ACCUMULATION OF RUBBISH OR GARBAGE
IPMC 308.1 All exterior property and premises shall be free from any accumulation of
rubbish or garbage.
Garbage is defined as the animal or vegetable waste resulting from the handling,
preparation, cooking and consumption of food. Rubbish is defined as combustible and
noncombustible waste materials, except garbage; the term shall include the residue from
the burning of wood, coal, coke and other combustible materials, paper, rags, cartons,
boxes, wood excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals,
mineral matter, glass crockery and dust and other similar materials.
Observed two full plastic trash bags, paint cans, and loose rubbish dumped on property in
driveway area. The open plastic refuse container is full of loose rubbish, and accessible to
pests, rodents and birds.

8.28.030 Vacant Buildings, Structures and Premises
A. All vacant buildings, structures and premises, and all vacant land, shall be maintained in
a clean, safe, secure and sanitary condition as required by the International Property
Maintenance Code.
Property and structure is unsecured and accessible to unauthorized entry by persons,
pests and animals. Main entryway door to house is unlocked and accessible, garage doors
pried open and accessible. Upper window near driveway area is open and accessible.
There is visual evidence that there has been intrusion into the home as seen through
ground floor window next to driveway, and front door entryway.
Entire property is covered in weeds, grasses and blackberries well in excess of 12 inches.
There are plastic trash bags, paint cans and open containers filled with loose rubbish
stored openly in driveway.

Code Reference:
IPMC 302.4 Weeds. Premises and exterior property shall be maintained free from weeds
or plant growth in excess of 12 inches. Noxious weeds shall be prohibited. Weeds shall be
defined as all grasses, annual plants and vegetation, other than trees or shrubs provided,
however, this term shall not include cultivated flowers and gardens. Upon failure of the
owner or agent having charge of a property to cut and destroy weeds after service of a
notice of violation, they shall be subject to prosecution in accordance with 106.3 and as
prescribed by the authority having jurisdiction.
Observed weeds and grasses in excess of 12 inches high over most of the property. Also
observed blackberries (a noxious weed) growing on the entire property, especially along
fences, driveway and front of property along roadway.

Appeal Provisions
A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal
containing the following:
1. A heading with the words: "Before the Hearing Officer of the City of Tukwila"
2. A caption reading: "Appeal of " giving the names of all appellants participating
in the appeal.
3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the
notice and order.
4. A brief statement of the specific order or action protested, together with any material facts claimed to
support the contentions of the appellant(s).
5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order should be
reversed, modified, or otherwise set aside.
6. The signature of all persons named as appellants and their official mailing addresses.
7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters
stated in the appeal.
8. The appeal fee for violations in the LDR zone is $100.00. All other zones $200.00. Fees must accompany the
written notice of appeals.
Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional
administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for
further action.
