is declared to be an Unfit Building in violation of Tukwila's Municipal Code (TMC),
TMC Chapter. TMC 8.28.020 International Property Maintenance Code Adopted (IPMC)
Specifically: IPMC 108.1.3 Structure unfit for human occupancy "Structure is
unsafe... insanitary lacks sanitary or heating facilities required by code."
The downstairs bathroom was built without building or plumbing permits. People are living and
sleeping in a basement where the sewage system has failed. Sewage is leaking up through the
bathroom floor. The overhead light fixtures in both basement bedrooms has not worked in over two
weeks. Tenants are using space heaters as their only source of heat. Basement lacks sanitary and
heating fatuities and adequate emergency escape openings.
Specifically: IPMC 504.1- Plumbing systems and Fixtures. "All plumbing fixtures shall be properly
installed and maintained in working order."
Plumbing system installed without a permit and the Sewage system has failed.
Specifically: IPMC 506.1- Sanitary Drainage System. "All plumbing fixtures shall be properly
connected...
Sewage ejection system not functioning properly.
Specifically. IPMC 601.2 Responsibility "Owner shall maintain mechanical and electrical facilities
and equipment..."
Overhead light fixtures in the basement bedrooms do not work.
Specifically: IPMC 602.3 Heat supply "Owner... shall supply heat... in all habatable rooms..."
No heat source in the basement. The use of space heaters does not achieve compliance with this code
section.
Specifically. IPMC 702.4 Emergency escape openings "Required emergency escape and rescue
openings shall be operational from inside of the room without the use of keys or tools."
Bars over windows are bolted into the framework and do not open, Upstairs bedroom windows tacks
adequate emergency egress. Basement rooms shall not be used for sleeping purposes.
Specifically: IPMC 305.3 Interior surfaces. "Cracked or loose plaster, decayed wood of other defective
surface conditions shall be corrected."
Plaster and floor in upstairs bathroom is disintegrating.
Specifically: IPMC 307.1 Accumulation of rubbish, debris, garbage "All exterior property and
premises—shall be free from any accumulation of rubbish or garbage."
Piles of debris around the yard and along fence line.
You are hereby notified of a Complaint Hearing before the Tukwila Improvement Officer scheduled as follows:

By receipt of this Complaint of Unfit Building, you are required to attend a Hearing before the Tukwila Improvement
Officer at which all parties in interest shall be given the right to appear in person, to bring witnesses, and to give
testimony regarding the complaint. At any time prior to or at the time of the hearing, any party may file an answer to
the Complaint. All rules governing the procedure of such Hearing, are available for public inspection at the Tukwila
Department of Community Development.
Within ten days of the Complaint Hearing, the Improvement Officer shall issue a Determination, Findings of Fact,
and Order stating whether the subject dwelling, building, structure, or premises is unfit for human habitation or
other use, findings of fact supporting the determination, an order specifying the actions necessary to address any
unfitness, and a deadline for completing the actions.
If you fail to comply with the Determination and Order and no appeals have been filed, the Improvement Officer may
order the building to be repaired or demolished. The cost of such action shall be assessed against the subject property
as a tax lien, pursuant to Chapter 35.80.030, Revised Code of Washington (RC4).
Tukwila Municipal Code 8.46 RELOCATION ASSISTANCE PROGRAM: If the City finds the structure
is Unfit for Occupancy and your tenants have a rental agreement with you, you may be liable for Relocation
Assistance to them. I have enclosed a copy of this regulation for your information.
