The applicant has proposed to install the antennas higher than the maximum permitted height. Pursuant to WAC 197- 11 -800 this project is exempt from SEPA review. File (L06 -008 and L06 -0Q) Cingular Wireless Upgrade to Roxbury (WA 15 8) Zoning Variance Justification Proposal This application for a zoning variance is the result of the combination of several parameters from different regulating agencies. Cingular currently has a wireless telecommunication facility on a Seattle City Light (SCL) lattice tower located next to the Tukwila US Postal Service processing facility on 27 Ave S. The antennas for the existing site are between the top two of the three high tension power lines. This location on the tower was allowed when the site was first constructed; however SCL no longer allows equipment installation between power lines. 'When Cingu'lar acquire. A 8thTPWireless, the C mandated that the networks =of the two companie_S"' betegrated� Because each company used different technologies, the integration requires that equipment be added to the existing facility so that both sets of customers retain service. Because the existing antennas need to replaced, the new SCL regulations apply, and the antennas must be moved above the lines. The SCL tower is located in an area zoned Manufacturing Industrial Center / Heavy Industrial (MIC /H). The height limit in that zone is 125 feet. This tower is currently 148 feet tall. To maintain the required separation between our antenna equipment and the transmission lines, five feet must be added to the tower. This zoning variance is being requested to permit the tower extension. Review Criteria 18.72.020 Criteria for Granting Variance Permit The Hearing Examiner shall consider all requests for variance from the Zoning Code; variance from the provisions of such ordinances shall not be granted by the Hearing Examiner unless the board finds that all of the following facts and conditions exist: 1. The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located; Response: The existing SCL towers in the area are above the height limit for the zone. The existing SCL towers and uses of the towers will not change. Cingular is not requesting a special privilege for the zone or other properties in the area which already has SCL towers above the zone height. Upgrade to Roxbury Page 1 of 3 Zoning Variance Criteria Response • 2. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; Response: The variance is requested because of SCL safety requirements guided by OSHA, no longer permit telecommunication antennas between high tension lines. In addition, there must be a 15 -foot separation between high tension lines and antennas to prevent electrical arcing. Due to topography in the area and the need for telecommunication sites to have "line of sight ", the only option for the telecommunication site to remain operational as required by FCC regulations for providing service, is to locate the antennas above the power lines with 15 -feet of separation between the high tension lines and the antennas. Placing the antennas below the lines would create a shadow effect based on the hills surrounding the valley and user would have breaks in service. 3. The granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated; Response: This tower is already above the height limit of this zone, and the wireless telecommunication site already exists, the applicant is not asking for anything that is different that existing use of the tower and the area, and the existing wireless services for the area will be retained. If this proposal is not approved, there will be a detrimental impact on the public welfare because service to the area, including E -911 service, will not be available. Historically, this existing site has not been injurious to the property or improvements in the vicinity and in the zone in which the proposal is located. By increasing the height by five feet on a 148 -foot tower, Cingular does not anticipate any negative impacts and the general public will visually even notice the five foot height difference. 4. The authorization of such variance will not adversely affect the implementation of the Comprehensive Land Use Policy Plan; Response: This location is already zoned MIC/H where telecommunication sites are permitted under Conditional Use Permits. 5. The granting of such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity. Response: The applicant already has a wireless telecommunication installation at this site.
