PROCEDURES AND TIME FOR APPEALING In order to appeal the Board of Architectural Review decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by April 10, 2006. The requirements for such appeals are set forth in Tukwila Municipal Codel8.1 16. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Board of Architectural Review. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Kathryn Devlin, who may be contacted at 206 - 431 -3670 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. No public access or public parking is located in this area and it will be controlled by an automatic gate for the use of employees only. The employee lounge and lunch room is located at the rear of the building allowing for visual security during the hours of operation. b) The bushes and shrubs around the rear yard, employee parking area will be maintained to screen the parking and maintenance yard from the small patio sitting area outside the lunch room. c) Uniform site lighting will be provided for security and to maintain functional lighting levels. (See Sheet E1.1). The exterior pole lights have a configuration and optical cutoff that will direct the throw of light onto the site and shield it from the surrounding properties. (See attached fixture information). d) We will review the Police Department and Sandra Whitings memo regarding landscape planting and consider some of the alternatives. This information will be included on our building permit submittal. 2) PUBLIC WORKS: a) Transportation Mitigation Fees must take into consideration that the two building tenants, Water District #125 and Val Vue Sewer District, are currently located at this site and across the street from this site. Only two or three people will be relocated from the current Water District administrative offices located at 2849 S. 150 Street Seatac, WA. Please review the impact fee assessment based on the fact that both District's currently existing at or near the new location and that the consolidation of their office's will reduce the overall Transportation &Traffic impacts within the area. Maybe a Transportation Mitigation credit is in order? We would like to evaluate the transportation mitigation fee in more detail to determine a more accurate assessment for the project. The existing concrete building is located on the property lines on it's north and west sides. The other two sides of the building are easily accessible and within the 150' min. and 300' max distance from the hydrant. See Sheet C -5.0, water and sewer plans. b) Fire flow per 2003 IFC Appendix B. See Water Availability Certificate. In order to reduce the amount of pruning that would be necessary to keep shrubs below 2 feet and tree canopy above 7 feet, I recommend that the landscape architect re- evaluate the plant palette, even though it could mean eliminating some very desirable plant varieties. In the case of trees, pruning to above 7 feet will probably not be a problem for the selected varieties, once the trees have matured. The exception is the Thuya occidentalis Emerald Green - Arborvitae (the landscape architect has put this in the tree category), which would not look very attractive if it were "pruned up ". Many of the shrub varieties will greatly exceed 2 feet at maturity (see list below) and regular pruning to keep them low enough could destroy the features they were probably selected for (like flowering and berry production), not to mention be costly to the owner. The shrubs that have been called out in the landscaping plan that would well exceed 2 feet upon maturity are: • Azalea Purple Splendor • Cistus purpurea (Orchid Rock Rose) • Berberis gladwynensis William Penn (Barberry) • Ilex Crenata Northern Beauty (Japanese Holly) • Mahonia aquifolium (Tall Oregon Grape) • Phormium tenax atropurpureum (New Zealand Flax) • Pieris floribunda Forest Flame • Prunus laurocerasus Otto Luyken (Laurel) • Viburnum davidii Lower growing varieties of the same species of shrubs could be substituted in some cases without losing desired design features. Or some of the taller species could be kept as long as they had a narrow or open growth habit, were used sparingly and were planted next to low growing shrubs or groundcover. This would ensure that there wouldn't be a solid "wall" of shrubs that could block views of the building and parking lot. It will be important that the owner keep the vines pruned so as not to allow views to be blocked by foliage — especially the Clematis armandii (Evergreen Clematis) that will be planted on the trellis on the east side of the building. January 17, 2006 • City of Tukwila Police Department An Accredited Agency MEMORANDUM Thank you for forwarding a copy of the Val Vue Sewer District's building plans for review by the Police Department. While I don't have specific "adopted development regulations," I have a couple of questions concerning the lighting and landscaping plans for the building. Please note that these tracts adjoin property on S. 146 Street where calls for police service are higher than average in Tukwila. For this reason, I want to emphasize the necessity for better than adequate, average, lighting and landscaping. The safety and security of employee and visitors and their property is extremely important. "assume" this application uses boilerplate language, and therefore, covers the topics required by the City in rather generic terms. Following are the areas of concern by the Police Department: 1 b) Parking and service areas are located at the rear of the building, "screened by the office building and landscaping." Discussion: What is the visibility inside the building to the outside parking area? It does not appear that the rear of the building contains office areas. Offices /desks provide a place where employees can easily and frequently see out the windows and easily view the parking area. This provides natural surveillance of the parking lot for people going to and from the building and their vehicles. Vehicle thefts and prowls are less likely to occur when potential thieves are actually being observed, or "feel" like they are being observed. It is important that landscaping near the building and in the paved areas (see 3 e of the proposal) does not block the view of the entire parking area and fenced area at the rear of the property. Shrubs should be 2 feet or lower to provide unobstructed view across the property from inside and outside the building. Indoor activities at the rear of the building should be encouraged so as to increase the natural surveillance of the parking lot. 3 c and e) Landscaping will act as a "buffer and screen" and shrubs and trees will be planted in paved areas where possible. Discussion: Landscaping is a great way to provide boundaries to property users. Sidewalks, curbs, shrubbery, grass, trees and picnic areas are indications as to how the property is to be used. Compliance with these standards help reduce potential hiding places and provide an unobstructed view of the parking areas to people looking into the area and to users looking outward. 3 h) Site lighting "will enhance the building, landscaping as well as safety and security." Discussion: I don't see lighting fixtures on the building or on the property in the drawing provided with the plans. For the money, we believe that lighting is the best and most affordable crime deterrent available. It is very important that outdoor lighting is uniformly applied around the property; as people move through a lighted space, their eyes should be able to easily adjust to the highest and lowest light levels in the area. It is also important for persons observing from outside the lighted areas to be able to see into the space without having to pass through uneven pockets of lighting. A lighting plan for the property should demonstrate lighting fixture placement, and that there are 3 -5 foot candles uniformly displayed at the parking lot's surface. The location of this property should prompt close attention to the lighting and landscaping plans for Val Vue Sewer District's building project. The lighting is will enhance the building, landscaping as well as safety and security. 4) BUILDING DESIGN a) The architectural style of the project is simple and subdued. The goal is high quality, low maintenance and longevity of materials. b) The building is appropriately scaled and is in harmony with the permanent neighboring developments. c) All building components have good proportions and relationships to one another.
