This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project and permit

equipment cabinet, one(1) concrete pad, one (1) GPS antenna and four (4)
hybrid cables. This will be replaced with three (3) W Tri-ban Antenna, three (3)
2500 MHz RRHs, one (1) concrete pad, one (1) equipment cabinet, one (1) B-
cabinet, one (1) PCC, one (1) sevice light, one (1) GPS antenna, four (4) hybrid
cables and the addition of three (3) 1900 MHz RRUs and six (6) 800 Mhz RRUs.
The project also qualifies as an Eligible Facilities Modification under § 6409 of
the FCC's Spectrum Act, and Tukwila Municipal code 18.58.200, which requires
the City to approve any eligible facilities request for a modification of an existing
tower or base station that does not substantially change the physical
dimensions of such tower or base station. This proposal is not considered a
substantial change under the Tukwila Municipal Code 18.58.200.7, and falls
within the guidlines for an eligible facilities modification.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a
SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The Community Development Director has determined that the application for a
Wireless Telecommunication Facility does comply with applicable City and state code requirements and has
approved this application with the following condition.
1. The applicant must apply for a business licence to operate the wireless facility at this location.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010.
Other land use applications related to this project may still be pending.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of
the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the
conditions which were imposed by the MDNS decision or the failure of the Department to impose additional
conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner.
A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King
County Superior Court from the Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written notice of
appeal must be filed with the Department of Community Development within 14 days of the issuance of this
Decision.
The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall
be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association
or other group, the address and phone number of a contact person authorized to receive notices on the
appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any
specific challenge to an MDNS.

4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the
decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The
scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner
costs will be passed through to the appellant.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the
Hearing Examiner based on the information presented to the Community Development Director, who made the
original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be
allowed to present oral argument based on the information presented to the Community Development Director
before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant
to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or
an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in
Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS,
an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the
subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are available for
inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila,
Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Jonathan

Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact
the King County Assessor's Office for further information regarding property tax valuation changes.

In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides
location and design requirements for the placement of WCF within the City of Tukwila. In 2016 the city adopted
amendments to this ordinance in compliance with the Federal Spectrum Act.

CONCLUSIONS
1. The proposed modifications to the existing WCF will not significantly alter the conditions that currently exist
and will not be materially detrimental to the public welfare or injurious to property or improvements in the
vicinity.
2. As demonstrated in Table 1, the project meets all applicable development standards for a Type 1 WCF.
3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian
circulation, building or site design.
4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan.
5. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, which
requires the City to approve any eligible facilities request for a modification of an existing tower or base station
that does not substantially change the physical dimensions of such tower or base station.
RECOMMENDATIONS
The recommendation to the Director of Community Development is to approve this application for a Type 1
Wireless Telecommunications Facility permit with the following conditions.
1. The applicant must apply for a business license to operate the wireless communications facility at this
location.

STATEMENT OF COMPLIANCE WITH 20.20.195 COMMUNICATION, BROADCAST, AND
RELAY FACILITIES
PROJECT DESCRIPTION
Sprint is proposing to modify an existing wireless facility located at 13130 S. 1315t Place
Tukwila, WA 98168. The proposal consists of removing (3) (E) Antennas and
replacement - with •(3).(N)W Tri-Band Antennas. Removal of (3) (E) 2500 MHz RRHs and
replacement with (3) (N) 2500 MHz RRHs onmonop=ole Adding (3) (N) 1900 MHzRRUs
and;(6)_(N) 800 MHz RRUs on monopol4. Removal of (1) (E) Cabinet. Removal of (E)
concrete equipment pad and installment of (N) concrete equipment pad. Installment of
(1) (N) E-Cab, (1) (N)'B-Cab, (1) (N) PPC, and (1) (N) service light: Removal of (E) GPS
Antenna and replacement with (1) (N) GPS Antenna. Removal of (E) Hybrid Cables and
replacement with (4) (N) Hybrid Cables: Installment of New Chain Linnt Fence, The
existing chain Zink fence will be extended 6 feet out for a total of 12 feet additional
fencing. The additional fencing will encompass an area that is 96 sq. ft. This will require
an additional 6 feet of fencing on the northside and an additional 6 feet of fencing on
the southside.
ELIGIBLE FACILITY REQUEST
This project includes the collocation of new transmission equipment on an existing
monopole and the replacement of transmission equipment as such, it qualifies as an
eligible facility request under Section 6409(a) of the Middle Class Tax Relief and Job
Creation Act of 2012.
Further, none of the scope of work exceeds the standards for a "substantial increase in
size." The definition of "substantial increase in size" can be found in the Nationwide
Programmatic Agreement for the Collocation of Wireless Antennas (47 C.F.R. Part 1,
App. B), and has been adopted by the FCC for use in interpreting Section 6409. The
thresholds are the greater of:
• Height increases of more than 10% or 20 feet
• Horizontal equipment protrusions of 20 feet or the width of the structure
These standards are also recognized in state law, in the revision of SEPA to include these
sorts of collocations in the list of exemptions. See RCW 43.21C.0384.
SEC. 6409. WIRELESS FACILITIES DEPLOYMENT
FACILITY MODIFICATIONS.
(1) IN GENERAL. Notwithstanding section 704 of the Telecommunications Act of
1996 (Public Law 104-104) or any other provision of law, a State or local
government may not deny, and shall approve, any eligible facilities request for a

modification of an existing wireless tower or base station that does not
substantially change the physical dimensions of such tower or base station.
(2) ELIGIBLE FACILITIES REQUEST. For purposes of this subsection, the term "eligible
facilities request" means any request for modification of an existing wireless
tower or base station that involves —
a. collocation of new transmission equipment;
b. removal of transmission equipment; or
c. replacement of transmission equipment.
(3) APPLICABILITY OF ENVIRONMENTAL LAWS. Nothing in paragraph (1) shall be
construed to relieve the Commission from the requirements of the National
Historic Preservation Act or the National Environmental Policy Act of 1969.

Statement of Compliance with TMC Section 18.58
governing minor communications facilities
Project Description:
Sprint proposes to upgrade their equipment on an existing monopole style
communications tower. The modifications will be confined to the existing array and
existing facility footprint, and include replacement of antennas and installation of
radio units and filters. All work will take place within the footprint of the existing
facility, and no ground disturbance will be created.
Eligible Facilities Criteria (6409(a) of the Middle Class Tax Relief Act)
This project involves the replacement of transmission equipment (new model
antennas and radio equipment) and additional equipment (filters) within the footprint
of an existing facility. The scope of the project thus meets the requirements for an
"eligible facility." Additionally, the project will not substantially change the physical
dimensions of the facility as the project does not increase the facility height, width,
or increase the facility ground footprint.
23.57.012.A., uses permitted outright states that minor communications utilities
are permitted outright on existing freestanding major or minor telecommunication
utility towers. The proposed project is an equipment upgrade on an existing minor
communications facility (array) on a minor communications tower.
23.57.012.C. Development Standards:
1. Location: the project is at a location that has been legally permitted, and is a
modification to an approved existing use. The existing tower height and existing
antenna array will not change as a result of this project, and have been permitted.
2. Access and Signage: The facility is secured behind a locked fence only accessible
to authorized personnel. Further, T-Mobile's ground equipment is contained within a
locked equipment enclosure. The only signs on premises are required FCC signs and
emergency contact information.
3. N/A.
4. Visual Impacts: Given that the most visible portion of work proposed is a
replacement of existing amplifiers and radio units installed immediately below and
behind the antennas, no additional visual impacts will be created by this project. The
finish on the replacement equipment will be similar to the existing finish.
5. Reception Window Obstruction: No waivers are sought.

SECOND AMENDMENT TO SCHEDULE LICENSE OF SPACE
This Second Amendment (the "Second Amendment") to that certain Schedule
License of Space dated June 21, 2005 by and between American Tower Delaware
Corporation and Clearwire, LLC (the "License"), as amended by that certain First

WHEREAS, Licensor and Licensee entered into the Agreement for the use of a
certain portion of the Tower Facility; and
WHEREAS, Licensee desires to modify its equipment at the Tower Facility
("Modified Equipment"); and
WHEREAS, the Parties agree that as consideration for Licensee's 98486 Modified
Equipment, the current License Fee payable under the Agreement shall be increased as
set forth herein.
NOW THEREFORE, in consideration of the foregoing promises and for other
good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the Parties hereto agree as follows:
1) Licensor and Licensee agree and acknowledge that Licensee shall modify its
equipment for a final installed configuration pursuant to Exhibit A-2.
2) Licensor and Licensee agree and acknowledge that Exhibit A-1 to the Agreement
is hereby deleted in its entirety as of the date this Second Amendment is fully
executed and shall be replaced with Exhibit A-2 attached hereto and incorporated
by this reference. In the event of inconsistency or discrepancy between the
Exhibit A-2 and Licensee's equipment information set forth in the Agreement, the
Exhibit A-2 shall control.
3) Effective upon the earlier to occur of: i) the issue date of the NTP by Licensor; or
ii) 180 days from the full execution of this Second Amendment ("Commencement
Date"), the License Fee shall be increased by One Hundred Forty Five and 00/100
Dollars ($145.00) per month ("Increased Fee"). The Increased Fee for any
fractional month at the beginning or end of the period shall be appropriately

prorated.
4) Notwithstanding anything to the contrary in the Agreement, the offer to Licensee
expressed in this Second Amendment shall automatically become null and void
with no further obligation by either party hereto if a structural analysis of the
Tower Facility completed after the execution of this Second Amendment by
Licensor but before the Commencement Date of the installation of Licensee's
Modified Equipment indicates that the Tower Facility is not suitable for
Licensee's Modified Equipment unless Licensor and Licensee mutually agree that
structural modifications or repairs shall be made to the Tower Facility on
mutually agreeable terms.
5) Licensor and Licensee agree and acknowledge that this Second Amendment is
contingent upon AirTouch Communications, Inc. and/or its Affiliates' Right of
First Refusal.
6) Capitalized terms contained herein, unless otherwise defined, are intended to have
the same meaning and effect as that set forth in the Agreement.
7) All other terms and provisions of the Agreement remain in full force and effect.
