HomeMy WebLinkAbout1970 - Easement - Moore Edith / Moore Harry - 66342186634218 E A S E M E N T THIS AGREEMENT made this day of 19�0 by and between the CITY OF TUgILA, a municipal corporation of King County, co Washington hereinafter termed "Grantee" and and hereinafter termed "'Grantor",, his wife, WITNESSETH: That the said Grantor for valuable consideration does by these presents grant unto the Grantee a perpetual right of -way or easement for utilities with the necessary appurtenances .through, over and across the following described property situated in King County, Washington, more particularly described as follows: This Utility Easement is through a portion of Tract 12, of Seattle Land Company's Five Acre Tracts as recorded in Volume 6 of Plats, Page 90, Records of King County, Washington. Said portion is described'as follows: The South 1/2 of said Tract 12. This'easement consists of a 10 foot permanent strip des- cribed as the Easterly 10 feet of said portion of said Tract 12. TOGETHER WITH a 20 foot temporary construction easement des- cribed as the Easterly 20 feet of said portion of said Tract 12. Said temporary construction easement shall remain in force during construction and until such time as the utilities and appurtenances have been accepted for maintenance and operation by the City of Tukwila. Harry Moore Easement No. 23 -2 -17 von 321 PAGE 158 If 0 C Said heretofore mentioned Grantee shall have the right, without prior institution of any suit or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of constructing, repairing, altering or reconstructing utilities or making any connections therewith, without incurring any legal obligation or liability therefor, provided that such construct- ing, repairing, altering or reconstructing of such utilities shall be accomplished in such a manner that the fences, lawn shrubbery, drives and walkways and land contours existing in the right -of -way CV shall not be disturbed or destroyed, or in the event that they are M disturbed or destroyed, they will be replaced in as good a condition .,O as they were immediately before the property was entered upon by the Grantee. The Grantor shall retain the right to use the surface of said ease- ment, so long as said use does not interfere with the installation and maintenance of the utilities and so long as no buildings or structures are erected on said easement.
