T11IS AGREEMENT made this f day of

P__ CITY OF TUKWILA, a municipal corporation of King County,
ID Washington hereinafter termed "Grantee" and

hereinafter termed 'Grantor
WITNESSETH:
That the said Grantor for valuable consideration does
by these presents grant unto the Grantee a perpetual right
of -way or easement for utilities with the necessary appurtenances
through, over and across the following described property
situated in King County, Washington, more particularly described
as follows:
This Utility Easement is through Lot 22, Block 17 of Hillman's
Seattle Garden Tracts as recorded in Volume 11 of Plats, Page 24,
Records of King County, Washington.
This easement consists of a 5 foot permanent strip described
as the masterly 5 feet of said Lot-22.
TOGETHER WITH a 15 foot temporary construction easement des-
cribed as the Easterly 15 feet of said Lot 22.
Said temporary construction easement shall remain in force
during construction and until, such time as the utilities and
appurtenances have been accepted for maintenance and operation
by the City of Tukwila.

Should lots 22 and 23 Block 17, of Hillman's Seattle
Garden Tracts become common ownership, the grantors, their
successors, heirs and assigns, reserve the right to relocate
f at their expense, the water line to the East. Any relocation
shall meet with the approval of The City of Tukwila, and
shall be reconstructed in accordance with the City's mini-
mum standards. Grantors also agree to grant to the, City of
Tukwila a new water line easement along the line asp constructed.

Said heretofore mentioned Grantee shall have the right, without
prior institution of any suit or proceeding at law, at such times
as may be necessary to enter upon said above described property for
the purpose of constructing, repairing, altering or reconstructing
utilities or, making any connections therewith, without incurring any
legal obligation or liability therefor, provided that such construct-
ing, repairing, altering or reconstructing of such utilities shall
be accomplished in such a manner that the fences, lawn shrubbery,
r. drives and walkways and land contours existing in the right -of -way
shall not be disturbed or destroyed, or in the event that they are
disturbed or destroyed, they will be replaced in as good a condition
