III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.
No administrative appeal of the determination of exemption from SEPA is permitted. One administrative
appeal to the Planning Commission of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Planning Commission decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 days of the
issuance of this Decision, that is by 5-1R-01
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. An appeal fee of $205.00 must accompany the appeal.

V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Planning Commission based on the testimony and documentary evidence presented at the open record
hearing. The Planning Commission decision on the appeal is the City's final decision.
Any party wishing to challenge the Planning Commission decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Planning Commission
decision is properly filed in Superior Court within such time limit, the Decision on this permit will be
final.

RE: L07 -025 6 -Union Pacific Railroad Site Investigation Special Permission, Director,
Request to Fill Alter Type 1 Wetlands
The engineering firm of Shannon and Wilson is requesting permission to perform a
geotechnical assessment in the proposed re- alignment of the Union Pacific Railroad
tracks east of West Valley Highway. The geotechnical work will take soil borings along
the proposed railroad track alignment, which includes Type 1 and Type 3 wetlands and
wetland buffers.
SEPA
This project is exempt from the State Environmental Policy Act under WAC 197 -11 -800
(18), Information collection and research.
Background
The City has been working with Union Pacific Railroad to realign the railroad tracks in
conjunction with the Strander Blvd. extension east into the City of Renton. As part of the
railroad realignment, nine soil borings are needed for geotechnical investigation work.
One boring will take place in a Type 1 wetland, one boring will be in a Type 1 buffer and
five borings will take place in the buffers of Type 3 wetlands. See Maps, Exhibit A.

and approval by the Director. Typically, no alterations are permitted to Type 1 wetlands
and isolated Type 3 wetlands may be altered or relocated only with the permission of the

Director. The work that is occurring under this land use application is setting the stage
for the actual realignment of the railroad tracks and the extension of Strander Blvd. east
into the City of Renton, which are essential streets, roads and rights of way, a permitted
use subject to administrative review. Most of the work is occurring in the buffer of Type
3 wetlands. The eventual railroad realignment and road extension will permanently
affect these wetlands and their buffers.
TMC 18.45.090 B. states that alterations to wetlands are discouraged and are limited to
the minimum necessary for project feasibility. In this case, the soil borings will be taken
to assist in the development of geotechnical studies for the railroad realignment and the
road extension. A representative sample of the soils is needed to assist in the engineering
of the essential right of way.
Requests for alterations must meet the criteria that follow below. The criteria are in
italics with the response following.
a. The alteration will not adversely affect water quality;
The information provided by the applicant on the soil borings process is as
follows:
"Drilling will be completed using a standard, mobile, track- mounted drill rig at
the boring locations. Because of the anticipated soft and loose soil deposits and
high groundwater table, mud rotary techniques will be used to drill each of the
boreholes 60 to 180 feet below ground surface, or to an appropriate depth
determined during fieldwork.. Traditional mud -rotary drilling requires use of a
drilling mud consisting of bentonite slurry, which is pumped out of a mud tank at
the ground surface, down the center of the drill rods, through the drill bit, up the
hole between the drill rods and borehole sidewalls, and back into the mud tank.
The circulation of drilling mud removes the cuttings generated during the drilling
process from the hole and carries them to the mud tank. Boreholes are typically
less than 8 inches in diameter. All cuttings and drilling mud will be containerized
and/or disposed of in an upland (and non - buffer) location."
The disturbed buffers and wetland areas will be reseeded with a native plant seed
mix once the geotechnical fieldwork is complete. See Exhibit B for the see
mixture. Eventually this area will be permanently altered when the railroad tracks
are relocated and the road is extended over the tracks.
b. The alteration will not adversely affect fish, wildlife, or their habitat;
The soil borings will not affect fish or their habitat; the borings may temporarily
disturb wildlife while the equipment is in place; however, this will be a temporary
occurrence over the course of one week.

c. The alteration will not have an adverse effect on drainage and /or storm water
detention capabilities;
The borings will not affect the drainage and/or storm water detention capabilities
of the wetlands and their buffers.
d. The alteration will not lead to unstable earth conditions or create an erosion
hazard or contribute to scouring actions;
The site where the soil borings will take place is flat. Disturbed areas will be
replanted after the borings are taken.
e. The alteration will not be materially detrimental to any other property; and
The borings will not affect properties other than those on which the railroad
realignment is taking place.
f The alteration will not have adverse effects on any other sensitive areas.
There are no other sensitive areas adjacent to the sites where the borings are
taking place.
Mitigation Plan
The Sensitive Areas Ordinance requires that impacts to wetland and their buffers be
mitigated by restoration, creation or enhancement. For the soil samples, the site will be
reseeded. Permanent impacts to the wetlands will be addressed at a later date prior to the
actual realignment of the railroad tracks and the construction of the road extension.
CONCLUSIONS
1. Permission is requested to perform geotechnical assessment via nine soil borings
in the area where the Union Pacific Railroad tracks east of West Valley Highway
will be located. The City has been working with relocating the railroad tracks to
facilitate the extension of Strander Blvd., an essential road and right of way, east
from the city limits into the City of Renton.
2. One boring will be located just inside a Type 1 wetland; one boring will be in the
wetland buffer of a Type 1 wetland and the remainder of the borings will be in the
buffer of a Type 3 wetland. Type 1 wetlands and their buffers may only be
altered for a use permitted in TMC 18.45. Essential streets, roads and rights -of-
way are a permitted use under the City's Sensitive Areas Ordinance.

3. The project is exempt from SEPA under WAC 197 -11 -800 (18), the exemption
for information collection and research.
4. The borings will not adversely affect water quality — the borings will removed and
carried to a mud tank. All cuttings and drilling mud will be containerized and/or
disposed of in an upland, non - buffer location.
5. The borings will not adversely affect fish and their habitat; wildlife may be
temporarily disturbed while the equipment is drilling. The drilling will last
approximately one week.
6. The soil borings will not have an adverse effect on the drainage and/or storm
water detention capabilities of the wetlands.
7. The site is flat so the borings will not lead to unstable earth conditions or create an
erosion hazard or contribute to scouring actions.
8. The borings will not affect properties other than those on which the railroad
realignment is taking place.
9. No other sensitive areas are adjacent to the sites where the borings are taking
place.
10. All disturbed areas, both the boring sites and areas affected by heavy equipment,
will be reseeded with a native plant seed mix. Mitigation, as required by the
City's Sensitive Areas Ordinance will be addressed at the time the wetlands are
permanently impacted by the road and railroad track realignment construction.
RECOMMENDATION
Staff recommends approval of the Special Permission permit.

I'm glad your dad is doing okay - my dad had a stroke a few years back - he made a full recovery but it
was a real wake up call to realize that my parents are mortal just like the rest of us. I guess we assume
as kids that our parents are infallible. :)
Unfortunately, the boring (B -301) will still be in the wetland - but closer to the wetland edge, so less
wetland will be impacted to get to it. It will be located at station 415 +00, which is marked in blue numbers
on the Proposed Boring Locations Map (sheet 2 of 4) that was attached to our permit application. I asked
our geotechs if we could move the boring to just outside of the wetland, but they said it would be too close
to the next boring (B -302). Let me know if you need more info or a revised map.

I understand your concern - I should have clarified. Someone from Shannon & Wilson will be on site to
monitor the drilling activities. If we complete the 2 upland borings before May 4th, we will likely relocate 2
or 3 of the northern borings 10 or so feet to the west so they are just outside of the wetland buffer (but still
within the proposed railroad realignment). We'd bring a tape to measure the distance from the wetland
boundaries to make sure were outside of the wetland buffers.

I talked to our project manager regarding the comment period. We plan to start work on April 30th, but will
stay out of all wetlands and buffers until May 4th (assuming no comments). Thanks again for getting the
permit processed so quickly.
Thank you for the information on the re- seeding of the disturbed buffer and wetland areas. I will put this
information in the file.
I talked with my supervisor on the issue of whether the clearing can take place prior to the close of public
comments - she confirmed my review of the code that it does not have any flexibility on starting work prior
to the end of the comment period, so no boring, clearing or moving of equipment into the buffer or wetland
areas may take place until, at the earliest Friday, May 4. This is assuming no comments are received on
the project that must be addressed.

Area's Ordinance to conduct nine (9) geotechnical borings in the area of the Union Pacific
Railroad track realignment east of Strander Boulevard and south of I-405. One boring will
take place in a Type 1 wetland, six borings will take place in the buffers to Type 2 and 3
wetlands and two borings will take place in uplands beyond the edge of the wetland

The City of Renton plans to extend Strander Boulevard over Union Pacific Railroad (UPRR) and
BNSF Railway Company (BNSF) tracks to connect the Cities of Renton and Tukwila, which will
provide significant benefits to both freight mobility and to general motorists. To allow for the
new roadway to cross over the railroad tracks, the UPRR railroad tracks will be relocated
approximately 300 feet to the east, so they are parallel with the existing BNSF tracks.
For this project, Shannon & Wilson is performing a geotechnical assessment of subsurface
conditions for the relocation of the UPRR railroad embankment. Our assessment will also
include a new bridge at Longacres Way and two utility crossings, which are part of the railroad
relocation phase of the Strander Boulevard Extension project. Data from our geotechnical
assessment will be used in engineering analyses for the railroad embankment, Longacres Way
bridge design, and utility crossings.
This letter describes our geotechnical assessment procedures and best management practices as
part of our Special Permission Director permit application (attached), and documents why our
proposed geotechnical work for the Strander Boulevard Extension project meets the criteria for a
State Environmental Policy Act (SEPA) exemption. Specifically, this letter addresses the criteria
of the Washington Administrative Code (WAC) 197 -11- 800(18) that provide for SEPA
exemptions, as adopted by reference in the Tukwila Municipal Code (TMC) 21.04.100.

The wetlands in the project corridor were delineated and categorized by David Evans &
Associates based on parameters outlined in the TMC. The project area wetland categories and
buffers are summarized in the table below. The wetland boundaries and associated buffers are
also shown on the attached Figure 2.

Our proposed work includes drilling nine borings to evaluate soil conditions along the new
railroad alignment, at the proposed Longacres Way bridge, and at utility crossings along the
alignment (Figure 2). One of the borings will be drilled in a wetland (B -301); up to six of the
borings will be in a wetland buffer (B -302, B -305, and B -306 to B -309); and two borings will be
in uplands beyond the edge of the wetland buffers (B -303 and B -304).
Drilling will be completed using a standard, mobile, track - mounted drill rig at the boring
locations. Because of the anticipated soft and loose soil deposits and high groundwater table,
mud rotary techniques will be used to drill each of the boreholes 60 to 180 feet below ground
surface, or to an appropriate depth determined during fieldwork. Traditional mud - rotary drilling
requires use of a drilling mud consisting of bentonite slurry, which is pumped out of a mud tank

at the ground surface, down the center of the drill rods, through the drill bit, up the hole between
the drill rods and borehole sidewalls, and back into the mud tank. The circulation of drilling
mud removes the cuttings generated during the drilling process from the hole and carries them to
the mud tank. Boreholes are typically less than 8 inches in diameter. All cuttings and drilling
mud will be containerized and /or disposed of in an upland (and non - buffer) location.
Limited grading and vegetation clearing will be conducted prior to drilling activities to allow for
drill rig access in heavily vegetated areas. Efforts will be made to minimize the amount of
disturbance at all boring locations. No long -term impacts are anticipated. In addition, all
borings will be located within the proposed embankment corridor, which will be impacted later
on by project construction.

Due to project schedule restrictions, we would like to conduct our fieldwork activities in late
April. Based on conversations with Carol Lumb, a planner at the City of Tukwila Department of
Community Development, we understand that it may take a month or more to receive approval
from the City. We request that the review time be expedited, if possible, and thank you in
advance for your understanding and cooperation in this matter.
The Special Permission Director permit requires right -of -entry agreements from all property
owners. We were unable to obtain a right -of -entry agreement from Sound Transit for your
review; however, the borings on the Sound Transit properties will not be in wetlands, and the
proposed locations are easily visible from the Longacres Way road right -of -way (Figure 2). The
remaining properties are owned by the City of Tukwila and Prium Companies (see enclosed
Affidavit of Ownership and Hold Harmless Permission to Enter Property form signed by Prium

Research (WAC 197 -11 -800 [18]), which states that "Basic data collection, research, resource
evaluation, requests for proposals, and the conceptual planning of proposals shall be exempt.

has not yet been approved, adopted, or funded; this exemption does not include any agency
action that commits the agency to proceed with such a proposal."
