THIS SEWER EASEMENT supersedes and replaces in its entirety
that certain easement recorded July 27, 2007 under King County recording No.
20070727002062. This sewer easement is between J & J Equities, LLC,
hereinafter "Grantor," and J & J Equities, LLC, hereinafter "Grantee."
For and in consideration of ten dollars ($10.00) and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, the
Grantor hereby conveys, grants and warrants to the Grantee a permanent non-
exclusive easement ( "Easement ") for sewer, including all appurtenances related
thereto, under, over through, upon and across the real property legally described
on the attached Exhibit A and as shown on the map attached as Exhibit B.
The Grantee shall have the right, without prior institution of any suit
or proceeding at law, at times as may be necessary, to enter upon the Easement
and adjoining property owned by the Grantor for the purposes of installing,

constructing, operating, maintaining, removing, repairing, replacing and using the
sewer, together with all the connections and appurtenances thereto.
The Grantee shall, if the Easement is disturbed by the
maintenance, removal, repair, or replacement of the access and utilities or
appurtenances restore the surface of the Easement to a condition substantially
equal to the condition that existed prior to the commencement of the
maintenance, removal, repair or replacement.
The Grantor shall have the right to use the surface of said
Easement area so long as the Grantor's use does not interfere with the work of
repairing, removing, replacing or adding to the sewer and appurtenances,
provided that no permanent building or structure of any kind shall be located on
said Easement. The Grantor shall not plant trees, shrubs or vegetation having
deep root patterns that may cause damage to or interfere with the sewer to be
placed within the Easement. The Grantor shall not change the ground surface
elevation within the Easement. The construction and installation of asphalt or
concrete parking surfaces by the Grantor shall be a permitted use.
This Easement and the covenants herein shall be covenants
running with the land and shall benefit and bind the parties and their respective
successors and assigns. The Grantor warrants that the Grantor has good title to
the property, and warrants the Grantee's title to and quiet enjoyment of the
Easement conveyed herein.
The cost of maintenance, repair or reconstruction of that portion of
the sewer used in common shall be borne in equal shares, except that the
owners of any lower parcel shall not be responsible for the part of the sewer
above their connection; and when necessary to repair, clean or reconstruct the
sewer, the parties to this agreement shall have a right of entry for that purpose.

follows:
Beginning at the Northeast corner of said Southwest Quarter of the Southwest
Quarter and running thence West along the North line thereof a distance of
765.00 feet; Thence South parallel to the East line of said subdivision a distance
of 20.00 feet to the True Point of Beginning of the Easement herein described;
Thence Easterly and parallel to the North line of said subdivision a distance of
