A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUKWILA, WASHINGTON, DECLARING AN
EMERGENCY IN RESPONSE TO A FAILED SEWER
LINE ON SOUTHCENTER PARKWAY.
WHEREAS, the Revised Code of Washington (RCW) chapter 38.52 authorizes the
Mayor to exercise emergency powers; and
WHEREAS, Tukwila Municipal Code (TMC) Section 2.57.030(1) empowers the
Mayor to proclaim a state of emergency when an incident, whether natural or man-made,
requires immediate responsive action to protect life and property; and
WHEREAS, a sanitary sewer line serving businesses on Southcenter Parkway has
failed, and the line has deteriorated to the point that a slip line repair was not possible,
thereby compelling the need to replace the failed sewer line; and
WHEREAS, on an interim basis only, a bypass pumping system has been
implemented to temporarily provide service and avoid serious risk to public health and
safety until the failed sewer line can be replaced; and
WHEREAS, heavy precipitation anticipated in the coming weeks coupled with high
traffic volumes on the Parkway could exacerbate the situation by destabilizing the soil
surrounding the failed sewer line; and
WHEREAS, the City wishes to waive the usual open, competitive bidding procedures
in order to replace the failed sewer line as expeditiously as possible, and a formal
declaration of emergency allows the City to procure the needed resources, such as crews,
equipment, and materials, in an urgent and expedient manner; and
WHEREAS, the City's Public Works Director and Emergency Management
Coordinator recommend that an emergency be declared in the City of Tukwila related to
this sewer line failure and expedited need to replace it with a new sewer line; and
WHEREAS, the Mayor and City Council do hereby find that conditions of peril to the
safety of persons and property are threatened within the City, caused by the failed sewer
line on Southcenter Parkway;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. Emergency Declared. The City Council supports this declaration of
emergency and authorizes the execution of contracts or agreements relating to the
replacement of the failed sewer line on Southcenter Parkway and hereby authorizes City
forces to respond in the most effective and expedient manner, without regard for the
procedures and formalities that would otherwise govern the assignment of duties,
procurement of materials, and contracting of services. This situation is an emergency as
defined in RCW 39.04.280(3).
Section 2. Emergency Powers Authorized. It is hereby declared that during the
existence of said local emergency, the powers, functions, and duties necessary to
prepare for, stabilize and control said incident are given to the Emergency Management
Coordinator and Public Works Director.
Section 3. Termination of Emergency Upon Completion of Sewer Line
Replacement, The local emergency shall be deemed to continue to exist until the work
to replace the failed sewer line is completed, which shall be reported to the Mayor and
Council by the Public Works Director or their designee.
