I. DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Director has determined that the application for a Master Sign Program does comply with applicable City and state code requirements and based on the findings and conclusions contained in the staff report has approved the following deviations from the sign code: 1. The maximum size of the flush mounted wall sign on the south and northwest facade is allowed up to six percent of the exposed building face, but no larger than 250 square feet. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type2 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Hearing Examiner of the Board of Architectural Review Decision is permitted. No administrative appeal of a DNS or an EIS is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal. IV. PROCEDURES FOR APPEALING All appeals of decisions issued under this code must be filed with the Department within 14 days of the date of decision. At the time an appeal is filed, the appealing party shall pay an appeal fee pursuant to the current fee schedule. Appeals will be heard by the Hearing Examiner who shall conduct a closed -record appeal and consider only the information originally present to the Director. No administrative appeal is permitted for sign variances which shall go directly to King County Superior Court. TMC 19.12.120 V. NOTICE OF APPEALS A. Every notice of Appeal Shall contain 1. The name of the appealing party; 2. The address and phone number of the appealing party and if the appealing party is a corporation, association or group, the address and phone number of contact person authorized to receive noticed on the appealing party's behalf; 3. A statement identifying the decision being appealed and the alleged errors in that decision. The Notice of Appeal shall state specific errors of fact or errors in application of the lar in the decision being appealed, the harm suffered or anticipated by the appellant, and the relief sought. The scope of the appeal shall be limited to matters or issues raised in the Notice of Appeal B. The Notice of Appeal shall be distributed by the Department to the office of the Heating Examiner. VI. Details of Proposed New Building Mounted Sign City of Tukwila Allan Ekberg, Mayor Department of Community Development - Jack Pace, Director FINDINGS Background In August of 2010, the City adopted a new sign code to replace a sign code that had been in place for over 25 years. In adopting a new sign code, the city council found that large commercial complexes in the Tukwila Urban Center and the Tukwila South Districts have "...unique sign needs which requires a code that provides flexibility". To provide this flexibility, the City Council created a process called a Master Sign Program. Tukwila Municipal Code (TMC) 19.32.010 states that the intent of the Master Sign Program is to "...provide a voluntary process to allow for adaptation of the standard provisions of the Sign Code to the specific needs of larger sites. The signs provided through this process must be integrated into a cohesive design and communication approach for the site, while continuing to meet the overall intent of the Sign Code...". Two categories are eligible for the Master Sign Program: 1. Sites of 15 acres or more, developed with one or more buildings, totaling at least 200,000 square feet; or 2. Essential Public Facilities within commercial or industrial zones. The Master Sign Program is voluntary. The owner of a premise eligible for the Master Sign Program can choose to be governed under the prescribed Sign Code regulations found in TMC 19.20 or make application for the greater flexibility available under TMC 19.32. Bow Lake Transfer Center has submitted a Master Sign Permit Application for review by the City. Existing Development The Bow Lake Transfer Station development is located at 18800 Orillia Road South, Tukwila WA 98188. The premise is one contiguous parcel (King County Parcel # 3523049037) that has a total land area of 873,082 square feet, equal to 20.043 acres. The premise contains two buildings, with adjacent loading and unloading docks, that total to a building area over 200,000 square feet. Thus, the project is eligible for the Master Sign Program under TMC 19.32.020 (1). The site contains a mix of uses, including utility and recycling depots. As seen in the aerial photo below, the project is bordered by Interstate 5 to the West. Access to the site is through Orillia Road to the South. A building mounted sign is "...a sign permanently attached to a building and includes flush mounted sign, awning signs, projecting signs, etc. (TMC 19.080.065)". As seen in the definition of building mounted signs, the City allows a wide range of building mounted sign types. A freestanding sign is "...a sign supported by one or more uprights, poles or braces installed on a permanent foundation, not attached to a building or other structure (TMC Page 3 of 7 City of Tukwila Allan Ekberg, Mayor Department of Community Development- Jack Pace, Director 19.02.130)". The City's standard sign code provisions only allow monument type freestanding signs. The maximum height for a monument sign is eight feet. Master Sign Program The applicant has proposed a comprehensive sign package for their premise. The applicant's narrative on the proposed Master Sign Program is found with the details of the proposed signage. TMC 19.32.060 allows a wide range of deviation from the prescribed sign requirements found in TMC 19.20 The applicant is requesting to allow for a building mounted sign on the south facing facade that is not to exceed the sign size of 250 square feet. The applicant is not requesting any deviation from the Master Sign Program found in TMC 19.32 Master Sign Permit Criteria The criteria for reviewing a Master Sign Permit Application is found in TMC 19.32.040. Staff response is below. 1. The Master Sign Program meets the intent of the Sign Code as well or better than the signage allowed under the standard code provisions. The applicant is complying with the standard code provisions of the sign code. The applicant is not requesting any modification to the Master Sign Program. The Master Sign program allows for better signage for this larger site, than what would normally be allowed under the standard sign code provision. 2. The requested deviations from the code respond to the speci fic characteristics of use on the premises. Approved building mounted signs will fit within the allowed size within the Master Sign program for a building this size. Under the Master Sign. Program, the wall sign size can be up to 6% of the exposed building face, up to a maximum of 250 square feet. Bow Lake Transfer station is a unique use and the large size of the building has specific characteristics that qualify it for Master Sign Program. The program complies with the applicable standards of this Chapter Yes, this program will comply with the applicable sign standards of the Master Sign Program Chapter. 4. The existing and proposed signage is integrated with an overall lighting scheme for the projectsite to create asafe, lively, and inviting night-time environment if the si to is in a commercial zone. The existing lighting for Bow Lake Transfer Station has been layered to provide a safe and convenient travel loop for all customers. Larger building mounted signs are lit; and smaller wayfinding signs help direct traffic within Bow Lake Transfer Stationbut are not discernable from any public right of way, 5. Nosign-related code enforcementviolationson thepremisesfor at least oneyear priortosubmitting the Master Sign Program application. There have been no sign related code enforcement violations on this property for the last year. 6. The program must contain a schedule for the removal of all non -conforming signs on the premise within three years from the date of Master Sign Program approval. There are no, non -conforming signs to be removed on this premise. TMC 19.32.060A lists the allowable modifications under a Master Sign Program that can be approved administratively. See discussion below on how the proposed project meets these criteria. 19.32.060 Allowable Modifications Under a Master Sign Program A. Modifications to the following standards may be allowed under an administratively approved Master Sign Program: 1. Increase in monument sign total area of up to 25 percent. No increase in height permitted. At this time, the applicant has not applied for any monument signs. All future monument signs will be revised at the time of permitting to verify that it falls within the provisions of the master sign program. Increase in the area of a flush -mounted building sign, allowed per Section 19.20.050.A shall be allowed as follows: a. For premises up to 85 acres in size, the flush mounted building sign can be increased to six percent of the exposed building face, up to a maximum of 250 square feet. b. For premises 85 acres and over in size, the flush -mounted building sign can be increased up to six percent of the exposed building face, up to a maximum of 500 square feet, provided that no flush -mounted building sign with an area greater than 250 square feet is located within 250 feet of a public street. The premises is below 85 acres and has 63,439 square feet in exposed building face. This location can have a flush mounted sign that has the maximum square footage of 250 square feet. 2. Aggregation of the building -mounted or freestanding sign area allowed per Table 1 or Table 2 into fewer, larger signs of the same type. The applicant will not aggregate the allowable building mounted signs to accommodate fewer larger signs. 3. Up to four additional directional signs. The directional signs must utilize materials, colors and details consistent with the design of the other site signage. The applicant is not applying for any directional signs currently. All future directional signs will be reviewed at the time of permitting to verify that it falls within this provision. 5. In no more than one location on a premise, the allowable sign area for an exposed building face may be split between two flush -mounted building signs located on the same exposed building face so long as there is a minimum vertical separation of 20 feet between the two flush -mounted building signs. The applicant does not require this accommodation for their sign permitting purposes. CONCLUSION Per the Tukwila Municipal Code, this master sign application complies with the criteria set forth in sections 19.32.040 and 19.32.060. 1. The site is eligible for the Master Sign Program because it is over 15 acres in area and Page 6 of 7 City of Tukwila Allan Ekberg, Mayor Department of Community Development - Jack Pace, Director has building space more than 200,000 feet. 2. The design of the building mounted sign complies with applicable code standards. This site has been approved to have a building mounted sign with the maximum of 250 square feet on the south and northwest facades of the building. Both proposed signs fit within this threshold. 3. Freestanding mounted signs will be reviewed at time of application, to deem if signs are discernable from public right-of-way. 4. Flush mounted signs currently comply with the City's sign regulations and will continue to meet the requirements allowed under an increased size deviation through the Master Sign Program. 5. The proposed Master Sign Program presents a uniform, clear, and comprehensive approach to signage on the property. This design is consistent with the finishes of the buildings on the site. The building mounted signage has been integrated into the overall design of the building architecture RECOMMENDATION Staff recommends approval of Master Sign Program for Bow Lake Transfer Center to allow for a building mounted sign their south and northwest facing facade that is not to exceed the sign size of 250 square feet. The designation of landmark business as approved shall not constitute a grant of special privilege, which is inconsistent with the intent of this Sign Code. The adherence to the master sign program's landmark business amendment does not constitute a grant of special privilege and remains consistent with the intent of the Tukwila Sign Code (19.04.020). Specifically, it conforms through: • An informative rather than distractive demand upon on the public's attention • The establishment and or preservation of view corridors with an emphasis on the minimized appearance of clutter and the enhanced visual aesthetics derived from a scale in harmony with both the buildings architectural design and greater site considerations. Bow Lake Recycling Transfer Station (RTS) is sited in an isolated location, buffered visually from City of Tukwila properties on all but the 1-5 corridor WSDOT right-of-way as it transits the Tukwila city limits. Current WSDOT regulations and application to WSDOT project managers indicate that there is a policy prohibiting "location identification" ahead of exits even for essential utilities. i.e. other than airports and terminals. Because of this, the brief section of the 1-5 corridor constitutes the only viewpoint from which to visually locate this regional community service. Without this identification component the Bow Lake RTS's remains a nondescript roadside facility. However, by providing fatality identification signage, easily readable from a short section of roadway used by north and southbound transiting vehicles on 1-5, the essential physical reference identifying Bow Lake RTS's location for future use by the community can be easily acquired. To encourage this, WSDOT has indicated that they will accept proximity signage for Bow Lake RTS as permitted by the City of Tukwila (Code Intent, Objectives 4 & 5). The position of signs, configuration and aesthetic qualities (subtle lighting with simple graphics that have been scaled to fit its background) indicate that it will be both "attractive and inviting" rather than a demand on a viewer's attention; it will thus implicitly be answering the questions as use and purpose of the facility (Code Intent, Objectives 1 & 3). Harmonizing with the existing color scheme and organizational form which was originally intended to blend into the northwest's familiar heavily treed interstate roadsides, the facility identification is underwhelming and low contrast yet highly informative for those just passing City of Tukwila Master Sign Program Application (Landmark Business) for Bow Lake RTS October 23, 2017 through Tukwila as well as those activated citizens of the City of Tukwila who are looking for the convenient services their community offers (Code Intent, Objectives 2 & 6). 2. This amendment is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property which must be addressed to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. As noted above, the Bow Lake RTS property is visually isolated from adjacent properties within the boundaries of the City of Tukwila on the north, east and south. It is sited alone on a plateau adjacent to 1-5 at the end of Orillia Road South (private -use for Bow Lake RTS only). The property is heavily treed on its perimeter, permitting only occluded, long range views from the Green River valley to the east and below. Unlike other commercial and institutional properties along 1-5, the first signage encountered identifying the Bow Lake RTS facility is approximately 300' north up Orillia Road South as it rises from a busy, convoluted intersection with S 188th Street with no facility signage of its own. It should be noted that at that S. 188th Street intersection the Bow Lake RTS facility is hidden behind the trees that border the eastern side of Orillia Road South as well as the slope of the entry roadway which vehicles must negotiate. Consequently, prior information as to the location of Bow Lake RTS is important for its users to maneuver through traffic (east and westbound along S. 188th St. & I-5 exit and entering ramp bound vehiclles) and position themselves in the short, uncontrolled (no traffic light) east bound left turn lane to the facility. Or, better, plan -ahead and make their way to Bowl Lake RTS by proceeding up from the valley along Orillia Road South, so there is no need to contend with crossing traffic. These routing decisions are improved and managed with a clear knowledge of their destination via its recalled physical location, hence the value of signage only seen from 1-5 or in this case onsite. See attached site plan. 3. Compliance with the applicable standards of Chapters 19.20 & 19.32.060 As the Bow Lake RTS is sited on an isolated plateau above the Kent Valley, special exception to the facility sign size limits for readability along a short section of 1-5 neither competes with nor detracts from any of the signage from neighboring businesses and commercial properties in the valley below. The long views to the Bow Lake RTS facility available from the valley floor where these businesses and commercial properties are located do not include views of the signage as proposed. Adhering specifically to the classification for Landmark status the Bow Lake RTS meets the square footage requirements for a facility of at least 60,000 square feet of building space with at least five separate businesses or uses with a total business area of 95,880 square feet and seven separate business/profit center areas, comprised of Garbage, Recycling, Yard Waste, Transfers, Community Services, Material Recovery, and Administration. None of the preceding have discernable signage through any of the aforementioned view corridors. The Bow Lake RTS will only utilize two flush mounted (to the adjacent wall surface) signs, one facing northwest and comprised of 178SF resulting from no more than 6% of that facades total area, and the other facing south comprised of 342SF which is less than the 6% wall coverage allowed. 4. Integration of proposed signage into the buildings existing overall lighting scheme. The signage lighting system will be such that it subtly accentuates the lettering and thereby adding to the overall facilities building lighting plan rather than competing with it which will in turn facilitate a more uniform cohesive appearance. This will help minimize visual impact through reduced clutter and exaggerated contrast when viewed from the 1-5 corridor. S. There have been no sign -related code enforcement violations on the premises prior to submitting the Master Sign Program application. N/A at this time. 6. The program must contain a schedule for the removal of all non -conforming signs on the premises within three years from the date of the Master Sign Program approval. I have complete my review of the master sign application (it was done in March) and I was waiting for a file from you. I now have uploaded the final signed Notice of decision and staff report, but have not finalized the file, as I have not seen a sign permit application for this location. At this point, Bow lake Transfer has been approved to be a part of the master sign program for a site that is smaller than 85 acres. The sight has been approved to have larger building mounted signs on the South and northwest facades that do not exceed 250 square feet. Again, I have not closed the file and am waiting on the sign application. Once I sent my initial comments on Mach 26th, the clock paused for review time. The master sign application is considered a landuse permit, because the decision remains with the parcel. II know its confusing, but its 2 just to keep our filing system correct for records purposes. All I need is a sign application for two building mounted signs and then I will be able to attach the proposed signs to this file and approve the file. You will be good to go. There had been some discussion with Signage contractors to reference the latest in sign printing and attachment technologies and these substantiate the included design proposals, but I understood that we were stalled in the permitting process until we could find a way to get permission for the sign sizes and locations that KCSW was hoping for. I trust that that is what the Master Sign Permit will provide. We assumed we should then apply for the specific sign and size at each of the (2) locations allowed by the Master Sign Permit. However, as we don't imagine that the (2) signs will vary much from what we've proposed already, is it possible that we could be permitted with what we've already submitted? The proposed signs you had sent to me have been approved. The issue at this point is that the approved signs needs to be linked to a sign permit. The master sign application is considered a landuse permit, because the decision remains with the parcel. I know its confusing, but its just to keep our filing system correct for records purposes. All I need is a sign application for two building mounted signs and then I will be able to attach the proposed signs to this file and approve the file. You will be good to go. I am attaching a copy of the sign permit application. Jaclyn, our permit tech is included in the email. You will need to come into the office to pay for this permit. There had been some discussion with Signage contractors to reference the latest in sign printing and attachment technologies and these substantiate the included design proposals, but I understood that we were stalled in the permitting process until we could find a way to get permission for the sign sizes and locations that KCSW was hoping for. I trust that that is what the Master Sign Permit will provide. 1 We assumed we should then apply for the specific sign and size at each of the (2) locations allowed by the Master Sign Permit. However, as we don't imagine that the (2) signs will vary much from what we've proposed already, is it possible that we could be permitted with what we've already submitted? Or will the signs, methods of attachment and illumination (as appropriate), etc. have to be reviewed and permitted separately? Thanks for checking...we're eager to get something from the City of Tukwila indicating progress on the Bow Lake signage as from KCSW's viewpoint it has been a long process with several iterated attempts before we obtained an approval.
