The Grantor(s) Corporate Property Investors, a Massachusetts Business Trust, for and in
consideration of the sum of One Dollar ($1.00) in hand paid, receipt whereof is hereby
acknowledged, do hereby grant, sell and convey to the City of Tukwila, Washington, a
municipal corporation, Grantee, its successors and assigns, a perpetual non exclusive
easement and right -of -way over, through, under, across, upon and in the following
described real property situated in King County, Washington, TO -WIT:

Portions of Lots 15 and 16 of the Plat of Southcenter South Industrial. Park as recorded
in Volume 97 of Plats, pages 22 through 25, Records of King County, Washington, being
in the southeast 1/4 and the northeast 1/4 of Section 35 and the southwest 1/4 and the
northwest 1/4 of Section 36, all in T.23N., RAE., W.M., more particularly described as
follows:

Parcel 1

A strip of land 10.00 feet wide lying 5.00 feet on each side of the following described
centerline:
BEGINNING at a point on 'the southerly line of said Lot 16, said point being
N78 11 W 27.00 feet from the southeasterly corner of said Lot 16; thence from said
POINT OF BEGINNING, parallel to the easterly line of said Lots 15 and 16, NI 1
882.02 feet; thence N32 11 W 175.33 feet; thence N27 11 W 170.82 feet; thence
N34 "W 70.73 feet; thence N23 11 W 76.28 feet; thence N35 "W 99.42
feet; thence N38 11 W 32.20 feet to a point hereinafter called "Point All for
reference; thence continuing N38 "W 89.69 feet to a point on the westerly line of
Lot 23 as said lot is shown on City of Tukwila Boundary Line Adjustment No. 88 -1 -BLA
as recorded under Auditor's File No. 8803310838, Records of King County, Washington;
said point being 511 11 W 83.76 feet from the northwesterly corner of said Lot 23,
and the terminus of this centerline. The sidelines of this 10.00 foot strip of land shall
be prolonged or foreshortened to terminate said strip for its full width in said westerly
line of said Lot 23.
Parcel II
A strip of land 45.00 feet wide lying 15 feet easterly and 30 feet westerly of the
following described baseline:
BEGINNING at the hereinbefore described "Point A thence from said POINT OF
BEGINNING N17 11 W 169.00 feet; thence N52 11 E 2.36 feet to a point on the
northeasterly line of said Lot 15; said point being S44 11 E 85.44 feet and
S37 11 E 56.99 feet from the northwesterly corner of said Lot 15, and the terminus
of this baseline. The easterly sideline of this 45 foot strip of land shall be prolonged or
foreshortened to terminate in the northeasterly line of hereinabove Parcel 1 and in the
northeasterly line of Lot 15. The westerly sideline shall be prolonged or foreshortened
to terminate in the northwesterly end of said Parcel 1 and the northeasterly line of said
Lot 15.
Said easement being for the construction, operation, maintenance and /or repair and /or
replacement of underground utility lines and appurtenances thereto, together with the
right -of -way for all purposes necessary and related thereto.

ow This easement is granted with the understanding that upon completion of any work on
the easement, the property affected will be restored as nearly as possible to the
condition in which it was at the commencement of such work. The Grantee also agrees
to indemnify and save harmless the Grantors from any liability or damages (including
costs and attorney's fees) arising from the acts of omissions of Grantee and Grantee's
agents, employees and contractors in the exercise of the rights granted herein.
