NOTICE OF UNSAFE, UNLAWFUL, OR
UNFIT TO OCCUPY STRUCTURE
WARNING: This structure is hereby declared to be unsafe, unlawful, and/or
unfit for human occupancy. As the owner(s), owner's authorized agent(s), or
person(s) responsible for this structure, you are hereby required to complete
tasks listed in the "Corrective Action Required" section below no later than the
stated deadline. If you fail to comply, the City may condemn this structure and
order the structure to be immediately vacated and boarded. In addition, the
City may institute other proceedings at law or in equity to restrain, correct, or
abate the violation. Any action taken by the City shall be charged against the
real estate which the structure is located and shall be a lien upon such real
estate.
Any person directly affected by this decision, may appeal this decision by
requesting such appeal within 10 calendar days after being served with the
decision. The request shall be in writing and include the applicable appeal fee
as specified in the City's fee schedule adopted by resolution of the City
Council as set forth in TMC Chapter 8.45. Appeals must be sent to the City
Clerk's office.
CODE VIOLATIONS:
• 2015 International Property Maintenance Code ("IPMC") 304.1 General.
The exterior of a structure shall be maintained in good repair,
structurally sound and sanitary so as not to pose a threat to the public
health, safety or welfare.
• IPMC 304.1.1 Unsafe conditions. The following conditions shall be
determined as unsafe and shall be repaired or replaced to comply with

the International Building Code or the International Existing Building
Code as required for existing buildings:
4. Siding and masonry joints including joints between the building
envelope and the perimeter of windows, doors and skylights are not
maintained, weather resistant or water tight;
5. Structural members that have evidence of deterioration or that are not
capable of safely supporting all nominal loads and load effects;
7. Exterior walls that are not anchored to supporting and supported
elements or are not plumb and free of holes, cracks or breaks and loose
or rotting materials, are not properly anchored or are not capable of
supporting all nominal loads and resisting all load effects;
8. Roofing or roofing components that have defects that admit rain, roof
surfaces with inadequate drainage, or any portion of the roof framing
that is not in good repair with signs of deterioration, fatigue or without
proper anchorage and incapable of supporting all nominal loads and
resisting all load effects;
9. Flooring and flooring components with defects that affect
serviceability or flooring components that show signs of deterioration or
fatigue, are not properly anchored or are incapable of supporting all
nominal loads and resisting all load effects;
IPMC 304.2 Protective treatment. Exterior surfaces, including but not
limited to, doors, door and window frames, cornices, porches, trim,
balconies, decks and fences, shall be maintained in good condition.
Exterior wood surfaces, other than decay -resistant woods, shall be
protected from the elements and decay by painting or other protective
covering or treatment. Peeling, flaking and chipped paint shall be
eliminated and surfaces repainted. Siding and masonry joints, as well as
those between the building envelope and the perimeter of windows,
doors and skylights, shall be maintained weather resistant and water
tight. Metal surfaces subject to rust or corrosion shall be coated to
inhibit such rust and corrosion, and surfaces with rust or corrosion shall
be stabilized and coated to inhibit future rust and corrosion. Oxidation
stains shall be removed from exterior surfaces. Surfaces designed for
stabilization by oxidation are exempt from this requirement.
IPMC 304.4 Structural members. Structural members shall be maintained
free from deterioration and shall be capable of safely supporting the
imposed dead and live loads.

• IPMC 304.6 Exterior walls. Exterior walls shall be free from holes, breaks,
and loose or rotting materials; and maintained weatherproof and
properly surface coated where required to prevent deterioration.
• IPMC 304.7 Roofs and drainage. The roof and flashing shall be sound,
tight and not have defects that admit rain. Roof drainage shall be
adequate to prevent dampness or deterioration in the walls or interior
portion of the structure. Roof drains, gutters and downspouts shall be
maintained in good repair and free from obstructions. Roof water shall
not be discharged in a manner that creates a public nuisance.
IPMC 304.13 Window, skylight and door frames. Every window, skylight,
door and frame shall be kept in sound condition, good repair and
weather tight.
IPMC 305.1 General. The interior of a structure and equipment therein
shall be maintained in good repair, structurally sound and in a sanitary
condition....
IPMC 305.3 Interior surfaces. Interior surfaces, including windows and
doors, shall be maintained in good, clean and sanitary condition.
Peeling, chipping, flaking or abraded paint shall be repaired, removed or
covered. Cracked or loose plaster, decayed wood and other defective
surface conditions shall be corrected.
• IPMC 305.6 Interior doors. Every interior door shall fit reasonably well
within its frame and shall be capable of being opened and closed by
being properly and securely attached to jambs, headers or tracks as
intended by the manufacturer of the attachment hardware.
IPMC 308.1 Accumulation of rubbish or garbage. Exterior property and
premises, and the interior of every structure, shall be free from any
accumulation of rubbish or garbage.
OBSERVED CONDITIONS:
1. Siding throughout the house has deteriorated significantly which
includes but limited to paint chipping, rotted or missing siding, missing
siding which allowed the interior structure to rot and become open to
weather.
2. Structural members / ceiling joists have evidence of deterioration and
the drywall ceiling has collapsed due to rot since the roof is open which
allows all weather conditions access to the interior of the house.

3. Exterior walls are not plumb, numerous holes for insulation have not
been sealed, cracks or breaks and loose or rotting materials.
4. Exterior surfaces, including but not limited to, doors, door and window
frames, porches, trim, have deteriorated to a point where the doors and
windows have become out -of -plumb and do not open or closed tightly.
5. Roofing or roofing components have defects that admit rain and roof
surfaces with inadequate drainage.
6. Flooring and flooring components with defects and signs of
deterioration.
7. Interior walls and ceilings have detached / broken due to the deteriorated
roof allowing rain and snow into the the house.
8. Severe black mold throughout the house.
9. No potable water. (Water meter has been turned off and locked.)
10. Rubbish and garbage strewn throughout the house.
11.Multiple dying or dead trees and overgrowth located in the rear yard.
CORRECTIVE ACTION REQUIRED:
1. Immediately board all windows, doors, and any other openings into the
house. Once boarding is complete, maintain the house to this standard
at all times. If the boarding is damaged or removed, repairs or complete
plywood replacement must be performed immediately.
Corrective Action Deadline: IMMEDIATELY
2. Obtain a Building Demolition permit for the structure on the property.
(To obtain a permit, you must submit a complete permit application and
plans for the demolition of the house.) After receiving said permit,
conduct a pre -demolition on-site meeting with appropriate City staff,
and, once given approval to proceed, complete demolition of the
structure and remove all debris from the site within ten (10) days of the
start of demolition.
Corrective Action Deadline: Obtain a building demolition permit no later
than May 20, 2022. Complete demolition of the structure and remove all
debris no later than June 20, 2022

3. Remove all dead trees, overgrowth, rubbish and garbage from the entire
property. Once the property is brought into compliance, maintain the
property to this standard at all times.
