The City issued a comment letter for the above project on January 13, 2006. Additionally, the City sent you a letter dated March 23, 2006 informing you that the pending application would be canceled if the items in the January 13, 2006 letter were not addressed by May 1, 2006. The above applications are canceled. If you wish to proceed on the above short plat and SEPA application you must submit a new application. The City issued a comment letter regarding the Rehal short plat on January 13, 2006. As of today's date, the City has not received a response or the items requested in the January 13, 2006 letter. Please note, L05 -058 will be canceled it the comments raised in the January 13, 2006 letter are not addressed by May 1, 2006. Any vesting under the current application will be lost. There is also the outstanding issue of the trees that were removed on steep slopes, without a valid tree permit. The City had intended to work under the pending short plat application to address the tree removal issue. However, if the applicants are unable to proceed with the short plat application and remedy this situation the City will begin Code Enforcement action against the property owner(s). The application was submitted on September 23, 2005 and deemed complete on October 4, 2005. The following is the development review team that reviewed the short plat application: Each Departments comments are listed separately below. For questions related to this letter, the short plat process, and resubmitting please address those directly to myself. For technical questions regarding a specific Departments comments, please address those directly to the appropriate individual. 1. The Title Report prepared by Fidelity National Title Company of Washington and dated March 3, 2005 notes three easements on the property. Recording Number In Favor Of 2605916 Pacific Telephone and Telegraph Company 7901170813 City of Seattle 8107220758 Sewer and Water Lines The Title Report does not note the location of these easements nor are the easements shown on the survey. In order to determine if the lot is build -able and not hindered by easements, the survey must show the exact location of these easements. The Geo- technical report prepared by GEO Group Northwest, Inc and dated June 22, 2005 is inadequate. The report makes conclusions and recommendations for Lot two development, however no conclusions and recommendations are made for proposed lot one. The report must include a section for conclusions and recommendations for proposed lot one as was done for proposed lot two. 3. As part of the current house that is under construction on proposed lot 2, the City permitted the removal of one large maple tree on the property. However, an inspection of the site revealed that approximately six trees have been removed. The trees were removed on an area classified as steep slope. The removal of any trees on a steep slope requires the approval of a tree - clearing permit from the City. Please submit an application for a tree - clearing permit. 4. On the civil plan, show the proposed location of the house on proposed lot one and location of the driveway serving the house. Public Works 1. For your short plat application to be complete, you must provide civil plans that show all of the existing and proposed easements, all of the expected utilities and other expected improvements. Due to the unusual nature of the lot configuration, and the unusual order of development, please include all utilities and easements for all three lots that will access onto 42n Av. S. (Parcels 7360600531 and 7360600271) 2. This project will add more than 2000 SF of impervious surface in a sensitive area. Please provide a technical information report that defines threshold discharge areas for all three lots (total expected). Include a drawing showing the discharge areas. 3. Provide a drainage plan for the short plat that accounts for the added impervious surface including the access from 42n Av. S and both residences. Fire Department 1. An approved Fire Department turnaround shall be installed prior to construction activities. Some of the communication lines were damaged by Mr. Rehal's earthwork contractor, Kennedy Contracting, around October 7, 2005 while initiating site Gearing for a residence being constructed by Rehal's Dhiman Corporation under Tukwila Building Permit 1305 -102 by NW Custom Homes. The damaged communication lines were located near the surface adjacent to an existing building in a location where the proposed residence is to be constructed. We understand that there is a communications easement recorded May 21. 1930 under recording number 2605916 to then Pacific Telephone and Telegraph Company. That easement description provided for an underground conduit over an undeterminable portion of the site. Construction of the new home is now on hold pending relocation of the Qwest communication lines or redesign of the home footprint to not adversely impact the communication lines. We request that the communication line present alignment be determined by Qwest and buried depth determined such that if the lines are not relocated, proper depth and accurate alignment description provided and recorded. Relocation of the line about 10 to 20 feet in select locations and increased burial depth would allow for the new home to be constructed. We are available to discuss your process for further actions. A draft comment letter is prepared and ready to be sent out. However, before the comment letter can be completed the City must first conclude the mandatory Notice of Application period. On page 1 of the report it notes that the property will be subdivided and a house will be constructed on each lot. In the email it was noted that the tree was hazardous. On Tuesday, September 27, 2005 I conducted a site visit and other trees were removed that were not listed as needing to be removed. The removal of any tree greater than four inches in diameter on a steep slope requires the approval of a tree clearing permit. As part of the three clearing permit a landscaping plan must be prepared and submitted to the City. I don't want to stop work on the house, but for now no trees can be removed on the property without first approval from the City. The trees that will be required to be replaced would be best done after the construction of the 2nd house. I have attached a tree clearing permit with this email. Brandon J. Tax lot number is 73600600271 Access to the site is from paved road, 42 " Ave. South and onto a private gravel easement road. The gravel surfaced easement road serves an existing home plus this parcel. When the short plat is completed the gravel driveway would serve three homes. Water to the site is by Water District 125 which has a main within 42 Ave. South that will serve the two lots with service lines from 42 Ave. South. Val -Vue Sewer District would serve the two new lots from a sanitary sewer main located within 42 Ave. South stub out side sewer and by this property owner upsizing an existing 4" sanitary side sewer to a 6" sanitary side sewer that would serve the three lot from the existing side sewer stub out Sensitive areas of streams or wetlands were not found on site or within 100 feet of the parcel. Steep slopes of 20% or greater are located on the west, south, and north side of the parcel. Topography of the site slopes generally south to north on site and westerly along the westerly boundary and off site. It appears that a residence once existed on the parcel as indicated by a concrete foundation and by a brick retaining wall near the middle of the parcel. The site has had some previous grading. New impervious area includes the new private driveway 20 feet wide by 60 feet long (1200 square feet) that would extend southerly from the existing easement access road that will be paved by the adjacent home owner that is to pave the driveway according to that property building permit conditions.
