The sign is a 36 cubic foot three - dimensional chowder bowl affixed above and adjacent to the restaurant's main entrance doors. LOCATION: NOTIFICATION: The restaurant is located at 757 Southcenter Mall. It is one of five restaurants with an exterior entrance located on the south facade of the Westfield Southcenter Mall. The tax parcel number is 6364200010. Notice of Application and Notice of Public Hearing for this Type 4 permit were mailed or hand - delivered to surrounding property owners, interested parties, affected agencies and posted on the site on or before October 30, 2008. Notice of Public Hearing was published in the Seattle Times on October 30, 2008. The site is, for the most part, owned and managed by Westfield. City streets of various widths surround the site. Beyond the City streets are interstate freeways and Gilliam creek on the north and west and retail and commercial service uses on the east and south. The City's Tukwila Pond park sits just to the south of the Target development south of Strander Boulevard. The south face of the Mall completed an extensive addition in the summer of 2008. The new south face includes five new restaurants each with an exclusive exterior entrance and an outdoor dining patio. The south face of the Mall is lined with wide sidewalks and is separated from the public street by large parking lots and outbuildings. PROJECT INFORMATION The applicant proposes a three- dimension chowder bowl to be installed at his restaurant's front entrance. The chowder bowl is 36 cubic feet in size. The base of the chowder bowl is 12.1 feet from the ground. The chowder bowl is one of two allowed signs at this restaurant. As a structure and advertising device, the chowder bowl requires review as a Unique Sign. PUBLIC COMMENT The public comment period continues to the day of this hearing. Any public comment received will be disclosed at the public hearing and entered into the record. SPECIAL PERMISSION PUBLIC HEARING CRITERIA The project is subject to a Pubic Hearing under Tukwila Municipal Code (TMC) Chapter 18.112. The Planning Commission evaluates the project under the criteria established in TMC 19.28.010. They are the decision criteria from which the Board will evaluate whether to approve, condition, or deny this project. The applicant's response to the unique sign approval criteria is Attachment A. Below is the staff analysis and response. 1. Unique Sign Approval Criteria: Unique Signs may be approved if in the judgment of the Planning Commission or, on appeal, the City Council, the effect of the proposed sign would not contribute to a cluttered, confusing, or unsafe condition (TMC 19.28.010 5). SM Page 3 of 6 10/30/2008 H: \L08 -062 S08 -100 Duke's \Dukes SP SR.doc • The building face where the chowder bowl mount is proposed is nineteen feet high and seventeen feet wide. This face is the main entrance into the restaurant and is adjacent to the south entrance of Southcenter Mall. In addition to the chowder bowl, this building face also will have a transparent glass canopy over the front entrance doors. The chowder bowl serves as a sign and draws attention to the front entrance. No other sign is located on this facade. The bowl's design and mounting have been reviewed by the City's building department and no concerns were raised. In addition to the specific criteria of the Planning Commission, proposed development must show consistency with adopted plans and regulations (18.100.030 TMC.) Below are the specific policies from the adopted Comprehensive Plan that relate to the location of the proposal. SIGN CODE REGULATIONS 2. Definition of Unique Sign: 19.08.260 Unique Sign "`Unique sign' means a building or other structure of unique design and exterior decor, where the entire structure may be considered an advertising device, including but not limited to shapes imitating hats, boots, tires, statues, parts of anatomy, or manufactured items such as airplanes, cars, boats, carriages, or symbols which may or may not contain lettering." The proposed chowder bowl is a three- dimensional structure serving as an exterior decor advertising the goods and services sold at Duke's Chowder House. It does not contain any lettering. 3. Planned Shopping Centers (Mall): 19.32.1 50 Building Identification Signs — Displays `A. Individual businesses in a planed shopping center (Mall) shall be limited to wall mounted signs, the total allowed signage for any building face shall be equal to 6% of the exposed building face area on which the signs are to be placed, up to a maximum of 500 square feet. Each business is permitted a maximum of four signs with not more than one sign for any particular business allowed o any one exposed building face... " Duke's Chowder House is located in Southcenter Mall. The chowder bowl is one of two signs for the restaurant and the only sign proposed on the east building face. However, the sign code does not make a provision for calculating allowed area of three - dimensional signs. Simply meeting the criteria as a unique sign and not creating an unsafe, cluttered, or confusing condition leaves open the potential for approval of large unique signs that are not the intent of the unique sign provision. Viewing the sign as if it was two dimensional and calculating the area in square feet as if the sign had a flush face allows the existing sign area standards to be applied. 6% of the east building face is 19.77 square feet. The chowder bowl is 36 cubic feet. If viewed from the side and treated as a two - dimensional object, the sign occupies 9 square feet of wall area which is 2.7% of the east exposed building face. Design Review L04 -049: Tenant Exterior Storefront Criteria: Attachment E: "Significant design elements are anticipated to include patio seating awnings, umbrellas and /or canopies, vertical and horizontal articulation at and above street level, accent lighting, fenestration, signage, landscaping and sculptural elements." The BAR- approved Design Review Criteria for the Westfield south facade expansion allows for signage and sculptural elements. The chowder bowl could be viewed as either or both. 5. Second Amendment to Development Agreement between the City of Tukwila , WEA Southcenter LLC, for the Expansion and Renovation of Westfield Southcenter Mall: The development agreement, aside from restating the sign code in the recitals, does not address signs for tenants or businesses. 6. Pending new sign code: The impacts of the new sign code on this sign are not known. The applicant is vested under the existing sign code. If the new sign code causes this sign to be legally non - conforming, it will be required to comply with the new code only if the thresholds (adopted as part of the new sign code) for compliance of non - conforming signs are triggered. CONCLUSIONS SPECIAL PERMISSION PUBLIC HEARING CRITERIA 1. Unique Sign Approval Criteria The chowder bowl sign does not create a confusing, cluttered, or unsafe condition. SIGN CODE REGULATIONS 2. Definition of Unique Sign As a structure and advertising device the chowder bowl meets the definition of a unique sign. 3. Planned Shopping Centers (Mall) Allowed sign area for Mall signs is 6% of the exposed building face. With no provisions to calculate allowed sign area for a three dimensional sign, the chowder bowl should be viewed as if it is two - dimensional; it will then occupy 3% of the exposed building face and meet the size criteria. Design Review L04 -049: Tenant Exterior Storefront Criteria The chowder bowl conforms to the BAR approved Tenant Exterior Storefront Criteria. 5. Development Agreement between the City of Tukwila and Westfield Southcenter The chowder bowl does not conflict with the development agreement. 6. Pending new sign code It is possible that this sign may become non - conforming with the new code. The requirements for compliance of non - conforming signs will be addressed in the new code. RECOMMENDATION Staff recommends that the BAR adopt the Findings and Conclusions of the staff report and approve the request. The exposed building face upon which the sign is to be mounted is 306 square feet (18 ft high and 17 ft wide). 6% of the exposed building face is 18.36 square feet. The Chowder Cup is 9 square feet (4 ft wide and 2.25 ft tall). This is less than the allowable square feet. Duke's has only one other sign located on a different face (see drawing showing block letters "DUKES CHOWDERHOUSE" on the south face). Therefore, for all of the above reasons, Duke's meets the development standards for mall tenant signage. Unique Sign 19.08.260 Duke's further meets the criteria because it does not contribute to a cluttered, confusing or unsafe condition. Examples of how these individual elements could evolve are shown on sheet 4.2. Westfield will work with the individual tenants to develop facade designs that integrate harmoniously with the larger elevation while providing . pedestrian -scale visual interest, variation, and individual tenant identity. Significant design elements are anticipated to include patio seating, awnings, umbrellas and/or canopies, vertical and horizontal articulation at and above street level, accent lighting, fenestration, signage, landscaping and sculptural elements. Colors and materials will be selected which complement the larger design theme of the project, and may include slate or other stone, brick, plaster, glass, painted or brushed metal, wood and/or masonry. The objective for each tenant facade will be to achieve a modern design with high - quality materials, providing tenant visibility and identity with a pedestrian orientation, visual variety and interest, compatible with the greater surrounding design theme. Permitted materials Slate Stone Brick Plaster Glass Painted or brushed metal Wood Masonry Lighting Essential to creating the sense of intimacy and a pedestrian friendly environment, exterior lighting fixtures are encouraged. The lighting shall be appropriately scaled and compatible with the overall architectural expression of the project. Patios Patio seating is encouraged, including both outdoor, covered, semi - enclosed or enclosed patios. Fences and/or gates enclosing the patio areas shall permit visibility into the Attachment D • • patio space. Any enclosed patio structure shall be compatible with the overall tenant architectural statement. Patio seating shall allow for pedestrian passage outside the line of the patio. Bump - outs /Articulation The overall south elevation includes significant vertical and horizontal articulation. Additional vertical and horizontal articulation to animate tenant facades is encouraged. Entries Each exterior- facing tenant shall have at least one exterior entry into the tenant space. Color Tenant facades may include a variety of colors. Facade colors shall be approved by Westfield and shall be harmonious with the colors and materials of the greater area. Signaee Signage shall conform to the requirements of the comprehensive signage program to be developed in conjunction with the City of Tukwila. 2_AA). -Orn7J0DrAlk-i- —TD s • Contract # 05 -123B SECOND AMENDMENT TO DEVELOPMENT AGREEMENT BETWEEN THE CITY OF TUKWILA, WEA SOUTHCENTER LLC, FOR THE EXPANSION AND RENOVATION OF WESTFIELD SOUTHCENTER MALL THIS SECOND AMENDMENT TO DEVELOPMENT AGREEMENT ( "Second Amendment") is entered into by and between the City of Tukwila, a Washington Non - Charter Optional Municipal Code City (the "City ") and WEA Southcenter LLC, a Delaware limited liability company ( "Westfield "), the majority owner and developer of the Property (defined below). RECITALS A. The City, Westfield and Prudential Financial Inc. ( "Prudential ") entered into that certain Development Agreement (Contract No. 05 -123) recorded under King County Recording No. 20060621000329 (the "Development Agreement"). The Development Agreement (File No. DA7 -003) related to the expansion and renovation of the Westfield Southcenter Mall development site (the "Project"), as depicted and legally described and in Exhibit A and Exhibit B, respectively, of the Development Agreement (the "Property "). B. Westfield acquired the majority of the Property from Prudential on September 29, 2006, and is now successor -in- interest to Prudential under the Development Agreement. Except for a portion owned by Federated Department Stores, Inc., the Property is owned by Westfield. C. The City and Westfield entered into that certain First Amendment to the Development Agreement recorded under King County Recording No. 20070920001425 (the "First Amendment"), to provide that Westfield was vested to the provisions of the Tukwila Sign Code, Tukwila Municipal Code ( "TMC ") Chapter 19 (the "Sign Code "), in effect on January 1, 2007, as opposed to the provisions in effect on the EIS Issuance Date. Per the First Amendment, references to TMC sections in this Second Amendment are citations to the Sign Code in effect on January 1, 2007. D. The City and Westfield now desire to execute this Second Amendment in order to formalize past applications of the Sign Code, Tukwila Municipal Code (TMC) 19 and related signage procedures to Southcenter Mall and to provide clarity on application of the Sign Code to Mall Garages. E. There are two types of signs specified in Sign Code that are allowed at the Mall — signs for tenant/businesses and signs for the center as a whole. Signs for the center as a whole underwent design review and were approved as to color, materials and type by the Board of Architectural Review. (File no. L07 -007 hereinafter the "Sign Package Approval".) This Agreement modifies the Sign Package Approval for Brand Alliance signage. Page 1 of 6 Attachment E • • F. There are multiple buildings on the Property. Any approved future development that abuts the Main Building shall be considered part of the Main Building for the purposes of this Agreement and the Sign Code. Any approved future development that does not abut the Main Mall Building (other than a parking garage) shall be considered a Perimeter Building G The complexities of sign regulation relative to the changing character of the Mall have resulted in the following City interpretations and administration of the Sign Code on the regulation of tenant/business signage on the Mall Property. 1) Tenants in the Main Building that have their own exterior public entrance are allowed signage on that portion of the Building that serves as an exterior wall to its tenant space; and 2) Tenants in the Main Building are allowed up to two, and anchor tenants are allowed up to four, wall signs, one for each wall that faces one of the four cardinal directions (north, south, east and west); and 3) Sign size for Tenants in the Main Building is 6% of the total area of the wall that serves as an exterior wall to the tenant's space but not more than 500 square feet; and 4) Tenants who have a portion of their exterior wall blocked by a Garage are allowed instead to place signage on the Garage walls that are parallel to the tenants blocked exterior walls. The area allowed for the Garage mounted wall sign is calculated using the area of the wall upon which it is mounted. 5) Tenants in perimeter buildings are allowed two wall signs. 6) One freeway interchange sign is allowed per the height and area allowance of Freeway Interchange Businesses; Permitted Signs — Height and Area Allowance (TMC 19.32.180.) H. The City and Westfield agree that each has entered into this Second Amendment knowingly and voluntarily, and agree to be bound by the terms and conditions of this Second Amendment. I. The Tukwila City Council held a public hearing to consider this Second Amendment on July 14, 2008, and approved this Second Amendment by Resolution #1665 on July 21, 2008. J. SEPA review for the entire Project was fully and completely evaluated through an Environmental Impact Statement entitled Westfield Shoppingtown Southcenter Expansion dated October 6, 2004, prepared pursuant to the State Environmental Policy Act, RCW 43.21 C, and no further SEPA review is required in connection with this Second Amendment. AGREEMENT NOW THEREFORE, in furtherance of the recitals set forth above, the parties hereby agree as follows: Section 1. Southcenter Mall. Tukwila Urban Center Installation of a sign does not require a SEPA threshold determination because it is categorically exempt. A Determination of Significance was issued on July 29, 2003 for the mall addition. Decision Based upon the plans and information submitted in connection with this application; and after holding the public hearing and deliberating on November 13, 2008 the Tukwila Planning Commission has denied the application for a unique sign for Duke's Chowder House at Westfield Southcenter. III. Your Appeal Rights The decision on this Permit Application is a Type 4 decision pursuant to the Tukwila Municipal Code (18.104.010 TMC.) One administrative appeal to the City Council of the Planning Commission Decision is permitted. No administrative appeal of the EIS is permitted. A party, who is not satisfied with a City Council decision on an appeal, may file an appeal of the Council's decision in King County Superior Court. IV. Procedures and time for appealing In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, which is by December 2, 2008. The requirements for such appeals are set forth in the Appeal Processes Chapter of the Tukwila Municipal Code (18.116). All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. Appeal Hearings Process Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the City Council based on the testimony and documentary evidence presented at the open record hearing. The City Council decision on the appeal is the City's final decision. An appeal of the EIS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue an EIS for this approval and any other pending permit applications for the development of the subject property is final. VI. Inspection of Information on the Application Project materials including the application, the staff report, the EIS, and other studies related to the approval are available for inspection at the: Tukwila Department of Community Development, 6300 Southcenter Blvd., and Suite 100, Tukwila, Washington 98188 Monday through Friday - 8:30 a.m. and 5:00 p.m. The project planner is Stacy MacGregor, who may be contacted at 206 - 431 -3670 for additional information. The exposed building face upon which the sign is to be mounted is 306 square feet (18 ft high and 17 ft wide). 6% of the exposed building face is 18.36 square feet. The Chowder Cup is 9 square feet (4 ft wide and 2.25 ft tall). This is less than the allowable square feet. Duke's has only one other sign located on a different face (see drawing showing block letters "DUKES CHOWDERHOUSE" on the south face). Therefore, for all of the above reasons, Duke's meets the development standards for mall tenant signage.
