SPECIAL MEETINGS/EXECUTIVE SESSIONS Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters as prescribed by law. Executive Sessions are not open to the public. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: 1. The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. 3. Each side is then allowed 5 minutes for rebuttal. 4. Members of the public who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at that time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. Council action may only be taken during Regular or Special Meetings. COUNCIL MEETING SCHEDULE No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four-year term, presides at all Regular Council Meetings held on the 1st and 3rd Mondays of each month at 7:00 p.m. and Special Meetings. Official Council action in the form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular or Special Council meetings. Committee of the Whole Meetings - Councilmembers are elected for a four-year term. The Council President is elected by the Councilmembers to preside at all Committee of the Whole meetings for a one-year term. For 2017, these items include: False Alarms equaling $4,750.00, Miscellaneous Billings equaling $4,224.76 and returned checks equaling $ 30.49 for a grand total of $9005.25. BACKGROUND The process for tracking accounts receivable is quite thorough. The steps below are followed prior to preparation of the attached write-off resolution. • Invoice is sent to the recipient by the Finance Department payable in 30 days. • If payment is not received within 30 days, the receivable is forwarded to our collection agency, Armada Corp., and placed into pre -collect status. • At this time, Armada sends a Delinquency Notice to debtor notifying them of the past -due status of the receivable and asks them to contact the City to make payment. Payments can still be made directly to the City while in pre -collect status. • Once 30 days has passed in pre -collect status, the receivable then rolls over to active collections. At the onset of active collections, a letter is sent to the debtor notifying them of status change and advising that all payments must now be made through the collection agency. • When in active collections status, debtor is contacted both by phone and letter. A search is made for assets with which the debt could be satisfied. Once the debt has been in active collections for 45 days, it is then reported to the national credit bureaus. • The last process in the collections cycle is the pursuit of legal action. This includes attaching checking accounts, garnishments and lawsuits. • The City will not issue or renew a business license until all outstanding debt owed to the City is paid. • It should be noted that while a debt may be written off our books: it is still active in Armada's collection process. 13 INFORMATIONAL MEMO Page 2 DISCUSSION The proposed amount of the 2017 Cancellation of Accounts Receivable of $9005.25 is $37,675.21 lower than last year's total of $46,680.46. This is attributable to three main factors: • This year we are only writing off one street department invoice in the amount of $498.15. Normally there are multiple street department invoices being written off with much higher dollar amounts. • We are still seeing the positive impact of not issuing or renewing a business license until all past -due debt has been paid to the City. • We are also still seeing a positive impact of having higher false alarm fees. While $25.00 and $50.00 fees were often ignored in the past, since the fees have gone up to $150.00 and $200.00, recipients are paying much more attention to the invoices we send them and timely payments have increased. FINANCIAL IMPACT The financial impact of cancelling $9005.25 will be to reduce our accounts receivable balance by this amount in keeping with Generally Accepted Accounting Principles (GAAP) for writing off bad debt. Please note that while we are writing off the accounts receivable for accounting purposes, the accounts are still being actively worked for collection purposes with the exception of those accounts where a responsible party cannot be identified. Accounts covered by bankruptcy law cannot be pursued. RECOMMENDATION The Council is being asked to approve the annual resolution authorizing the cancellation of Accounts Receivable and to forward this item to the Regular Meeting Consent Agenda of October 16, 2017. BACKGROUND Each year by November 1st, the City of Tukwila reports abandoned or unclaimed property that is owed either to individuals or business vendors to the Washington State Department of Revenue Unclaimed Property Section and removes these items from the accounting records. All local governments are required to report unclaimed property except unclaimed restitution. Normal restitution is then reported each year by the County Treasurer to the State Treasurer. Current Finance Department policy dictates that all abandoned or unclaimed property be reported annually to the Washington State Department of Revenue Unclaimed Property Section through the Council approved resolution process. DISCUSSION For the 2017 unclaimed property report year, reporting of abandoned or unclaimed property totals $3,184.12 comprised of General Fund Accounts, Payable claims checks and a Court check. To the extent possible, those individuals and businesses with unclaimed accounts payable claims and payroll checks have been notified by the City through "good faith" effort of being mailed due diligence letters. These individuals and businesses have either not responded to the due diligence notifications and/or cannot be located in order to claim their property. One of the largest contributors to Unclaimed Property are juror reimbursement checks. To help reduce unclaimed property, a member from Finance is reimbursing jurors from a petty cash fund in the courtroom prior to the start of the trial. Checks are no longer being issued for reimbursement. RECOMMENDATION The Council is being asked to approve the Resolution declaring the cancellation of unclaimed General Fund accounts payable claims and consider these items on the Consent Agenda at the October 16, 2017 Regular Council Meeting. BACKGROUND B -Force security has been a great contractor for the Tukwila Parks Department for 4 years and gives excellent service for security and locking our park gates and restrooms. The park restrooms will be closed a month earlier from now on starting in November which will be a considerate amount of labor hours cut and a few parks no longer need gates due to maintenance improvements. These changes will significantly cut the rate. DISCUSSION With the evolving parks system and staff efficiency, we are able to take the existing contract with B -Force security and cut the services needed in order to better financially set our security services for the future. FINANCIAL IMPACT Current B -Force contract is $2,100 a month for 2 years not to exceed $50,400. Implementing the cut in services and at a new rate of $1,400 a month the contract will not exceed $40,600 which provides a savings of $9,800 for the remainder of the contract. RECOMMENDATION The Committee is being asked to consider the amendment and forward it to the Regular Meeting on October 16, 2017 under the Consent Agenda. ATTACHMENTS - Original B -Force contract - Contract Amendment, with updated Exhibit 29 30 City of Tukwila 6200 Southcenter Boulevard, Tukwila WA 98188 CONTRACT FOR SERVICES Contract Number: 16-165 Council Approval 12/5/16 This Agreement is entered into by and between the City of Tukwila, Washington, a non -charter optional municipal code city hereinafter referred to as "the City," and B -Force Protection, hereinafter referred to as "the Contractor". WHEREAS, the City has determined the need to have certain services performed for its citizens but does not have the manpower or expertise to perform such services; and WHEREAS, the City desires to have the Contractor perform such services pursuant to certain terms and conditions; now, therefore, IN CONSIDERATION OF the mutual benefits and conditions hereinafter contained, the parties hereto agree as follows: 1. Scope and Schedule of Services to be Performed by Contractor. The Contractor shall perform those services described on Exhibit A attached hereto and incorporated herein by this reference as if fully set forth. In performing such services, the Contractor shall at all times comply with all Federal, State, and local statutes, rules and ordinances applicable to the performance of such services and the handling of any funds used in connection therewith. The Contractor shall request and obtain prior written approval from the City if the scope or schedule is to be modified in any way. 2. Compensation and Method of Payment. The City shall pay the Contractor for services rendered according to the rate and method set forth on Exhibit A attached hereto and incorporated herein by this reference. The total amount to be paid shall not exceed $50,400 at a rate of 2,1!2.9_ per month. 3. Contractor Budget. The Contractor shall apply the funds received under this Agreement within the maximum limits set forth in this Agreement. The Contractor shall request prior approval from the City whenever the Contractor desires to amend its budget in any way. 4. Duration of Agreement. This Agreement shall be in full force and effect for a period commencing January 1, 2017, and ending December 31, 2018, unless sooner terminated under the provisions hereinafter specified. 5. Independent Contractor. Contractor and City agree that Contractor is an independent contractor with respect to the services provided pursuant to this Agreement. Nothing in this Agreement shall be considered to create the relationship of employer and employee between the parties hereto. Neither Contractor nor any employee of Contractor shall be entitled to any benefits accorded City employees by virtue of the services provided under this Agreement. The City shall not be responsible for withholding or otherwise deducting federal income tax or social security or contributing to the State Industrial Insurance Program, or otherwise assuming the duties of an employer with respect to the Contractor, or any employee of the Contractor. vt d of G2 on' CA Revised 2012 Page 1 of 4 31 6. Indemnification. The Contractor shall defend, indemnify and hold the City, its officers, agents, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with the performance of this Agreement, except for injuries and damages caused by the sole negligence of the City. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Contractor and the City, its officers, officials, employees, and volunteers, the Contractor's liability hereunder shall be only to the extent of the Contractor's negligence. It is further specifically and expressly understood that the indemnification provided herein constitutes the Contractor's waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement. 7. Insurance. The Contractor shall procure and maintain for the duration of the Agreement, insurance against claims for injuries to persons or damage to property which may arise from or in connection with the performance of the work hereunder by the Contractor, their agents, representatives, employees or subcontractors. Contractor's maintenance of insurance, its scope of coverage and limits as required herein shall not be construed to limit the liability of the Contractor to the coverage provided by such insurance, or otherwise limit the City's recourse to any remedy available at law or in equity. A. Minimum Scope of Insurance. Contractor shall obtain insurance of the types and with the limits described below: 1. Automobile Liability insurance with a minimum combined single limit for bodily injury and property damage of $1,000,000 per accident. Automobile liability insurance shall cover all owned, non -owned, hired and leased vehicles. Coverage shall be written on Insurance Services Office (ISO) form CA 00 01 or a substitute form providing equivalent liability coverage. If necessary, the policy shall be endorsed to provide contractual liability coverage. 2. Commercial General Liability insurance with limits no less than $1,000,000 each occurrence, $2,000,000 general aggregate and $2,000,000 products -completed operations aggregate limit. Commercial General Liability insurance shall be written on ISO occurrence form CG 00 01 and shall cover liability arising from premises, operations, independent contractors, products -completed operations, stop gap liability, personal injury and advertising injury, and liability assumed under an insured contract. The Commercial General Liability insurance shall be endorsed to provide the Aggregate Per Project Endorsement ISO form CG 25 03 11 85 or an equivalent endorsement. There shall be no endorsement or modification of the Commercial General Liability Insurance for liability arising from explosion, collapse or underground property damage. The City shall be named as an insured under the Contractor's Commercial General Liability insurance policy with respect to the work performed for the City using ISO Additional Insured endorsement CG 20 10 10 01 and Additional Insured - Completed Operations endorsement CG 20 37 10 01 or substitute endorsements providing equivalent coverage. 3. Workers' Compensation coverage as required by the Industrial Insurance laws of the State of Washington. B. Other Insurance Provision. The Contractor's Automobile Liability and Commercial General Liability insurance policies are to contain, or be endorsed to contain that they shall be primary insurance with respect to the City. Any insurance, self-insurance, or insurance pool coverage maintained by the City shall be excess of the Contractor's insurance and shall not contribute with it. CA Revised 1-2013 Page 2 of 4 32 C. Acceptability of insurers. Insurance is to be placed with insurers with a current A.M. Best rating of not less than A: VII. D. Verification of Coverage. Contractor shall furnish the City with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsement, evidencing the insurance requirements of the Contractor before commencement of the work. E. Subcontractors. The Contractor shall have sole responsibility for determining the insurance coverage and limits required, if any, to be obtained by subcontractors, which determination shall be made in accordance with reasonable and prudent business practices. F. Notice of Cancellation. The Contractor shall provide the City and all Additional Insureds for this work with written notice of any policy cancellation, within two business days of their receipt of such notice. G. Failure to Maintain Insurance. Failure on the part of the Contractor to maintain the insurance as required shall constitute a material breach of contract, upon which the City may, after giving five business days notice to the Contractor to correct the breach, immediately terminate the contract or, at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the City on demand, or at the sole discretion of the City, offset against funds due the Contractor from the City. 8. Record Keeping and Reporting. A. The Contractor shall maintain accounts and records, including personnel, property, financial and programmatic records which sufficiently and properly reflect all direct and indirect costs of any nature expended and services performed in the performance of this Agreement and other such records as may be deemed necessary by the City to ensure the performance of this Agreement. B. These records shall be maintained for a period of seven (7) years after termination hereof unless permission to destroy them is granted by the office of the archivist in accordance with RCW Chapter 40.14 and by the City. 9. Audits and Inspections. The records and documents with respect to all matters covered by this Agreement shall be subject at all times to inspection, review or audit by law during the performance of this Agreement. 10. Termination. This Agreement may at any time be terminated by the City giving to the Contractor thirty (30) days written notice of the City's intention to terminate the same. Failure to provide products on schedule may result in contract termination. If the Contractor's insurance coverage is canceled for any reason, the City shall have the right to terminate this Agreement immediately. 11. Discrimination Prohibited. The Consultant, with regard to the work performed by it under this Agreement, will not discriminate on the grounds of race, religion, creed, color, national origin, age, veteran status, sex, sexual orientation, gender identity, marital status, political affiliation or the presence of any disability in the selection and retention of employees or procurement of materials or supplies. 12. Assignment and Subcontract. The Contractor shall not assign or subcontract any portion of the services contemplated by this Agreement without the written consent of the City. 13. Entire Agreement; Modification. This Agreement, together with attachments or addenda, represents the entire and integrated Agreement between the City and the Contractor and supersedes all prior negotiations, representations, or agreements written or oral. No amendment or modification of this Agreement shall be of any force or effect unless it is in writing and signed by the parties. CA Revised 1-2013 Page 3 of 4 33 14. Severability and Survival. If any term, condition or provision of this Agreement is declared void or unenforceable or limited in its application or effect, such event shall not affect any other provisions hereof and all other provisions shall remain fully enforceable. The provisions of this Agreement, which by their sense and context are reasonably intended to survive the completion, expiration or cancellation of this Agreement, shall survive termination of this Agreement. 15. Notices. Notices to the City of Tukwila shall be sent to the following address: City Clerk, City of Tukwila 6200 Southcenter Blvd. Tukwila, Washington 98188 Notices to the Contractor shall be sent to the address provided by the Contractor upon the signature line below. 16. Applicable Law; Venue; Attorney's Fees. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. In the event any suit, arbitration, or other proceeding is instituted to enforce any term of this Agreement, the parties specifically understand and agree that venue shall be properly laid in King County, Washington. Final Report on Partnerships to Improve Community Health Grant - Healthy Tukwila Staff presented the final report on the Partnerships to Improve Community Health (PICH) - Healthy Tukwila project. The project was funded by a three-year grant from Public Health - Seattle & King County with a total award of $102,500. The final year of the grant included staff training and a public education/awareness campaign. Activities included removal of snack vending machines at the community center, addition of bottle refill station, creation of a "How to Have a Healthy Meeting" presentation, cooking lessons for camp attendees, and more. DISCUSSION ONLY. II. MISCELLANEOUS Councilmember Kruller previously requested that an issue raised by a Sharon Mann at the September 18, 2017 Regular Meeting be addressed through the committee. The City's current code disallows the reparking of vehicles on the same block to get around parking time limits such as 72 hours for cars and 24 hours for recreational vehicles. Ms. Mann noted that she has observed a driver of a recreational vehicle reparking between 146th Street to 148th Street and would like the ordinance to be revised to prohibit this. Staff is seeking Committee direction on next steps, such as development of an ordinance. The Committee did not arrive at a decision, so staff offered to return with more information. (RH2). BACKGROUND RH2 is the consultant for the 2016 CBD Sanitary Sewer Rehabilitation Project with Contract No.16-054. The consultant is designing the CBD Sanitary Sewer Rehabilitation Program for repair and relining of the remaining sanitary sewer pipe in the CBD (Commercial Business District). DISCUSSION This Supplemental Agreement will revise the construction documents to include the use of ultraviolet (UV) cured in place pipe lining (CIPP) as an option to steam cured felt liner. The use of UV CIPP liner will increase the number of contractors that do CIPP pipe relining and this may result in better bid pricing. The time for the consultant to complete the project will be extended to January 31, 2018. The original contract and Supplemental Agreement No. 1 (time only) and No. 2 were under $40,000, but with Supplemental Agreement No. 3, the total contract will now be $41,382.28 and requires Council approval. IMPACT: COMMENT: The asbestos concrete pipe in the CBD (commercial business district) is approximately 45 years old and becoming soft. Slip lining the pipe will reinforce the strength with little impact to roadways and minimal excavation. If the pipe collapses, the street will have to be excavated and the cost of the repairs will be significant. In the last five years we have had four major pipe failures on Andover Park West and Andover Park East. In 2014 and 2015, over 10,500 feet of asbestos sanitary sewer pipe were relined. In 2016 through 2018, 20,000 feet of asbestos sewer is scheduled to be relined. Reduced maintenance and repair costs. A Public Works Trust Fund loan was successfully obtained in 2012 for $750k. Background The proposed project is located at 13112 Military Road South on a 10.87 acre parcel zoned Medium Density Residential (MDR). Included in the project are 145 housing units - 124 units for seniors who can live independently or who require assistance with activities of daily living, and a special needs section of the building containing 21 memory care units. The proposed project includes amenities such as trails and sidewalks, landscaping, common open spaces such as patios and decks, a dog park and gardening area for residents, and parking for residents, visitors and employees. Stormwater infrastructure includes a green roof system, detention pond, underground storage vault, and pervious pavement. Approximately half of the site containing wetlands, enhanced wetland buffers, and steep slopes is preserved as open space. A SEPA Determination of Non -Significance, Special Permission Parking Determination, and Special Permission Wetland Buffer Reduction have been approved administratively for the project. Discussion The proposed senior housing/assisted living project is subject to PRD and Design Review permit approval as a Type 5 decision, made by the Tukwila City Council following a public hearing. The MDR zone is intended to provide areas for family and group residential uses up to 14.5 dwelling units per acre, but limits the type and size of the buildings to duplex, triplex, fourplex, or a townhouse up to four attached units. The applicant meets the permitted use and density requirements of the zone, but has submitted a Planned Residential Development (PRD) application to propose a different building design that would function more efficiently for a senior housing/assisted living facility. Under the PRD provisions in TMC 18.46, residential developments of all types are permitted in the MDR zone regardless of the type of building in 93 INFORMATIONAL MEMO Page 2 which the units are located, provided significant features of the natural environment are retained and open space created or preserved, and the proposal meets the review criteria in TMC 18.46.112. Project Desc`tiom: This project a proposed 145 unit, approximately 160,000 GSF multi -family senior housing project. It will include approximately 80 parking spaces (40) tuck -in style (under the building footprint) and (40) surface parking stalls located in groups located four different areas on the site to help reduce the impact on the lots of the landscape design. The project will also provide a variety of interior and exterior amenities for the community including, but not limited to, walking trails, nature overlooks, green roof, storm water swales, gardens, putting greens, private balconies and porches, common deck, etc... Internally amenities would include several dining faci|ides, multi-purpose activity rooms, club nonms, a chape|, a biutro, game parlors, a theater, etc... This project is not only a housing for the senior population but will provide employment to the city through a variety of the services being provided within the facility. Services such as full time dining, activities, maintenance staff, housekeeping, grounds keeping, facilities management and more. 18.46.112 Review criteria. The City Council shall find that the proposed development plans meet all of the following criteria in their decision making: See response in Bold below. 1. Requirements of the subdivision code for the proposed development have been met, if appropriate; 2. Time limitations, if any, for the entire development and specified stages have been documented in the application; construction is intended to start May 2017 and be completed December 2018. 6. Development in accordance with the Comprehensive Land Use Policy Plan and other relevant plans; The comp plan provides excellent guidelines on designing vibrant and diverse neighborhoods in the City of Tukwila. The development goals align well with elements of the Tukwila Comprehensive Plan. Below is a list of just some of the comp plan goals that are directly addressed in this project. • Policy 1.1.1 The project will bring more age diversity into the city and provide interaction (through staff contact and activities) to the local community. This will help to support the regional diversity of all ages and culture. • Policy 2.1.6 This site is currently under utilize land. Development will provide positive infill while protecting wetlands and open space • Policy 2.1.15 The addition of 145 housing units and staffing required to support will help promote economic and job growth • Policy 3.2.2 Provide senior housing specific residence to positively support and provide for an aging population. • Policy 3.6.1 This project will act as a long-term investment in housing and to provide for residents an ability to "age in place" as services, residence design and support staff are planned to help support "aging in place" and promote long term residency, • Policy 4.5.1 This development will provide the max units allowable by zoning on half the site while preserving the other half the site for the wetlands. No more units will be allowed to be developed thus protecting any future encroachment on the valued wetlands. • Policy 4.9.2 The building and site has been designed in a manner that respects natural drainage patterns and the topography of the site. The project construction will limit the excavation by constructing in a manner that slopes with the existing grade changes. • Policy 4.11.2 Setbacks at top of slope will be respected on all areas of the site • Policy 7.5.1 Residents of the community will be able to identify the location via the entryway off Military Rd to the north. Various onsite gathering and amenity spaces (gardens, walking path, putting green, public decks, outdoor seating areas) will be provided to support and enhance community. • Policy 7.5.3 This infill design will provide a harmonious transition between the single-family homes to the south and east and the multi -story medical office buildings to the north. The site will promote human scale plantings and outdoor rooms. The massing will be divers with variation in both vertical and horizontal scale and populated with human scale elements such as doors, windows and decks. The gable roofline design and abundant dormers will respect current neighborhood residential buildings as it "steps" with the current site. 7. Compliance with design review guidelines (see TMC 18.60); See section below "18.46.112 Review Criteria". 8. Appropriate retention and preservation of existing trees and vegetation recommended by the Director. See PRD landscape plans previously provided. BRAND 18.46.112 Review Criteria C. Multi -Family, Hotel and Motel Design Review Criteria. In reviewing any multi- family, hotel or motel application the following criteria shall be used by the BAR in its decision making as well as the Multi -Family Design Manual. — NOTE see responses below in BOLD 1. SITE PLANNING. a. Building siting, architecture, and landscaping shall be integrated into and blend harmoniously with the neighborhood building scale, natural environment, and development characteristics as envisioned in the Comprehensive Plan. For instance, a multi -family development's design need not be harmoniously integrated with adjacent single family structures if that existing single family use is designated as "Commercial" or "High Density Residential" in the Comprehensive Plan. However, a "Low Density Residential" (detached single family) designation would require such harmonious design integration. - The proposed project siting is designed to match the natural grade of the site, stepping as the site slopes down from west to east. It also has been positioned on the flattest part of the site to minimize the scale and not impact to the wetlands and healthy trees to the north and northeast and to reduce the visual impact to LDR zone to the south. The building's footprint also has sections that turn and articulate to create a variety of facades with less "continuous linear" faces, thus helping to create more massing diversity from all perspectives. b. Natural features which contribute to desirable neighborhood character shall be preserved to the maximum extent possible. Natural features include, but are not limited to, existing significant trees and stands of trees, wetlands, streams, and significant topographic features. "Natural features" design intent are, but not limited to, i. Maintaining the Wetlands area to the north and east ii. On site water retention via the use of a storm water pond iii. Maintaining almost 5 acres of old growth clusters of trees to the north east iv. Utilizing as much of eth natural topography as reasonable to inform the modulation of the stepping facade c. The site plan shall use landscaping and building shapes to form an aesthetically pleasing and pedestrian scale streetscape. This shall include, but not be limited to facilitating pedestrian travel along the street, using architecture and landscaping to provide a desirable transition from streetscape to the building, and providing an integrated linkage from pedestrian and vehicular facilities to building entries. The pedestrian experience is critical for the design of eth is project. A variety of site experiences shall be provided to enhance the quality of eth project as well as the well-being of the residence. i. Walkways along vehicle travel paths ii. Building masses that vary in scale at pedestrian entrances (smaller at secondary entrances and larger at the more primary entrance. iii. Diversity in building plan as well as elevation to provide more pedestrian interest iv. Lights, plantings and natural rockery retain walls will be used to express diverse conditions throughout the site. v. Various outdoor rooms will be provided as areas of "pause" or "views" to nature to help enhance the site and the residence experiences d. Pedestrian and vehicular entries shall provide a high quality visual focus using building siting, shapes, and landscaping. Such a feature establishes a physical transition between the project and public areas, and establishes the initial sense of high quality 121 Ankrom Moisan 122 development. - The vehicular entrance to the site will be at the west end of the property off Military Road South. This entry drive will be "framed" with trees and various landscape elements to help guide visitors and residents. The vehicular circulation will be a large loop with a drop-off at the primary entry facing to the north and away from the LDR zone to the south. This drop-off location and design will help direct most of the onsite vehicular traffic to the more remote north location. The site perimeter design to the south will be series of earth berms, metal and wood fencing and landscaping. Around the perimeter of the building will be an additional layer of trees and landscape to help provide natural shading and visual entrance to all faces of the structure. e. Vehicular circulation design shall minimize driveway intersections with the street. - Due to the "flag lot" nature of the site the only intersection to the street will be at Military Rd. Per the Fire Department, there will also be a secondary "fire access point" will be provided at the SW corner of the site off 32nd Ave S only to be used in case of emergency. f. Site perimeter design (i.e. landscaping, structures, and horizontal width) shall be coordinated with site development to ensure a harmonious transition between adjacent projects. - The site perimeter to the south (adjacent to single family homes) will be delineated with a residential scale wood privacy fence. Inside of the fence will be earth berms and landscaping (existing trees as well as new trees and plantings) to help soften the transition from the neighboring sites to the project. This will also help reduce acoustics and provide a residential feel to the site. To the east and north the wetlands will remain. To the west an architectural entry gate and landscaping will be provided off Military rd. g. Varying degrees of privacy for the individual residents shall be provided; increasing from the public right-of-way, to common areas, to individual residences. This can be accomplished through the use of symbolic and actual physical barriers to define the degrees of privacy appropriate to specific site area functions. - The perimeter landscaping and fences will provide several layers of screening for the adjacent neighbors. On the site the units will have a great deal of privacy provided by landscape screen and a predominant amount will not face each other in this design. The few units that face across each other will be across a tree and landscaped courtyard with over 150' of separation between buildings. h. Parking and service areas shall be located, designed, and screened to interrupt and reduce the visual impact of large paved areas; - Half (40 spaces) of the site parking will be tucked in and facing to the East at the lower end of the site. These "tucked in" spots will be over 150' from the street edge and screened by landscaping and old growth trees. The remainder of the parking will surface parking in multiple location throughout the site in order to reduce the visual impact and the amount of hardscape. These stall locations will have a variety of strategic landscaping and screening to help integrate the stalls with the site. i. The height, bulk, footprint, and scale of each building shall be in harmony with its site and adjacent long-term structures. - The height of the project will be within the code requirements and not require any adjustment. The massing has been designed to vary in scale both in elevation and in plan in order to provide visual interest and building form variety for the occupants and the neighbors. The overall massing "steps" down to match the existing topography. Additional secondary massing elements are provided such as decks, patios, and bay windows in order to help give the project a "human scale". The elevations change persistently through the use of predominantly gabled roofs with accent dormers and decreasing floor levels to the Southeast and to the Northwest. In plan the project utilizes massing changes to the facade as well as a series landscaped open spaces. nli'0 Ankrom ioikan 2. BUILDING DESIGN. a. Architectural style is not restricted, evaluation of a project shall be based on the quality of its design and its ability to harmonize building texture, shape, lines and mass with the surrounding neighborhood. - Architecturally the proposed building design is based on a "mountain lodge" or "hillside village" vernacular. The roof lines will be mostly gables and dormers to reflect the residential neighborhood style & scale. The building siding will be horizontal siding with board batten elements and stone accents. The composition will help to provide a visual variation in textural quality as well as a palette that references its Northwest regional style. Buildings shall be of appropriate height, scale, and design/shape to be in harmony with those existing permanent neighboring developments which are consistent with, or envisioned in, the Comprehensive Plan. This will be especially important for perimeter structures. Adjacent structures which are not in conformance with the Comprehensive Plan should be considered to be transitional. The degree of architectural harmony required should be consistent with the non -conforming structure's anticipated permanence. - Neighboring buildings to the south and east are predominantly 1-3 story single-family residential buildings. To the north and west they are 3-5 story medical office buildings. This building will be mostly 3 stories in the main sections and 1-2 stories on the perimeter as it engages the entry to the west and the single- family homes to the south. In general, the building is set back over 40' min. from property lines to the south and is only one story at that setback. As the building grows taller it sets further away from the single-family zones to the south and east. This along with layers of landscapes and plantings will help to support the goals of the comp plan as outlined above line item 1.1. c. Building components, such as windows, doors, eaves, parapets, stairs and decks shall be integrated into the overall building design. Particular emphasis shall be given to harmonious proportions of these components with those of adjacent developments. Building components and ancillary parts shall be consistent with the anticipated life of the structure. - The materials designed for the elevations provide a variety of types and quantity to help create a more "human scale". The material types will change vertically in order to help provide a "design order" that allows a sense of human scale (base, body and cap). Components such as decks, patios, multi -mullioned windows, corbels, dormers and architecturally expressed structural features will be integrated in order to reinforce the design intent and style. d. The overall color scheme shall work to reduce building prominence and shall blend in with the natural environment. - Colors and materials will draw from a natural pallet of earth tones that are appropriate for a heavily wooded site and a "Lodge" vernacular. These colors will be applied with thought to the design language of the materials not frivolously in order to reinforce a sense of "authenticity" to the design decision and structural elements such as columns, beams and corbels will also be utilize and revealed to accentuate the design. The diversity of interior amenities will also translate to more diverse and visually interesting architectural massing and form and less redundant "rows" of monotonous residential units e. Monotony of design in single or multiple building projects shall be avoided. Variety of detail, form, and siting shall be used to provide visual interest. Otherwise monotonous flat walls and uniform vertical planes of individual buildings shall be broken up with building modulation, stairs, decks, railings, and focal entries. Multiple building developments shall use siting and additional architectural variety to avoid inappropriate repetition of building designs and appearance to surrounding properties. - The building design reflects the variety of the topography, the natural amenities of the site and the varied program requirements with in. The massing has been formed to respond 123 RBANDES N hG N gas 124 to the stepping topography and the dedicated wetlands on the site. It modulates to best utilize form to reduce scale as well as reflect upon opportunities for engagement with views and the existing old growth tree in the wetland setbacks. The building massing shift in plan with the intent of providing a variety of forms at different scales to reinforce both a human scale and its concept of a "Journey of Discovery". The varying nature of the is building's program drives it to create interest in massing and exterior accent elements in the design. This plethora of variety is attractive both on the interior and exterior as it creates opportunities for the residents and visitors to explore both the building and the site. 3. LANDSCAPE AND SITE TREATMENT. a. Existing natural topographic patterns and significant vegetation shall be reflected in project design when they contribute to the natural beauty of the area or are important to defining neighborhood identity or a sense of place. The topography and landscape design are critical elements of the project as stated above. - The primary design intent is to integrate the building with the natural topography and wetlands. Designing the building so that it is engaged in the site and reflects topographical changes with its own stepping -down massing. The site and building also provides many opportunity for residents and visitors to interact with the site's green spaces and natural elements (such as the wetlands setback) through walking trails, overlooks and vistas from common spaces and private decks setbacks. b. Landscape treatment shall enhance existing natural and architectural features, help separate public from private spaces, strengthen vistas and important views, provide shade to moderate the affects of large paved areas, and break up visual mass. - The overall site treatment landscape will help to support the outdoor amenities and the natural topography of the site. Landscape trees will be provided throughout the site over parking and drives to reduce heat on the paved areas. Outdoor "rooms" will be created through the use of site features at different elevations to provide a variety of vantage points and exterior experiences. Each of eth outdoor amenities will have different treatment based on location, views and functions. Putting greens will be in the sun. South facing patios will be shaded by deciduous trees. My rational for this opinion are as follows: - Surfaces paved with impervious pavement are first routed through a Modular Wetland treatment vault. City Staff have reviewed these systems in the field several years ago including a trip to Portland to see one installed at a City shop yard. The yard had heavy equipment and was used to test striping equipment. Staff witness paint flakes, oil sheen, and turbid waters entering the treatment vault and that the discharge appeared clear and without any oil sheen or other evidence of contamination. These systems have now become the preferred options for City projects due to their lower cost to maintain and excellent performance. - The DOE has tested and approved the use of Modular Wetlands for basic water quality applications. Following treatment by the two Modular Wetland vaults, Stormwater is then routed to a Stormwater "wet"pond prior to discharge. A wet pond is a DOE approved method to provide Stormwater quality treatment This pond will provide additional levels of treatment prior to discharge. - Pervious pavement will also be used for the lower volume roadway5, parking areas, and paths. This is consistent with the City's LID regulations and will provide water quality treatment through filtration of the base soils as well as help maintain the base flows to the wetland and Riverton Creek. Given the nature of this development, redundant water quality designuse of LID, expected level of maintenance, and required City site inspections following completion, I am satisfied that this development has provided adequate controls to protect downstream receiving waters including Riverton Creek from storm water impacts. Karen expressed concerns regarding potential degradation to Riverton Creek through the discharge of stormwater proposed by the project to the slope wetlands within the creek's drainage basin. SVC shares Ms. Walter's concerns regarding the integrity of Riverton Creek's ecologic function, and as such, has been involved with the planning and design of the project from the beginning. SVC is also concerned with protecting and maintaining wetland hydrology within the watershed. These wetlands and associated seeps are protected by the City of Tukwila and provide the hydrology for Riverton Creek. As such, we worked closely with the architect and engineer in the design of the project to specifically protect existing wetland hydrology and the downstream drainages beyond the scope of what is required by the City of Tukwila's codes. The intent of discharging clean water to multiple locations is to help ensure the proposed project will maintain wetland hydroperiods. Being slope wetlands, the primary source of wetland hydrology comes from shallow groundwater seeps and runoff from the adjacent uplands. For this reason, we chose to restore the wetland buffers and convey some clean roof runoff and all foundation drainage directly to the wetlands in three key locations. In addition, the treated and detained stormwater outfall will be released to the wetland buffer in a fourth key location. These discharge locations are proposed at the toe of the steep slope and start of the lower gradient slope wetlands where the shallow groundwater currently emerges as seeps. These areas already experience surface water flows, and the proposed supplemental discharge will be dissipated through dispersal systems in vegetated areas designed to ensure that there will not be downstream erosion problems. As long-term maintenance and monitoring of the buffer restoration areas will be implemented, we could easily add a monitoring component for these discharge locations. Seven 15' radius sample plots in the buffer will be used as permanent photo points for buffer enhancement monitoring purposes. Four photographs pointing to each cardinal direction will be taken at each plot, which will be flagged with PVC pipe and rebar as mapped and geolocated. 4. If performance standards are not met, contingency measures will be prepared and implemented on a case-by-case basis that reflects failed mitigation characteristics. The contingency plan and implementation measures will require approval by the City's Urban Environmentalist. 5. A split rail fence or similar alternative is required per TMC 18.45.060.6 to delineate the boundary of the sensitive area buffers. The fence shall be installed after grading and digging within the buffer takes place and prior to enhancement planting. The fence shall be installed adjacent to the driveway and the proposed pervious trail around the stormwater pond, and no mowing or driveway maintenance may occur within the buffer area. The note on Sheet 3 of 4 has been added in red to indicate the correct installation location for the fence. 6. Given the invasive qualities of Lotus coniculatus, consider a substitution in the Wet Soil Seed Mix around the dispersal trenches. 7. A pre -construction meeting shall be held with DCD staff prior to the start of construction work to verify that the location of the reduced wetland buffer boundary/10' planting strip has been adequately flagged and that any tree protection measures are installed prior to any construction activity taking place. 8. The City prefers mechanical weed control methods, and herbicide will only be used if deemed absolutely necessary. Vietnam veterans of the Project Welcome Home Committee, one of whom flew this B - 52G in Operation Linebacker II and contributed to the release of 591 U.S. POWs spoke at the event. • Presentation to Duwamish Rotary: On September 28 Mayor Ekberg gave a presentation at the Duwamish Rotary meeting about his recent trip to Southeast Asia as a member of the YSEALI Professionals Fellow Program sponsored by the US State Department. • Potential Shoreline Restoration Partnership: Community Development staff attended a meeting to discuss a possible partnership between the Desimone Trust and WRIA 9 on shoreline restoration. Staff Updates Public Safety • Tukwila Masonic Lodge Honor Officer Matt Valdez: On September 30 Officer Matt Valdez received the Outstanding Police Officer of the Year Award for 2017 from the Tukwila Masonic Lodge. Each year, the Masonic Lodge recognizes a Tukwila Police Officer for their contributions to the department and the City of Tukwila. Officer Valdez received the award for his work doing community outreach, as well as work with Tukwila's immigrant population and the Tukwila schools. • CERT Classes: CERT Classes started on September 30. Class Graduation is scheduled for October 14 at 4:30 PM at Fire Station 51. • Officers Receive Life Saving Award: On October 2 Sergeant Zack Anderson, Officer Mike Richardson and Officer James Thompson received Life Saving Award for saving the life of an unconscious and unresponsive citizen in September 2016. • Retirees Breakfast: On October 7 ten past employees (representing a total of 295 years of service to Tukwila) came to Station 51 to enjoy breakfast and re -connect with the crews. • Community Police Team meets with Tukwila Teens: Sergeant Kraig Boyd, Officer Adam Balcom and Detective Randy Rusness attended the October 14 Tukwila Teens meeting where they took part in a round table discussion with the teens centered around current events. Beacon Ave Bridge: Currently closed to traffic with completion expected in October. The bridge deck has been removed and the contractor is prepping the inside structure for painting. Frank Zepp Bridge (S 180th): The bridge reopened On October 1. The new deck overlay has been installed. Next steps include painting of the structure and completing the seismic upgrades. Grady Way Bridge: No major impacts to Grady Way with only temporary lane closures on Longacres Drive. • 42nd Ave Phase Ill: Work is proceeding on the culvert replacement and installation of the underground power utility infrastructure. This project is scheduled to be complete in August 2018, barring any setbacks. • Cascade View SRTS Phase II: Construction continues with the installation of the mini roundabout. All work should be completed by the end of October. • Baker Blvd Non -Motorized: Water line, street lighting conduits, and storm drainage modifications are wrapping up on Christensen Rd. Light pole bases have been poured and curbing grades are set. Curb pouring on Christensen Road and the Baker/Andover Park East intersection ramp removal and pedestrian signal upgrades are scheduled to begin October 9. All work should be complete by December 2017. • S 119th St Pedestrian Bridge: Work for this structure has been completed for this year. The King County maintenance crews were able to finish the girder top repairs and place a non-skid deck section on the bridge. • 2017 Overlay & Repair: Final paving of the Fort Dent parking lot took place the week of October 2. • 2017 Annual Small Drainage Program: Work has been completed on 58th Ave South. Drainage work is complete and the concrete sidewalk has been replaced along Strander Blvd near the Target store. Site restoration work still remains to be completed. At the 48th Ave S site crews have completed the majority of the drainage work but are awaiting delivery of a 'Modular Wetland' stormwater treatment device that is not scheduled to be in until the end of October. All work is scheduled to be completed by November. • Strander Boulevard/SW 27th St: The project design kickoff meeting was held on October 5. Given the number of activities required during this start-up phase of the Plan and with the Coun- cil's continued engagement, the team is making good progress overall. Timely Council ac- tion on site selections and acquisitions are key to maintaining the Plan's momentum. FIRE STATIONS 0 Site selection and acquisition The Council will be asked to provide direction 16 October in order to take final action 6 November on property commitments for Fire Stations 52 and 54. Schematic design Weinstein AU is performing Station 51 schematic design, scheduled for completion by the end of this year. With input from the GC/CM, the schematic design estimate will be the first "real" number that the Council sees in January. Sustainability features The Council can expect to see a short list of sustainability options for Fire Station 51 with their ROM (rough order of magnitude) budgets as schematic design alternates for GC/CM pricing. GC/CM authorization and selection Four Fire Station GC/CM proposals were submitted 9 October. Interviews of the high- est-rated firms will be held 18 October, and final proposals are due 20 October for se- lection of the highest-rated firm that day. Council approval of the GC/CM will be sought in November. Equity/diversity and local participation One criterion for the selection of a GC/CM is a five-year track record in utilizing small/ disadvantaged/women business firms and hiring from economically distressed areas. Based on a 15 May discussion in the Public Safety Committee, the PET is considering piloting a program similar to the City of Seattle's: formalized in a Project Labor Agree- ment (PLA) and/or Community Workforce Agreement (CWA). The Council needs to weigh the cost and efficacy of a formal PLA/CWA approach in light of your draft equity policy and the stations' budget stress. An alternative approach like the University of Washington's would be less costly and equally effective. 163 JUSTICE CENTER Site selection and acquisition wr The Council will be asked to provide direction 16 October in order to take final action 6 November on a property commitment for the Justice Center. Programming DLR is performing programming. Pending successful site selection, the Council should expect a program and estimate early in December. This estimate will only be as (un)certain as Fire Station 51's 2040 programming estimate. GC/CM authorization and selection The Justice Center's GC/CM application will be submitted 1 November for considera- tion 30 November by a panel of the State's Project Review Committee. Upon the PRC's approval, GC/CM selection will begin in December. The Council should expect a recom- mendation in January. CONSOLIDATED SHOPS Site selection and acquisition The Council will be asked to provide direction 16 October in order to take final action 6 November on a property commitment for the Shops. SCHEDULE Tight schedule The overall schedule remains very ambitious. With so many activities under way, there is little room for any missteps to meet the Plan's milestones. PROPERTY ACQUISITIONS Due diligence The PET will seek Council approval for contracts to conduct surveys, environmental reviews, geotechnical analyses, and title reports to prepare for property acquisitions. BUDGET Project and program contingencies Without a budgeted program contingency, there will be pressure on all program ele- ments' budgets for the life of the Plan. At its 3 October meeting, the Finance Committee began discussing with staff how to approach the Plan's significant financial gap. Market conditions Like the Fire Stations, the Justice Center and Consolidated Shops budgets will need to be sensitive to tight construction market conditions and increasing property values. These external budget pressures will manifest themselves as property is procured and project estimates are refined.
