DECISION SEPA Determination: The City of Tukwila prepared a Supplemental Environmental Impact Statement (SEIS) for the Southcenter Subarea under the State Environmental Policy Act (SEPA) as set forth in RCW 43.21C.420. Therefore, this project was exempt from SEPA review. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Design Review Minor Modification does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Jaimie Reavis, who may be contacted at 206-431-3659 for further information. The applicant is proposing to change colors and materials used for the siding, EIFS, and Sunscreen Structures of the building. The narrative below each of the proposed modification describes the existing condition; the proposed revisions; applicant's rationale for revision; and staff analysis. 1. Substitution of anew color and material for the gray siding used on the building, and anew color for the lighter EIFS areas of the building. Existing Design Condition: The color of the gray siding originally approved for Woodspring Suites is a Woodtone "Coastal Gray", a prefinished cement board siding manufactured with a horizontal wood grain pattern and dark and light gray tones to resemble wood planks. The proposed modification is to substitute cement board siding painted "Grizzle Gray". The color of the EIFS originally approved by in the design review of Woodspring Suites is a light gray "Gray Screen". The proposed modification is to substitute a "Pure White" color. See last page of Attachment B for samples of existing and proposed colors. Applicant's Rationale for Design Revision (from Attachment A): Switching to painted cement board vs. the prefinished Woodtone cement board siding will have very little impact on the overall aesthetics of the building and results in a significant cost savings to the owner. The SW Grizzle Gray follows the Southcenter Design Manual (SDM) requirements in that the primary color of the building should complement the region. In our case, the darker gray color complements the often - overcast skies of the region. The EIFS portions of the building are considered the accent elements of the elevation per the SDM. The current EIFS color does not give the necessary contrast to the other colors present on the elevations. Revising to SW "Pure White" will give the elevations visual relief and contrast to the rest of the elevation. Another factor that has prompted the requires for this color substitution request is due to brand identity. There are several Woodspring Hotels being built in the Seattle market. Keeping the color palette of the properties the same will help increase brand identity. The picture above shows the Woodspring Suites Hotel that was recently completed in Redmond, which uses the same "Grizzle Gray" color on painted cement board and "Pure White" color for the EIFS as is proposed in this application. The colors are similar to the originals but are unique enough to help bring even more appeal and contrast to the building elevations. Staff Analysis: The color substitutions proposed for siding and EIFS areas can be considered a minor modification. Both the original prefinished Woodtone cement board siding and the proposed painted cement board siding are simulated cladding materials. The prefinished Woodtone cement board has texture and variegated color to simulate wood grain. The "Grizzle Gray" painted cement board proposed will not have the texture or variegated gray colors that were originally proposed, but will instead simulate painted wood siding, using a flat gray color. The proposed cladding material and color is appropriate to the architectural style and building type, and the color is saturated, consistent with the original design review approval and the SDM. Staff agrees that the "Pure White" EIFS proposed will provide greater contrast to the gray and brown siding used on the building, giving the elevations visual relief. As part of the change to the EIFS color, staff inquired as to whether elements on the building fagade within the EIFS areas, including the PTAC units and window shadow boxes, could be painted white to match the EIFS and blend in with the surrounding fagade. This requested treatment would result in the same look of the PTAC units, vents, and window areas in the white EIFS areas of the Redmond project (see area highlighted in the red box at right). The applicant agreed to paint the PTAC units and window shadow boxes the same "Pure White" color, as the EIFS as part of this minor modification request. 2. Substitution of black for the cedar sunscreen structures color. Existing Design Condition: The color of the sunscreen structures approved as part of the original design review is the Woodtone "Alpine Cedar"; the same color used for the cedar -colored siding at the middle and ends of the building. Applicant's Rationale for Design Revision (from Attachment A): The applicant would like the sunscreens to be painted black (Caviar) to match the window frames and the fascia. Staff agrees that the black color will still be consistent with the color scheme of the building, and will still have the effect of creating a horizontal element that helps to aesthetically "tie" the building to the ground. CONCLUSIONS: The following proposed modifications can be considered minor modifications: 1. Substitution of the cement board siding painted "Grizzle Gray" for the originally approved Woodtone "Coastal Gray" prefinished cement board siding. 2. Substitution of "Pure White" colored EIFS for the originally approved "Gray Screen" colored EIFS. Other elements within the white EIFS areas will be painted "Pure White" to blend in, including PTAC units, vents, and window shadow boxes. 3. Substitution of black "Caviar" color for the originally approved Woodtone "Alpine Cedar" color for the sunscreen structures. RECOMMENDATION: Staff recommends approval of the request for a minor modification to the Board of Architectural Review of the Woodspring Suites. Your comments are in regular type followed by our responses in bold face type. BUILDING DEPARTMENT REVIEW: 1. Please provide a site plan with the plan set. Show "north arrow," show streets, setbacks and dimensions, show drainage, driveways, sidewalks, parking, accessible parking, with number of parking spaces identified (refer to planning requirements) and all necessary elements for a site plan. RESPONSE: A copy of the latest Public Works Permit plan set provided with this re -submittal for reference as requested. That permit is currently under (review and approval is pending. A copy of the approved Public Works Permit will be provided prior to final building permit approval. 2. The cover sheet Applicable Code column references International Plumbing Code and 2010 American Standards accessible codes. Revise to specify 2012 UPC Uniform Plumbing Code and only 2009 ANSI accessible codes. RESPONSE: Acknowledged. Please see the Cover Sheet T1 for revised applicable codes. 3. Sheet GIA for the shower wall detail #2 specifies 2 layers of GWB for the shower. It also refers to sheet 4/A3.3 which appears to be an incorrect detail. Shower compartments and walls above bathtubs with installed shower heads shall be finished with a smooth, nonabsorbent surface to a height not less than 70 inches above the drain inlet. Revise notes and details to reflect the wall covering requirements at the shower & tub walls. (IBC 1210.2.3 & 2511.5) RESPONSE: Acknowledged. Provide details about the elevator and elevator shaft specifications concerning the shaft pressurization, shaft penetrations and items not allowed in shaft walls as it applies. In the details for the elevator car sized to accommodate an ambulance stretcher. Provide specific information for the elevator doors to show compliance with the shaft ratings for smoke and fire. (IBC 3002.4 & WSA) RESPONSE: Acknowledged. Per the elevator manufacturer, the exhaust duct penetrating the elevator shaft is required. There is to be a fire/smoke damper installed where the duct penetrates the elevator shaft as called out on Detail 4 on Sheet M-2. Please see Sheet A6.2 showing the addition of fire and smoke doors at each of the upper floors, separating the corridor from the elevator shaft. Please also see attached elevator model information for required clearances and dimensions per Code as called out on page 15 of Specification Section 142400. 10.In the door schedule some of the doors are not indicating the rating. Show the space for recycled materials and waste materials are sized to be sufficient for the potential volume of waste materials described above. (WAC 51-50-009) RESPONSE: Acknowledged. The owner shall engage and designate on this building permit application a registered design professional who shall act as the registered design professional in responsible charge. The registered design professional in responsible charge shall be responsible for reviewing and coordinating submittal documents prepared by others, including phased and deferred submittal items, for compatibility with the design of the building. Also note, the building official shall be notified in writing by the owner if the registered design professional in responsible charge is changed or is unable to continue to perform duties. Please provide this signed documentation from the owner, the name of the registered design professional in responsible charge and to include all necessary contact information i.e. email address, business phone and location. This documentation shall be presented to the building official prior to approval of construction plans and related permit documents. (IBC [A] 107.3.4) RESPONSE: An updated building permit application is included with this resubmittal showing the project architect of BRR Architecture, Inc. as the registered design professional in responsible charge. 13. Provide specifications for area of refuge and two way communications as required at the exit stairs. The elevator car must be large enough to accommodate a stretcher per IBC. RESPONSE: Please see the attached cut sheet from the elevator that is specified indicating that the elevator size meets the requirements of the International Building Code. PLAAWZNG DEPARTMENT REVIEW: 1. This permit includes 114 guest rooms and 110 parking spaces on site. Zoning requires ,J one parking space per guest room. Plans shall be revised to address parking requirements. RESPONSE: The owner/developer of the proposed hotel is in the process of negotiating a shared parking agreement with an established professional office building (dentist office) located immediately opposite the site on the east side of West Valley Highway. That agreement would secure a minimum of 4 additional narking stalls for the project and would make the 114-room plan conforming. It Ss understood that a formal shared parking agreement would need to be recorded against the title for both the receiving and sending sites, and the form of that agreement would require City review and approval. While both the agreement is secured and the form reviewed (separate from the building permit), it is requested that the review and approval process for the building permit be allowed to proceed based on the 114-room configuration. The owner/developer understands that if a shared parking agreement is not executed, that the maximum number of rooms that the hotel can have is 110. In that unlikely event, the plans would be revised to show_110 guest rooms. 2. Provide detailed construction sequencing so we will know at what stage during construction the following will occur: work within the shoreline area, (including removal of invasive species, installation of storm drainage features, installation of irrigation, planting with native species); excavation (with depth indicated for different areas of the site); installation of structural soils; paving; installation of storm drainage features and utilities, installation of landscaping, installation of parking lot lighting, building construction, etc. Indicate which work will be done as part of this permit, and which work will be done as part of the public works permit. Mark plan sheets that include work to be done as part of the public works permit on "For Reference Only - See Public Works Permit." It seems like project landscaping will need to be done once the building is constructed in order to prevent damage to landscape areas and plantings during construction. The mitigation work, however, may be able to be completed as part of the Public Works permit. Construction sequencing should be made very clear for both permits. Add notes related to the recommendations from the Cultural Resources Assessment to any application plan sheets, including the recommendation that a professional archaeologist monitor construction excavation to identify any deeply buried cultural deposits that could potentially be present. The farms they established stretched from Renton Junction (in the area of Interurban Avenue and Grady Way) to the area known as Orillia as well as Westfield Southcenter. A family home was built in 1905 and the structure is now known as the Nelsen Family residence. Helen, the youngest daughter of James Nelsen, was born in the home in 1906. She was a local business- woman, former Tukwila City Council member and founding officer of the Tukwila Historical Society. A 1909 ban on gambling closed the racetrack known as "the Mead- ows" located on the south end of present day Boeing Field. The ban was lifted after a bill became law on March 20, 1933. Then on June 20th, 1933, Vinson "Joe" Gottstein founded the Washington Jockey Club. Some of the dairy land originally owned by James Nelsen was purchased by Gottstein and others to operate a one -mile track which became Lon- gacres Racetrack in August 1933. A permit was obtained and the Lon- gacres Racetrack was created in only 30 days. The Longacres Racetrack was in operation from Aug. 3, 1933 until Sept. 21, 1992. At the time of the sale to the Boeing Co., the track was owned and operated by members of the Alhadeff family, who were re- lated to the Gottstein family. This facility hosted an exhibition by Triple Crown winner, Seattle Slew, and saw the famous jockey, Gary Stevens, on several mounts at the track. A former paddock barn (featured in the photo by Richard McLeland-Wieser) which was originally located at Longacres can still be seen next to the Nelsen House. Our annual December Holiday "Open House;' which is hosted by the Tukwila Historical Society and the Nelsen Family Residence Trust, will be held on Thursday, Dec. 17, from 6 p.m. to 9 p.m. Tours of the home and refreshments will be provided. STEAM is much more than just a focus on these certain academic subjects; it is a way of teaching that helps students think deeply and critically as they use content knowledge to collaboratively solve real -world problems. Because busi- ness and industry are calling attention to the importance of these subject areas and their relationship to preparing students for the competitive workplace — where they will be expected to collaborate, cooperate, and communicate with team members us- ing project -based scenarios —the district must respond accordingly. -Therefore, Tuk- wila School District will began to redesign its facilities and curriculum to mirror the real world, to ensure content knowledge is interwoven, layered, and sophisticated, not experienced in isolation such as in tra- ditional education settings (separate math time, separate science time, etc.). We don't know exactly what that looks like yet, but we are exploring in- novative classrooms, creative spaces and 21st century state-of-the-art technology. One potential model is called SmartLabs — a fully integrated learning environ- ment where everything from the furniture to the technology to the curriculum work together to support hands-on, minds -on learning. If you were to peek into such a lab, you'd see students moving and creat- ing, inquiring, building, exploring, and collaborating, working in pods with pre- sentation stations.- There is a buzz! Stu- dents lead their own learning with teachers guiding and facilitating. Students with all different abilities and skills —not just those who gravitate toward math and science — are engaged and successful. This is par- ticularly powerful for gifted students who want to dig deeper, for special education students who may learn kinesthetically, for English language learners who understand through hands-on experiences, for un- engaged students who need relevancy in classwork—okay, this is a powerful model for all students! Our teachers and educa- tional leaders will be involved in every as- pect of designing the new classroom spaces to match these instructional practices. We are also working on exciting new partnerships and programs that fit our STEAM focus. Our region is rich with in- dustry: manufacturing, technology, medi- cal care, aviation, and more. After meeting with business leaders, it is clear that they are hungry for graduates with skills to fill their job vacancies. We are speaking with some of these corporations about a nation- al certificated program that would usher a student directly into a living -wage, career - oriented job. If a student is college -bound, she or he would enter with advanced cred- its and skills. If we can train our students, business leaders have told us they have space for them in abundance! Our efforts with students will begin early, helping even elementary children to identify career in- terests with job shadows, career presenta- tions, STEAM clubs, mentorships, science and technology fairs, field trips and more. Perhaps most simply stated, STEAM is our effort to prepare our students with 21st Century skills for 21st Century jobs. This is our commitment to invest in our local and global economy. We will cre- ate clear pathways for every student to a skilled, living -wage job that matches their interests. We will enhance our community through ensuring our students are well prepared for future employment with lo- cal industry. All of this will take focused business partnerships, and we have started those conversations. We already have an analysis in hand of the top 25 jobs in our region that will be the most in demand in the next few decades. Our students will be ready to fill them. Those that suffered property damage or other losses in the storm may be eligible for assistance to get their property back in order. Eligibility is determined through a damage assessment process which takes into account the total reported losses within King County. In order to compute the losses; individuals and busi- nesses,are encouraged to submit reports to King County Emergency Management. A webpage, www.kingcounty. gov/damage, is now open to receive damage reports for individuals and businesses in King County. In addition, a hotline number, 1-800-523-5044, will be available for individuals and businesses to record a dam- age report Monday through Friday, 10 a.m. to 4 p.m. be- ginning Dec. 14. Submitting a report does not guarantee reimbursement. Damage reports are for uninsured losses. Before filing a damage report with King County, residents and business owners should contact their insurance provider about existing coverage and deductibles. They are -also urged to document damage with photographs and keep records of all cleanup and repair costs. Residents in unincorporated King County whose homes were damaged in the storm can obtain free build- ing inspections from the King County Department of Per- mitting and Environmental Review (DPER). DPER has waived the associated fee to help residents speed up repair to their property. Priority service will be given for dam- - aged structures requiring permits for repair work. Inspectors will evaluate the integrity of structures, as- sess if a structure is safe to occupy, and whether a permit is required for repair work. Inspection. staff may also advise customers of the need to pursue a more detailed inspec- tion from a licensed structural engineer to determine the full extent of the damage.
