The Hearing Examiner viewed the site on April 10, 2017. EXHIBITS: The following exhibits were entered into the record: 1. Department's staff report with Attachments A-C. Introduction The applicant seeks a conditional use permit to allow a school facility within a Low Density Residential zone. A public hearing was held on the application on April 10, 2017, at the Department of Community Development, 6300 Southcenter Boulevard, Tukwila, WA. Represented at the hearing were: the Department, by Maxwell Baker, Assistant Planner ("City"); and the applicant, Tukwila School District ("District."), by Lisa Klein. No members of the general public testified at the hearing. For purposes of this decision, all section numbers refer to the Tukwila Municipal Code ("TIVMC" or "Code") unless otherwise indicated. After considering the evidence elicited L17-0008 FINDINGS AND DECISION Page:2 of 4 during the appeal hearing, the Hearing Examiner enters the following findings of fact, conclusions, and decision on the application. Findings of Fact 1. The subject site is addressed as 13601 32nd Ave S ("Property"). The site is a 286,625 square foot lot. The site is developed with a 56,593 square foot building that has historically been and continues to be used for the Cascade View Elementary School ("School"). The original School was built in 1958. The current applicant is for a 2,257 square foot expansion of the cafeteria, interior improvements, and exterior improvements such as fencing, roof replacement, security gates and sidewalk repair. 2. The use of the Property for the School will remain unchanged. The proposed additions to the building will serve the student population by maintaining and repairing existing educational facilities, increase security, and allow for greater seating capacity in the cafeteria to reduce the number of staggered lunch times during the school day. The proposal does not include any changes to parking or landscaping. Fencing that is included in the proposal for a portion of the Property to the south will be placed in order to maintain an existing pedestrian foot path for the public. 3. The subject property is located on 32nd Avenue S. S 136th Street and S 137th Street terminate at 32nd Avenue in front of the school. All surrounding properties are zoned Low Density Residential. Properties to the north, west, and east across 32nd Avenue are developed with single family housing. Properties to the south are occupied by a veterinary clinic, food bank, cemetery, and single family homes. 4. The proposed alterations will comply with height limitations for the Low Density Residential zone. 5. The proposal will create no change in traffic circulation for surrounding land uses, because the proposal is an alteration of an existing school use that is not anticipated to increase student attendance as a result of the proposal. 6. The Property is zoned Low Density Residential. Schools are allowed as a conditional use within the Low Density Residential zone. TMC Title 18 Table 3. 7. The criteria for granting of a conditional use permit are set forth in TMC 18.64.050: (1) the proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity; (2) the proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy; (3) the proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; (4) the proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan; and (5) all measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. L16-0077 FINDINGS AND DECISION Page 3 of 4 8. No public comments were received concerning the proposal. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.104.010.3, which provides that a decision on a conditional use permit application is a quasi-judicial decision by the Hearing Examiner. 2. The proposal will not be injurious to the property or improvements in the vicinity, because the proposal is for alterations that are consistent with the existing uses (e.g. roof replacement, and fencing), are largely interior to the existing structure (e.g. the cafeteria expansion), and/or will not noticeably alter the property and will not affect improvements in the vicinity. The proposed use will not be materially detrimental to the public welfare, because the proposed use is consistent with the existing school use of the Property for the School, and where necessary the proposed alterations are designed to reduce impacts to the public. For example, fencing installed around the playground area in the southern portion of the Property will accommodate an existing public path. Further, aspects of the proposal are directed at improving the safety of the School environment, and this is an enhancement to the public welfare. 3. The existing parking, landscape, and other onsite elements conform to the Code, and will not change from current conditions. Therefore, the proposal will meet or exceed the same standards for parking, landscaping yards and other development regulations that are required in the district it will occupy. 4. The proposed use is compatible with the surrounding land uses. The Property has been utilized as a school since 1958, and that use for the Property is fully integrated into the surrounding land uses. 5. The proposal is consistent with the goals and policies of the Tukwila Comprehensive Land Use Policy Plan. According to the Tukwila Comprehensive Plan, the Low Density Residential land use designation is primarily characterized for single- family residential structures, as well as educational and institutional uses. The proposed use is part of the District's campus, and is consistent with the purpose of the Low Density Residential zone. The proposal is consistent with the goals and policies of the Residential Neighborhood Element of the Comprehensive Plan, including Goal 7.2 which calls for neighborhood quality, and Goal 7.3 which call for educational attainment. An implementation measure of Tukwila's Economic Development goals (Element 2) is to collaborate with local school districts to improve the educational opportunities for Tukwila schoolchildren. The proposal is important in supporting the educational opportunities for students. L17-0008 FINDINGS AND DECISION Page 4 of 4 6. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area. As indicated above, the use of the Property for school uses is compatible with the long-established use of the Property. 7. The application meets all criteria for a conditional use permit, and should be approved. Decision The Conditional Use Permit is hereby GRANTED. Entered this 11t" day of April 2017. The building itself was constructed in 1958, with additions created through the years. The proposal calls for a 2,257 sq. ft. expansion to the school's cafeteria, which will include a new walk-in freezer and storage space. Interior improvements are to include new office space through reconfiguration of interior areas, as well as replacement of flooring throughout. Exterior improvements include replacement of the existing roof and site improvements including a new outdoor generator, site fencing, security gates and sidewalk repair. See Attachment B. Surrounding Land Uses The subject property is located along 32nd Ave S in Tukwila. Streets S 136th St and S 137 St. terminate at 32nd Ave in front of the school. All surrounding parcels are zoned Low Density Residential and mainly contain single family zones. Parcels to the south and east of the site include Riverton Park United Methodist Church and the Riverton Crest Cemetery. See Attachment A. Conditional Use Permit Criteria The proposed project must comply with criteria detailed in the Conditional Use Permit Chapter of the Tukwila Municipal Code (TMC 18.64.050). The property is zoned Low (Density Residential and schools are listed as a conditional use. The applicant's response to the conditional use permit criteria is Attachment C to this staff report. Staff makes the following findings using the Code's conditional use permit criteria (TMC 18.64.050) listed in italics: 1., The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The use of Cascade View Elementary as a school will remain unchanged. The additions proposed are to better serve the students by maintaining and repairing the educational facilities•and allowing for greater seating area in the cafeteria to reduce the number of staggered lunch times throughout the day. The improvements will not substantially alter the function of the site, and the building increase is minimal. No site changes such as landscaping or parking are proposed, and the project is not expected to generate any adverse effects on the property or adjacent uses. The project is part of the of the Tukwila School District's approved 2016 $99.16 million Construction Bond. 2. The proposal calls for a 2,257 sq. ft. cafeteria expansion that will not exceed height limits for the Low Density Residential zone. Fencing improvements will fully enclose the site and will not interfere with the existing pedestrian path located along the frontage. The existing parking, landscape and other onsite elements conform to the Tukwila Municipal Code development regulations and will not change from current conditions. There are no requested deviations from the adopted development standards. The building meets minimum setbacks per TMC 18.10.060. The site meets/exceeds perimeter landscaping standards set in TMC 18.52. 3. The proposed use shall be compatible generally with the surrounding land uses. The exterior improvements, cafeteria expansion, and interior improvements/alterations are not expected to create any nuisances such as noise pollution or Tight pollution. According to the Tukwila Comprehensive Plan, education and institutional uses are compatible with single-family areas. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. Cascade View Elementary is within a residential area and is a central part of the neighborhood character. Per the Tukwila Comprehensive Plan, the LDR land use designation is primarily characterized for single-family residential structures, as well as education and institutional uses. The proposed use is consistent with the purpose of the LDR zone. With the proposed building addition, the school will remain consistent with the goals and policies of the Residential Neighborhoods Element of the Comprehensive Plan, such as neighborhood quality (Goal 7.2) and educational attainment (Goal 7.3). The proposal will also not cause any undue noise impacts (Goal 7.8), as the new cafeteria expansion will be used for storage and office space. The Comprehensive Plan's Capital Facilities chapter requires adequate public facilities to service development in the City, which would include facilities for public schools. The proposed expansion is intended to improve the operation of Cascade View Elementary. The Tukwila Comprehensive Plan calls for growth, and as Tukwila schools modernize and expand, expansions such as the one proposed are needed to support students, staff, and faculty. 5. All measures shall be taken to minimize the possible adverse impacts which (sic) the proposed use may have on the area in which it is located. The existing use of the site as a school, as well as enrollment or capacity, will not change with this proposal. No adverse impacts on the surrounding area are expected to occur. Conclusions 1. Exterior improvements consist largely of maintenance projects and improvements to existing features such as perimeter fencing. No changes are proposed for the building's setback, its parking area, or landscaping. 3. The proposed use will be compatible with the surrounding land uses. 4. The proposed use will not conflict with the goals and policies of the Comprehensive Plan. The project site is located within Parcel No. 1623049038 and 7346600024 at Cascade View Elementary School Tukwila, Washington. The parcels total 8.5 acres. The project site is approximately 0.10 acre. The "Vicinity Map" depicts the site location in Figure 1-2, attached to this report section. The proposed project includes construction of a building addition, re -roofing, new and relocated site accessories. The site area specifically includes the building addition, which is the only source of land disturbance with new and replaced impervious surface area. This building addition is located in the southwest quadrant of the parcel, between Buildings A and B. Demolition includes approximately 675 square feet of existing concrete and 1,325 square feet of existing landscaping. Stormwater conveyance within the building envelope will be replaced with a new storm drain encased in ductile iron. Stormwater flows will be routed to an existing detention facility located east of the building addition, matching the existing drainage pattern. Stormwater management is to comply with the 2016 King County Surface Water Design Manual (KCSWDM) as adopted by City of Tukwila. 1.2 Existing Conditions The existing developed parcel includes a northern terrace currently occupied by the existing school, playgrounds, and asphalt parking Tots along the north and east sides of the property, and a higher southern terrace occupied by a pervious athletic field. Covered concrete walks provide pedestrian access to the separate buildings. The 32nd AVE South right-of-way provides ingress and egress to the property. The overall topographic relief across the site is 33 feet. Sloped landscaping between the existing paved playground and the existing athletic field provides 6 feet of grade change. Refer to the "Existing Conditions Map," Figure 1-3a. The project area is small portion of the existing developed parcel. The existing condition of the project area proposed for redevelopment is a landscaped courtyard surrounded by a covered concrete walkway. A water line, concrete swale, and storm conveyance system cross the landscaped courtyard from west to east. The courtyard slopes towards its center, where a grated catch basin routes the stormwater away from the project site, towards the existing flow control facility. The concrete walks to the west and south sheet flow towards the midpoint of the courtyard. The eastern walk slopes east to the adjacent parking lot, where the stormwater enters the conveyance system. Stormwater runoff discharges into an underground ftow control facility, located underneath the main entry driveway and parking, east of the project site. The proposed project site drains to this singular discharge point, referred to as "Threshold Discharge Area A" (TDA A). According to the King County Soil Survey (Figure 1-4), the site soils consist of till deposits. 1.3 Developed Conditions The project proposes the construction of an addition to building B. The addition is located in the courtyard between Building A and B. Stormwater improvements include roof drains, foundation drains, and replacement of the drainage pipe. The portion of the storm pipe in the building's footprint will be replaced with a new 12" PVC line and encased in 18" ductile iron. The building addition's roof downspouts tee into the proposed storm line. The foundation drains connect to a Technical Information Report School Addition 1-1 0000 new catch basin. The conveyance system discharges to the existing conveyance system located east of the project area. Downstream of the project site, stormwater it is routed to the existing flow control facility, which discharges to the public storm system serving 32nd Avenue South. The project site area is 4,200 square feet, with 1,325 square feet of new and 1,500 square feet of replaced non -pollution generating impervious area. Figure 1-3b, titled "Developed Conditions Map' depicts these areas. The project site's developed drainage patterns are analyzed and discussed in further detail in Section 4.0, Flow Control, Low Impact Development (LID), and Water Quality Facility Analysis and Design. In the existing conditions, stormwater runoff sheet flows towards the center of the courtyard's catch basin, STCBs 2368, which drains to an existing flow control facility. The flow control facility discharges to the city storm system within 32nd Avenue South. In the developed conditions, the roof runoff, foundation drains, and upstream flows are captured by the replaced conveyance system. The conveyance system discharges to the existing storm drain, where it continues to flow east to the existing flow control facility, and therefore continuing to discharge at its natural location. 2.2.2 CR 2 — Offsite Analysis The discharge location of the project site is from a flow control structure located at the northeast corner of the site. This structure hydraulically connects to the existing detention facility located under the entry parking lot located adjacent to the east property line, where the existing site catch basins and area drain discharge as well. In the developed condition, the storm runoff flows to the same existing structures connected to the existing detention facility; therefore, there is no change in runoff to the detention facility. This project constructs 1,325 square feet of new impervious surface area. Per Section 1.2.2 Exception Requirement 2 in the KCSWDM, the proposed project is exempt from Core Requirement #2 if the project adds Tess than 2,000 square feet of new impervious surface, and less than 3/4 acres of new pervious surface. Because the project constructs less than 2,000 square feet of new impervious surface, this project is exempt from Core Requirement #2. AHBL staff walked the downstream and field inspected the area. The downstream path was found to be well defined with no signs of erosion or sedimentation. No signs of flooding or overtopping of the downstream were observed. No downstream complaints were reported downstream of the project site. The project will not create or aggravate potential downstream problems. 2.2.3 CR 3 — Flow Control The Cascade View Elementary School is exempt from Core Requirement 3 because the project meets the basic exemption of the following: 1. Less than 5,000 square feet of new plus replaced impervious surface will be created, and 2. Less than 0.75 acre of new pervious surface will be added. This project creates 2,825 square feet of new plus replaced impervious surface area and therefore flow control is not required. See Figure 1-3b, Developed Conditions Map for areas. 2.2.4 CR 4 — Conveyance System Conveyance systems will be designed and analyzed per Chapter 4 of the KCSWDM. The conveyance system will be designed to convey the 25-year peak flow and convey as much of the Technical Information Report School Addition 2-1 DWB� 100-year peak flow to prevent erosion and flooding. Any overflow from the conveyance system will overtop the control structure and discharge to the natural location of the project site. 2.2.5 CR 5 — Erosion and Sediment Control An erosion and sediment control plan will be developed for this site in accordance with the KCSWDM and the King County Sformwater Pollution Prevention Manual (KCSPPM). The full erosion and sediment control plan will be described further in Section 8.0 and in the project plans. 2.2.6 CR 6 — Maintenance and Operations The onsite drainage facilities are privately maintained by Tukwila Public Schools. An Operations and Maintenance manual will be provided in Section 10.0. 2.2.7 CR 7 — Financial Guarantees and Liability A Bond Quantity Worksheet will be provided, if requested by the City, at building permit submittal. 2.2.8 CR 8 — Water Quality The project site is exempt from Core Requirement 8„ The project site meets the surface area exemption, Exemption 1. The project site meets the following criteria: 1. Less than 5,000 square feet of new plus replaced pollution generating impervious surface (PGIS) that is not fully dispersed will be created, and 2. Less than 0.75 acre of new pollution generating pervious surface (PGPS) that is not fully dispersed will be added. This project does not include any new or replaced pollution generating impervious area, and therefore water quality is not required. 2.2.9 CR 9 — Flow Control BMPs Flow control Best Management Practices (BMPs) will be evaluated to meet the core requirements. The project falls under the requirements for Large Lot BMP; see Section 4.0. 2.3 Special Requirements 2.3.1 SR 1 — Other Adopted Area -Specific Requirements The project site discharges to the Duwamish River approximately 1.2 miles downstream from the project site. Technical Information Report School Addition 3-1 01200 Section 4 Flow Control, Low Impact Development (LID) and Water Quality Facility Analysis and Design Technical Information Report School Addition A 1200 4.0 Flow Control, Low Impact Development (LID), and Water Quality Facility Analysis and Design 4.1 Flow Control 4.1.1 Existing Site Hydrology (Part A) The existing project site consists of a courtyard with approximately 2,750 square feet of impervious surface and 1,450 square feet of pervious surface. The storm runoff from the concrete walks, concrete swale, and landscaping sheet flows to the catch basin located at the center of the courtyard (STCB 2368). The catch basin discharges flows east in a storm pipe that eventually connects to an existing stormwater flow control facility located 75 linear feet east of the project site. The entire site connects into the same TDA, TDA 1. See Figure 4-1. 4.1.2 Developed Site Hydrology (Part B) The developed site will construct a building where the landscaped courtyard currently sits. The existing impervious and pervious surfaces within the building footprint will be demolished to accommodate the proposed design. The total developed impervious surface area is 4,200 square feet of new roof area and existing covered concrete walk. The developed site hydrology includes supporting infrastructure for the new addition; roof drains, footing drains, and storm improvements. A portion of the storm pipe in the building's footprint will be replaced with a new 12" PVC line and encased in 18" ductile iron. The building addition's roof downspouts tee into the proposed storm line. The foundation drains connect to a new catch basin. The conveyance system discharges to the existing conveyance system located east of the project area. Downstream of the project site, stormwater it is routed to the existing flow control facility, which discharges to the natural discharge point located at the public storm system serving 32nd Avenue South. The conveyance system will meet the requirements of the KCSWDM. Calculations will be provided with the building permit submittal. See Figure 4-2. 4.1.3 Performance Standards (Part C) Area -Specific Flow Control Facility Standard This project is exempt from flow control requirements; see Section 2.2.4. Flow Control BMP Requirements Flow Control BMPs are required per CR 9. The project area totals 4,200 square feet. The proposed site includes 4,200 square feet of impervious area, including new (1,325 sf) and replaced (1,500 sf) impervious areas. The project falls under the Large Lot Low Impervious BMP Requirements. Below is a summary of the Flow Control BMPs (per Section 1.2.9.2.3 of the KCSWDM) that the project reviewed for use: 1. BMP Option 1: a. Full dispersion: The project area was evaluated for full dispersion of target impervious surfaces. It was determined that full dispersion is infeasible because of no available area and the soils in the area consist of till deposits, which provide little to no potential for infiltration. 2. BMP Option 2: Technical Information Report School Addition 4-1 01200 a. Full infiltration of roof runoff: Soils are till deposits, with little to no potential for infiltration. No formal infiltration facilities are proposed. 3. BMP Option 3: a. Full Infiltration: Soils are ice -contact deposits, with little to no potential for infiltration. No formal infiltration facilities are proposed. b. Limited Infiltration: Soils are ice -contact deposits, with little to no potential for infiltration. No formal infiltration facilities are proposed. c. Bioretention: The project site was evaluated for bioretention for target impervious surfaces. It was determined that bioretention is infeasible because of a lack of usable space. To the east and west of the site, there is not enough room to provide bioretention without eliminating access walks. To the north and south of the site, there are existing buildings. d. Permeable Pavement: The project site was evaluated for permeable pavement. It was found that permeable pavement is infeasible because there is not enough area available and all surroundings areas are matching adjacent existing standard concrete. 4. BMP Option 4: a. Basic Dispersion: The project site was evaluated for basic dispersion. It was found that basic dispersion is infeasible because there is no available vegetated area for runoff to disperse to. 5. BMP Option 5: a. Reduced Impervious Surface Credit: The project site was evaluated for applying the reduced impervious surface credit. It was found that the reduced impervious surface credit is infeasible because there is no area to reduce. b. Native Growth Retention Credit: The project site was evaluated for applying the native growth retention credit. It was found that the native growth retention credit is infeasible because there is not enough site area to receive credit. The KCSWDM requires approximately 10% of the project site, 420 square feet, be retained while there is zero square feet available. However, 57% of the existing lot area is landscaping to remain. Perforated Roof Drain for Connection All roof drains are tight lined, east, to the existing flow control facility. As such, no perforated pipe connections are proposed. Conveyance System Capacity Standards The storm conveyance system will be sized to adequately convey the fully developed, 25-year storm event, as stipulated by the KCSWDM. Technical Information Report School Addition 7-1 Section 8 CSWPPP Analysis and Design Technical Information Report School Addition 01200 8.0 CSWPPP Analysis and Design The proposed improvements comply with guidelines set forth in the KCSWDM and the KCSPPM. The plan will include erosion/sedimentation control features designed to prevent sediment -laden runoff from leaving the site or from adversely affecting critical water resources during construction. A draft stormwater pollution prevention and spill plan has been developed. The section will be completed for the building permit submittal. 8.1 ESC Plan Analysis and Design (Part A) The erosion potential of the site is influenced by four major factors: soil characteristics, vegetative cover, topography, and climate. Erosion/sedimentation control is achieved by a combination of structural measures, cover measures, and construction practices that are tailored to fit the specific site. The following measures will be used to control sedimentation/erosion processes: • Clearing Limits: All areas to remain undisturbed during the construction of the project will be delineated prior to any site clearing or grading. • Cover Measures: Disturbed areas will be covered, as required in Section D.2.1.2 of the KCSWDM. • Construction Entrances: A stabilized construction entrance consisting of existing asphalt of the parking lot will be used by construction traffic. • Perimeter Protection: Filter fabric fencing will be provided along the eastern and southern perimeters to prevent sediment laden runoff migration from the site. • Storm Drain Inlet Protection: Filter fabric protection will be provided on all new catch basins downstream of construction activities. • Surface Water Control: Interceptor ditches and straw wattles will be used to direct runoff from construction area to a sediment trap or existing flow control facility. Temporary sedimentation trap and/or existing stormwater facility will be used to contain sediment - laden water, and to control and monitor releases from site. All stormwater will be tested for NTU levels above background NTU to determine treatment requirements prior to discharge from the site. • Dust Control: Dust control measures will be implemented when exposed soils are dry to the point that wind transport is possible and roadways, drainage ways, or surface waters are likely to be impacted. 8.1.1 ESC Maintenance All ESC measures shall be maintained and reviewed on a regular basis, as prescribed in the maintenance requirements of each BMP proposed. 8.1.2 ESC Supervisor The applicant will designate an ESC supervisor who shall be responsible for maintenance and review of ESC, and for compliance with all permit conditions relating to ESC. The ESC supervisor must be available for rapid response to ESC problems. Technical Information Report School Addition 8-1 DeJB� The ESC supervisor will review the site at least once a month during the dry season, weekly during the wet season, and within 24 hours of significant storms. The City of Tukwila may require that a written record of these reviews be kept onsite with copies submitted to City of Tukwila within 48 hours (also see Section 8.2.3 below). The City may also require that the applicant designate an ESC supervisor with demonstrated expertise in ESC to perform these reviews and to be responsible for ESC due to the sensitive areas on or within the project site. The qualifications of such a person shall include at least several years of construction supervision or inspection. 8.1.3 Documentation If City of Tukwila requires that a written record be maintained and a standard ESC Maintenance Report may be used. A copy of all required maintenance reports shall be kept onsite throughout the duration of construction. Detailed maintenance requirements for each ESC measure are provided in Section 8-2. 8.1.4 Review Timing During the wet season, weekly reviews shall be carried out every 6 to 8 calendar days. During the dry season, monthly reviews shall be carried out within 3 days of the calendar day for the last inspection (e.g., if an inspection occurred on June 6, then the next inspection must occur between July 3 and July 9). Reviews shall also take place within 24 hours of significant storms. In general, a significant storm is one with more than 0.5 inch of rain in 24 hours or less. 8.2 Stormwater Pollution Prevention and Spill (SWPPS) Plan Design (Part B) The below draft SWPPS Plan design is awaiting input from the Contractor and the Owner for specific items. An updated plan will be provided with the building permit submittal. The Stormwater Pollution Prevention and Spill (SWPPS) Plan includes three elements: a site plan, a pollution prevention report, and a spill prevention and cleanup report. This report includes identifying the expected sources of potential pollution and spills that may occur during construction, and works to develop a plan to prevent pollution and spills. It also develops a plan to mitigate spills that may occur. The SWPPS Plan will be kept onsite at all times during construction. The general contractor will be responsible to ensure that subcontractors are aware of the SWPPS Plan and a form or record will be provided stating that all subcontractors have read and agree to the SWPPS Plan. An employee training worksheet is provided for the Contractors use (see Figure 8-3). A SWPPS Site Plan will be submitted. The SWPPS Site Plan, Pollution Prevention Report, and Spill Prevention and Cleanup Report have been developed and BMPs have been selected based on Section 2.3.1.4 of the KCSWDM and the KCSPPM. (The below plan will be updated with input from the Owner and Contractor.) 8.2.1 Pollution and Spill Prevention Source Controls and BMPs The sources of pollution and spills have been identified below, and the BMPs to be used for each source for prevention of both pollution and spills have been listed below: Liquids that will be handled or stored onsite are still being assessed by the Owner. Tight -fitting lids shall be placed on all containers containing liquids. Containers shall be covered with plastic sheeting during rain events. Drip pans or absorbent materials shall be placed beneath all mounted container taps and at all potential drip and spill locations during filling and unloading of containers. Containers shall be stored such that if a container leaks or spills, the Technical Information Report School Addition 8-2 01200 contents will not be discharged, flow, or be washed into the storm drainage system, surface water, or groundwater. Appropriate spill cleanup materials shall be stored and maintained near the container storage area. Storage area shall be swept and cleaned as needed. Area shall not be hosed down such that water drains to the storm drainage system or neighboring areas. Containers shall be checked daily for leaks and spills and replaced as necessary. All spilled liquids will be collected and disposed of properly. Spill control devices shall be routinely inspected on a weekly basis. Dry pesticides and fertilizers if stored onsite shall be covered with plastic sheeting or stored in a sealed container. Materials shall be stored on pallets or another raised method to prevent contact with stormwater runoff. Alternatively, the materials shall be contained in a manner such that if the container leaks or spills, the contents will not discharge, flow, or be washed into the storm drainage system, surface waters, or groundwater. Maintenance requirements are the same as liquid materials described above. Chemicals that will be handled or stored onsite are still being assessed by the Owner. BMPs and Maintenance requirements are the same as liquids unless otherwise listed. Soil, sand, and other erodible materials shall be stored onsite as shown on TESC detail plans (to be provided). Fueling shall not occur onsite. If fueling does occur onsite, the Contractor shall develop a containment plan for spills and provide lighting and signage if fueling occurs at night in conformance with the KCSPPM. Maintenance and repair of vehicles shall not occur onsite. If maintenance or repair of vehicles does occur onsite, the Contractor shall develop a spill prevention plan in Conformance with the KCSPPM. Truck wheel washing is not expected at a large scale due to small area of disturbance for the project. All other vehicle washing shall occur in a controlled manner, such that runoff is collected and disposed of in a legal manner. Rinsing of hand tools shall occur as located on the TESC plans (to be provided with the building permit submittal). Water for washing shall be collected and disposed of in a legal manner. Contaminated soils are not expected. If encountered, contaminated soils will be covered with plastic to prevent stormwater from carrying pollutants away to surface or ground waters. Appropriate spill cleanup materials, such as brooms, dustpans, vacuum sweepers, etc., shall be stored and maintained near the storage area. Storage area shall be swept and cleaned as needed. Area shall not be hosed down such that water drains to the storm drainage system, groundwater, surface water, or neighboring areas. During concrete and asphalt construction, the Contractor shall provide the following BMPs or equivalent measures, methods or practices as required: 1. Drip pans, ground cloths, heavy cardboard or plywood wherever concrete, asphalt and asphalt emulsion chunks and drips are likely to fall unintentionally, such as beneath extraction points from mixing equipment. 2. Storm drain inlet protection is being provided as shown on TESC plans (to be provided). Storm drains shall be covered to prevent concrete and asphalt from entering the storm system. Concrete, concrete slurry and rinse water shall be contained and collected and shall not be washed or allowed to discharge into storm drain, ditch, or neighboring parcels. All collected runoff shall be properly disposed of. 4. Contractor shall designate an area where application and mixing equipment cleaning will be conducted. Rinse water and slurry shall be collected, contained, and disposed of in a legal manner. 5. Routine maintenance: the pouring area shall be swept at the end of each day or more frequently if needed. Loose aggregate chunks and dust shall be collected. Areas shall not be hosed down. The Contractor may provide the following optional BMPs if the above do not provide adequate source controls: 1. Cover portable mixing equipment with an awning or plastic sheeting to prevent contact with rainfall. 2. Provide catch basin inserts configured for pollutant removal. pH elevated water shall not be discharged from the site. Contractor shall monitor stormwater for pH prior to discharging from the site. An enlarged chair storage room and an outdoor walk-in freezer room will also be added at Building B. New office space and reconfiguration of the reception counter at Building A and replacement of the existing roof and the existing flooring at Buildings A, B, C, D, and E will also be included. Miscellaneous site improvements include adding a new outdoor generator, site fencing, security gates, and sidewalk repair. No parking or landscaping changes to the site are proposed. Gates and card readers will be upgraded. There will be no additional staff or increase in student enrollment as a result of the project. Conditional Use Criteria The property is zoned Low Density Residential (LDR). Per Table 18-6 of the Tukwila Municipal Code (TMC), schools are permitted in the LDR zone with a CUP. Responses below show consistency with the criteria for a CUP, as required per TMC 18.64.050: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The purpose of a CUP is to allow uses that may not be appropriate within a given zoning district, but may be permitted subject to conditions and mitigation measures that protect health, safety, and welfare, and ensure compatibility with surrounding uses. The building expansion to Cascade View Elementary School does not adversely affect health, safety, and welfare, nor does it present an incompatible use. The use of the building as a school will remain unchanged. The additions are proposed to better serve the students by maintaining and repairing the educational facilities and allowing for greater seating area in the cafeteria to reduce the number of staggered lunch times throughout the day. The improvements will not substantially alter the function of the site, and the building size increase is minimal. No site changes such as landscaping or parking are proposed, and the project is not expected to generate any adverse effects on the property or adjacent uses. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. The proposal will not reduce any onsite landscaping or parking. The building height and setbacks conform to City code and will remain unchanged. The additions to the building footprint are relatively minor, as they will add 2,257 square feet to the existing 28,850 square feet of floor area. Fencing improvements will fully enclose the site and will not interfere with the existing pedestrian path located along the frontage. 3. The proposed development shall be compatible generally with the surrounding land uses. The project site is surrounded by single-family residential to the north, east, and west. In general, most elementary schools are located within residential neighborhoods to best serve the children living in the area. The south end of the site is a ball field, bordered by a large church property and cemetery. The expansion will extend into an interior courtyard of the site, and will be not be discernable from neighboring properties. The expansion will not create any nuisances to adjacent properties such as noise, light, or odor. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. Cascade View Elementary is within a residential area and is a central part of the neighborhood character. According to the Tukwila Comprehensive Plan, the LDR land use designation is primarily characterized for single-family residential structures, as well as education and institutional uses. The proposed use is consistent with the purpose of the LDR zone. With the proposed building addition, the school will remain consistent with the goals and policies of the Residential Neighborhoods Element of the Comprehensive Plan, such as neighborhood quality (Goal 7.2) and educational attainment (Goal 7.3). The proposal will also not cause any undue noise impacts (Goal 7.8), as the new cafeteria expansion will be used for storage and office space. The Comprehensive Plan's Capital Facilities Chapter requires adequate public facilities to service development in the City, which would include facilities for public schools. The proposed expansion is intended to improve the operations of Cascade View Elementary. The Tukwila Comprehensive Plan calls for growth, and as Tukwila schools modernize and expand, expansions such as the one proposed are needed to support students, staff, and faculty. 5. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The existing use of the site as a school, as well as enrollment or capacity, will not change with this proposal. No adverse impacts on the area are expected to occur.
