Marginal Way S PROJECT DESCRIPTION: The grading, paving and installation of fencing, storm drainage, lighting and landscaping for a proposed automobile towing storage yard within the Shoreline Zone. II. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that the project, as proposed, does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to WAC 197 -11 -172, that the probable significant adverse environmental impacts of the project were adequately analyzed in the EIS previously prepared for the planned action and will implement the conditions and mitigation measures imposed by the planned action approval. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Shoreline Substantial Development Permit complies with applicable City and state code requirements and has approved the application based on the findings and conclusions contained in the staff report. The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. YOUR APPEAL RIGHTS One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings Board for details. IV. PROCEDURES AND TIME FOR APPEALING The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW 90.58 and WAC 461.08. V. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the Shoreline Substantial Development Permit are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Nora Gierloff, who may be contacted at 206 -431- 3670 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Mullet, Mayor Department of Community Development Steve Lancaster, Director Project: ABC Towing File Number: L06 -015 - Shoreline Substantial Development Permit Applicant: John Chase, Owner Request: The grading, paving and installation of fencing, storm drainage, lighting and landscaping for a proposed automobile towing storage yard within the Shoreline Zone located at 10315 E. Marginal Way S. Associated Permits: PW site work permit Comprehensive Plan/ Zoning Designation: Manufacturing Industrial Center/Heavy (MIC/H) The project is to improve a gravel and asphalt parking lot by grading, paving and installation of fencing, storm drainage, lighting and landscaping in order to establish an automobile towing storage yard within the Shoreline Zone. The project is subject to the shoreline substantial development permit since the project area is located within 200 feet of the Duwamish Waterway. Currently site runoff flows untreated to an outfall in the Duwamish River. The proposed improvements would route the drainage through two new stormfilter catch basins for treatment prior to discharge through the existing outfall. Best management practices will be used to contain erosion and siltation during construction. The site is located in an area that was annexed by Tukwila from King County in 1989. As no new shoreline master program has been adopted for this area, the project is subject to King County Shoreline Master Program and regulations. Shoreline Regulations • Following are the relevant review criteria as contained in the King County Shoreline Regulations as applied by the City of Tukwila: King County Code (KCC) Section 25.16.030 General Requirements: A. Non -water related development shall not be permitted waterward of the Ordinary High Water Mark (OHWM). Response: The proposed project is not water ward of the ordinary high water mark. B. ...No structure shall exceed a height of a thirty -five feet ... Response: The existing single story commercial building is lower than 35 feet and will not be altered. The new light pole will be 30' in height. C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. Response: The proposed project will meet all King County Surface Water Design Manual requirements for retention and sedimentation facilities during the construction period. D. Development shall maintain the first fifty feet of property abutting a natural environment as required open space. Response: This criterion is not applicable, as the King County shoreline environment designation adjacent to this site is "Urban Environment ". E (1) Parking areas must be located beneath or upland of the development... Response: The existing building is less than 2,000 square feet in area and is located adjacent to East Marginal Way. No additional buildings are proposed that could be used to screen the proposed impound yard. E (2) Any outdoor parking area perimeter...must be maintained as a planting area with a minimum of five feet. E (3) One live tree...shall be required for each thirty linear feet of planting area. E (4) One live shrub...for each 60 inches of planting area shall be required. Response: Five feet of landscaping will be installed along the East Marginal Way and S. 104` Street frontages. One tree will be provided every 20 linear feet and one shrub every 5 linear feet. Live groundcover will be installed to provide 90% coverage within 3 years. E (5) Additional perimeter and interior landscaping of parking areas may be required when large parking areas are proposed. Response: Additional density of trees along the perimeter rather than additional width has been proposed by the applicant. 2 • • F. Collection facilities to control and separate contaminants shall be required where storm -water runoff from impervious surfaces would degrade or add to the pollution of receipt waters or adjacent properties. Response: The proposed project will meet all King County Surface Water Design Manual requirements and provide treatment to the storm -water before discharging into the Duwamish River. IV. Comprehensive Plan Shoreline Policies The site is located within the Manufacturing/Industrial Center along the Green/Duwamish River. The Tukwila Comprehensive Plan establishes the following priorities in this shoreline environment: • Redevelopment of under - utilized areas and development of intensive commercial and industrial activities; • Enhancement and restoration of access to the river; and • Protection and restoration of natural environment features and riverbank characteristics, where compatible with development. Response: The proposed project is an upgrade of an existing parking lot rather than a complete redevelopment of the site. The area of work is across a public R -O -W from the river bank. While it does not further these goals it does not worsen the existing situation. V. SEPA and other approvals A planned action determination was made for the site. VI. The Planning Division review does not supplant each department's ability to administer its own regulations and permits. There are some areas in Tukwila that are still subject to the King County Shoreline Master Plan. Shoreline substantial development permits subject to King County's Shoreline Master Plan will be reviewed against the shoreline regulations found in K.C.C.25.16 particularly K.C.C. 25.16.030 below. K.C.C.25.16.030 General requirements: A. Nonwater related development and residential development shall not be permitted waterward of the ordinary high water mark. B. Except in those cases when the height requirements of the underlying zones are more restrictive, no structure shall exceed a height of thirty-five feet above average grade level. This requirement may be modified if the view of a substantial number of residences will not be obstructed, if permitted by the applicable provisions of the underlying zoning, and if the proposed development is agricultural, water related or water dependent. C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. D. Development shall maintain the first fifty feet of property abutting a natural environment as required open space. E. Parking facilities except parking facilities associated with detached single - family and agricultural development shall conform to the following minimum conditions: 1. Parking areas serving a water related or a nonwater related use must be located beneath or upland of the development which the parking area serves. 2. Any outdoor parking area perimeter, excluding entrances and exits, must be maintained as a planting area with a minimum width of five feet. 3. One live tree with a minimum height of four feet shall be required for each thirty linear feet of planting area. 4. One live shrub of one - gallon container size or larger shall be required for each sixty linear inches of planting area. 5. The maintenance of these provisions may be assured by requiring a performance bond of sufficient size to substantially defray the cost of a cleanup or rehabilitation effort. C. The height limitations of the general requirements section (Section 25.16.030) of this chapter shall not apply to water dependent industrial development. D. The provisions of this chapter shall not be construed to permit the construction of any oil port facility designed to load or unload ships 125,000 dead weight tons or larger in size. E. Predeveloped Conditions: The proposed site is currently developed with a single commercial structure and partially paved parking lot, as shown on Figure 3 following this section. Those portions of the site which are not currently covered with structure or pavement consist of compacted gravel surfacing. The site is predominantly flat, with slight rises up to the fronting streets on the east and west sides. Site slopes are in the range of 0% to 2 %. The drainage from the site is currently conveyed via overland flow to a single catch basin located in the southern portion of the site. From this CB, flows are piped to a CB located at the northern edge of S.104 Street, and then flow by pipe under S. 104 Street to an outfall to the Duwamish River. Developed Conditions: • • The developed condition of the site includes retention of the existing structure, and a paved storage lot. Perimeter landscaping amounts to approximately 1600 SF. Parking lot drainage in the developed condition will be collected by two Stormfilter Catch Basins. The site has been graded to divide flows into two equal subbasins, with each subbasin draining to a Stormfilter CB.
