The reason is that the private easement Toil- originally proposed across Parcel A must be 30 feet wide, with a 20 -foot wide gravel surface. However, now that you are re- designing the lot lines in your short plat, we can reconsider the issue. We have previously discussed your options. If you re- design Parcel B so that it is adjacent to 133rd, the 30 -foot easement across Parcel A is not required. Instead of the "easement," Parcel B can be served by a "driveway." In this situation, the Fire Department has the authority to approve a driveway which is less than the normal 20 -foot width. After reviewing your proposal to preserve the row of existing trees, the Fire Department has given preliminary approval to a 12 -foot -wide driveway for Lot B. However, you must meet the following conditions: A. The driveway for Parcel B must be paved the full 12 foot width from 133rd Street for a minimum length of 150 feet. Obtain all required permits prior to beginning any construction. For sewer and water permits, contact the individual provider District. For City of Tukwila utilities and roadway construction, contact John Pierog of Public Works at 433 - 0179. If you need final approval prior to installing these site improvements, you must assure the City that the improvements will be completed at a later date. Bill has not provided sufficient documentation that there is hardship, why he cant provide required 30- foot easement. That's why exception denied; Ive explained this to him. Critical issue is fire access: 20 feet is minimum. Im still waiting for him to decide what he wants to do. He first asked for 20', then asked for 12' (his existing road easement). She did not seem to be familiar with his site plan and surroundings. Did not seem to understand what an easement is or how one is created or that you cant superimpose over a building. Kept confusing access easements and utility easements and who grants easements to whom. Didnt know that setbacks measured from property lines; that you could build up to edge of easement. Had long, confusing discussion on basic definitions, features of his site plan and what City is asking for. Told her Bill has sizable 11,500 s.f. lot, will have 29' feet on side to expand building or garage, has a 68' front yard. I believe this is enough room to build. Roadway only needs to be 20 feet. I dont see any hardship from the 30' easement. Apparently, she hadnt really looked at this before, but agreed that there seemed to be enough room on the lot. She thought that if she told Bill this same thing he might see how it would all work. As part of the issue, shes concerned about a row of big trees. Trees located along east side of existing road /utility easement. Believes road will mean removal of trees. I clarified that if he really wants to save trees, he can widen the easement a few feet and build the road to the east of trees. Now that she has understanding of what needs to be done, she will talk to Bill to see if he will agree to 30 -foot easement. Will call me if more info needed or if she wants to discuss alternatives. Letter of conditional approval was sent to BG with items he needed to complete. He did not want to do 30' road easement, so he asked for exception (his letter of 8/25/93). DRC denied his request, as no hardship demonstrated. However, Rick had told BG he would reconsider if BG obtained fire access easement from adjacent neighbors. BG was to go measure existing easement and talk to neighbors. We have been waiting for this from BG, plus final improvements specified in my letter of approval conditions. BG angry that I wasn't at DRC meeting. Explained that I had asked to attend, but wasn't called in for it. BG mentioned this several times during this discussion. BG also angry that his exception wasn't granted. Didn't seem to realize that it was denied. Said it was the stupidest meeting he's ever been to. Only 2 people there (not sure who they were), and they didn't give him a chance to talk at all. Made some derogatory references to them. Wants to talk to their bosses, the Mayor, and "whoever is under him." Wants me to come out and look at his place. I said I have been out to his site. I explained process to him again. Meeting was for him to demonstrate hardship. He made 3 points in his request letter, and brought'pictures to meeting as I had suggested. Based on this, his request was denied. (for Grosso Short Plat Application #L93 -0041) Dear Mr. Cassutt: The Department of Community Development has reviewed your letter of April 18, 1994, in which you requested an exception to the Zoning Code building front yard setback requirements for the above short plat. We understand from your letter and earlier discussions that you are authorized to act as Mr. Grosso's agent for the duration of the short plat review process. Based upon a review of your lots and the Code's exception criteria, DCD has approved your setback exception request. The basis of our decision on your request is summarized below. The Zoning Code states that the front of a lot is "that portion nearest the street..." (TMC 18.06.470). A street is defined in the Code as a "public thoroughfare which affords the principal means of access to abutting properties" (TMC 18.06.790). Thus, the front yard of each of your lots would be that portion closest to South 133rd Street, or the northernmost portion of the lot. However, the Code provides for exceptions to front yard requirements (TMC 18.50.070). Under this provision, DCD may make an exception as follows: a) "Where the front yard that would normally be required on a lot is not in keeping with the prevailing yard pattern;" b) the requirement for the normal front yard may be waived and substituted with "a special yard requirement;" 'c) and such yard requirement "shall not exceed the average of the yards provided on adjacent lots." These setbacks for Parcel B must be delineated on your survey with a dotted "Building Setback Line." See diagram, attached. Since that time, you have proposed revisions to your original application. We have discussed these short plat requirements and revisions several times. Based on our discussions, the City has revised the requirements for your short plat approval. These new requirements are described below. 1. Access drive As you will recall, the City did not approve your roadway exception request of August 25, 1993. The reason is that the private easement you originally proposed across Parcel A must be 30 feet wide, with a 20 -foot wide gravel surface. However, now that you are re- designing the lot lines in your short plat, we can reconsider the issue. We have previously discussed your options. If you re- design Parcel B so that it is adjacent to 133rd, the 30 -foot easement across Parcel A is not required. Instead of the "easement," Parcel B can be served by a "driveway." In this situation, the Fire Department has the authority to approve a driveway which is less than the normal 20 -foot width. After reviewing your proposal to preserve the row of existing trees, the Fire Department has given preliminary approval to a 12- foot -wide driveway for Lot B. However, you must meet the following conditions: A. The driveway for Parcel B must be paved the full 12 -foot width from 133rd Street for a minimum length of 150 feet. Survey revisions In addition to the survey revisions noted above, some items remain to be completed. We have previously discussed these in more detail. To summarize, you will need to do the following: A. Revise your survey to show how Parcel B is to be connected to the sewer main. B. Revise your survey to show your new lot lines for Parcel B. As I understand it, you wish to re- design Parcel B to have an "ax" shape, where the end of the "handle" is adjacent to 133rd Street. If so, the "handle" width must be at least 20 feet wide. 3. Required site improvements As I stated in my letter to you of July 23, 1993, all site improvements must be installed prior to final approval of your short plat. Below are the requirements for short plat site improvements: A. Install paved driveway, required Fire lane marking, and other requirements noted in Item #1 above. If you need to record your short plat prior to installing these site improvements, you must assure the City that the improvements will be completed at a later date. This is accomplished by providing the following: A. A written cost estimate from a contractor for completion of all work; and B. A bond, letter of credit, assignment of account or cash assignment for 150% of the value of the work. This is scheduled for a Subdivision Committee decision at the September 2, 1993 DRC meeting. Mr. Grosso has applied for a short plat at 3029 South 133rd Street (see... attached). For access, he proposes a 20 -foot wide easement, rather than the 30 -foot easement required by the Subdivision Code. The proposed access easement would serve one lot (Parcel B), as the existing house on Parcel A is served by a separate driveway. The roadway will have a minimum length of 123 feet to Parcel B, or 153 feet to a house on Parcel B (the survey map shows the road running the length of Parcel B, but this isn't necessary). Under the Subdivision Code, a "private access road" has a minimum easement width of 30 feet, is no more than 200 feet long, and serves no more than four lots (TMC 17.24.030, attached). An exception to these requirements may be granted by the Short Subdivision Committee in "hardship" cases (TMC 17.32.010, attached). The following are our comments: 1. Variances have typically been granted to reduce the required easement widths for private accesses from 30' to 20', but no less. The proposed easement shown is only 15'. Details asso- ciated with the access road; i.e., grade, material for sur- facing, width, etc., need to be shown. 2. Applicant shall sign a No- Protest Water Agreement due to the distance of the fire hydrant from the rearmost parcel which exceeds 150' and the size of the water main which is only 6 ". 3. Water and sewer utilities serving the individual parcels need to be shown. 4. Two foot contours need to be shown for existing and proposed conditions. 5. Storm drainage improvements, including detention /conveyance sys- tems need to be shown. If soil type permits, infiltration sys- tems are preferred and the short plat shall include a note to the effect that ground infiltration will be utilized for storm drainage. 6. Applicant shall build all infrastructure required or provide performance bonding equal to 150% of the estimated construction cost. 7. Applicant shall also provide a copy of an agreement which runs with the land and covers the maintenance of common access and utilities. Determination and Payment of Loss (a) The liability of the Company under this policy shall in no case exceed the least of: (i) the actual loss of the insured claimant; or (ii) the amount of insurance stated in Schedule A. Limitation of Liability No claim shall arise or be maintainable under this policy (a) if the Company, after having received notice of an alleged defect, lien or encumbrance insured against here- under, by litigation or otherwise, removes such defect, lien or encumbrance or establishes the title, as insured, within a reasonable time after receipt of such notice; (b) in the event of litigation until there has been a final determination by a court of competent jurisdiction, and disposition of all appeals therefrom, adverse to the title, as insured, as provided in paragraph 3 hereof; or (c) for liability voluntarily assumed by an insured in settling any claim or suit without prior written consent of the Company. 8. Reduction of Liability All payments under this policy, except payments made for costs, attorneys' fees and expenses, shall reduce the amount of the insurance pro tanto. No payment shall be made without producing this policy for endorsement of such payment unless the policy be lost or destroyed, in which case proof of such loss or destruction shall be furnished to the satisfaction of the Company. 9. Liability Noncumulative It is expressly understood that the amount of insurance under this policy shall be reduced by any amount the Company may pay under any policy insuring either (a) a mortgage shown or referred to in Schedule B hereof which is a lien on the estate or interest covered by this policy, or (b) a mortgage hereafter executed by an insured which is a charge or lien on the estate or interest described or referred to in Schedule A and the amount so paid shall be deemed a payment under this policy. Apportionment If the land described in Schedule A consists of two or more parcels which are not used as a single site, and a loss is established affecting one or more of said parcels but not all, the loss shall be computed and settled on a pro rata basis as if the amount of insurance under this policy was divided pro rata as to the value on Date of Policy of each separate parcel to the whole, exclusive of any improve- ments made subsequent to Date of Policy, unless a liability or value has otherwise been agreed upon as to each such parcel by the Company and the insured at the time of the issuance of this policy and shown by an express statement herein or by an endorsement attached hereto. 11. Subrogation upon Payment or Settlement Whenever the Company shall have settled a claim under this policy, all right of subrogation shall vest in the Com- pany unaffected by any act of the insured claimant. The Company shall be subrogated to and be entitled to all rights and remedies which such insured claimant would have had against any person or property in respect to such claim had this policy not been issued, and if requested by the Company, such insured claimant shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect such right of subro- gation and shall permit the Company to use the name of such insured claimant in any transaction or litigation involv- ing such rights or remedies. If the payment does not cover the loss of such insured claimant, the Company shall be subrogated to such rights and remedies in the proportion which said payment bears to the amount of said loss. If loss should result from any act of such insured claimant, such act shall not void this policy, but the Company, in that event, shall be required to pay only that part of any losses insured against hereunder which shall exceed the amount, if any, lost to the Company by reason of the impairment of the right of subrogation. 12. Liability Limited to this Policy This instrument together with all endorsements and other instruments, if any, attached hereto by the Company is the entire policy and contract between the insured and the Company. Any claim of loss or damage, whether or not based on negligence, and which arises out of the status of the title to the estate or interest covered hereby or any action asserting such claim, shall be restricted to the pro- visions and conditions and stipulations of this policy. Iam purchasing Parcel B from Grosso and will be completing his obligations. I was under the impression I could submit an applica- tion for a building permit while the short plat was being completed It was explained to me a county number was necessary to start a building permit process. I understand now and will shortly submit a cash bond so the building permit process can be started before the short plat is approved. During my discussions i showed a plot plan of the proposed building to Ann and Mr. Jack Pace. According to my plan which is enclosed I designated the front of the lot to be the Westerly side facing the access road. It was explain= ed the front of Parcel B would be that portion closest to a street, or the Northerly portion of Parcel B facing S- 133rd. requiring a 30foot setback. You can see on the plot plan the house is orientated to the West offering a view of the Caacades. I am requesting a variance according to your 18.50.070 Yard Regulations *3. The house South of Parcel B faces West and is serviced by an access road off S -133rd running Notth and South the some as my access to Parcel B. I would alter my setbacks to make the South line 8 feet(10% of the 77 foot length) and the North line to 22 feet as shown on the enclosed plot plan in red. The variance would allow Parcel B to have a 22 foot front instead of 30 feet while still allowing the access to stay the same and allow the hogse to be oriented to the view. If the variance is approve4 I will submit a new plot plan when I submit a building permit application. I realize Grosso has not fullfilled his short plat requirements.
