The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Informational Items: 1) : Fire hydrants: For short plat development (four single-family homes or less) and individual • single-family homes, fire hydrants shall be placed so that a hydrant is no more than 250 feet by line of vehicular travel to the nearest point of the building. For developments greater than four single-family homes, the hydrant shall be no more than 150 feet by line of vehicular travel to the nearest point of the building. 2) Fire Sprinkler System: An approved automatic fire sprinkler system shall be installed in new one - family and two-family dwellings and townhouses. Size water supply to accommodate the fire sprinkler system demand. 3) Fire ladder access: The final grading plan must show a flat area below any second story rescue windows for Fire Department ground ladder placement. If unable to provide a suitable flat area adjacent to the houses, please contact Don Tomaso at Don.Tomaso@Tukwilawa.gov with any questions. 4) The existing active Building Permit D17-0219 covers only the window and door removal/replacement and doesn't cover installation of two parking stalls nor abandonment of the existing water service and installation of a new one. Please see approval conditions 4-6 above. Installation of two parking stalls can be included in your Public Works permit. NEXT STEPS: 1. Construction permits: Install all required site improvements, including those proposed in the application and those identified above as conditions of approval. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433-0179 for a Public Works (PW) Type 'C' permit. For utilities provided by other entities, contact the individual providers. 2. Final Approval: Submit documents for final approval. After installing the required site improvements and complying with the conditions of approval submit the necessary short plat documents (survey, legal descriptions, and other required paper work) for city signatures. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. In Paragraph 9 of the Public Works section, a perc test for the site was considered. In this case I think we are okay at this stage with the observed soil documentation. The soils encountered on the site were a reasonably good medium sand (with slight traces of silt/clay) which based on appearance and manual field testing would function as the prescriptive "medium sand" in Appendix C. The two important logs (#1 and #2) were at the rear downhill part of the site where the trenches would be located. Based on the observed soil characteristics and the uniform material to depths of logs to 5 feet, I think we have soils that would function properly for the prescriptive rating. Also specific to this site is the downslope of the rear yard areas which would prevent a subsurface build-up of the underlying water table, which can be a real concern with level sites. If you still think a formal perc test is required we will be glad to do so, but would like to avoid the extra time and expense at this time unless you think the information would be really helpful. (An alternate idea would be to require a perc test (Small PIT) as a requirement for the residential permit drainage plan, which will require additional reworking anyway from this preliminary evaluation due to the specifics of the future house/pad layout and the actual areas of the new impervious areas created. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording: The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. EXPIRATION OF PRELIMINARY APPROVAL The final approved short plat must be filed with the King County Department of Records within one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. APPEAL RIGHTS This short plat approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW 36.70C. PAVEMENT MITIGATI[ON FEE The City does not allow pavement cuts in pavement that is three years old or newer (TMC 11.04 Recently Improved Street), except by written approval from the Public Works Director. Public Works charges a pavement mitigation fee whenever pavement in the right-of-way is disturbed. The pavement mitigation fee compensates the City for reduced life span due to disturbance of roadway surfaces. The fee is based on the total square footage of impacted pavement and on the remaining life of the existing pavement. The mitigation fee, based on cut limits shown on the permit plan set, is paid when the permit is issued. To estimate the cut area, add two feet to all sides of the expected cut limits before calculating the area. This fee may be adjusted, based on the Inspector's measurement of the actual cut limits. Steep Slopes. This site slopes downward to the east, away from the street. I appears the original general site slope was about 10 to 15 percent, with the front or west portion of the site leveled when the house and garage were constructed in 1954, some of the surplus being pushed to the rear behind the house and garage. Per the attached portion of the topographic drawing showing steep slopes, a fairly limited area of backyard area has an observed modest slope of from 15 to 25 percent. The area of the slope in this category is approximately 2,400 square feet. (Note that a very small localized area was rate at 40 percent, but it may be neglected for purposes of this discussion.) At present the slope area is old lawn or meadow, with some areas disturbed by the preliminary house remodel. Stability. The slope areas as they are presently configured and their vegetated surface present neither a soil failure/landslide failure possible situation or an erosion problem. More dramatic surface disturbance would require the placement of a silt fence along the rear downslope property line. 6 Note that the soils are substantially an original medium sand with enough fines (or silt) to act as a mechanical interlocking binder in the soil matrix. This feature of the site soils, combined with the actually very moderate slopes, provide the low possibility of slope failure due to seismic or wet season saturation failures. Contributing to this determination are the relatively deep permeable soils and sloping site topography, both of which features combine to prevent the soils becoming saturated and acquiring the 'lubrication" and "buoyancy" which would allow gravity failures in these modestly sloped soils. Conclusion. The site in its present condition has essentially no soils or topographic areas subject to seismic, wet season or serious erosion failure. Further evaluation is not required. Bruce S.
