Affidavit of Qualification and Certification for Sprint PCS F. Applicant's response to conditional use criteria. FINDINGS The applicant is currently operating a wireless communication facility at the subject property. The City approved this facility in 2000 under permit number L2000 -043. The existing antenna components are located on building B on the site. The ground equipment is located on a small concrete pad on the west side of the building B. South Transit has exercised eminent domain over a portion of the property and will be demolishing the building where the antennas are currently located. The applicant is requesting that the City allow the existing antennas to be moved from building B to building C. The existing ground equipment will remain and the applicant will install landscaping to screen the equipment from view. The applicant will install an OSHA approved vertical ladder on the east elevation of building C. Existing Development The property is approximately 200,471 square feet in size and there are currently three office buildings located on the site. The site also includes a large number of parking stalls and outdoor storage. The existing buildings on the site are 23 feet six inches in height. Surrounding Land Uses The subject property is surrounded by commercial and light industrial uses. The project area is bordered to the south by an onramp to Interstate Five. Martin Luther King Jr. Way borders the property to the east. On the east side of Martin Luther King Jr. Way is a self - storage business. To the north subject property is large commercial property currently used for warehouse operations. The Lindal Cedar Homes and Interstate Five border the property to the west. FINDINGS FOR CONDITIONAL USE PERMIT CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has chosen to move an existing antenna facility from one building on the property to another building. The antennas have been located on the rear portion of the building. A metal shroud will be used to help screen the antennas from view. The Planning Commission approved the location of the existing ground equipment in 2000. The ground equipment is currently screened from view by building C, which is proposed to be demolished by Sound Transit. The applicant has proposed to install landscaping around the ground equipment to screen it from view. The antenna shroud and the ground equipment will likely be most visible from Interstate Five and the adjacent on ramp. The applicant has submitted a letter from an RF Engineer demonstrating that the facility will be within all Federal Standards for frequency emissions. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The setback requirements for the Light Industrial zone are as follows: 20 feet from the front, five feet from the sides and five feet from the rear. The maximum height in the LI zone is 45 feet. The ground equipment will be setback over five feet from the rear property line. The antenna, with shroud will be 33 feet and five inches tall. Minimum landscaping requirements do not apply to this application. However, the applicant has chosen to install landscaping around the ground equipment. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. The shroud, access ladder and security device will be painted to match the color of the existing commercial building. Landscaping will be used to screen the existing ground equipment from view from adjacent properties and rights of ways. The plans submitted are unclear if irrigation will be provided in the landscaped areas. Staff has provided two conditions to address compatibility with future land uses (Sound Transit). (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. The applicant has proposed to install an antenna on an existing commercial building. A shroud will be used to screen the antennas from view and landscaping will be used around the ground equipment. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. No adverse impacts are foreseen from the proposed project. CONCLUSIONS The proposal to install an antenna on an existing commercial building will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. The facility will be located in an industrial zone where the nearest residential dwelling is approximately two miles away. The proposed use will not generate a high number of traffic trips. The purpose of the light industrial zones is as follows: "To provide areas characterized by distributive and light manufacturing uses, with supportive commercial and office uses ". While the proposed shroud may not be appropriate for other zones in the City, it provides an appropriate level of screening for the LI zone. Perhaps the biggest issue regarding the proposed facility is coordination with Sound Transit for the demolition of the existing building. The proposed landscaping for the existing ground equipment cannot be installed until Sound Transit has demolished the existing building and restored the site to pre - building Q: \CUP \Sprint \staff report.doc Staff Report to the Planning Commission L05 -024 SPRINT PCS AT 10400 MLK JR Way Page 5 of 5 condition. Additionally, the applicant will relocate certain utility lines that will need to be placed at an appropriate location so to not interfere with Sound Transit's demolition work. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit as presented with the following conditions: 1) The landscaped areas shall be provided with automatic irrigation. 2) The applicant shall install the approved landscaping 30 days after Sound Transit has completed site restoration work for the demolition of building B. The applicant shall provide the City a financial guarantee of 150 percent for the landscaping material, irrigation material, and estimated labor to install the landscaping with irrigation. The financial guarantee must be provided to the City prior to final approval being issued for the building permit for the proposed antenna. 3) All underground equipment shall be at least five feet from the foundation of building B. The transmit band is located between 1950 Mhz and 1965 Mhz and the receive band is located between 1870 Mhz and 1885 Mhz. Under FCC guidelines directed under CFR 47, subpart E, parts 20.200 through 24.238 — Sprint PCS must comply with the stated directives for Boradband PCS providers. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvement in the vicinity. The proposed use will not be materially detrimental to public welfare, injurious to the property or improvements in the vicinity The existing wireless facility presently located on Building C was conditionally approved in September, 2000 under project file number L2000 -043. Sound Transit has petitioned Eminent Domain and approval for demolition has been granted. Sprint PCS is proposing to relocate the antenna (only) onto Building B (same parcel, adjacent building), while the existing radio equipment will remain on the ground in its present location. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. The proposed use shall meet or exceed the standards for parking, landscaping, yards and all other development regulations required in the district. The proposed changes to the existing wireless facility will not change the present use. The facility will remain unmanned and will only require periodic maintenance; therefore a dedicated parking space is not required. A 5' landscaping buffer is being proposed to screen the ground equipment from public view. The number of antenna are being reduced to one antenna per sector (3 total), and a 24" diameter shroud will be placed over them to camouflage their presence. 3. The proposed development shall be compatible generally with the surrounding land uses. The proposed use is compatible with the surrounding land uses in the industrial area in which it is located. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. In keeping with the goals and policies of the Comprehensive Land Use Policy Plan, the proposed facility addresses the City's requirement that equipment be incorporated into the overall design and be screened from view. The Sprint PCS proposal minimizes the number of antenna, as well, reduces the current visibility of screening material used to disguise and incorporate the equipment into the building's design. The presence of wireless in the subject area is key to continued business growth and expansion in the City of Tukwila. Neighboring manufacturing and commercial businesses depend on wireless services to communicate with client base and product suppliers. In addition, the proposed site will provide updated wireless and 911 coverage to the heavily traveled I -5 corridor, as well as to the Sound Transit lines anticipated in the near future. Shoreline Conditional Uses (T1VIC 18.44. 050) shall be processed in accordance with. the Shoreline regulations and the Conditional Use Permits Chapter of the Tukwila Municipal Code.
