Dear Mr. Main:
The Short Subdivision Committee has completed review of your short plat application (No. L06-
026), and determined that it complies with all applicable City code requirements.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project
submittal, preliminary approval is granted subject to the conditions stated below.
There are three basic steps in the short plat approval process:
1. Preliminary Approval
This letter constitutes your preliminary approval. The application was reviewed by the
Tukwila Short Subdivision Committee and approved with conditions. The conditions
imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval
listed at TMC 17.12.020 C in the Tukwila Subdivision Code.
a. The approved easement documents must be recorded at King County recorder's office and the
recording number should be referenced on the survey plat document. Provide draft copy of the
private ingress /egress & utility easement to the Public Works Department for their approval.
b. The proposed water line, sewer connection and storm water improvements will be required as
part of the building permit for the construction of the new house on lot 2. You will need to

obtain all required permits prior to beginning any construction. Extension of the sewer and
water lines to the lots shall be approved by the appropriate utility. For sewer permits, contact
Valvue Sewer district. For the city of Tukwila utilities including water, contact Tukwila Public
Works at (206) 433 -0179. As -built plans shall be provided to the Public Works Department.
c. The shed on lot 2 must be removed. The shed on lot 1 must be shown on the survey plat map
and must meet 10 feet minimum setback requirement from the new property line. If the shed on
lot 1 is less than 10 feet from the new proposed property line, then it must be removed prior to
the final short plat approval. Please contact the Building Department at 206 - 433 -7165 to obtain
information about demolition permits.
d. The following changes must be addressed on the final survey plat:
i) There is no sidewalk adjacent to the site along the east side of 40` Ave South. The
short plat survey map and the site development plan incorrectly show the sidewalk.
ii) The shed on lot 1 must be shown if it is at least 10 feet from the new property line.
Otherwise the shed shall be removed.
iii) The setbacks are measured from the property line and they are 20 from front, 5 feet
from the side and 10 feet from rear property line. Show the correct setbacks as
shown on the attached red -lined plan.
iv) All other changes as shown on the redlined survey shall be incorporated including
the file number.
v) Provide the following two notes on the final short plat map
1. The proposed water line, sewer connection and storm water improvements
will be required as part of the building permit for the construction of the new
house on lot 2.
2. The home on lot 2 shall not be located more than 150 feet from entry point
at 40 Ave South.
vi) The recording number of the new 10 feet ingress /egress utilities easement shall be
referenced on the plat map.
e. The following changes must be addressed on the Site Development Plan:
i) Proposed storm drainage shall be within the new private 10 easement within lot 1
and within the street right -of -way. Verify that the new storm drainage system will
not be constructed within the adjacent property to the south.
ii) Storm drainage pipe between catch basins shall be 8 inch or greater.
iii) Provide Type I catch basins at bends, not cleanouts as shown and labeled on plan
sheet.
iv) Show and label crossing information for existing sanitary sewer and proposed storm
drainage pipe.

v) From north edge of the existing driveway pavement to north line of the proposed
private 10 feet easement is approximately 4.5 feet. Verify there is adequate width to
install all utilities including storm and water line.
vi) All utilities including power are required to be underground.
f. Submit a set of recording documents in record of survey format that meet the King County
Recorder's requirements including margin requirements and please do not fold the documents
that will be recorded. The survey map must be revised to reflect the changes as shown on the
attached redlined map and those listed above. The surveyor's original signature must be on the
face of the plat.
This short plat approval decision is appealable to the Hearing Examiner. In order to appeal the
decision a written notice of appeal must be filed with the Department of Community
Development within 21 days of the issuance of the Notice of Decision (08/21/2006). The
requirements for such appeals are set forth in Tukwila Municipal Code 18.116.
If no valid appeals are filed within the time limit the decision of the Department will be final.
Appeal materials shall include:
APPEALS
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact
person authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the
decision. The Notice of Appeal shall state specific errors of fact or errors in
application of the law in the decision being appealed; the harm suffered or
anticipated by the appellant, and the relief sought. The scope of an appeal shall be
limited to matters or issues raised in the Notice of Appeal.
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The
Hearing Examiner's decision on the appeal is the City's final decision. A party who is not
satisfied with the outcome of the administrative appeal process may file an appeal in King County
Superior Court from the Hearing Examiner's decision pursuant to the procedures and time
limitations set forth in RCW ch. 36.70C.

3. Recording

a) Revise the survey plat map and the site development plan to reflect the changes as
shown on the attached redlined plans and those listed above as conditions of
approval.
b) Submit the ingress, egress & utilities easements for city's review and record it with
King County upon City's approval.
d) Submit the necessary short plat documents (survey, legal descriptions, and other
required paper work) with revisions made as shown on the redlined plans. The
documents must meet the King County Recorder's requirements. The surveyor's
original signature must be on the face of the plat.
All taxes and fees assessed against the property must be current prior to final approval.
Please check with the King County Assessor's Office and the City of Tukwila Finance
Department prior to submitting final mylars.
After the documents have been found to be in order, and the all of the requirements of the
short plat have been met, the Chair of the Short Subdivision Committee signs your short
plat which constitutes a grant of final approval.
Expiration
The final approved short plat must be filed with the King County Department of Records by
August 11, 2007, one year from the date of this preliminary approval or the application will
expire. The City may grant a single one -year extension if requested in writing prior to the
expiration date.
The signature of the Chairman of the Short Subdivision Committee certifies that your short
plat application is ready for recording. It is your responsibility to record the City approved
short plat documents with the King County Department of Records. You will need to pay
the recording fees and submit your approved original short plat to King County, see the
Recording Procedures handout. The short plat is not complete until the recording occurs and
copies of the recorded documents are provided to the Department of Community
Development.
After recording, the County returns the recorded original to the City of Tukwila within 4 -6
weeks, at which time your short plat is considered complete. You can shorten this
processing time by hand - delivering a copy of the recorded short plat to the project planner.
In many circumstances, building permits on the short platted property may not be issued
until a copy of the recorded short plat (or original) is returned to the Department of
Community Development.

This letter with the accompanied civil plan is intended to satisfy the Targeted Drainage Review
(TDR) Category #1 requirements for the subject project. The 2005 edition of the King County
Surface Water Design Manual (KCSWDM) provides specifics on the TDR In general a project that
undergoes a Category 1 review must demonstrate that it complies with the following five
requirements. Please note that given the limited scope of the project, many of the requirements do
not apply.
Project Overview:
The proposed project is the short platting of an existing 18,860 square -foot residential lot located at
11606 40 Avenue South. The property is bordered to the north, east, and south by developed
residential property and to the west by 40 Avenue South. The area downstream of the project site is
developed with single family residences and private and public street right -of -way improvements.
This project clearly meets the Small Site Drainage Review Requirements based on the impervious
threshold of 10,000 sf is not exceeded and the project cleared area is less than 2 acres or 35% of the
property (please see the enclosed Civil Plan). Given the amount of new impervious area added the
project is exempt from stormwater peak rate runoff control and water quality treatment.
Core Requirement #5 - Temporary Erosion and Sediment Control Plan: Given the limited
improvements required to create the 2 lot short plat, an erosion and sediment control plan was not
prepared for the project. It is anticipated that the proposed improvements will be made at the time of
building permit issuance for Lot 2 of the short plat. A TESCP can be created at this time which will
serve to minimize soil erosion/sedimentation during the proposed site improvements.
Special Requirement #1: Other Adopted Area- Specific Requirments:
• Critical Drainage Areas (CDAs): Requirements for CDAs such as more restrictive flow
control or clearing standards would not apply to the limited scope of this project.

• Basin Plans (BPs): Area specific BPs that may control adverse drainage related impacts to the
environment would not be applicable given the limited scope of this project.

through mechanisms such as habitat improvements, regulations, incentives, BMP's, land
acquisition, and public education, would not be applicable to this project given its' limited
scope.
• Stormwater Compliance Plans (SWCPs): A SWCP would not be applicable to this project
given its' limited scope.
• Lake Management Plans (LMPs): Not applicable to this project.
• Flood Hazard Reduction Plan Updates (FHRPs): Not applicable to this project.
• Shared Facility Drainage Plans (SFDPs): Not applicable to this project.
Special Requirement #2: Floodplain/Floodway Analysis: Not applicable to this project.
Special Requirement #3: Flood Protection Facilities: Not applicable to this project.
Special Requirement #4 — Source Controls: Given the limited scope of work, this special
requirement is not applicable to the project.
Improvements in City R.O.W.: With exception to some minimal work associated with the installation
of the project utilities, no improvements are planned within City R.O.W.

CERTIFICATE OF SEWER AVAILABILITY/NON- AVAILABILITY
The following terms and conditions apply to the attached Val Vue Sewer District ( "District ")
Certificate of Sewer Availability/Non - Availability ( "Certificate ").
1. This Certificate is valid only for the real property referenced herein ( "Property"), which is in
the District's service area, for the sole purpose of submission to the King County Department of Development
and Environmental Services, King County Department of Public Health, City of Seattle, City of Tukwila, City
of Burien and/or City of SeaTac. This Certificate is between the District and the applicant only, and no third
person or party shall have any rights hereunder whether by agency, third -party beneficiary principles or
otherwise.
2. This Certificate creates no contractual relationship between the District and the applicant and
its successors and assigns, and does not constitute and may not be relied upon as the District's guarantee that
sewer service will be available at the time the applicant may apply to the District for such service.
3. As of the date of the District's signature on this Certificate, the District represents that sewer
service is available to the Property through sewer systems that exist or that may be extended by the applicant.
The District makes no other representations, express or implied, including without limitation that the applicant
will be able to obtain the necessary permits, approvals and authorizations from King County, City of Seattle,
City of Tukwila, City of Burien, City of SeaTac or any other governmental agency before the applicant can
utilize the sewer service which is the subject of this Certificate.
4. If the District or the applicant must extend the District's sewer system to provide sewer
service to the Property, the District or applicant may be required to obtain from the appropriate governmental
agency the necessary permits, approvals and authorizations. In addition, the governmental agency may
establish requirements that must be satisfied as a condition of granting any such permits, approvals or
authorizations, which may make impractical or impossible the provision of sewer services to the Property.
5. Application fr and possible provision of sewer service to the Property shall be subject to and
conditioned upon availabilitp.of sewer service to the Property at the time of such application, and compliance
with federal, state, local and District laws, ordinances, policies, and/or regulations in effect at the time of such
application.

Preliminary Short Plat meets Public Works requirements.
Public Works requires the following to be completed, prior to Final Short Plat
approval.
1. Applicant shall provide a draft copy of the Private Ingress/Egress & Utility
Easement. This shall be a separate document from the Final Short Plat map and
be recorded at King County. The language for the easement should be clear on
who will maintain the installed utilities.
Short Plat Site Development Plan
1. Provide Type I — CB's at bends, not cleanouts as shown and labeled on plan
sheet.
2. Proposed storm drainage shall be within the new private 10' easement within
Lot 1 and within street right -of -way. Verify that the new storm drainage system
will not be constructed within the adjacent property to the South.
3. Storm drainage pipe between catch basins shall be eight (8) inch or greater.
4. Show and label crossing information for existing sanitary sewer and proposed
storm drainage pipe.
5. From North edge of existing driveway pavement, to North line of proposed
private 10' easement is approximately 4.5 feet. Verify there is adequate width to
install all utilities.
Miscellaneous Comments
1. There is no sidewalk along the East side of 40 Ave. South, including adjacent to
the site. The short plat map and site development plan, both label sidewalk as
existing.
2. Street Use as part of the Building Permit, requires a Bond and Insurance for work
within City right -of -way.
3. Prior to work within the City right of way, the Owner /Applicant shall sign with
Notary, a Hold Harmless Agreement.
4. All utilities including power are required to be underground, per City of Tukwila
ordinance.
