Dear Mr. Neal:
The Short Subdivision Committee has completed their review of the above - referenced
Boundary Line Adjustment application. Preliminary approval of the BLA is approved,
subject to the following conditions. These conditions are to ensure compliance with the
City's Zoning, Fire, and Public Works requirements. All conditions must be satisfied
prior to final approval and subsequent recording of the BLA documents.
General Conditions

1. Update the survey map to reflect the location of the King County Metropolitan
Easements (Recording Number 20060907900003) that is located on the
property. The easement must not be located within the building envelope for the
two lots.
2. The existing structures on the site must be removed prior to final approval of the
BLA. A demolition permit will be required from the Department of Community
Development for the removal. Please contact (206) 431 -3670 for more
information. Remove the buildings from the recording documents.
3. With dashed lines, show the required setbacks for parcel A and Parcel B. Please
note that parcel B will have a 20 -foot setback from 48 Ave S and a ten foot
setback from S. 124 Street. The remaining setbacks for parcel B will be five
feet from the north property line and five feet from the east property line.
4. Add the following note to the BLA document, "Access for Parcel B shall be from
48 Ave South, no access is permitted via S. 124 Street ".
5. The line between Parcel A and Parcel B needs to be identified as "new line ".
6. Show the location of the nearest fire hydrant on the BLA map. The fire hydrant
location must meet the distance requirements of the Tukwila Fire Department. If
the fire hydrant does not meet the distance requirements a fire hydrant will have
to be installed.
7. The proposed legal description should reference Tukwila and not Seattle.
8. Include the file number of L07 -033 on both plan sheets.
9. Explain the purpose of the note on page 1 of 2 which references King County
Code 19.08.112. This appears to be in error and should be removed. PECE_,IF )
10. The final BLA document shall meet the recording requirements of the King

Once the above conditions are satisfied you may submit for final approval of the BLA.
When you resubmit, please provide four copies of the BLA document, one document
must contain the original signatures of all individuals and entities which have an interest
in the property. Additionally, the surveyor's original stamp and signature must be on this
copy.
Recording
It is your responsibility to record the City approved BLA document with the King County
Department of Records. The BLA is not complete until the recording occurs and copies
of the recorded documents are provided to the Department of Community Development.
After recording, the County returns the recorded originals to the City within four to six
weeks at which time your BLA is considered complete and you can obtain individual
building permits for each lot. You can shorten this process by hand delivering a copy of
the recorded BLA with parcel numbers to the Department.
Do not fold or bend the final short plat map that will be recorded with King County.
Expiration
The final BLA must be filed with the King County Department of Records by July 15,
2008, exactly 12 months from the date of this preliminary approval or the application will
expire. Please keep this date in mind in the coming months. The City is in no way
obligated to remind you of this expiration date.
The City may grant one extension of not more than twelve months. The request for an
extension must be made in writing and must be submitted to the City prior to the
expiration of the BLA.
If the BLA approval expires, subsequent development permits that are related to the
short plat shall also expire and any vesting will be lost.

Final Approval Request
Dear Mr. Neal:
The City has completed its review of your request for final approval of the above BLA
application. At this time the BLA application cannot receive final approval because
certain conditions of preliminary approval have not been met.
Please revise the BLA survey as follows:
1. As was requested in the City's Preliminary Approval letter dated July 15, 2007,
show the location of the King County Metropolitan Easement. A note on the plat
map will not suffice.
2. Remove the note on sheet 1 of 2 which cites King County Code. Section 19A
references doing short plats and BLAs in King County. 19A.28.020 notes, "The
review shall include examination for consistency with the King County Zoning
Code ". The City is not in a position to determine if it meets King County Codes
nor would King County zoning regulations apply to property within the City.
Once the above chances are made to the final BLA map please provide one copy with
original signatures of all property owners and which includes the surveyor's original
signature and stamp.

The entire statement needs to be removed. Section 19A references doing short plats and BLAs in King County.
19A.28.020 notes, "The review shall include examination for consistency with the King County Zoning Code ". I
cannot determine if it meets King County Codes. The chapter references the "Department" which is defined
under KCC 19A.04.100 as the King County Department of Development and Environmental Services.
This chapter is meant to apply to land divisions and BLAs in unincorporated King County and not within an
incorporated City.
I will more than happy to discuss this item with your surveyor.
The City is still completing its review of the final BLA request. Other changes to the final document may be
needed, please hold off on submitting the revised mylar until the City's review is complete.

The undersigned Grantor(s), their heirs, successors and
assigns (hereinafter together referred to as
"Grantor(s) "), for and in consideration of the sum of
SEVENTEEN THOUSAND TWO HUNDRED AND FORTY ONE Dollars
($17 and Other valuable considerations, the
receipt of which is hereby acknowledged, hereby convey
and grant to the KING COUNTY DEPARTMENT OF METROPOLITAN
SERVICES, its successors and assigns (hereinafter
together referred to as "METRO "), a permanent non
exclusive easement over, across, along, in, upon and
under the following described property:

Said easement being for the purpose of installing,
constructing, operating, maintaining, removing,
repairing, replacing and using a 48 -inch gravity sewer
and siphon with all connections, manholes and appurte-
nances thereto, together with the right of ingress to
and egress from said described property for the
foregoing purposes.
Grantor(s) do further convey and grant to the
METRO a temporary construction easement for all
purposes during the construction of said facilities
over, across, along, in, upon and under the following
described property:
see Exhibit A
together with the right of ingress to and egress from
said described property for the foregoing purposes,
said easement to commence on the date of this
instrument and to terminate on the date actual use of
said easement area shall terminate or on December 31,
1995, whichever shall first occur.
Payment for the temporary construction easement herein
granted shall be made at the rate of FOUR HUNDRED AND
SEVENTY ONE Dollars ($471.00) per month or fraction
thereof that said temporary construction easement area
is in actual use by METRO. The term "actual use" as
used herein shall be construed to include only the
period from the start of construction of said sewer
line in the above described temporary construction
easement area until completion thereof, including
reconstruction and restoration of improved areas.

The Grantor(s) hereby and the METRO, by accepting
and recording this easement, mutually covenant and
agree as follows:
1. METRO shall, upon completion of any construction
of any facilities described herein, remove all debris
and restore the surface of the above described property
as nearly as possible to the condition in which it
existed at the date of this agreement.
2. METRO shall, if the above described property is
disturbed by the maintenance, removal, repair or
replacement of the facilities specified herein, restore
the surface of the above described property as nearly
as possible to the condition in which it existed at the
commencement of said maintenance, removal, repair or
replacement.
3. METRO shall protect and save harmless Grantor(s)
from any and all claims, demands, loss, damage, expense
and liability of every kind and description including
personal injury and for any damage to or loss or
destruction of property whatsoever suffered by
Grantor(s), their heirs, successors and assigns, or by
any persons, firms or corporations, because of the
construction and /or maintenance of said facilities.
4. All right, title, and interest that may be used
and enjoyed without interfering with the easement
rights herein conveyed are reserved to the Grantor(s).
5. METRO shall pay up to $200.00 for expenses
incurred by Grantor(s) for the expert evaluation of
this easement under tho terms of A.C.W. 8.25.020.
