The Grantor, DAG'S SUNSET CORPORATION, a Washington corporation,
for and in consideration of the sum of 1EN AND NO /100 ($10.00) DOLLARS, and other
valuable consideration, conveys and warrants unto the CITY OF TUKWILA, a
Washington municipal corporation, and its assigns, an Easement over, under, upon and
across the hereinafter described lands for the purpose of the construction. installation, and
maintenance of sidewalk, to the same extent and purpose as if the rights herein granted
had been acquired under Eminent Domain statutes of the State of Washington:
Said lands being situated in King County. State of Washington, and described as
follows:
See Exhibit A, attached hereto and made a part hereof.
This Easement is subject to the rights of Wendy's International, Inc. ("Wendy's"),
as tenant in possession of the premises pursuant to a lease dated July 14, 1979, with
Grantor as the current landlord, a memorandum of which Lease is recorded as Document
No. 7905290755, King County, Washington.

EASEMENT
The Grantee shall repair /restore the Easement property disturbed during
construction, installation, or future maintenance of the sidewalk located therein.
It is understood and agreed that delivery of this Easement is hereby tendered and
that the terms and obligations hereof shall not become binding upon the City of Tukwila
unless and until accepted and approved hereon in writing by the City of Tukwila, and
indicated by the signature of the City Mayor, below.
