As part of the Final Approval for the Short Plat application referenced above, we have listed each of the
preliminary conditions of approval and summarized how they have been addressed:
Preliminary Approval Conditions
1. Revise the Short Plat Map:
a. On Sheets 1 and 2 of 2-Add L17-0026 to Short Plat Number.
Response: Completed.
b. Short plat map sheet 2-Add Sanitary Easement and Maintenance Agreement NOTE on the
short plat map.
Response: A callout for 7' sanitary sewer easement has been added to the Short Plat
Sheet 2 along the west boundary of Lot 1.
c. Provide a 15 ft Private Access. Strom Drainage, Sanitary Sewer & Utilities Easement and
Maintenance Agreement NOTE on the short plat map.
Response: A callout for 15' access & utility easement has been added to the Short Plat
Sheet 2 of 2 along the east boundary of Lot 1.
d. Label addresses for both lots. 4264 S 148th St is the newly assigned address for Lot 1. Lot
2 will retain the original address of 4260 S 148th St.
Response: Added notes.
2. Provide a draft copy of the 15' private access, storm drainage, sanitary sewer and utilities
easement within Lot 1 for the benefit of Lots 1 and 2 (1) This document shall be recorded prior to
recording of the Final Short Plat Map, and the recording number be shown on the short plat map.

(2) The 15' private access, storm drainage, sanitary sewer and utilities easement should include
language stating who will maintain the utilities lines, and by what portion.
Response: Please see legal description and exhibit provided by Centre Polinte Surveying. Please
provide a sample easement document that we can submit for recording.
3. All sawcut areas with South 148t'' Street shall be shown and labeled on the Civil plan sheet(s) as
part of the future Public Works permit, it applicable.
Response: All road work has been completed and inspected under the public works construction
permit (PW17-0101).
4. All Utilities, including power, are required underground, per city of Tukwila Ordinance. Sewer,
Water and Utility lines must be placed under 15" easement, as per civil plans, created by J3NP
Engineering and submitted on May 25th, 2017.
Response: Please note the sanitary sewer line (with approval by City Inspector) was installed
along the west boundary of Lot 1. A 7' wide sanitary sewer easement has been added to the Short
Plat. All remaining utilities including storm drainage, domestic water, power and natural gas have
been installed in the 15' wide access and utilities easement along the east boundary of Lot 1.
We trust these responses summarize how each of the preliminary conditional of approval have been met.

On August 1, 2019, we received your request for an extension on the Short Plat application file number L17-
0026. This file was applied for on May 25th, 2017 and was granted Preliminary Approval on August 14th, 2017.
The listed expiration date for this application was one year from the dated Preliminary Approval.
Under TMC 17.12.040, an applicant is eligible for a single one-year extension. On August 14th, 2018, the Short Plat

Dear Mr. Cosic,
The Short Subdivision Committee has completed review of your short plat application (No. L17-0026), and
determined that it complies with all applicable City code requirements. The City SEPA Responsible Official
has previously determined that this application does not require a SEPA threshold determination because
it is categorically exempt.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal,
preliminary approval is granted subject to the conditions stated below. The conditions imposed are to
ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in
the Tukwila Subdivision Code.
Preliminary Approval Conditions
1. Revise the Short Plat Map:
a) On Sheets 1 and 2 of 2 -Add L17-0026 to Short Plat Number.
b) Short plat map sheet 2-Add Sanitary Easement and Maintenance Agreement NOTE on the
short plat map.

"The cost of maintenance, repair, or reconstruction of that portion of the sewer used in
common, located inside the 6' private side sewer easement, shall be borne in equal shares,
except that the owners of any lower parcel shall not be responsible for the part of the sewer

parties to this agreement shall have a right of entry for that purpose."

c) Provide a 15 ft Private Access, Strom Drainage, Sanitary Sewer & Utilities Easement and
Maintenance Agreement NOTE on the short plat map.

easement for the benefit of the owners of lots 1 and 2 of this short plat. Ownership of said lots 1
and 2 within this short plat includes an equal and undivided responsibility for the maintenance
of said easement and the construction, maintenance, repair and replacement of improvements
contained therein."
d) Label addresses for both lots. 4264 S 148th St is the newly assigned address for Lot 1. Lot 2
will retain the original address of 4260 S 148th St.
2. Provide a draft copy of the 15' private access, storm drainage, sanitary sewer and utilities
easement within Lot 1 for the benefit of Lots 1 and 2 (1) This document shall be recorded prior
to recording of the Final Short Plat Map, and the recording number be shown on the short plat
map. (2) The 15' private access, storm drainage, sanitary sewer and utilities easement should
include language stating who will maintain the utilities lines, and by what portion.
3. All sawcut areas with South 148th Street shall be shown and labeled on the Civil plan sheet(s) as
part of the future Public Works permit, it applicable.
4. All Utilities, including power, are required underground, per city of Tukwila Ordinance. Sewer,
Water and Utility lines must be placed under 15" easement, as per civil plans, created by J3NP
Engineering and submitted on May 25th, 2017.

1. Transportation Impact Fee Applies to the future Building Permit. See Pavement Mitigation and

4. The applicant shall apply for a Public Works (PW) type "c" permit for approval. A Street Use will
part of the permit and require bonding, insurance, and Hold Harmless Agreement for work
within the Public Right -of -Way.
5. Turnover documents will be required as part of the Public Works Permit, for any Public
Infrastructure within South 148th Street. Including the proposed storm drainage catch basin;
within the City Right -of -Way. City will prepare document(s) for Owner's signature.
6. Fire hydrants: For short plat developments (four single-family homes or less and individual
single-family homes) fire hydrants shall be placed so that a hydrant is no more than 250 feet by
line of vehicular travel to the nearest point of the building. (This parcel is less than 250 feet
from the nearest fire hydrant)
7. Fire sprinkler systems: An approved automatic fire sprinkler system shall be installed in new
one -family and two-family dwellings and townhouses. Size water lines and water meter to
accommodate the fire sprinkler system.
8. Fire ladder access: The final grading plan must show a flat area below any second story rescue
windows for Fire Department ground ladder placement. If unable to provide a suitable flat area
adjacent to the house, please contact the Tukwila Fire Marshal's Office.
NEXT STEPS:
1. Construction permits: Install all required site improvements, including those proposed in the
application and those identified above as conditions of approval. You will need to obtain all
required permits prior to beginning any construction. For City of Tukwila utilities, contact Tukwila
Public Works at (206) 433-0179 for a Public Works (PW) Type 'C' permit. For utilities provided by
other entities, contact the individual providers.
2. Final Approval: Submit documents for final approval. After installing the required site
improvements and complying with the conditions of approval submit the necessary short plat
documents (survey, legal descriptions, and other required paper work) for city signatures. All
taxes and fees assessed against the property must be current prior to final approval. Please
check with the King County Assessor's Office and the City of Tukwila Finance Department prior
to submitting final documents. After the documents have been found to be in order, and the all
of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee
signs your short plat which constitutes a grant of final approval.
3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your
short plat application is ready for recording. It is your responsibility to record the City approved
short plat documents with the King County Department of Records. You will need to pay the
recording fees and submit your approved original short plat to King County. The short plat is not
complete until the recording occurs and copies of the recorded documents are provided to the
Department of Community Development. After recording, the County returns the recorded original

to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You
can shorten this processing time by hand -delivering a copy of the recorded short plat to the project
planner. In many circumstances, building permits on the short platted property may not be issued
until a copy of the recorded short plat (or original) is returned to the Department of Community
Development.
EXPIRATION OF PRELIMINARY APPROVAL
The final approved short plat must be filed with the King County Department of Records within one
year from the date of this preliminary approval or the application will expire. The City may grant a
single one year extension if requested in writing prior to the expiration date.
APPEAL RIGHTS
This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of
the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed
within the time limit, the decision of the Department will be final.
In order to appeal the decision a written notice of appeal must be filed with the Department of
Community Development within 21 days of the issuance of the Notice of Decision. The requirements for
such appeals are set forth in Tukwila Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.

Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing
Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the
outcome of the administrative appeal process may file an appeal in King County Superior Court from the
Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW 36.70C.
An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal.

The following terms and conditions apply to the attached Valley View Sewer District ("District")
Certificate of Sewer Availability/Non Availability ("Certificate")
1. This certificate is valid only for the real property referenced herein ("Property") which is in
the District's service area, for the sole purpose of submission to the King County Department of Development
and Environmental Services, King County Department of Public Health, City of Seattle, City of Tukwila, City
of Burien and/or City of SeaTac. This certificate is between the District and the applicant only and no third
person or party shall have any rights hereunder whether by agency, third -party beneficiary principles
or otherwise.
2. This Certificate creates no contractual relationship between the District and the applicant and
its successors and assigns and does not constitute and may not be relied upon as the District's guarantee that

On May 25th, 2017, the Department of Community Development received your application to short plat
4260 South 148th Street, Tukwila WA 98168. Based on a review of your submittal relative to those
requirements as set out in the Complete Application Checklists for Design Review and SEPA review,
your application was deemed submitted and complete.
Review of the document showed that there were additional corrections needed to the proposal before we
could proceed with the short plat permitting process. Per the Tukwila Municipal Code, "any period of
time during which the applicant has been requested by any City department, agency or hearing body
with jurisdiction over some aspect of the application to correct plans, perform required studies, or
provide additional information. If the applicant fails to provide a request correction of additional
information within 90 days of the request the Department may cancel the application due to inactivity."
(TMC 18.104.130-1B).
The following corrections are required to this short plat permit application:

15' Access Easementj
1) Fire hydrants: For short plat development (four single-family homes or less) and
individual single-family homes, fire hydrants shall be placed so that a hydrant is no more
than 250 feet by line of vehicular travel to the nearest point of the building.
2) Fire Sprinkler System: An approved automatic fire sprinkler system shall be installed
in new one -family and two-family dwellings and townhouses. Size water lines and water
meter to accommodate the fire sprinkler system.
3) Fire ladder access: The final grading plan must show a flat area below any second
story rescue windows for Fire Department ground ladder placement. If unable to
provide a suitable flat area adjacent to the houses please contact the Tukwila Fire
Marshal's office.

Expiration — The concurrency test notice shall expire 90 days after issuance unless the applicant submits a SEPA or other documentation pursuant to
TMC 21.04. If the submittal is made within 90 days, the test notice shall be valid for one calendar year from the date of issuance of the notice. Once
the associated development permit or building permit is approved, the final concurrency certificate shall be valid for 2 years or as long as the
developer possesses a valid building permit for the development. Extensions may be granted in accordance with TMC 9.50.

This Bulletin summarizes pavement mitigation fees and transportation impact fees applicable to private
development projects within the city.
PAVEMENT MITIGATION FEE
The City does not allow pavement cuts in pavement that is three years old or newer (TMC 11.04 Recently Improved
Street), except by written approval from the Public Works Director.
Public Works charges a pavement mitigation fee whenever pavement in the right-of-way is disturbed. The
pavement mitigation fee compensates the City for reduced life span due to disturbance of roadway surfaces.
The fee is based on the total square footage of impacted pavement and on the remaining life of the existing
pavement. The mitigation fee, based on cut limits shown on the permit plan set, is paid when the permit is
issued. To estimate the cut area, add two feet to all sides of the expected cut limits before calculating the
area. This fee may be adjusted, based on the Inspector's measurement of the actual cut limits. Use the
following table to estimate the pavement mitigation fee.

TRANSPORTATION IMPACT FEE
Consistent with the Comprehensive Plan, the Six -year Transportation Plan and the Capital Improvement Plan, the
transportation impact fee helps ensure that new development bears its proportionate fair share of transportation
facilities necessitated by the new development. The fee applies to any construction, reconstruction, conversion,
structural alteration, relocation or enlargement of any structure that requires a building permit and generates any
new PM peak hour trips . The transportation impact fee is charged to each development according to an impact
fee schedule based on defined zones. The fees are assessed as part of the building permit and are due and payable
when the permit is issued. (TMC 9.48 and Ordinance 2111)

2. This easement is for the sole purpose of the construction, use and maintenance of a Private
Access, Storm Drainage, Sanitary Sewer and Utilities Easement.
3. Grantee shall install any improvements in said Private Access, Storm Drainage, Sanitary
Sewer and Utilities Easement at its sole cost and expense and shall continue to maintain and
shall continue to bear all cost of repair and maintenance or repair of said Private Access, Storm
Drainage, Sanitary Sewer and Utilities Easement.
4. Grantee shall hold Grantor harmless from and against any and all claims which may be made
against Grantor arising out of the installation, operation, maintenance or repair or said Private
Access, Storm Drainage, Sanitary Sewer and Utilities Easement.
5. The herein easement and agreement may be amended only with the written agreement of the
Grantee herein, his heirs and/or assigns.
This easement agreement shall run with the land and shall be binding on all parties having or
acquiring any right, title or interest in the land descried herein or any part thereof.
It is the intent of the GRANTOR that this agreement shall not be extinguished by the doctrine of merger.

Public Works has the following Preliminary Short Plat comments.
1. Owner/Applicant to complete a Traffic Concurrency Certificate Application and pay a
Transportation Concurrency Test Fee in the amount $300 as part of this Short Plat — L17-
0026. (See enclosed.)
2. Provide a current Water Availability Certificate Letter from Water District 125 (206) 242-
9547.
3. Provide a current Sanitary Sewer Availability Certificate Letter from Valley View Sewer
District (206) 242-3236.
Prior to Final Short Plat, the following comments need to be addressed for Public Works.

NOTE on short plat map. SAMPLE from Valley View Sewer District (for information
only) follows — "The cost of maintenance, repair or reconstruction of that portion of the
sewer used in common, located inside the 15' private access, storm drainage, sanitary sewer
and utilities easement, shall be borne in equal shares, except that the owners of any lower
parcel shall not be responsible for the part of the sewer above their connection; and when
necessary to repair, clean or reconstruct the sewer, the parties to this agreement shall have a
right of entry for that purpose." Contact Valley View Sewer District at 3460 S. 148th Street,

Short Plat Site Development Plan

as part of the future Public Works permit; if applicable.
Miscellaneous Comments
1. Transportation Impact Fee applies to the future Building Permit. See Pavement Mitigation
and Transportation Impact Fees Bulletin no. A3 — enclosed.
2. All utilities including power are required to be underground, per City of Tukwila ordinance.
3. Pavement Mitigation Impact Fee applies to future Public Works permit. Reference
Pavement Mitigation and Transportation Impact Fees Bulletin no. A3.
4. The applicant shall apply for a Public Works (PW) type 'C' permit for approval. A Street
Use will be part of this permit and require bonding, insurance, and a Hold Harmless
Agreement for work within the Public Right -of -Way.
5. Turnover documents will be required as part of the future Public Works permit, for any
Public infrastructure within S. 148r'' Street. Including the proposed storm drainage catch

1.0 PROJECT OVERVIEW
This project proposes to create two residential lots from an existing single family residence
located on parcel number 004000-0791. The project site is located within a portion of the
NE Qtr. in Section 22, Township 23 North, Range 4 East, of the Willamette Meridian, City
of Tukwila, King County, Washington. The address of the existing residence is 4260 South
148th Street, Tukwila, Washington. Please see Exhibit A — Vicinity Map.
The site totals approximately 21,494 square feet (0.49 acre)„ The existing site contains a
1420 square foot building with basement that will remain. It also includes a detached
garage and asphalt driveway that will be removed as part of the project.
The short plat will create a southerly new vacant Lot 1 with, approximately 6,555 square
feet, adjacent to S 148th Street with a 15 foot wide easement for access and utilities for
the northerly Lot 2, which is approximately 14,923 square feet. Lot 2 will include the
existing residential building to remain. The development will remove and replace the
existing asphalt driveway through the 15' wide easement.
The existing site slopes from east to west and runoff from the north half of the parcel
discharges to the northwest corner, while the south half of the parcel discharges to the
southwest corner toward South 148th Street right-of-way. The topography elevations
range from 282 to 274. The site is bounded by South 148th Street along the south
boundary, and adjacent residential Tots and residences along the north, east and west
boundaries.
The project proposes a gravel infiltration trench to handle the surface water runoff for the
access road through the 15' wide easement.
2.0 CONDITIONS AND REQUIREMENTS SUMMARY
Req. #1 — Discharge at the Natural Location: The runoff from the existing site generally
flows from east to west. The north half of the site drains to the northwest corner of the
site and the south half drains to the south based on the topography. The project will
maintain the drainage patterns of the site.
Req. #2 — Offsite Analysis: The site does not have any significant surface runoff from the
north, east or west properties.
Req. #3 — Flow Control: The project proposes to infiltrate the access easement pavement
area up to the 100-year storm event. The KCRTS computer modelling software will be
used to size the infiltration trench.
Req. #4 — Conveyance system: The storm drainage system will be designed to sufficient
capacity to convey and contain the 25-yr peak flow.
Req. #5 — Construction Stormwater Pollution Prevention: This project includes temporary
erosion and sedimentation control BMPs that help minimize erosion and impact to
surrounding properties during construction including establishing clearing limits,
construction entrance, silt fencing, and catch basin inserts.
Req. #6 — Maintenance & Operations: An operations and maintenance manual will be
provided for the drainage facilities constructed for this project.
Req. #7 — Financial Guarantees and Liability: All financial guarantees and liabilties will be
provided by the owner or general contractor.
Req. #8 — Water Quality: The amount of proposed pollution generating surfaces for this
development is 1,425 square feet, which is under the 2,000 square foot threshold for
requiring basic water quality on the site.
Req. #9 — Flow Control BMPs: The project proposes to impement low limpact development
by infiltrating roof runoff for each lot.

3.0 OFFSITE ANALYSIS
Based on the topography of the surrounding area, the project site flows south toward
South 148th Street right-of-way and then drains west along South 148th Street toward 42nd
Avenue South where is drains south along 42nd Avenue South toward South 152nd where
is drains east and discharges to the Gillam Creek System. There were no downstream
drainage complaints listed during the parcel research.
A level 1 downstream anaylsis will be conducted and included in this report to include the
following tasks if required after initial review.

4.0 FLOW CONTROL AND WATER QUALITY ANALYSIS AND DESIGN
The infiltration gravel trench will be sized according to the 2016 KCSWDM using the
KCRTS Hydology model. The calculations for the trench are included in this section.
Existing Site Hydrology (Part A)
The existing site is a single family residence.
Developed Site Hydrology (Part B)
The developed site will be modeled with the following surface areas:
Basin A:
Access Driveway through Easment = 1,425 SF
Performance Standards (Part C)
The site will meet all the required conveyance performance standards and will be
sized according to the 2016 KCSWDM using the rational method. The conveyance
system will be sized to collect and convey the 25-year design storm event.
Flow Control System (Part D)
The project will meet the flow control requirements and will be sized according to
the 2016 KCSWDM using the KCRTS software. The projest proposes to retain
and infiltrate the 100-year storm event. This criteria is more restrictive than
detention and will meet the flow control requirements.
Water Quality System (Part E)
The project is exempt from basic water quality requirements.
5.0 CONVEYANCE SYSTEM ANALYSIS AND DESIGN
The site will meet all the required conveyance performance standards and will be sized
according to the 2016 KCSWDM using the rational method. The conveyance system will
be sized to collect and convey the 25-year design storm event.
6.0 SPECIAL REPORTS AND STUDIES
All special reports and studies for this project will be included in this section.
7.0 OTHER PERMITS
This project is expected to require a building and site development permit through the City of
Tukwila for the proposed improvements.

Department and the Department of Community Development. Please contact each Department if you feel that certain items
are not applicable to your project and should be waived. Application review will not begin until it is determined to be

The initial application materials allow project review to begin and vest the applicant's rights. However, the City may require
additional information as needed to establish consistency with development standards.

and encumbrances, must be dated within 45 days of application filing (two copies).
