The Planning Commission approved the applicant's request for a Conditional Use Permit (CUP) to install wireless communication antennas on the existing Doubletree Inn located with the City's Urban Center. The Planning Commission approved the application with no conditions. Clearwire provides wireless internet to both residential and commercial users. The applicant has proposed to locate three panel antennas, two BTS units, two microwave dishes, and a GPS antenna on the penthouse portion of the Doubletree Inn. Approximately 7' by 2' 11" (See Sheet CO5, detail 6) Approximately 5' by 1' 7" (See Sheet CO5, detail 3) 2 feet in diameter (See Sheet CO5, detail 5) Approximately 6' by 5' (See Sheet CO5, detail 7) The applicant will lease 49 square foot area for the placement of the associated cabinet equipment. The cabinet equipment will be placed below the parapet wall. The Doubletree Inn with associated parking currently occupies the site (See Attachment D, Aerial Photo). The height of the building for the Doubletree Inn is approximately 80 feet. A penthouse structure is located on the top of the roof and the penthouse is an additional nine feet above the roofline. An existing antenna array extends from the top of the penthouse structure. There are three other wireless telecommunications providers located on the Doubletree Inn. The providers include, Cingular, Sprint, and Qwest and all three providers are operating under previously approved CUPs. Surrounding land uses are predominately commercial. Tukwila Pond is located directly to the east of the Doubletree property (See Attachment D: Aerial Photo). CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment F. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The facility will be located on an existing commercial building within the Tukwila Urban Center. Only authorized personnel will have access to the roof -top area. The applicant has provided documentation that the proposed facility will be within FCC standards for maximum exposure to radio frequency energy (See Attachment E). (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The proposed facility will be located on an existing commercial structure which meets setbacks for the TUC zone. The maximum height within the TUC zone is 115 feet. The applicant's antennas will be flush mounted to the existing penthouse structure which has an elevation of approximately 90 feet. The applicant has not proposed any additional parking for the proposed facility. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. There are no new buildings proposed for this project, instead the applicant is installing the wireless communication facility on an existing commercial building. Staff Report to the Planning Commission, L06 -065 Doubletree Site, Clearwire Page 5 of 6 (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas and dishes that will be mounted on the walls of an existing commercial structure. The equipment will not extend above the existing roofline as a result of this project. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a location on an existing building instead of constructing a new freestanding pole. All cabinet equipment will be placed on the roof the building. The applicant is not proposing to utilize a generator, which means the site will not have any impact on noise. CONCLUSIONS 1. The proposal to install an antenna on an existing commercial building will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. The applicant has submitted documentation that the antennas will meet Federal regulations for frequency emissions. By locating the operating equipment on a secured roof, potentially hazardous operating equipment has been made inaccessible to the public. 2. The proposed project meets the performance standards that are required in the TUC zone. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. No noise will be generated from the new antennas or ground equipment associated with this application. 5. The wireless communications facility has been designed in a way to minimize any visual impact from the project. The size of the Doubletree Inn will dwarf the antennas placed on the roof top. The parapet walls will conceal the cabinet equipment from view. 6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan, because it is a building co- location.
