EASEMENT
GROUP HEALTH COOPERATIVE OP PUGET SOUND, a Washington non-profit
corporation, hereinafter referred to as "GRANTOR," for 51000, which is hereby
acknowledged to be fair and Just compensation. do by these presents grant unto THE CITY
OF TUKWILA, a municipal corporation of King Canty. Washington, hereinafter referred
to as "GRANTEE." a perpetual right-of-way easement for traffic signal Zaps- traffic signal
poles, mast arms and cabmen purposes with the necessary appurtenances through, over and
across the property crosshatched and described on Exhibit A. which property is situated in
King County, Washington
GRANTEE shall have the right, without prior institution of any suit or proceeding at law, at
times as may be necessary to enter upon said property, for the purpose of construction.
repairing, altering or reconstruction said traffic signal loops, traffic signal poles, mast arms
and cabinets or malting any connections therefore; provided that such constructing,
repairing, altering or reconstructing of said traffic signal loops, traffic signal poles, mast
arms and cabinets shall be accomplished m such a manner that the private improvements
existing outside the sidewalk area in this right-of-way shall not be disturbed or destroyed. or
in the event they are disturbed or destroyed, they will be replaced in as good a condition as
they were immediately before the properly was entered upon by the GRANTEE
The GRANTOR shall retain the right to use said easement, so long as said use does not
interfere with the installation and maintenance of the traffic signal loops, traffic signal
poles. mast arms and cabinets and so long as the use does not interfere with use and
purposes herein mentioned.
GRANTEE agrees that upon completion of such work, the surface of such easement shall be
restored and replaced to a condition substantially equal to that before the work was
commenced, to the extent that it is practical to do so.
GRANTOR shall not be liable for, and GRANTEE shall defend. indemnify, hold harmless
and protect GRANTOR from any claim or liability, which may be made, incurred or
asserted by GRANTEE, GRANTEE', agents or employees, contractors, or any third
part., arising directly of indirectly from the construction. repair, alteration, improvement
or use of the traffic signal loops, traffic signal poles. mast arms and cabinets
This easement shall be a covenant running with the land and shall be binding upon the
successors, hairs and assigns of the GRANTOR hereto
