is based on:
(a) the transaction creating the estate or interest insured by this policy being deemed a fraudulent conveyance or fraudulent transfer; or
(b) the transaction creating the estate or interest insured by this policy being deemed a preferential transfer except where the preferential transfer
results from the failure:
(i) to timely record the instrument of transfer; or
(ii) of such recordation to impart notice to a purchaser for value or a judgment or lien creditor.

CONDITIONS AND STIPULATIONS
(c) Whenever the Company shall have brought an action or interposed a
defense as required or permitted by the provisions of this policy. the
Company may pursue any litigation to final determination by a court of
competent jurisdiction and expressly reserves the right. in its sole discretion.
to appeal from any adverse judgment or order.
(d) In all cases where this policy permits or requires the Company to
prosecute or provide for the defense of any action or proceeding, the
insured shall secure to the Company the right to so prosecute or provide
defense in the action or proceeding, and all appeals therein. and permit the
Company to use, at its option. the. name of the insured for this purpose.
Whenever requested by the Company, the insured. at the Company's
expense, shall give thc Company all reasonable aid (1) in any action or
proceeding. securing evidence, obtaining witnesses, prosecuting or
defending thc action or proceeding, or effecting settlement. and (ii) in any
other lawful act which in the opinion of the Company may be necessary or
desirable to establish the title to the estate or interest as insured. If thc
Company is prejudiced by the failure of the insured to furnish the required
cooperation. the Company's obligations to the insured undcr the policy
shall terminate, including any liability or obligation to defend, prosecute, or
continue any litigation. with regard to the matter or matters requiring such
cooperation.
S. PROOF OF LOSS OR DAMAGE.
In addition to and after the notices required under Section 3 of these
Conditions and Stipulations have been provided the Company. a proof of
loss or damage signed and sworn to by the insured claimant shall be
furnished to the Company within 90 days after the insured claimant shall
ascertain the facts giving rise to the loss or damage. The proof of loss or
damage shall describe the defect in. or lien or encumbrance on the title. or
other matter insured against by this policy which constitutes the basis of
loss or damage and shall state. to the extent possible, the basis of
calculating the amount of the loss or damage. If the Company is prejudiced
by the failure of thc insured claimant to provide the required proof of loss
or damage, the Company's obligations to the insured under the policy shall
terminate, including any liability or obligation to defend, prosecute. or
continue any litigation. with regard to the matter or matters requiring such
proof of loss or damage.
in addition. the insured claimant may reasonably be rcquircd to submit
to examination under oath by any authorized representative of the
Company and shali produce for examination. inspection and copying, at
such reasonable times and places as may be designated by any authorized
representative of the Company. all records, books. ledgers. checks.
correspondence and memoranda, whether bearing a date before or after
Date of Policy. which reasonably pertain to the loss or damage. Further, if
requested by any authorized representative of the Company , the insured
claimant shall grant its permission, in writing, for any authorized
representative of the Company to examine , inspect and copy all records.
books. ledgers. checks, correspondence and memoranda in the custody or
control of a third party. which reasonably pertain to the loss or damage.
All information designated as confidential by the insured claimant provided
to the Company pursuant to this Section shall not be disclosed to others
unless. in the reasonable judgement of the Company. it is necessary in the
administration of the claim. Failure of the insured claimant to submit for
examination under oath. produce other reasonably requested information
or grant permission to secure reasonably necessary information from third
parties as required in this paragraph shall terminate any liability of the
Company under this policy as to that claim.
6. OPTIONS TO PAY OR OTHERWISE SETTLE CLAIMS;
TERMINATION OF LIABILITY.
In case of a claim under this policy. the Company shall have the
following options:
(a)To Pay or Tender Payment of thc Amount of Insurance.
To pay or tender payment of the amount of insurance under
this policy together with any costs. attorneys' fees and expenses incurred by
thc insured claimant. which were authorized by the Company. up to the
time of paymant or tender of payment and which the Company is obliga-
ted to pay.
Upon the exercise by the Company of this option. all liability and
obligations to the insured under this policy. other than to make the
payment required. shall terminate. including any liability or obligation to
defend, prosecute, or continue any litigation, and the policy shall be
surrendered to the Company for cancellation.
(h) To Pay or Otherwise Settle With Parties Other than the Insured or
With the Insured Claimant.
(i) to pay or otherwise settle with other parties for or in the name
of an insured claimant any claim insured against under this policy, together
with any costs. attorneys' fees and expenses incurrcd by thc insured
claimant which were authorized by the Company up to time of payment
and which the Company is obligated to pay; or
(ii) to pay or otherwise settle with the insured claimant the loss or
damage provided for under this policy, together with any costs, attorneys'
fees and expenses incurred by the insured claimant which were authorized
by the Company up to the time of payment and which the Company is
obligated to pay.
Upon the exercise by the Company of either of the options provided for
in paragraphs (h)(i) or (ii), the Company's obligations to the insured under
this policy for the claimed loss or damage. other than the payments
required to be made, shall terminate, including any liability or obligation to
defend, prosecute or continue any litigation.
1. DEFINITION OF TERMS.
The following terms when used in this policy mean:
(a) "insured ": the insured namcd in Schedule A, and. subject to any
rights or defenses the Company would have had against the named insured,
those who succeed to the interest of the named insured by operation of law
as distinguished from purchase including, but not limited to, heirs,
distrihutces, devisees, survivors, personal representatives. next of kin. or
corporate or fiduciary successors.
(b) "insured claimant ": an insured claiming Toss or damage.
(c) "knowledge" or "known ": actual knowledge. not constructive
knowledge or notice which may he imputed to an insured by reason of the
public records as defined in this policy or any other records which impart
constructive notice of matters affecting the land.
(d) "land ": the land described or referred to in Schedule A, and
improvements affixed thereto which by law constitute real property. The
term "land" does not include any property beyond the lines of the area
described or referred to in Schedule A. nor any right . title, interest, estate
or easement in abutting streets, roads. avenues, alleys, lanes, ways or
waterways. but nothing herein shall modify or limit the extent to which a
right of access to and from the land is insured by this policy.
(e) "mortgage ": mortgage, decd of trust, trust deed, or other security
instrument.
(f) "public records ": records established under state statutes at Date of
Policy for thc purpose of imparting constructive notice of matters relating
to real property to purchasers for value and without knowledge. With
respect to Section I(a) (iv) of the Exclusions From Coverage, "public
records" shall also include environmental protection liens filed in the
records of the clerk of the United States district court for the district in
which the land is located.
(g) "unmarketability of the title ": an alleged or apparent matter affecting
the title to the land. not excluded or excepted from coverage, which would
entitle a purchaser of the estate or interest described in Schedule A to he
released from the obligation to purchase by virtue of a contractual
condition requiring the delivery of marketable title.
2. CONTINUATION OF INSURANCE AFTER CONVEYANCE
OF TITLE.
The coverage of this policy shall continue in force as of Date of Policy in
favor of an insured only so long as the insured retains an estate or interest
in the land, or holds an indebtedness secured by a purchase money
mortgage given by a purchaser from the insured, or only so long as the
insured shall have liability by reason of covenants of warranty made by the
insured in any transfer or conveyance of the estate or interest. This policy
shall not continue in force in favor of any purchaser from the insured of
either (1) an estate or interest in the land, or (ii) an indebtedness secured by
a purchase money mortgage given to the insured.
3. NOTICE OF CLAIM TO BE GIVEN BY INSURED CLAIMANT.
The insured shall notify the Company promptly in writing (i) in case of
any litigation as set forth in Section 4(a) below. (ii) in case knowledge shall
come to an insured hereunder of any claim of title or interest which is
adverse to the title to the estate or interest. as insured. and which might
cause toss or damage for which the Company may be liable by virtue of
this policy, or (iii) if title to the estate or interest. as insured. is rejected as
unmarketable. If prompt notice shall not he given to the Company. then as
to the insured all liability of the Company shall terminate with regard to
the matter or matters for which prompt notice is required: provided,
however, that failure to notify the Company shall in no case prejudice the
rights of any insured under this policy unless the Company shall he
prejudiced by thc failure and then only to the extent of the prejudice.
4. DEFENSE AND PROSECUTION OF ACTIONS; DUTY OF
INSURED CLAIMANT TO COOPERATE.
(a) Upon written request by the insured and subject to the options
contained in Section 6 of these Conditions and Stipulations, thc Company.
at its own cost and without unreasonable delay. shall provide for the
defense of an insured in litigation in which any third party asserts a claim
adverse to the title or interest as insured, but only as to those stated causes
of action alleging a defect, lien or encumbrance or other matter insured
against by this policy. The Company shall have the right to select counsel
of its choice (subject to the right of the insured to object for reasonable
cause) to represent the insured as to those stated causes of action and shall
not be liable for and will not pay the fees of any other counsel. The
Company will not pay any fees, costs or expenses incurred by the insured
in the defense of those causes of action which allege matters not insured
against by this policy.
(b) The Company shall have the right, at its own cost. to institute and
prosecute any action or proceeding or to do any other act which in its
opinion may be necessary or desirable to establish the title to the estate or
interest. as insured, or to prevent or reduce loss or damage to the insured.
The Company may take any appropriate action under the terms of this
policy, whether or not it shall be liable hereunder, and shall not thereby
concede liability or waive any provision of this policy. If the Company
shall exercise its rights under this paragraph, it shall do so diligently.

CONDITIONS AND STIPULATIONS
7. DETERMINATION, EXTENT OF LIABILITY AND COINSURANCE.
This policy is a contract of indemnity against actual monetary loss or
damage sustained or incurred by the insured claimant who has suffered loss
or damage by reason of matters insured against by this policy and only to
the extent herein described.
(a) The liability of the Company under this policy shall not exceed the
least of:
(i) the Amount of Insurance stated in Schedule A; or,
(ii) the difference between the value of the insured estate or interest as
insured and the value 3f the insured estate or interest subject to the defect,
lien or encumbrance insured against by this policy.
(b) In the event the Amount of Insurance stated in Schedule A at the
Date of Policy is less than 80 percent of the value of the insured estate or
interest or the full consideration paid for the land, whichever is less, or if
subsequent to the Date of Policy an improvement is erected on the land
which increases the value of the insured estate or interest by at least 20
percent over the Amount of Insurance stated in Schedule A, then this
Policy is subject to the following:
(i) where no subsequent improvement has been made, as to any partial
loss, the Company shall only pay the loss pro rata in the proportion that
the amount of insurance at Date of Policy bears to the total value of the
insured estate or interest at Date of Policy; or
(ii) where a subsequent improvement has been made, as to any partial
loss, the Company shall only pay the loss pro rata in the proportion that
120 percent of the Amount of Insurance stated in Schedule A bears to the
sum of the Amount of Insurance stated in Schedule A and the amount
expended for the improvement.
The provisions of this paragraph shall not apply to costs, attorneys' fees
and expenses for which the Company is liable under this policy, and shall
only apply to that portion of any loss which exceeds, in the aggregate, 10
percent of the Amount of Insurance stated in Schedule A.
(c) The Company will pay only those costs, attorneys' fees and expenses
incurred in accordance with Section 4 of these Conditions and Stipulations.
8. APPORTIONMENT.
If the land described in Schedule A consists of two or more parcels
which are not used as a single site, and a loss is established affecting one or
more of the parcels but not all, the Toss shall be computed and settled on a
pro rata basis as if the amount of insurance under this policy was divided
pro rata as to the value on Date of Policy of each separate parcel to the
whole, exclusive of any improvements made subsequent to Date of Policy,
unless a liability or value has otherwise been agreed upon as to each parcel
by the Company and the insured at the time of the issuance of this policy
and shown by an express statement or by an endorsement attached to this
policy.
9. LIMITATION OF LIABILITY.
(a) If the Company establishes the title, or removes the alleged defect, .
lien or encumbrance, or cures the lack of a right of access to or from the
land, or cures the claim of unmarketability of title, all as insured, in a
reasonably diligent manner by any method, including litigation and the
completion of any appeals therefrom, it shall have fully performed its
obligations with respect to that matter and shall not be liable for any loss
or damage caused thereby.
(b) In the event of any litigation, including litigation by the Company
or with the Company's consent, the Company shall have no liability for
loss or damage until there has been a final determination by a court of
competent jurisdiction. and disposition of all appeals therefrom, adverse to
the title as insured.
(c) The Company shall not be liable for loss or damage to any insured
for liability voluntarily assumed by the insured in settling any claim or suit
without the prior written consent of the Company.
10. REDUCTION OF INSURANCE; REDUCTION OR TERMINATION
OF LIABILITY.
All payments under this policy, except payments made for costs,
attorneys' fees and expenses, shall reduce the amount of the insurance pro
tanto.
11. UABIUTY NONCUMULATIVE
It is expressly understood that the amount of insurance under this
policy shall be reduced by any amount the Company may pay under any
policy insuring a mortgage to which exception is taken in Schedule B or to
which the insured has agreed, assumed, or taken subject, or which is
hereafter executed by an insured and which is a charge or lien on the
estate or interest described or referred to In Schedule A, and the amount
so paid shall be deemed a payment under this policy to the insured owner.
12. PAYMENT OF LOSS.
(a) No payment shall be made without producing this policy for endorsement
.of the payment unless the policy has been lost or destroyed, in which case proof
of Toss or destruction shall he furnished to the satisfaction of the Company.

(b) When liability and the extent of loss or damage has been definitely
fixed in accordance with these Conditions and Stipulations, the loss or
damage shall be payable within 30 days thereafter.
13. SUBROGATION UPON PAYMENT OR SETTLEMENT.
(a) The Company's Right of Subrogation.
Whenever the Company shall have settled and paid a claim under this
policy, all right of subrogation shall vest in the Company unaffected by
any act of the insured claimant.
The Company shall be subrogatcd to and be entitled to all rights and
remedies which the insured claimant would have had against any person or
property in respect to thc claim had this policy not been issued. If
requested by the Company, the insured claimant shall transfer to the
Company all rights and remedies against any person or property necessary
in order to perfect this right of subrogation. The insured claimant shall
permit the Company to sue, compromise or settle in the name of the
Insured claimant and to use the name of thc insured claimant in any
transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the
insured claimant, the Company shall be subrogated to these rights and
remedies in the proportion which the Company's payment bears to the
whole amount of the loss.
If loss should result from any act of the insured claimant, as stated
above. that act shall not void this policy, but the Company, in that event,
shall be required to pay only that part of any losses insured against by this
policy which shall exceed the amount, if any, lost to the Company by
reason of the impairment by the insured claimant of the Company's right
of subrogation.
(b) The Company's Rights Against Non - insured Obligors.
The Company's right of subrogation against non - insured obligors shall
exist and shall include, without limitation, the rights of the insured to
indemnities, guaranties, other policies of insurance or bonds,
notwithstanding any terms or conditions contained in those instruments
which provide for subrogation rights by reason of this policy.
14. ARBITRATION
Unless prohibited by applicable law. either the Company or the insured
may demand arbitration pursuant to the Title insurance Arbitration Rules
of the American Arbitration Association. Arbitrable matters may include.
but are not limited to, any controversy or claim between the Company and
the insured arising out of or relating to this policy, any service of the
Company in connection with its issuance or the breach of a policy
provision or other obligation. All arbitrable matters when the Amount of
Insurance is 51,000.000 or less shall be arbitrated at the option of either the
Company or the insured. All arbitrable matters when the Amount of
Insurance is in excess of $1,000,000 shall be arbitrated only when agreed to
by both the Company and the insured. Arbitration pursuant to this policy
and under the Rules in effect on the date the demand for arbitration is
made or, at the option of the insured, the Rules in effect at Date of Policy
shall be binding upon the parties. The award may include attorneys' fees
only if the laws of the state in which the land is located permit a court to
award attorneys' fees to a prevailing party. Judgment upon the award
rendered by the Arbitrator(s) may be entered in any court having
jurisdiction thereof.
The law of the situs of the land shall apply to an arbitration under the
Title Insurance Arbitration Rules.
A copy of the Rules may be obtained from the Company upon request.
15. LIABILITY LIMITED TO THIS POLICY; POLICY ENTIRE
CONTRACT.
(a) This policy together with all endorsements, if any, attached hereto
by the Company is the entire policy and contract between thc insured and
the Company. In interpreting any provision of this policy, this policy shall
be construed as a whole.
(b) Any claim of loss or damage, whether or not based on negligence,
and which arises out of the status of the title to the estate or interest
covered hereby or by any action asserting such claim, shall be restricted to
this policy.
(c) No amendment of or endorsement to this policy can be made
except by a writing endorsed hereon or attached hereto signed by either the
President. a Vice President, the Secretary, an Assistant Secretary, or
validating officer or authorized signatory of the Company.
16. SEVERABILITY.
In the event any provision of the policy is held invalid or unenforceable
under applicable law, the policy shall be deemed not to include that provi-
sion and all other provisions shall remain in full force and effect.
17. NOTICES, WHERE SENT.
All notices required to be given the Company and any statement in writing
required to be fumished the Company shall include the number of this policy and
shall be addressed to Transamerica Title Insurance Company, 44 Montgomery
