DECLARATION OF COVENANT FOR INSPECTION AND
MAINTENANCE OF Sl'ORMWATER FACILITIES AND BMPS
1. Parties
1.1 This Covenant for Inspection and Mailgenance of Stormwater Facilities and Best
Management Practices ("Covenant") is made by and 1 Grantor, and the City of
Tukwila, a Washington Municipal Corporation, as Grantee. GT/Aeon-and Gane (also denoted as City herein)
are each a Party and collectively the Parties to this Agreement.
2. Recitals
PUBLIC VVORKS CONSTRUCTION PERMIT - PW20-0070, ISSUED 12-18-20
DEVELOPMENT PERMIT - D21-0044, ISSUED 8-20-21
2.1 Grantor applied to City for issuance of a [type ofpermit] on , 20_.
2.2 Pursuant to TMC 14.30.060, application for and issuance of such permit requires the property
owner to enter into this Covenant.
2.3 The subject of the Covenant is the real property located in King County, Washington, bearing
King County Tax Parcel No. and legally described in the attached Exhibit A incorporated
herein ("Property"). 336590-0830, -0845, -0850, -0855
2.4 The City approved the applications which consist of the following documents, attached and
incorporated herein:
20-0070 AND 021-00414
2.4.1 City issued Permit No. , Exhibit B.
2.4.2 Stormwater Facility/BMP Site Plan, Exhibit C.
2.4.3 Operations & Maintenance Plan including schedule, Exhibit D.
3. Terms of Agreement
NOW THEREFORE, in consideration of the foregoing recitals and other good and valuable
consideration including approval and issuance of City of Tukwila Permit [number and date], the sufficiency
and receipt of which are acknowledged, Grantor hereby irrevocably covenants as follows:
3.1
Covenant .
The foregoing Recitals and references to documents are incorporated as material terms of this
3.2 The Grantor(s) for itself and its successors in interest having any ownership interest in the
Property (collectively Owners) shall at their sole cost and expense retain, uphold, operate, maintain, and repair
the stormwater facilities and best management practices ("BMPs") located on the Property pursuant to the
schedule within the Operations & Maintenance Plan.
3.3 The obligations required under Section 3.2 above shall be taken consistent the following:
3.3.1 The City shall have the right of ingress and egress over those portions of the Property
necessary to perform inspections of the stormwater facilities and BMPs and conduct other activities specified
in this Declaration of Covenant and in accordance with Tukwila Municipal Code ("TMC") 14.30.80. This
right of ingress and egress, right to inspect, and right to perform required maintenance or repair shall be as
provided for in subsection 3.3.2 below.

3.3.2 If the City determines that maintenance or repair work is required to be done to any
of the stormwater facilities or BMPs, the Director of Public Works or designee (the "Director") shall give
notice of the specific maintenance and/or repair work required pursuant to TMC 14.30.080. The Director shall
also set a reasonable time in which such work is to be completed by the Owner. If the above required
maintenance or repair is not completed within the time set by the Director, the City may perform the required
maintenance or repair, and is hereby granted access to the Property for such purposes. Written notice will be
mailed to the Owner stating the City's intention to perform such work, This work will not commence until at
least seven (7) days after such notice is mailed. If, within the sole discretion of the Director, there exists an
imminent or present danger, the seven (7) day notice period will be waived and maintenance and/or repair
work will begin immediately.
3.4 If at any time the City reasonably determines that a stormwater facility or BMP on the
Property presents an imminent hazard, as identified by TMC 14.30.080 and herein incorporated by reference,
the Director or equivalent municipal successor's official may take measures specified therein.
3.5 The Owner shall assume all responsibility for the cost of any maintenance or repair work
completed by the City as described in Covenant. Such responsibility shall include reimbursement to the City
within thirty (30) days of the receipt of the invoice for any such work performed. Overdue payments will
require payment of interest at the current legal rate as liquidated damages. All such costs and expense shall
constitute a lien against the Property,
3.6 The Owners shall obtain a Type C Public Works permit from the City prior to filling, piping,
cutting, or removing vegetation (except in routine landscape maintenance such as replacement of plants and
pretreatment mulch) in open vegetated stormwater facilities (such as swales, channels, ditches, ponds, etc.),
or performing any alterations or modifications to the stormwater facilities and BMPs referenced in this
Covenant. Prior to the final approval and issuance of the new permit, a new Covenant with updated exhibits
reflecting the changes to the stormwater facilities shall be recorded at the Owner's sole cost, and a copy of the
new recorded Declaration of Covenant provided to the City.
3.7 Any notice or consent required to be given or otherwise provided for by the provisions of this
Declaration of Covenant shall be effective upon personal delivery, or three (3) days after mailing by Certified
Mail, return receipt requested, to the address listed below for that party:

3.8 With regard to the matters addressed herein, this Covenant constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements whatsoever whether
oral or written. This Covenant shall be governed by the laws of the State of Washington. Any suit to enforce
or relating to this Covenant shall only be filed in King County Superior Court, King County, Washington, and
the Parties consent to the jurisdiction thereof In the event of any legal action by either Party relating to this
Covenant, the Parties shall pay their own costs or fees.

3.9 This Covenant is intended to protect the value and desirability of the real property described
in Exhibit A, promote the efficient and effective management of stormwater drainage, and shall inure to the
benefit of all the citizens of the City and its municipal successors and assigns. References herein to the TMC
shall include subsequent amendments to such statutes and all successor statutes.
3.10 This Covenant shall run with the land and shall be binding upon the Owners as defined in
Section 3.2 above.
3.11 This Covenant may be amended or terminated only with the advance express written consent
of the City as determined pursuant to its discretion.

The granting of this permit does not presume to give authority to violate or cancel the provisions of any other
state or local laws regulating construction or the performance of work.
This permit shall become null and veld if the work Is not commenced within 180 days for the date of lssuanca, or If
the work Is suspended or abandoned for a period of 180 days from the last Inspection,
PERMIT CONDITIONS:
17: An exterior electrically supervised post Indicator valve (PIV) must be installed upstream of the fire
department connection (FOC).
1: All valves controlling the water supply for automatic sprinkler systems and waterflow switches on all
sprinkler systems shall be electrically supervised,
2: All piping and attached appurtenances subjected to system working pressure shall be hydrostatically tested
at 200 psi (13.8 bar) or 50 psi (3.5 bar) In excess of the system working pressure, whichever Is greater, and
shall maintain that pressure at /- 5 psi (0.35 bar) for 2 hours. Contact the Public Works Department at 206-
433.0179 to make an appointment. (NFPA 24, sec. 10.10.2.2.1)
3: The fire department connection (FDC) shall have a downward angle bend between 22,5 and 45 degrees,
with a 5 -inch Storz fitting(s) and Knox FDC locking Storz cap. (qty Ordinance 82436)
4: The height of the FDC shall be 36 to 48 Inches above grade.
5: Fire department connections (FDC's) shall be oriented In the direction of fire apparatus access, have a 4
foot clear space In front and to the sides of the connection, be appropriately signed, have the building

12: Hydrants shall not be closer than 4 feat to any fixed object (e.g., fences, parking, building, etc.), with the
exception of hydrant guard posts. Guard Posts shall be Installed around hydrants not protected by curls,
so as to help prevent motor vehicles from contacting the hydrant. The guard posts shall be either steel plpe
(minimum 4" dlstance) filled with concrete or concrete (minimum 8" diameter). Posts shall be 3 feet from
the center of the hydrant and shall not be In direct Ilne with any discharge ports. Posts shall be 6 feat long;
3-31/2 feet shall be burled. Painted finish shall be the same color as for the applicable hydrants. The 4 -

13: When subject to vehicular damage, protective guard posts or curbs are required around all gas meters,

26: The City of Tukwila has an undergrounding ordinance requiring the power, telecommunications, and cable
service lines be underground from the point of connection on the pole to the house.
27; Flagging, elgn(ng and coning shall be In accordance with MUTCD for Traffic Control, Contractor shall
provide certified flagmen for traffic control. Sweep or otherwise clean streets to the satisfaction of Public
Works each night around hauling route (No flushing allowed). Notify Public Works Inspector before 12;00
Noon on Friday preceding any weekend work,
28: Any material spilled onto any street shall be cleaned up Immediately.
29: Hauling 6 loaded vehicles per hour/8 hours a day for 2 or more consecutive days er hauling hazardous
waste shall require application for a Hauling Permit prior to any associated activity.
30: Temporary erosion control measures shall be Implemented as the first order of business to prevent
sedimentation off-site or Into existing drainage facilities.
31: The site shall have permanent erosion control measures in place as soon as passible after final grading has
been completed and prior to the Final inspection.
32: The Land Altering Permit Fee Is based upon an estimated - cubic yards of cut and _ cubic yards of
fill. If the final quantity exceeds this amount, the developer shall be required to recalculate the final
quantity and pay the difference In permit Fee prior to the Final Inspettton.
33; From October 1 through Apr1130, cover any slopes and stockpiles that are 311;1V or steeper and have a
vertical rise of 10 feet or more and will be unworked for greater than 12 hours. During this time period,
cover or mulch other disturbed areas, If they will be unworked more than 2 days. Covered material must
be stockpiled on site at the beginning of this period, Inspect end maintain this stabilization weekly and

34: From May 1 throughSeptember 30, Inspect and maintain temporary erosion prevention and sediment at
least monthly. All disturbed areas of the site shall be permanently stabilized prior to final construction
approval.
35; All private storm drain pipe shalt be either concrete or reinforced ADS pipe, Treated corrugated metal pipe
may be used for detention facilities.
36; The property owner Is responsible for the maintenance of Its storm drainage system and, for this purpose,
shall have a maintenance plan In place and the responsibility for maintenance assigned prior to Public
Works final
37: A double detector check valve assembly is required for the fire lines.
38: The applicant shall Install a Washington State Health Department approved backflow device between the
fire hydrant and the temporary water meter.
39: The water meter box shall be located within City right-of-way at the property line or a recorded utility
easement.
40: All double check valve assemblies shall be approved by the State Department of Health.
41: It shall be verified In writing to the Public Works Inspector that the fire loop system for the building
contains a State Department of Health approved double check detector valve assembly. This shall be done
prior to the Final Inspection.
42: Prior to backfill of pipe and final sl3n off, provide as -constructed plan sheet showing dimensions In relation
to property line and house.
43: It shall be verified In writing to the Public Works Inspector that the landscape Irrigation system contains a
State Department of Health approved double check valve assembly, This shall be done prior to the Final
Inspection.
44: Driveway shall comply with Clty commercial standards. Driveway width shall be a Z5' minimum and 35'
maximum. Slope shall be a maximum of 15%. Turning radii shall be a minimum of 10'.
45: Geotechnical Engineer/Solis Engineer shall provide certification of trench backfill to the Public Works
Inspector. Trench backfill shall be per 2012 WSDOT Standard Specifications for Road, Bridge, and Municipal
Construction. (No native backfill unless approved by the City Engineer.)
46: Maintain emergency, pedestrian, and vehicular access to buildings, trails and transit at all times,
47: Construction equipment shall be kept off of existing 5 foot wide pedestrian path, es much as possible, to
avoid damage of asphalt

Plan Goal
The goal of the plan is to treat all on-site runoff for water quality by directing flows to a modular wetland
and through a storm detention vault prior to discharge to the public system along Interurban Ave S.
Preventative BMP's
The catch basins shall have stenciled next to them "DUMP NO WASTE -DRAINS TO STREAM". Activity
that involves pollutants shall be done under a covered area. The private driveways and parking lot shall
be cleaned and swept as necessary to remove debris.
Inspection
Inspect the stormwater system and clean out catch basins at least twice a year, especially after periods of
heavy runoff. Maintenance records must be kept for five (5) years and available for City Inspector review.
The modular wetland shall be maintained as recommended by the manufacturer.

from stormwater runoff. Impervious surfaces and other urban and suburban landscapes generate a variety of
contaminants that can enter stormwater and pollute downstream receiving waters unless treatment Is provided.
The BloPod system uses proprietary StormMix"' biofiltration media to capture and retain pollutants Including
total suspended solids (TSS), metals, nutrients, gross solids, trash and debris as well as petroleum hydrocarbons.
Function
The BloPod system uses engineered, high-flow rate filter media to remove stormwater pollutants, allowing for a
smaller footprint than conventional bloretentlon systems. Contained within a compact precast concrete vault, the
BloPod system consists of a blofiltration chamber and an optional integrated high-flow bypass with a contoured
Inlet rack to minimize scour. The blofiltration chamber is filled with horizontal layers of aggregate (which may or
may not include an underdraln), blofiltration media and mulch, Stomiwater passes vertically down through the
mulch and biofiltration media for treatment. The mulch provides pretreatment by retaining most of the solids or
sediment. The blofiltration media provides further treatment by retaining finer sediment end dissolved pollutants.
The aggregate allows the media bed to drain evenly for discharge through an underdraln pipe or by Infiltration.
Configuration
The BloPod system can be configured with either an internal or external bypass. The Internal bypass allows both
water quality and bypass flows to enter thetreatment vault. The water quality flows ere directed to the blofiltration
chamber while the excess flows are diverted over the bypass welrwithout entering the biofiltration chamber. Both
the treatment and bypass flows are combined In the outlet area prior to discharge from the structure. BloPod
units without an Internal bypass are designed such that only treatment flows enter the treatment structure. When
the system has exceeded Its treatment capacity, ponding will force bypass flows to continue down the gutter to
the nearest standard catch basin or other external bypass structure.
The BloPod system can be configured as a tree box filter with tree and grated inlet, es a planter box filter with
shrubs, grasses and an open top, or es an underground filter with access risers, doors and a subsurface Inlet
pipe. The optional internal bypass may be Incorporated with any of these configurations. In addition, an open
bottom configuration may be used to promote Infiltration and groundwater recharge. The configuration and size
of the BloPod system Is designed to meet the requirements of a specific project.
Inspection & Maintenance Overview
State and local regulations require all stormwater management systems to be Inspected on a regular basis and
maintained as necessary to ensure performance and protect downstream receiving waters. Without maintenance,
excessive pollutant buildup can limit system performance by reducing the operating capacity of the system and
Increasing the potential for scouring of pollutants during periods of high flow.
Some configurations of the BioPod may require periodic irrlgatlontoestablish and maintain vegetation. Vegetation
will typically become established about two years after planting. Irrigation requirements are ultimately dependent
on climate, rainfall and the type of vegetation selected.

Maintenance Frequency
Periodic Inspection Is essential for consistent system performance and Is easily completed. tnspectlon Is
typically conducted a minimum of twice per year, but since pollutant transport and deposition varies from site to
site, a site-specific maintenance frequency should be established during the first two or three years of operation.
Inspection Equipment
The fallowing equipment Is helpful when conducting BloPod inspections;
• Recording device (pen and paper form, voice recorder, !Pad, etc.)
• Suitable clothing (appropriate footwear, gloves, hardhat, safety glasses, etc.)
• Traffic control equipment (cones, barricades, signage, flagging, etc.)
• Manhole hook or pry bar
• Flashlight
• Tape measure
Inspection Procedures
BioPod Inspections are visual and are conducted without entering the unit. To complete an Inspection, safety
measures Including traffic control should be deployed before the access covers or tree grates are removed. Once
the covers have been removed, the following Items should be checked and recorded (see form provided on page 6)
to determine whether maintenance Is required:
• If the BloPod unit Is equipped with an internal bypass, Inspect the contoured inlet rack and outlet chamber
and note whether there are any broken or missing parts. In the unlikely event that Internal parts are broken
or missing, contact Oldcastle Infrastructure at (800) 579.8819 to determine appropriate corrective action.
• Note whether the curb Inlet, inlet pipe, or - if the unit Is equipped with an Internal bypass - the Inlet rack Is
blocked or obstructed.
• If the unit is equipped with an intemai bypass, observe, quantify and record the accumulation of trash and
debris In the Inlet rack. The significance of accumulated trash and debris Is a matter of Judgment. Often,
much of the trash and debris may be removed manually at the time of Inspection If a separate
maintenance visit Is not yet warranted.
• If It has not rained within the past 24 hours, note whether standing water Is observed In the biofiltration
chamber.
• Finally, observe, quantify and record presence of Invasive vegetation and the amount of trash and debris
and sediment load In the bioflltratlon chamber. Erosion of the mulch and biofiltration media bed should
also be recorded. Sediment load may be rated Tight, medium or heavy depending on the conditions.
Loading characteristics may be determined as follows:
o Light sediment load - sediment is difficult to distinguish among the mulch fibers at the tap of the
mulch layer; the mulch appears almost new.
o Medium sediment load - sediment accumulation is apparent and may be concentrated In some areas;
probing the mulch layer reveals lighter sediment loads under the top 1" of mulch.
o Heavy sediment load - sediment Is readily apparent across the entire top of the mulch layer; individual
mulch fibers are difficult to distinguish; probing the mulch layer reveals heavy sediment load under the
top 1" of mulch.
Often, much of the invasive vegetation and trash and debris may be removed manually at the time of inspection
if a separate maintenance visit Is not yet warranted.

Maintenance Indicators
Maintenance should be scheduled If any of the following conditions ere Identified during Inspection:
• The concrete structure is damaged or the tree grate or access cover is damaged or missing,
• The curb Inlet or Inlet rack Is obstructed,
• Standing water is observed In the biofiltration chamber more than 24 hours after a rainfall event (use
discretion if the BioPod Is located downstream of a storage system that attenuates flow).
• Trash and debris In the inlet rack cannot be easily removed at the time of Inspection.
• Trash and debris, Invasive vegetation or sediment load In the biofiltration chamber is heavy or excessive
erosion has occurred.
Maintenance Equipment

Maintenance Procedures
Maintenance should be conducted during dry weather when no flows are entering the system. All maintenance
may be conducted without entering the BloPod structure. Once safety measures such as traffic control are
deployed, the access covers may be removed and the following activities may be conducted to complete
maintenance:
• Remove ell trash and debris from the curb Inlet and Inlet rack manually or by using a vacuum truck as
required.
• Remove all trash and debris and Invasive vegetation from the blofiltratlon chamber manually or by using a
vacuum truck as required.
• If the sediment load Is medium or light but erosion of the biofiltration media bed Is evident, redistribute
the mulch with a rake or replace missing mulch as appropriate. If erosion persists, rocks may be placed In
the eroded area to help dissipate energy and prevent recurring erosion.
• If the sediment Toad Is heavy, remove the mulch layer using a hoe, rake, shovel and bucket, or by using a
vacuum truck as required. If the sediment load is particularly heavy, Inspect the surface of the biofiltration
media once the mulch has been removed, If the media appears clogged with sediment, remove and
replace one or two Inches of biofiltration media prior to replacing the mulch layer.
• Prune vegetation as appropriate and replace damaged or dead plants as required.
• Replace the tree grata and/or access covers and sweep the area around the BloPod to leave the site clean.
• All material removed from the BloPod during maintenance must be disposed of In accordance with local
environmental regulations, In most cases, the material may be handled In the same manner as disposal
of material removed from Bumped catch basins or manholes.

Natural, shredded hardwood mulch should be used In the BioPod. Timely replacement of the mulch layer
according to the maintenance Indicators described above should protect the biofi tration media below the
mulch layer from clogging due to sediment accumulation. However, whenever the mulch Is replaced, the
BloPod should be visited 24 hours after the next major storm event to ensure that there Is no standing water
In the biofiltration chamber. Standing water Indicates that the biofiltration media below the mulch layer Is
