Grant(, .».sue a g i+ `.3 p=tilEriy d s c ib e as fo r l' :z s This utility easement is through a portion of the described tract: Parcel (a) That portion of the Stephen Foster Donation Claim No. 38, Town- ship 23 North, Range 4 East W.M., in King County, Washington, described as follows: Beginning at a point and stake in the South line of said Donation Claim, which is 926.45 feet South and 1499.40 feet East of the quarter section corner in the West line of Sectibn 14 of said township; running thence East along the South line of said Donation Claim 444.50 feet, more or less, to a point and stake in the Westerly line of the right -of- way of the Seattle Tacoma Interurban Railway; thence North 44 West along said right of way line 39.53 feet, more or less, to a stake markins the Southeast corner of the tract of land conveyed to Joseph Foster and wife to Philip K. Ahern by deed recorded in Volume 362 of deeds, Page 625, Records of King County; thence West along the South line of said tract 444.50 feet, more or less, to a stake marking the Southwest corner of said tract; thence South 45 ®49' East 39.53 feet, more or less, to the point of beginning; EXCEPT that portion thereof lying North- easterly of a line parallel with and distant 60 ft. Southwesterly of the Westerly line of said right of way of the Seattle Tacoma Inter- urban Railway heretofore conveyed to King County for road purposes; and EXCEPT any lying within Lemon Road (56th Avenue South) as establish- ed; ALSO Parcel (b) That portion of the Stephen Foster Donation Claim No. 38, Town- ship 23 North, Range 4 East W.M., in King County, Washington, described as follows: Beginning at a point in the Westerly line of the right of way of Puget Sound Electric Railway, which point is 49 ft. Northerly from the intersection of said Westerly line with the South line of said Dona- tion Land Claim; thence along said Westerly line North 45 West 512 ft., more or less, to a point 397 ft. Southerly from its intersection following sed VOL 4745. PAGE 310 Page #2 (contd with the Southerly line of an 18 foot lane (now known as South 137th Street); thence South 65® West, 211 ft. more or less, to a point which is 128 ft. North 65° East from the Easterly margin of Lemon Road (56th Avenue South) as established March 9, 1906; thence South 45 °49` East 85 feet; thence South 65 West 128 ft, to a point on said road margin which is South 45 East 541.25 ft. from the Southerly margin of said 18 foot roadway; thence along said Lemon Road, South 45°49' 234 feet, more or less, to an intersection with a line which is parallel to the South line of said Donation Land Claim extending Westerly from the point of beginning; thence Easterly along said parallel line to the point of beginning; EXCEPT the Easterly 60 ft. in width heretofore conveyed to King County for road. This utility easement consists of a 10 foot permanent easement lying 10 feet Northerly of and measured at right angles to the South line of Stephen Foster Donation Claim No. 38, in Township 23 North, Range 4 East W.M., as established by Leonard I. Schroeter, Land Surveyor, on September 3, 1965. TOGETHER WITH a 20 foot temporary construction easement lying 20 ft, Northerly of an5 measured at right angles to the Southerly line of said Donation Claim No 38. All buildings lying within the above described easements are to be excluded from said easements. Grantees herein agree to fully indemnify the Grantors from any claim that may be made by any person against either Grantor or Grantee arising out of the construction, maintenance or use of the said easement, ItAxiadkeart6Whga d teat thEM d 1 It is understood and agreed that there is some dispute as to the exact boundary line along and across the area in which the easement is to run, and in the event that (Burton Lutes Viola mates or their heirs or assigns) should make a claim against Grantors because of the existence of this said easement, then Grantees agree to defend the Grantors in said action and to fully hold them harmless from any claim or judgement which may be rendered as a result of said action.
