This will be replaced with three (3) W Tri-ban Antenna, three (3) 2500 MHz RRHs, one (1) concrete pad, one (1) equipment cabinet, one (1) B- cabinet, one (1) PCC, one (1) sevice light, one (1) GPS antenna, four (4) hybrid cables and the addition of three (3) 1900 MHz RRUs and six (6) 800 Mhz RRUs. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, and Tukwila Municipal code 18.58.200, which requires the City to approve any eligible facilities request for a modification of an existing tower or base station that does not substantially change the physical dimensions of such tower or base station. This proposal is not considered a substantial change under the Tukwila Municipal Code 18.58.200.7, and falls within the guidlines for an eligible facilities modification. DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a Wireless Telecommunication Facility does comply with applicable City and state code requirements and has approved this application with the following condition. 1. The applicant must apply for a business licence to operate the wireless facility at this location. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. Surrounding Land Uses The property is zoned within the Commercial/ Light Industrial zone(CLI) Surrounding parcels are zoned within the Commercial/ Light Industrial zone (CLI). The parcels sits adjacent to South 133rd Street and South 131' Place Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides location and design requirements for the placement of WCF within the City of Tukwila. In 2016 the city adopted amendments to this ordinance in compliance with the Federal Spectrum Act. The table below indicates if the applicant's proposal complies with required standards. The proposed modifications to the existing WCF will not significantly alter the conditions that currently exist and will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Table 1, the project meets all applicable development standards for a Type 1 WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 5. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, which requires the City to approve any eligible facilities request for a modification of an existing tower or base station that does not substantially change the physical dimensions of such tower or base station. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type 1 Wireless Telecommunications Facility permit with the following conditions. 1. The applicant must apply for a business license to operate the wireless communications facility at this location. ELIGIBLE FACILITY REQUEST This project includes the collocation of new transmission equipment on an existing monopole and the replacement of transmission equipment as such, it qualifies as an eligible facility request under Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012. Further, none of the scope of work exceeds the standards for a "substantial increase in size." The definition of "substantial increase in size" can be found in the Nationwide Programmatic Agreement for the Collocation of Wireless Antennas (47 C.F.R. Part 1, App. B), and has been adopted by the FCC for use in interpreting Section 6409. The thresholds are the greater of: • Height increases of more than 10% or 20 feet • Horizontal equipment protrusions of 20 feet or the width of the structure These standards are also recognized in state law, in the revision of SEPA to include these sorts of collocations in the list of exemptions. See RCW 43.21C.0384. SEC. 6409. WIRELESS FACILITIES DEPLOYMENT FACILITY MODIFICATIONS. (1) IN GENERAL. The modifications will be confined to the existing array and existing facility footprint, and include replacement of antennas and installation of radio units and filters. All work will take place within the footprint of the existing facility, and no ground disturbance will be created. Eligible Facilities Criteria (6409(a) of the Middle Class Tax Relief Act) This project involves the replacement of transmission equipment (new model antennas and radio equipment) and additional equipment (filters) within the footprint of an existing facility. The scope of the project thus meets the requirements for an "eligible facility." Additionally, the project will not substantially change the physical dimensions of the facility as the project does not increase the facility height, width, or increase the facility ground footprint. 23.57.012.A., uses permitted outright states that minor communications utilities are permitted outright on existing freestanding major or minor telecommunication utility towers. The proposed project is an equipment upgrade on an existing minor communications facility (array) on a minor communications tower. 23.57.012.C. Development Standards: 1. Location: the project is at a location that has been legally permitted, and is a modification to an approved existing use. The existing tower height and existing antenna array will not change as a result of this project, and have been permitted. 2. Access and Signage: The facility is secured behind a locked fence only accessible to authorized personnel. Further, T-Mobile's ground equipment is contained within a locked equipment enclosure. The only signs on premises are required FCC signs and emergency contact information. 3. N/A. 4. Visual Impacts: Given that the most visible portion of work proposed is a replacement of existing amplifiers and radio units installed immediately below and behind the antennas, no additional visual impacts will be created by this project.
