EASEMENT
KNOW ALL IMMi BY THESE PRFMIMTS, that PANSY
CAMPBELL RATHVON and H F RATHVON, her husband,
for and in consideration of the sum of One Dollar ($1.00).
in hand paid by the Town of Tukwila a municipal corporation
organized under the laws of the State of Washington, and other
valuable considerations, do hereby grant and convey unto said
Town of Tukwila, its successors and assigns, a right of way
over the property hereinafter described for any water pipes or
mains which may be laid by said Town of Tukwila, and the right
to maintain such water pipes or mains, including the use of
so much land as is necessary in laying down and maintaining
such pipes or mains, and the right to enter into and upon the
lands, hereinafter described for the purpose of laying and
maintaining said pipes or mains, and also at all times in the
future for the purpose of repairing, inspecting and maintain-
ing said pipes or mains; provided, that in no case shall such
pipes or mains interfere with the proper cultivation of the
lands of the parties hereto. The easement herein referred to
is particularly described as follows:
An easement 10 feet wide across the middle -third
of the south 1/2 of the S. E. 1/4 of the N. E. l/4 of
the N. E. 1/4 of Soo. 14 T. 23 No R. 4 E. The said
easement lied one -half on each side of the pipe line,
the base line of said pipe line is described as follows:
Commencing at a point on the section line dividing see
tions 13 rind 14 T. 23 N. R. 4 which said point is
930.47 feet South "0" degrees 13' 09" W. from the oornor
common to sections 11, 12, 13 and 14 To 23 N. R. 4 E.
and is the zero or initial point of the base. The line
bears thence South 44 degrees 18' 43" W. for a distance
of 3643.59 feet, more or less, to a point on the norther-
ly line of "Hillman's Seattle Garden Tracts filed for
record November 30th, 1903. The said point lies on the
northerly line of Edward Street and is 10 feet East of
the East line of Lot 13, Block 9 of the said plat, ex-
tended North. The base line as described cuts the east
line of the tract 173 feet, more or less, north of the
5. E. corner of the traot, and outs the south line 170
feet, more or less, West of the S. E. corner of the tract,
all being in King County, Washington.

As a pert of the consideration for the granting
of said easement, the said Town. of Tukwila agrees that when
said water mains are laid across the above described lands 0

of the parties hereto, And does furth ag ree that if the
parties hereto should desire to use water from such main
through such tap or oonneetion, said Toss, will charge for
the use of such water as may be used from such tap or con
necstlon, the samo rate as paid by such Town to the City of
Seattle,
Said Town of Tukwila does farther agree that if
at any time after said water maaias are la M across said above
deseribeed lands it shall be determined that the same interfere
with the oonstruotion of buildings on said laands said Fawn
will, at its own expense, consa :said mains to be moved so as
not to interfere with such construction*
It is further understood and agreed that the right
of the parties hereto to use scatter from the mains as laird
across said above described lands shall be limited to the ex-
tent that such use shall not interfere with the distribution
of wafter within the corporate limits of they Town. of Tukwd:la,
and shou14 the Town of Takwila at any time require the use
of all of the water passing through said mains for the in-
habitants residing within the corporate boundaries of said
Town, then said Town shall have the right to discontinue the
use of any water from suoh mains by the parties hereto.
