Tukw ila, a W%ashin-ton Municipal Corporation. as Grantee. Grantor and Grantee (also denoted as Cite herein)
are each a farts and collectively the Parties to this Agreement.

2.2 Pursuant to "TMC 14.30.060.. application for and issuance ol`such permit requires the property
owner to enter into this Covenant.
2.3 The Subject ofthe Covenant is the real property located in King County_ Washington. bearing=
King County Tax Parcel No. 34gg0-0950and legally described in the attached Exhibit A
incorporated herein ("property").
2.4 The Cit) approved the applications which consist of the 1,611mt ing docunhents, attached and
incorporated herein:

NOW THEREFORE, in consideration of the foregoing recitals and other good and valuable
consideration including approval and issuance of City of Tukwila Permit (ruurnc�r anJ cl�rlc �. the 51.111 iency
and receipt of atihich are acknowledged. Grantor herch)• irrevocably covenants as follows:
3.1 The foregoiing Recitals and references to eloamlents are incorporated as material terms of this
Covenant .
3.2 The Grantor(s) Ibl, itself and ils Successors in interctil having any o%ti nership interest in (lie
Property (collectively O»ncrs) shall at their sole cost and expense retain_ uphold, operate. maintain. and repair
the stormaeater facilities and best management practices ('FiMPs") located on the Property pursuant to the
schedule within the Operations R Maintenance Plan.
3.3 The obligations required under Section 3.2 above shall be taken consistent the lollov,ing:

necessary to perform inspections ol'tlhe stormwater lacililies and 13NIPs and conduct other activities specified
in this Declaration of Covenant and in accordance with Tukwila Municipal Code (`:TMC") 14.30.80. This
Light of ingress and egress, right to inspect. and right to perform required maintenance or repair shall be as
provided Iihr in subsection 3.3 .2 below.

3.3.2 Ifthe City determines that maintenance or repair nyork is required to be done to any
of the stornnwater facilities or 13NiPs, the Director of Public Works or designee (the "Director") shall give
notice ofthe specific maintenance and/or repair work required pursuant to TYIC 1=4.30.080. -file Director shall
also set a reasonable time in which such work is to be completed by the Owner. If the above required
maintenance or repair is not completed within the time set by the Director. the City may perform the required
maintenance or repair. and is hereby granted access to the Property for such pu poses. Written notice will be
mailed to the Owner stating the City's intention to perform such work. This work will not commence until at
least seven (7) days alter such notice is mailed. 11. within the sole discretion of the Director. there exists an
imminent or present clanger. the seven (7) clay notice period will be waived and maintenance and/or repair
wort: will begin immediately.
.3.4 11' at any time the City reasonably determines that a stornmater facility or BN1P on the
Property presents an imminent hazard. as identified by TIVIC 14.30.080 and hereon incorporated by reference.

3.5 Tine Owner shall assume all responsibility for the cost of any nnaintenance or repair work
completed by the Cit\ as describes! in Covenant. Such responsibility shall include reimbursement to the City
within thirty (30) days of the receipt of the irivoice for any Such lvork performed. Overdtle payments will
require payment of interest at the current legal rate as liquidated damages. All such costs and expense shall
constitute alien aw,minst the Properly.
3.6 The Owners shall obtain a Type C Public Works permit from the City prior to filling. piping.
cutting. or removing vegetation (except in routine landscape maintenance such as replacement ol'plants and
pretreaunnent mulch) in open vegetated storrrtwater facilities (such as swales, channels_ ditches, ponds, etc.).
or performim, ant alterations or modifications to the stormwater facilities and BN I's referenced in this
Covenant. Prior to the final approval and issuance of the new permit, a new Covenant with updated exhibits
reflecting the changes to the stormwater facilities shall be recorded at tine Owner's sole cost. and a copy of the
neer recorded Declaration of Covenant provided to the City.
3.7 Any notice or consent regtdred to be ugiven or otheree ise proti ided for by the provisions of this
Declaration ol'Covenant shall be effective upon personal delivery, or three (3) clays ager mailing by Certified

3.8 With regard to the matters addressed herein. this Covenant constitutes the entirea`.:reemenl
between the pat -ties. and supersedes all prior discussions, negotiations. and all agreements whatsoever «hcther
oral or written. This Covenant shall be governed by tine laws orthe State of Washington. Anv suit to enforce
or relating to this Covenant shall only be filed on King County Superior Court. Kong County. Washimton. and
the Parties consent to the jurisdiction thereof. In fine event of any legal action by either Party relating to this

If the basic dispersion flow control BMP is proposed. for a project, the following maintenance and
operation instructions must be recorded as an attachment to the required declaration of covenant and
grant of easement per Requirement 3 of Section 0.1.3.4 (p. C-23), The intent of these instructions is to
explain to future property owners, the purpose of the BN4P and how it must be maintained and operated.
These instructions are intended to be a minimum; MS -Permitting may require additional instructions
based on site-specific conditions. Also, as the County gains more experience, with the maintenance and
operation of these BMPs, future updates to the instructions will be posted on King County's &rface Water
Design Manual website.
A reproducible copy of the instructions, prepared for inclusion with the declaration of covenant, is located
in Reference M.
Your property contains a stormwater management flow control BMP (best management practice) called
"basic dispersion," which was installed to mitigate the stormwater quantity and quality impacts of some or
all of the impervious surfaces or non-native pervious surfaces on your property. Basic dispersion is a
strategy for utilizing any available capacity of onsite vegetated areas to retain, absorb, and filter the runoff
from developed surfaces. This flow control BMP has two primary components that must be maintained: (1)
the devices that disperse runoff from the developed surfaces and (2) the vegetated area over which runoff
is dispersed,

The dispersion devices used on your property include the following as Indicated on the flow control BMP
site plan: U splash blocks, U rock pads,Xgravei filled trenches, b sheet flow. The size, placement,
composition, and downstream flowpaths of these devices as depicted by the flow control BMP site plan
and design details must be maintained and may not be changed without written approval either from the
King County Water and Land Resources Division or through a future development permit from King
County,
Dispersion devices must be inspected annually and after major storm events to identify and repair any
physical defects, When native soil is exposed or erosion channels are present, the sources of the erosion
or concentrated flow need to be identified and mitigated. Concentrated flow can be mitigated by leveling
the edge of the pervious area and/or realigning or replenishing the rocks in the dispersion device, such as
in rock pads and gravel filled trenches.

The vegetated area over which runoff is dispersed must be maintained in good condition free of bare spots
and obstructions that would concentrate flows,

all of the impervious surfaces on your property. Limited infiltration is a method of soaking runoff from
impervious area (such as paved areas and roofs) into the ground. Infiltration devices, such as gravel filled
trenches, drywells, and ground surface depressions, facilitate this process by putting runoff In direct
contact with the soil and holding the runoff long enough to soak most of it into the ground. To be
successful, the soil condition around the infiltration device must be able to soak water into the ground for a
reasonable number of years.
The infiltration devices used on your property include the following as indicated on the flow control BMP
site plan: Q gravel filled trenches, W drywells. The size, placement, and composition of these devices as
depicted by the flow control BMP site plan and design details must be maintained and may not be changed
without written approval either from the King County Water and Land Resources Division or through a
future development permit from King County.
Infiltration devices must be Inspected annually and after major storm events to identify and repair any
physical defects. Maintenance and operation of the system should focus on ensuring the system's viability
by preventing sediment -laden flows from entering the device. Excessive sedimentation will result in a
plugged ar non-functioning facility. If the infiltration device has a catch basin, sediment accumulation must
be removed on a yearly basis or more frequently if necessary. Prolonged pending around or atop a device
may indicate a plugged facility. If the device becomes plugged, it must be replaced, Keeping the areas
that drain to infiltration devices welt swept and clean will enhance the longevity of these devices. For roofs
frequent cleaning of gutters will reduce sediment loads to these devices.
