The Grantor a California limited partnership as a
donation and for no other consideration, hereby conveys and
grants to the City of Tukwila (Grantee), a Washington
municipal corporation, a perpetual, nonexclusive easement
over, across, along, under, in and upon the real property
legally described on Exhibit A, attached hereto and incorporated
herein by this reference as if fully set forth, hereinafter
referred to as "the easement area subject to the following
terms and conditions:
1. Purpose of Easement. This easement is for the
purpose of providing for pedestrian access through the
installation, construction and maintenance of sidewalks to
r- City standards or otherwise, and for the purpose of installing,
m constructing, reconstructing, g g, maintaining, operating,
repairing and replacing any and all appropriate utilities
N and related facilities. The Grantee shall have the right,
M without prior institution of any suit or proceeding at law,
and without incurring any legal obligation or liability
therefor, to enter upon the easement area and the adjacent
property of the Grantor for the foregoing purposes.
2. Restoration. Upon completion of any installation,
construction, reconstruction, maintenance, repair, replacement
or alteration of such sidewalks or utilities and related
facilities, the Grantee shall restore the surface of the
easement area to a condition which is as close to the
condition of the property immediately prior to the entry by
the Grantee as is reasonably feasible.
3. Reservation of Riqhts. The Grantor reserves the
right to use the easement area in any manner which is not
inconsistent with the use of the area by the Grantee in the
manner prescribed by this easement. Grantor shall place no
permanent structures or improvements on said easement area.
4. Bindinq Effect. This easement shall be recorded
with the King County Department of Records and Elections,
and shall constitute an easement and servitude running with
the land, binding upon the Grantor, its successors and
assigns, and inuring to the benefit of the a� tee„ its j,:19 7 D
