This letter constitutes the findings and conclusions for the minor modification to a Board of Architectural Review (BAR) decision (18.46.130 Tukwila Municipal Code (TMC)) This letter encompasses the Type 1 decision that is appealable to the City's Hearing Examiner per the Appeal Processes Chapter (18.116 TMC.) Background In 1991, the Mervyn's Company constructed a new building and opened it into the northeast corner of Southcenter Mall. The proposal underwent SEPA analysis and received design review approval from the Board of Architectural Review. A three sided structure that opened into the Mall's concourse was approved. The architecture and high quality materials harmonized with the Mall's design. The Mervyn's company however went out of business some time in 2006 and the building has been vacant since then. Project Description The Westfield Corporation, owner of Southcenter Mali purchased the Mervyn's building and has leased approximately 35,000 square feet of the lower floor of the two story building to Seafood City. The new tenant, who will be using only one of the three exterior entrances has presented drawings modifying parts of the former Mervyn's building. The majority of the changes are to the east facade over Seafood City's entrance along with some modifications to the lower elevation of the north facade that abuts their back of house. For the proposed modifications to the BAR approved design, the following criteria have been highlighted due to their relationship to the proposed changes. Comments regarding the current submittal have been made as they relate to the relevant criteria. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety efficiency and convenience should be encouraged. The new use is a food market that will make shopping carts available for their customers. Four cart corrals will be located in the parking field to the east of the store's entrance. There is a curb ramp to the south of the entrance directly opposite the handicap parking. The applicant has presented two new ramps — one directly in front of the entrance and to the north of the east entrance. There is a parking field to the north of the building. Customer parking in this area previously had access to the building through an entrance on the north side that with this proposal will be closed. Westfield, the building's property owner, recently acquired the "Bank of America" lot to the north and will be leasing the building to a new tenant and providing needed mall parking on that parcel. The applicant proposes replacing one of the loading area for the required recycling area. A trash compactor is proposed for one space and the general recycling area is proposed for one other. Discussion The proposed north curb ramp location is a compromised location for two reasons: the shallowness of the sidewalk at this location and its intersection with the east driveway circling the mall. An additional ramp should be installed at the north end of the sidewalk that extends along the front of Seafood City's entrance. The presence of a business to the north and parking to the north and the cart corrals to the north indicate that functionally, a ramp would be needed at the end of this sidewalk. A modified ramp location would support customer movement to the north parking field and to the business and parking to the north and would avoid dropping pedestrians into the main circulation drive around the mall. An ADA sewer cover could be substituted to make a functional ramp at the northernmost end of the sidewalk acceptable. Page 2 of 8 04/07/2010 • • The most effective recycling program for a food market is food and paper composting, which needs to be placed in an area with truck access. The business owner has expressed disinterest in a recycling program. Therefore in order to meet the recycling area standard of 182 square feet (18.52.080 TMC) and not impact the required three loading spaces, (18.56.080 TMC) a recycling area will need to be identified within the tenant space. Condition Sheet AR1.1 Hardscape Plan • Relocate ramp at the northernmost end of the sidewalk that runs along the east side of the building. • Identify and demarcate 182 square feet of recycling area with the tenant space. Landscape and Site Treatment (b) Landscape treatment shall enhance existing natural and architectural features, help separate public from private spaces, strengthen vistas and important views, provide shade to moderate the affects of large paved areas, and break up visual mass. Two trees in front of planter E& F and a tree on the north side are proposed for removal. The applicant proposes compensation by planting four trees in the landscape area along the entry drive off Andover Park West where no plants exist other than grass. The applicant desires to create a clear visual corridor to future exterior tenant signage on the east facade. The sidewalk along this building edge is fairly narrow - from four to seven feet. The parking field to the east of this sidewalk is bare of any plantings and does not meet current landscape standards. Discussion Any removal of trees from the sidewalk and this side of the property would weaken the trees function in providing an edge and barrier for pedestrians from the adjacent circulation drive aisle. The trees also assist in breaking up the building mass along the east elevation that extends from the southern edge of J.C. Penny to the Mervyn's facade. There is little relief or modulation along the building wall or pedestrian amenity along the length of the sidewalk. Removal of the trees will reduce the attractiveness of this area thereby reducing the incentive for pedestrians/customers to walk along the building's facade. Visibility to future signage along this wall is a relevant concern; however, mall businesses do not typically rely on street signage. Most mall businesses do not have exterior signage. Other means to indicate an exterior shop entrance would be exterior entry treatment that emphasizes a retail entrance. Condition Sheet L-1 of 1 Landscape Plan • Retain trees or replace trees in place with a minimum 2 inch caliper tree of the same species. Landscape and Site Treatment (a) Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced. Page 3 of 8 04/07/2010 • • (c.) Walkways, parking spaces, terraces, and other paved areas shall promote safety and provide an inviting and stable appearance. Direct pedestrian linkages to the public street, to on-site recreation areas, and to adjacent public recreation areas shall be provided. (d) In locations where plants will be susceptible to injury by pedestrian or motor traffic mitigating steps should be taken. (g) In areas where general planting will not prosper other materials such as fences, walls and pavings or wood brick, stone or gravel may be used. Except for the trees, the existing planting beds, which have been in place since 1992, are for the most part bare of plants. The plants, particularly in the north bed, did not survive. The design revisions lack measures to reverse this outcome. A drawing of the north elevation shows a new planting bed that extends into the sidewalk area. Discussion Protecting the plant material from foot traffic seems necessary given the experience here. Shopping carts will be a new source of injury and do not lend themselves to travel along a curvilinear walkway. A small curbed edge and slight berming and significant planting could emphasize the edge and help protect the plant material. A review of plant species spread, condition of existing bed, and setting for the plantings causes us to conclude that plantings should be increased in order to meet City standard of 90% coverage in three years. Condition Sheet L-1 • Provide a curb and berming to protect and demarcate the planting edge. ■ Increase the number of Daylilies to 1 per foot in all beds along all edges • Add 4 Holly in Bed C (on south side of entrance) to mirror treatment in Bed B ■ Increase Sarcococca to one every 2 feet along edges of all beds ■ Deepen the setback of the new EFIS wall so that the planting bed does not extend past the building line on the north elevation • Provide a scaled planting plan for the north landscape area. Building Design (a) Architectural style is not restricted; evaluation of a project should be based on quality of its design and relationship to its surrounds. The applicant proposes to cover the east entry architectural feature with a green tinted glass curtain wall above and below the canopy and cover the canopy and columns with 4 mm Page 4 of 8 04/07/2010 "alucobond," a metal cladding material. The applicant states that clear vision glass is proposed for the storefront door system. These two new facade materials are shown topped with a sheet metal cornice. The profile of the cornice does not exactly duplicate the cornice surrounding the existing building. A new wall will be constructed over the existing north entrance. The new wall will extend around and over the two existing columns. The area between the two columns will be finished with a painted EIFS wall. A paint color has been specified but not shown on the color and materials board. The walls around the columns are proposed to be faced with brick veneer and stone to match the color and pattern of the main building material. Discussion The applicant has provided a 4mm alucobond sample in silver metallic. The cornice color specifies "champagne metallic" that is intended to match the alucobond cover below. A tinted storefront glass would harmonize and carry out the colors of the glass facade above and surrounding the storefront. Painted surfaces behind the glass walls will provide a uniform back ground for the semitransparent glass curtain wall systems above and below the canopy. Accurate drawings of the column treatment are not provided. There will be seaming along the columns. The applicant proposes converting the round column to a square that would extend the length of the column with two to three seams horizontally and one to two seams down the length. Condition Sheet A4.0; A5.0: ■ Modify the drawing to show the actual column treatment. Condition Sheet A6.1: ■ Create an irrigated planting bed with plant materials that sufficiently screens the blank wall on the north facade. Building Design (d) Colors should be harmonious with bright or brilliant colors used only for accent. Two colors - Walrus and Roman Gold - are shown on the color and materials board. The roman gold is a suggested color for a canopy or awning element at Red Ribbon, for which there are no submitted elevations. The walrus color will be painted on the new stud wall behind the glass Page 5 of 8 04/07/2010 • • curtain wall above the canopy as well as the existing tile wall around the entrance. A sample for the color of the new painted EFIS wall on the north elevation is not provided. Discussion The lack of information regarding the tenants adjacent to Seafood City prevents any findings or conclusions regarding their proposal. The use of Walrus will be a neutral color that should help provide a uniform background for the glass curtain wall. No plans were submitted for a tenant space other than Seafood City. Building Design (f) Exterior lighting should be part of the architectural concept. Fixtures, standards and all exposed accessories should be harmonious with building design. The proposed sign will be internally illuminated. Lights behind the lower parapet were added per Seafood City to accent the upper glass curtain wall. Additional lighting to illuminate the curtain wall below the parapet is requested so that the glass curtain wall appears the same both above as well as below the canopy. Currently there are four recessed can lights in the ceiling of the canopy. The applicant proposes two fixtures for the east facade. A decorative cylindrical fixture will be an accent feature on the column and more functional square down lights are proposed for the walls on either side of the entrance. Discussion The two accent lights are in keeping with the new architectural program for the east entry and six wall sconces are subdued and are in harmony with the decorative detailing of the existing building. Miscellaneous structures (a) Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and proportions should be to scale. The roof plan (Sheet A3.0) shows new equipment and mentions that details are available on sheet A 6.0, which is not submitted. According to the applicant, the details on A6.0 are roof platforms. The intent is for the existing parapet to screen the new Rut's from views from the site (not necessarily level view). The sign shown on plan elevations are individual letters and a logo that according to the applicant are internally illuminated. A bench, bike rake and waste receptacle are shown on the color and materials board. Discussion The City's sign code will allow one sign on the east side where the Seafood City sign is shown Outline of thee additional signs are also shown on the east canopy. We are unable to judge the scale of the sign relative to the size of the building; however, the sign code formula for sign size Page 6 of 8 04/07/2010 • • will determine the maximum allowable sign area. A separate sign permit must be submitted and approved. Summary The conditions listed above and summarized below need to be incorporated into the Seafood City proposal in order for the project to be in keeping with the original BAR decision. This decision does not encompass or approve the Jollibee or Red Ribbon examples as there are no supporting plans or details on those projects. This decision may be appealed to the City's Hearing Examiner within 14 days of the date of this letter. Conditions 1. Our client, Wooden III LLC, currently owns three parcels near the southeast corner of Duwamish Hill Park. The three parcels are (A) 3351400005, (B) 1023049063, and (C) 1023049072. Please refer to the attached site plan for the parcel locations, shaded in color. Parcel A is located on the western edge of the residential neighborhood, zoned Low Density Residential (LDR). It is positioned adjacent to Parcel C, which is currently zoned Manufacturing, Industrial Center Light (MIC/L). Parcel B is located on the bank of the Duwamish River, also zoned Manufacturing, Industrial Center Light (MIC/L). This parcel interrupts a stretch of publicly owned land along the Duwamish River to the east and west. Parcel C is located at the southeast corner of Duwamish Hill Park, and zoned Manufacturing, Industrial Center Light (MIC/L). Wooden III Ilc proposes a rezone of two of these parcels in the interest of creating a development opportunity that will both improve the Duwamish Hill Park and support the adjacent residential neighborhood with a more appropriate and inviting use. In this proposal, the zoning for Parcels A and C would be changed to Office (0), with the intention of establishing professional offices, galleries and/or daycare facilities per TMC chapter 18.18. This zoning change will eliminate the possibility of adverse MIC/L development at this juncture between the park and the residential neighborhood. Further, in the interest of improving the Park and general environment, Wooden III would donate Parcel B to the City of Tukwila for integration into its river bank restoration program and pedestrian trail development, if the proposed Office rezone of Parcels A and C were to be approved. This three parcel proposal will benefit the Park, the River and the adjacent residential neighborhood in three significant respects: 1. A potentially harmful MIC/L future development (gas station, auto repair, contractor storage, etc) would no longer border the southeast corner of the Park and adjacent residential neighborhood to the east. 2. In lieu of the MIC/L "island" parcel (meaning a single privately owned parcel zoned differently than its surroundings), two "Office" zoned parcels would create a more pedestrian friendly environment, and be more supportive of both the park and the residential neighborhood. 3. Tukwila would gain public land along the Duwamish River for restoration and possible trail development, which is currently interrupted by this "island" of private owners,. • (c.) Walkways, parking spaces, terraces, and other paved areas shall promote safety and provide an inviting and stable appearance. Direct pedestrian linkages to the public street, to on-site recreation areas, and to adjacent public recreation areas shall be provided. (d) In locations where plants will be susceptible to injury by pedestrian or motor traffic mitigating steps should be taken. (g) In areas where general planting will not prosper other materials such as fences, walls and pavings or wood brick, stone or gravel may be used. Except for the trees, the existing planting beds, which have been in place since 1992, are for the most part bare of plants. The plants, particularly in the north bed, did not survive. The design revisions lack measures to reverse this outcome. A drawing of the north elevation shows a new planting bed that extends into the sidewalk area. Discussion Protecting the plant material from foot traffic seems necessary given the experience here. Shopping carts will be a new source of injury and do not lend themselves to travel along a curvilinear walkway. A small curbed edge and slight berming and significant planting could emphasize the edge and help protect the plant material. A review of plant species spread, condition of existing bed, and setting for the plantings causes us to conclude that plantings should be increased in order to meet City standard of 90% coverage in three years. The colored rendering does not seem to accurately show the capital and base of the column and the seaming, nor to accurately show the color of the mirrored glass being presented.. Two tenant entrances are shown on the rendering without any supporting plans. Please clarify the intent of the rendering. I think it may be confusing for the BAR and for the file to show these unless they are part of the application. We will send a more detailed elevation of the storefront — closer view to reflect what is happening there — it's being developed now to assist the GC. We will also provide a better detail of the columns - what we are planning to do is to square off the columns so that the lower base (approx 6" high concrete) will remain. The capital, round column and the rest of the base would be covered with the alucobond. Concerning the two tenants to the south — Jollibee & Red Ribbon, we have asked the architect to provide the detailed drawings and are copying them here to request that they send their working drawing elevation to us to submit to you. We can assemble a new set rather than expect you to slip sheet changed drawings. I guess hindsight is 20/20 and perhaps I should have sent one set at the beginning until we worked out some of the details.
