The Hearing Examiner viewed the site on September 5, 2017. EXHIBITS: The following exhibits were entered into the record: 1. Department's staff report with Attachments A-D Introduction The applicant seeks a conditional use permit to allow a school facility within a Regional Commercial zone. A public hearing was held on the application on September 5, 2017, at the Department of Community Development, 6300 Southcenter Boulevard, Tukwila, WA. Represented at the hearing were: the Department, by Maxwell Baker, Assistant Planner ("City"); and the applicant by James Heugas, Pacific Charter Institute ("Applicant"). No members of the general public testified at the hearing. For purposes of this decision, all section numbers refer to the Tukwila Municipal Code ("TMC" or "Code") unless otherwise indicated. After considering the evidence elicited L17-0049 FINDINGS AND DECISION Page 2 of 4 during the appeal hearing, the Hearing Examiner enters the following findings of fact, conclusions, and decision on the application. Findings of Fact 1. The subject site is addressed as 3438 148th Street ("Property"). The site is a 78,217 square foot lot. The site is developed with a 41,305 square foot building that has historically been used by Soka Gakkai International as a center for Buddhist studies. The original structure was built in 1991. The property around the structure is developed with a surface parking lot with approximately 155 spaces, and an additional 33 spaces are located beneath the structure in a covered parking garage. The site is accessed by two driveways on South 148th Street. Most of the site is encompassed by existing fencing. The site includes three vacant parcels to the north of the developed portion of the property. 2. The current proposal is to convert the existing structure into a K-5 charter school that will serve up to 504 students with 29 staff and administration positions. The proposal includes interior improvements to create classroom spaces, and exterior improvements including windows on the structure, and a recreation area for the school on adjacent parcels. The proposal does not include any changes to parking or landscaping. 3. All surrounding properties are zoned Regional Commercial. Properties to the south across 148th Street are the headquarters building for the Valley View Sewer District and a parking lot and single-family home owned by the Church by the Side of the Road. Properties to the east are occupied by the King County Water District #125 headquarters building and accessory garages. Properties to the north are vacant with the exception of a daycare facility. To the west properties are dedicated to single-family homes or are residential buildings that have been converted to commercial uses. 4. The Applicant prepared a transportation and parking assessment ("Traffic Study") that found that the site has ample space to accommodate the parking needs of the proposal. The Traffic Study further indicated that although the proposal will alter traffic patterns from those associated with the change of use to a school new traffic patterns would largely be accommodated on site by a traffic plan that includes on -site pick-up and drop-off, and school staff management of traffic particularly during the afternoon pick-up time. 5. The property is zoned Regional Commercial. Schools are allowed as a conditional use within the Regional Commercial zone. TMC Title 18 Table 3. 6. The criteria for granting of a conditional use permit are set forth in TMC 18.64.050: (1) the proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity; (2) the proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy; (3) the proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design; (4) the proposed development shall be in keeping with the goals L17-0049 FINDINGS AND DECISION Page 3 of 4 and policies of the Comprehensive Land Use Policy Plan; and (5) all measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. 7. No public comments were received concerning the proposal. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 18.104.010.3, which provides that a decision on a conditional use permit application is a quasi-judicial decision by the Hearing Examiner. 2. The proposal will not be injurious to the property or improvements in the vicinity, because the proposal is primarily for interior improvements to the structure, and will not noticeably alter the property and will not affect improvements in the vicinity. Further, although the proposal will change current traffic trends, negative impacts from traffic and parking will be addressed by accommodating these on -site. 3. The existing parking, landscape, and other onsite elements conform to the Code, and will not change significantly from current conditions. Therefore, the proposal will meet or exceed the same standards for parking, landscaping yards and other development regulations that are required in the district it will occupy. 4. The proposed use is compatible with the surrounding land uses. Most of the area uses are commercial and separated from the proposal by existing fencing. Traffic and parking conditions in the area will not be negatively impacted by the proposal. 5. The Tukwila Comprehensive Plan calls for growth. As Tukwila schools modernize and expand, the proposed school is necessary to increase education services to help accommodate that growth. An implementation measure of Tukwila's Economic Development goals (Element 2) is to collaborate with local school districts to improve the educational opportunities for Tukwila schoolchildren. The proposal is important in supporting the educational opportunities for students. 6. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area. As indicated above, measures to consolidate parking and traffic impacts on -site will minimize possible adverse impacts to the area. 7. The application meets all criteria for a conditional use permit, and should be approved. Decision The Conditional Use Permit is hereby GRANTED. Soka Gakkai International is a community -based Buddhist organization with members in 192 countries and territories. The building was constructed in 1991. The site has a surface lot that surrounds the building with about 155 spaces, and a covered parking garage below the building's ground floor with about 33 spaces. The building has two vehicle access points for the covered parking area — one on the north side and one on the south side. Vehicle access for the site is provided by two driveways on S 148th St. The property also includes three vacant parcels of land to the north of the main building. Impact Public School's proposal calls for the conversion of the building into a K-5 charter school that will serve up to 504 students with 29 staff and administration positions. Interior improvements are to include the creation of new classroom spaces and installation of exterior windows in said spaces. Exterior improvements on the parcel containing the Soka Gakkai building (APN 0040001025) would be minimal, but the applicant intends to create a recreation area for the school on adjacent parcels (APN 2044000025, 2044000040). There is also the potential for the school to create a recreation area that is accessible to the greater public through a joint venture with Tukwila Parks and Recreation in the future. The current Conditional Use Permit application, however, is applying with the understanding that these vacant parcels will be used primarily for the school's needs. There exists a pedestrian stair connection between the Soka Gakkai parcel and the parcels to the north. See Attachment B. Surrounding Land Uses The subject property is located along S 148th St in Tukwila. All surrounding parcels are zoned Regional Commercial. Parcels to the east are owned by King County Water District #125 and contain the Water District's headquarters building and accessory garages. Parcels to the west contain either single-family residences or former residential buildings that have been converted into commercial uses. To the north are vacant parcels and a daycare building. To the south across S 148th St are Valley View Sewer District's headquarters building, the parking lot for Church by the Side of the Road, and a single-family residence owned by Church by the Side of the Road. See Attachment A. Conditional Use Permit Criteria The proposed project must comply with criteria detailed in the Conditional Use Permit Chapter of the Tukwila Municipal Code (TMC 18.64.050). The property is zoned Regional Commercial and schools are listed as a conditional use. The applicant's response to the conditional use permit criteria is Attachment C to this staff report. Staff makes the following findings using the Code's conditional use permit criteria (TMC 18.64.050) listed in italics: 2 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. Applicant Response: The proposed school use will not be detrimental to public welfare or injurious to any other property or improvements. In fact, it will be a benefit to public welfare by increasing educational choice for residents — please see full project description attached to this application. Staff Comments: The school's operating hours will be a departure from those that the Soka Gakkai center occupied, as the center largely provided larger gathering services on Sundays with smaller workshops and meditation classes taking place during the mornings, afternoons, and evenings on weekdays. Citing the findings of the Transportation and Parking Assessment provided by Heffron Transportation Inc., there will be a marked increase in net vehicle trips following the replacement of the Buddhist center with an elementary school, with 204 estimated total inbound and outbound trips in the AM Peak Hour, 118 in the Afternoon Peak Hour, and 53 in the PM Peak Hour. See attachment D. 2. The proposed use shall meet or exceed the same standards for parking, landscaping yards and other development regulations that are required in the district it will occupy. Applicant Response: No changes are proposed to the existing parking, landscaping, and yards, except 2 of the 152 existing parking spaces will be removed to accommodate a new egress ramp at the rear side of the building. The existing parking exceeds the requirements of TMC 18.56 for the new school use, even with the two spaces removed to, accommodate the egress ramp. Staff Comments: Parking requirements for Elementary Schools are 1.5 parking spaces per staff member. With the anticipated 29 faculty members at full enrollment, a minimum of 45 parking spaces would be required. The provided parking onsite far exceeds this requirement. Proposed site improvements do not trigger threshold for design review. However, bicycle parking is recommended to provide alternative transportation options for faculty and students. 3. The proposed use shall be compatible generally with the surrounding land uses. Applicant Response: The property is in the Regional Commercial (RC) zone, in the Tukwila International Boulevard (TIB) district and in the Cascade View residential neighborhood. Charter 3 public schools are available to all students with no tuition, so the elementary school will provide another education option for local families. It is adjacent to residences to the west and the Valley View Sewer District administration building to the east, across S. 148th St. from a church, another community use. These are generally compatible uses. Staff Comments: None. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. Applicant Response: Per the Comprehensive Plan, the new school will serve Goal 1.1.3, "Capitalize on the potential that public projects have for serving as symbols of the community, and for expressing the identity any special character of the area where they are located." Per Policy 3.6.4, the City is committed to "Continue and expand partnerships with the school districts serving Tukwila students, in support of programs that seek to improve school performance and student access." Staff Comments: The applicant's ability to meet the intent of Goal 1.1.3 would principally be completed through the improvement of adjacent parcells into a recreation area/park that is accessible to the public. The proposed minimal improvements to the Soka Gakkai building presented to the city will do little to enhance the structure from its current state. 5. All measures shall be taken to minimize the possible adverse impacts which (sic) the proposed use may have on the area in which it is located. Applicant Response: With ample parking and vehicular circulation surrounding the building connecting to two drive entries off S. 148th, traffic impacts are minimized. Measures taken for the supervision and security of the elementary school students will also minimize the students' impact on the surrounding areas. Staff Comments: None. CONCLUSIONS 1. The proposed project, a conversion of an existing religious facility, will not significantly change the overall character of the site and its structures. The only noise impacts expected are due to children from the school and neighborhood using the new 4 playground. 2. The proposed tenant improvements will have little impact on the site itself. Exterior improvements consist largely of maintenance projects and improvements to the building, such as the installation of exterior windows. No changes are proposed or needed for the building's setback, its parking area, or landscaping. Parking exceeds the code requirements for this use. 3. Pedestrian circulation needs to be improved on site and to the ROW to ensure potential conflicts with school buses and student drop-off areas are reduced. 4. The proposed joint venture with Tukwila Parks and Recreation for a public recreation area on the vacant parcels to the north of the site could provide a valuable amenity that can be utilized by both the school's students and the general public. It would also work to improve currently vacant properties that have had a history of creating code enforcement issues. 5. The proposed use will be compatible with the surrounding land uses. 6. The proposed use will not conflict with the goals and policies of the Comprehensive Plan. RECOMMENDATION Staff recommends adoption of the above findings and conclusions and approval of the conditional use permit with the following conditions: 1. Owner/Applicant to complete a Traffic Concurrency Certificate Application and pay a Traffic Concurrency Test Fee in the amount $3,000.00 as part of this Conditional Use Permit. Traffic Concurrency Test Fee based on between 40,001 and 50,000 sq. ft. of gross floor area (GFA) of Institutional Use (School). 2. Prior to issuance of the future Building permit for this project Owner/Applicant shall pay a Transportation Impact Fee in the amount of $56,244.13. Transportation Impact Fee based on Trip Generation Analysis by Heffron Transportation, Inc., dated August 28, 2017. This assessment is based upon guidance provided by the City of Tukwila (City) and provides information requested by the City to help support project permitting and determination of the traffic impact fee. 1. Project Description The proposed school would repurpose the existing building on the site. The building, which is about 41,305 square feet (sf) in size, is currently unoccupied but was most recently utilized as a Buddhist Cen- ter. The site has a surface lot that surrounds the building with about 155 spaces, and a covered parking garage on the building's ground floor with 33 spaces. Vehicle access for the site is provided by two driveways on S 148th Street. Vehicles can circulate through the surface parking lot to the under -building garage, which can be accessed from the north or south ends of the building. There is also a pedestrian stair connection between the site and the property to the north. The school would serve grades kindergarten through 5, with an ultimate planned enrollment capacity of 504 students and 22 faculty/staff members. School enrollment at the proposed site would be phased, be- ginning with kindergarten and 1S` grade in fall 2018, with new grades added each year as each class pro- gresses; full enrollment and staffing could be reached in the 2022/2023 school year. 2. Trip Generation Estimate 2.1. Project -Generated Trips Vehicle trips that the school could be generate were estimated by applying average Institute of Transpor- tation Engineers (ITE)' trip generation rates for an "Elementary School". These rates are summarized in Table 1. As the table shows, a total enrollment of 504 students is estimated to result in about 650 daily vehicle trips, with 227 occurring in the AM peak hour when students are dropped off, 141 occurring in the after- noon peak hour when students are picked up, and 76 trips during the commuter PM peak hour, which is when traffic on the vicinity streets is the highest. Conver- sion to a school would prevent re -occupation of the building as a Buddhist Center, so it is appropriate for the project to receive credit for vehicle trips that would be eliminated with the removal of this use. There is no explicit ITE land use category for Buddhist facilities. However, review of the operating char- acteristics of other Buddhist centers around the region, combined with review of potential ITE land use categories, found that "Church" (ITE Land Use Code 560) is the category that most closely represents this use. ITE defines the "Church" land use as "...a building in which public worship services are held. A church houses an assembly hall or sanctuary; it may also house meeting rooms, classrooms, and occa- sionally, dining, catering, or party facilities." Review of the calendars of other Buddhist temples and centers in the region found that most hold regular Sunday gatherings, along with events throughout the week including meditation or other classes during weekday mornings, afternoons, or evenings; they also provide guidance and resources for their members. Table 2 summarizes the average rates and trip esti- mates for each peak hour that would be eliminated with removal of the existing use. Table 2. Estimated Transportation Impact Fee The City has adopted a transportation impact fee program that is based upon net new trips generated by a project during the PM peak hour. The program divides the city into four zones, and the cost per new vehi- cle trip varies depending on the zone in which the project is located. The project site is located in Zone 3, which has an impact fee rate of $1,061.21 per net new PM peak hour trip.2 Based upon the results pre- sented in Table 3, the impact fee required for the project is estimated to be $56,244.13 (53 net new PM peak hour trips X $1,061.21/trip). 4. Vehicle Access, Loading, and Circulation For student drop-off in the morning and pick-up in the afternoon, the school is proposing a clockwise "loop" configuration, shown on Figure 1. With this circulation, vehicles would enter via the west drive- way, circulate clockwise through or around the building, unload or load students on the vehicle passenger side at designated areas, and exit the site via the east driveway. Family vehicles would utilize an inside lane and pull into the underground parking area, where they would unload or load students at a designated loading zone. School buses would utilize an outer lane and pull around to a school bus load zone on the east side of the building. The site plan with proposed loading areas is shown on Figure 2. The project site is well suited to accommodate vehicle traffic generated by morning student drop-off and afternoon student pick-up activities. It is estimated that there would be space for 25 to 30 family vehicles to queue in a single line from the proposed vehicle loading zone, through the garage, and around the west side of the building to the entrance driveway, without spilling over to the street. Observations and analyses conducted by Heffron Transportation staff at numerous schools throughout the region have found that even though morning vehicle volumes are typically higher than afternoon vol- umes, queues during the morning drop-off period tend to be shorter because vehicles are more spread out, and stop only long enough for students to disembark. The following measures could be applied to reduce the potential for overspill during the afternoon pick up area: • Establish a secondary queue pick up line if a greater number of waiting vehicles are anticipated than a single line would accommodate, as shown on Figure 1. If needed, the school could direct families to proceed around the building (when the initial queue is full) and form an additional line (or lines) on the east side of the building. Staff would need to be present at the front of the east - side queue, and wave vehicles around to join the primary queue as pick-up activity proceeds and space becomes available (similar to how lanes of ferry queues are managed). As shown on Figure 2, there is a minimum 23-foot width throughout the drive aisles, including where landscaped curb bulbs serve as pinch points, so two lanes of traffic can be accommodated on all sides. • Lengthen the designated loading area within the garage to allow more than one vehicle to drop off or pick up students at a time. This would require restriction of a greater number of parking spaces within the garage. The recommended afternoon loading plan would require staff on site to direct traffic, with approximate locations where staff could be stationed shown on Figure 1. At a minimum, staff would need to be present at the student loading zones (family vehicle and bus). If a secondary vehicle queue is needed in the after- noon, additional staff should be stationed at the garage exit door (where vehicles exiting the garage would cross paths with vehicles proceeding from the secondary queue to the back of the primary queue), and also at the front of the secondary queue to direct vehicles when to proceed. The Figure 2 site plan indicates that the school bus load zone could accommodate two buses at a time. If more buses are anticipated, they could be accommodated either by staggering their arrivals, and/or by lengthening the bus loading zone. 5. Parking Demand Estimate The City's parking requirement for elementary schools is 1.5 spaces per staff member. The anticipated full staffing level of 22 equates to a parking requirement of 33 spaces. Counts performed by Heffron Transportation at several Seattle elementary schools in 2013 and 2014 for modernizations and replacement projects found peak school -day parking demand rates that ranged from 1.06 to 1.23 vehicles per employee. At these rates, the school -day parking demand would be 23 to 27 ve- hicles, which would be accommodated by the City's required parking supply. The 33-space covered parking area would accommodate this level of demand. However, it is expected that parking would be prohibited in some spaces in the garage where the student loading zone would be located, at least during periods of peak morning and afternoon activity. To accommodate parking demand beyond what could be provided in the garage, it is recommended that specific areas of the surface parking lot be designated for employee and/or visitor parking, located in ar- eas that would still allow the space needed to accommodate vehicle queues during the morning drop-off and afternoon pick-up periods. For example, the spaces along the north side of the building could be des- ignated for employee parking, and spaces along the south side of the building could be designated for vis- itor parking (though possibly restricted during the peak afternoon pick-up period). This would leave the areas around the perimeter of the site free to accommodate vehicle queues while still maintaining drive aisles on all sides of the building. Additional Recommendations In addition to the measures described above related to access, student loading, vehicle circulation, and parking, the following recommendations could be considered: • Because the surrounding sidewalk system is incomplete, it would be advisable to identify and provide families with a "safe routes to school" map that identifies pedestrian routes within a one - mile radius of the school. Crossing guards may be needed at intersections near the school. • The City of Tukwila has designated school zones with 20 mph speed limits. It is recommended that the school work with the City to request a school zone designation in the site vicinity. • The school could consider providing covered bike parking on site, to support bicycle commuting by faculty and staff. • The availability of transit service on Tukwila International Boulevard (with stops serving King County Metro Bus Routes 124 and 128) would provide a travel alternative that could reduce ve- hicle trips and parking demand generated by family vehicles and employees. The school could consider providing alternative mode incentives to faculty and staff (e.g. full or partial bus fare reimbursement, preferred parking spaces for those who commute by carpool or use alternative modes a designated number of times per week or month, and/or provision of "guaranteed ride home"3 for those who use alternative modes). Trip Generation Estimate 2.1. Project -Generated Trips Vehicle trips that the school could be generate were estimated by applying average Institute of Transpor- tation Engineers (ITE)t trip generation rates for an "Elementary School". These rates are summarized in Table 1. There is no explicit ITE land use category for Buddhist facilities. However, review of the operating char- acteristics of other Buddhist centers around the region, combined with review of potential ITE land use categories, found that "Church" (ITE Land Use Code 560) is the category that most closely represents this use. ITE defines the "Church" land use as "...a building in which public worship services are held. A church houses an assembly hall or sanctuary; it may also house meeting rooms, classrooms, and occa- sionally, dining, catering, or party facilities." Review of the calendars of other Buddhist temples and centers in the region found that most hold regular Sunday gatherings, along with events throughout the week including meditation or other classes during weekday mornings, afternoons, or evenings; they also provide guidance and resources for their members. Table 2 summarizes the average rates and trip esti- mates for each peak hour that would be eliminated with removal of the existing use. Table 2. Curbs, gutters, and sidewalks are intermittent and they are present along the frontage of the site. Parking lanes are not delineated but the street adjacent to the site has sufficient width (about 35 feet) to accommodate on -street parking in the westbound direction along the site frontage. • Tukwila International Boulevard — is a five -lane Principal Arterial that is a major north -south thoroughfare in Tukwila. The speed limit varies but is 40 mph near the site. • Military Road — is a two-lane Minor Arterial oriented roughly north -south direction. It has a speed limit of 35 mph. Transit: the site is served by King County Metro. The nearest stops are located on Tukwila International Boulevard at S 148th Street, about 600-feet walking distance. Planned transportation projects in site vicinity: no planned transportation improvements were identified that would affect transportation or capacity near the site. Proposed traffic circulation Without any additional surface or site improvements, the existing site configuration site supports a "loop" circulation clockwise around the building. It is expected that cars and busses would enter through the east entrance and form two parallel lanes of traffic - cars to the interior lane and busses to the exterior lane.
