MOVE TO authorize the Mayor to sign an agreement with CM Design
Group, in the amount of $197,900.80 for the TIB Light Rail Access
Project.
This project improves bike and pedestrian access to the Sound Transit Tukwila International Boulevard
(TIB) stop through upgraded bike lanes, safer crossings, a traffic -calmed corridor on 42nd Ave S, and a
new pathway connecting the TIB North Park -and -Ride parking lot to the existing path at S 152nd St
along the Confluence Apartments. With Sound Transit funding, the design will support phased
improvements that strengthen non -motorized access to the light rail station, reduce parking demand,
and provide safer, more direct "last -mile" options for nearby residents.
DISCUSSION
The design will include new/updated bike lanes, shared -use paths, and traffic -calming elements along
42nd Ave S and Southcenter Blvd, including separated bike lanes, high -visibility crosswalks, and
shorter crossing distances at key intersections. Within the TIB North Park -and -Ride parking lot, the
design will create a new pathway linking the station to the sidewalk on S 152nd St, supported by
lighting, markings, and minor grading. Overall, the design will enhance bike/vehicle separation, improve
pedestrian visibility, and expand the non -motorized network serving the surrounding neighborhoods.

Project Description
This project includes the design and preparation of plans, specifications and estimates (PS&E) for the City of
Tukwila Tukwila International Boulevard (TIB) Light Rail Access Project. The project limits are:
y Southcenter Boulevard from 42"d Ave S to Tukwila International Boulevard
42"d Ave S from Southcenter Boulevard to S 150th St
Southcenter Boulevard is a is a two-lane arterial adjacent to residential and multi -family properties at the
south end of the corridor, and the TIB Light Rail Station parking lots and commercial properties at the north
end. 42"d Ave S is a two-lane.
Improvements to Southcenter Boulevard include:
• Rechannelize roadway with 11' general purposed lanes to accommodate separate bike lanes with a
tuff curb post buffer
• Tighten the intersection at both legs of 40th Ave S to shorten crossing distance for peds and bikes
• Add bike channelization such as crossbikes at the intersection of Southcenter Boulevard and TIBS
station entrance
• Upgrade crosswalk markings to high visibility at Southcenter Boulevard and TIBS station entrance
and Southcenter Boulevard & 40th Ave S
Improvements to 42"d Ave S include:
• Develop a traffic calmed bikeway along 42"d Ave S between S 150th St & Southcenter Blvd
• Add striped bike lanes on both sides of 42"d Ave S between Southcenter Blvd and S 1515Y St.
Continue the southbound bike lane on the west side of the street to S 150th St.
• Widen the sidewalk on the east side of 42"d Ave S between S 1515k St and S 150th St to create a
shared, widened sidewalk as a low traffic stress option, with an in -lane marking for more confident
bicyclists to remain in the roadway.
A new light will be installed on the north TIB Light Rail parking lot, and a connection from the north parking
lot will be made to the existing sidewalk on the north side of the Confluence Apartments. The new sidewalk
connection will require acquisition of right-of-way from the Avalon Apartments.
Tasks on this project will include preparation of base maps, a storm drainage memo, SEPA exemption
documentation, right-of-way acquisition, and PS&E documents.
The design and construction phase of the pedestrian and bicycle improvements are funded by Sound Transit
Stride Access Funding. The scheduled project advertisement date is January 2027.

Task 1. Project Management and Coordination
A. Project Management
The CONSULTANT is responsible for project management of the various work elements described within
this document. These responsibilities shall include but shall not be limited to:
• Communication with team members.
• Identification of project scope changes and immediate discussion of them with CITY staff.
• Development and maintenance of a project budget. If events that are outside the control of the
CONSULTANT increase project cost, the CONSULTANT'S project manager shall immediately notify
CITY staff and work towards a resolution.
B. Project Schedule and Updates
The CONSULTANT shall develop a schedule to track progress of the PS&E development. The schedule shall
establish dates for the QA/QC process and PS&E, as well as dates when CITY action is required. The
schedule shall be developed based on a project advertisement no later than January 28, 2027. This
information shall be developed using MS Project.
The schedule timing and sequencing in this contract is subject to adjustment by the CITY, as affected by
cash flow, mitigation, or other factors that may influence the scheduling of work. Any adjustment in the
schedule shall be coordinated between the CITY and the CONSULTANT. No modifications shall be made
to the schedule without prior written approval from the CITY. The CONSULTANT will develop
strategies/recommendations for keeping the project on schedule and within budget if changes are
required.
ASSUMPTIONS
Major Milestones will include the following:
❑ Notice to Proceed — no later than April 15, 2026
❑ Ad Date — no later than January 28, 2027
DELIVERABLES
❑ Progress schedule — Project Schedule in MS Project format — one electronic and one hard copy.
C. Coordination Meetings
Coordination meetings shall be conducted as needed, and at least monthly. it is assumed there will be
ten (10) general coordination meetings lasting 30 minutes. The CONSULTANT shall be responsible for
taking minutes at all meetings and shall supply the CITY with a copy of the notes.
It is assumed two (2) field meetings at the project site will be conducted during the project.

Coordination with citizens and property owners along the project length will be the responsibility of the
CITY. Any questions by these parties shall be referred to the CITY. As the property owner meetings occur,
design information and needs obtained from those meetings will be incorporated into the design.
The CONSULTANT shall address the project schedule at each meeting and provide a status report for the
project in terms of meeting the schedule. If the project is behind schedule, due to the CONSULTANT, CITY
or outside forces, the CONSULTANT shall provide a recovery strategy at each meeting. The CONSULTANT
shall be proactive in discussing any potential budget problems and may present alternatives or make
recommendations to alleviate the problem.
All project meetings will be virtual with the exception of the field meeting.

D. Invoices and Progress Reports
Monthly invoices for work completed to date will be submitted to the CITY. The invoices shall summarize
budget, expenditures and percent expended for deliverable tasks during the billing period, percent
expended of overall project elements and shall contain all elements outlined in the project contract.
Invoices shall be submitted in accordance with the WSDOT LAG Manual and with the Monthly Progress
Report.
Monthly progress reports shall be submitted with invoices. The status reports shall summarize activities
completed for each task during the billing period and anticipated deliverables for the next month.
The CONSULTANT shall also summarize in the monthly progress reports problems encountered and
actions taken for their resolution, potential future delays, and issues/activities requiring CITY direction.
Any elements that may impact project completion time and cost shall be highlighted.
The CONSULTANT shall enter all payment information into the WSDOT DMCS each month. The
information entered by the CONSULTANT shall include amounts received from the CITY and amounts paid
to all subconsultants. Subconsultants shall confirm the payment amount and date payment was received
from the CONSULTANT each month in the DMCS system.

Task 2. Base Mapping
A. Topographic Survey
The SUBCONSULTANT shall complete a topographic survey as described below:
➢ Southcenter Boulevard - topo survey from back of sidewalk to back of sidewalk full length of
project including median islands, channelization and surface features

Attachment 1):
o 42"d Ave S & S 152"d St — SE corner
o 42"d Ave S & S 151' St — SE corner of T-intersection
o Connection to Confluence Apartments sidewalk
Survey Details:
Horizontal control: Horizontal Datum NAD83(91), Vertical Datum NAVD88
Roadway centerline: Roadway centerline, stations and street names, bearing & distances between
monuments, when possible to obtain without closing lanes.
Right-of-way, property lines & easements: Right-of-way lines from GIS or offset from centerline, property
addresses
Transportation: Pavement, driveways, curb & gutter;, crosswalks; joints between different pavement types;
ADA ramps, sidewalk limits; traffic signal equipment including junction boxes, loops (if any), PPBs, and poles.
Utilities: Surface and underground locations of water, sewer, storm drain; gas & electric; telecommunications
such as utility manholes, vaults, inlets valves catch basins, hydrants, cleanouts, and the like.
ASSUMPTIONS
• Mapping will be prepared in AutoCAD 2025.
• CITY GIS and/or as -built data will be used only to depict property lines and rights -of -way.
DELIVERABLES
• Topographic Survey of project intersections and selected streets as described herein.
• Land XML files of everything in the Project Area
B. Legal Description and Exhibit
The SUBCONSULTANT shall prepare the legal description and exhibit for the right-of-way acquisition at the
Avalon Apartments property.
ASSUMPTIONS
• R/W information will be provided by the SUBCONSULTANT in Task 6.
DELIVERABLES
• One legal description and one right-of-way exhibit
C. Base Maps
The CONSULTANT shall use the data collected in items A, B and C above to complete the basemap
preparation.

Task 3. Permitting
A. SEPA Exemption Documentation
The Consultant shall prepare SEPA Exemption documentation.

ASSUMPTIONS
❑ Detention and water quality treatment, and upgrades to the existing storm sewer system will not be
required for this project.
❑ The Storm Drainage Memo will be limited to roughly a three -to -five -page document including figures.
DELIVERABLES
❑ One (1) hard copy of the Storm Drainage Memo and calculations at the time of the 50% PS&E submittal.
❑ One (1) hard copy of the final Storm Drainage Memo and calculations at the time of the 90% PS&E
submittal.
Task 4. Storm Drainage
A. Storm Drainage Memo
The CONSULTANT shall Storm Drainage Memo that summarizes the following information:
• Project description
• Drainage overview
• Removed and replaced hard surfaces and pollution generating surfaces.
• Compliance with the current edition of the King County Surface Water Design Manual (KCWSDM) and
City of Tukwila code.
The Storm Drainage Memo will be limited to roughly a three -to -five -page document including figures.
ASSUMPTIONS
❑ Detention, water quality and conveyance upgrades to the existing storm sewer system will not be
required for this project.
DELIVERABLES
❑ One (1) hard copy of the Draft Storm Drainage Memo at the time of the 50% PS&E submittal.

Task 5. Lighting Design
A. Lighting Design
Concord will design pedestrian lighting for the new sidewalk connection. This will include the light pole
locations, fixture types, arm length, mounting height, conduit and handhole systems, wiring schedules and
schematics. The lighting analysis and design will include new sidewalk connection, beginning at the end of
existing sidewalk west of the Confluence Apartments (north project limits) and extending approximately 100
feet south to the existing ST parking lot (south project limits). New pedestrian lighting will be connected to
existing ST parking lot illumination, and no coordination will be required for new service connection under this
scope.
Concord will conduct voltage drop, conduit capacity, and handhole capacity calculations. Adjustments will be
made to the design, if needed, to ensure capacities are not exceeded.
Concord will provide specification and construction cost estimate assistance.
The proposed lighting design will include the following plan sheets:
ASSUMPTIONS
❑ All plans will be prepared using AutoCAD version 2018 or newer.
❑ No service coordination will be done for the new lights under this scope of work.
❑ Geotechnical work is not anticipated.
❑ This scope assumes there is no required public involvement.
❑ CAD basemap/survey files will be provided by others.
❑ The scope of work does not include any traffic signal design.

Task 6. R/W Acquisition
R/W Acquisition will be completed by a SUBCONSULTANT. The scope is based upon an assumption of
potential ROW impacts, assuming up to one (1) partial acquisition (permanent and/or temporary easements)
from one (1) parcel, as well as any associated work receiving and filling out forms/documents as may be
required by Sound Transit for this project's work occurring on their property. It is understood that any change
in scope will require an amendment in scope and fee. All ROW activities will comply with the Uniform
Relocation Assistance and Real Property Acquisition Policies Act (URA), WSDOT LAG manual, and the CITY'S
VDIRZIMi.

WSDOT-approved ROW Procedures. This is a total amount not to exceed (NTE) budget and allocation
between subtasks is for reference only and does not constitute separate budgets for each subtask.
A. Project Management and Administration
• Prepare for and attend early design development meetings as requested by the CITY or the project
tea m;
• Provide pre -acquisition services as requested by the CITY or project team to support early design
development;
• Respond to inquiries and needs identified by your team, the CITY, and/or project stakeholders;
• Oversight of preliminary ROW activities to comply with WSDOT requirements;
• Provide written and oral status updates on right of way activities;
• Review CITY'S WSDOT-approved Right of Way Procedures;
• Develop and execute the Right of Way program in compliance with state law, Uniform Act, and
WSDOT requirements;
• Maintain quality control/quality assurance protocols in the execution of the ROW tasks;
• Coordinate valuation task and any subconsultants;
• Commonstreet will manage ROW Team sub -consultants to prepare the Waiver Valuations or prepare
the Waiver Valuations in-house;
• Coordinate title reviews;
• Provide oversight of ROW activities to comply with WSDOT certification requirements;
• Provide oversight to all aspects of the ROW program.
B. Acquisition Services
• Create state or federal -compliant project files for each parcel;
• Request the CITY order new and/or updates to existing title commitments;
• Review title reports for each parcel and identify every exception;
• Once a parcel's title interest has been reviewed, identify methods of clearance per City direction;
• Project file set-up;
• Review of all valuation and compensation data;
• Produce templates approved by CITY to draft WSDOT-compliant offer packages;
• QA/QC all documents, tasks, and processes before, during, and after acquisition process;
• Prepare, deliver, and present offer packages;
• Negotiate settlements and draft justification memos when necessary;
• If amicable settlements are not approved by the CITY, prepare and submit a condemnation package.
Includes support preparing condemnation ordinance(s) when required.
C. Project File Close Out
• Collaborate with CITY during closing, payment, and recording processes;
• Set up client escrow account or facilitate execution of all conveyance documents, payment vouchers,
proof of payment, and closing data along with recorded conveyance documents and closing of files;
• Provide all documentation required to complete Waiver Valuations supporting CITY'S Determinations
of Value and integrate findings into offer packages;
• Prepare parcel files (electronic and/or hard copy) in a format requested by the CITY and provide to
City for retention.

ASSUMPTIONS
❑ The ROW and Construction phases of the project do not have federal funding and no WSDOT ROW
Certification will be required.
❑ Commonstreet has been provided a Sound Transit Path Connections drawing (dated 7/18/2023). This
scope and fee is based upon that drawing.
❑ The CITY requires no more than one (1) partial acquisition from one (1) parcel consisting of permanent
and/or temporary easements.
❑ The CITY requires SUBCONSULTANT to receive and fill out any forms and/or paperwork required by
Sound Transit for project work taking place on Sound Transit's parcel.

❑ No design changes will occur after the initial valuation assignment is authorized.
❑ Legal descriptions suitable for recording and meeting all WSDOT requirements will be provided to
SUBCONSULTANT from a licensed survey company.
❑ No occupants or personal property will be displaced requiring relocation services and no relocation
services will be required.
❑ The CITY will provide ROW document templates or Commonstreet will utilize WSDOT templates and
provide to the City for review and approval. Revisions will be limited to no more than two rounds of review
prior to City approval.
❑ Once offer package templates are approved by the CITY, no changes will be made.
❑ No more than one (1) Waiver Valuation will be required.
❑ If impacts make a Waiver Valuation ineligible (per WSDOT ROW Manual Section 3.4), an appraisal and
appraisal review will be completed. Appraisal and appraisal reviews will require additional scope and fee.
❑ No property owner will exercise the right to receive an appraisal and appraisal review for valuations
between $15,000 and $35,000 pursuant the CITY'S WSDOT-approved ROW Procedures and the FHWA Final
Rule dated June 3, 2025. If any property owners make this request, additional scope and fee will be
required.
❑ Receive and fill out any forms and/or paperwork required by Sound Transit for this project's work
taking place on their parcel.
❑ Title reports will be provided by the CITY and/or ordered by SUBCONSULTANT.
❑ The CITY will pay valuation directly to the property owner.
❑ The CITY will pay directly to the title company all expenses for title commitments, recording fees,
escrow services, and title insurance.
❑ If the Notice to Proceed (NTP) is received after 120 days from this proposal, fees and billing rates may
require revision to reflect cost of living increases and current business conditions.
Task 7. PS&E Design
A. Site Evaluations
The CONSULTANT shall review on -site conditions for the corridor to identify the specific construction items to
be included in the project improvements including paving limits, pavement repair areas, utility castings,
pavement markings, and edge treatments.

B. PS&E
PLANS, SPECIFICATIONS & ESTIMATES (PS&E)
A Basis of Design memo will be used to document design decisions, provide background information to
support to the design process, and outline issues to be resolved. The memo will be provided with the 50% and
90% submittals.
Plan Sheet size shall be 22 Inches, height, by 34 Inches, width. Plan Sheets will be prepared at a scale of 1" =
30'. The drawing scales, lettering, and general delineation of the plans will render legible reproduction at half
scale (11" x 17" size).
The CONSULTANT will be supplied with a "Boiler Plate" version of the CITY Project Manual. The CONSULTANT
will edit the "Boiler Plate" version, by supplementing as necessary with project specific information, and by
deleting unnecessary special provisions. The CONSULTANT will prepare any special provisions necessary for
the project. The CONSULTANT may support the CITY in creating additional special provisions for the 2026
WSDOT Spec book at the request of the CITY.
The CITY shall provide the CONSULTANT with review comments after each milestone submittal. Comments
shall be compiled by the CITY. The CONSULTANT shall provide a response for each CITY comment. If there is
not clear direction in the comment or there are conflicting comments the CONSULTANT shall provide the CITY
with options for how to resolve the issue raised in the comment.
The CONSULTANT will implement at QA/QC program and document the process at each milestone submittal.
QA/QC documents will be submitted to the CITY at each milestone.
COVER SHEET, INDEX AND PROJECT LOCATION MAP
Shall include an index listing plan sheet titles as they appear in the plan set, city map and project
location, project title, contract bid number and Federal Aid number. The vicinity map illustrating the
project limits shall be shown on the map on the cover sheet (Assume 1 sheet).
LEGEND AND GENERAL NOTES SHEET

documents for the 100% design. This submittal shall be the complete PS&E and shall include all drawings,

C. MEF Document Preparation
The CONSULTANT will develop the MEF Document that outlines the existing and proposed ramp conditions,
compliance with ADA requirements and provides a narrative "Maximum Extent Feasible" justification for non -
complaint ramps to be replaced. The document will include existing and proposed ramp design information as
well as a narrative describing design considerations, options and analysis that were evaluated to determine
the "maximum extent feasible" was reached. A draft document will be prepared after the 50% submittal and
a final document will be submitted with the 100% submittal.

Redemption Fellowship, Inc. has submitted a right-of-way (ROW) vacation request to the City to vacate
approximately 12,040 square feet of unopened ROW located at the northeastern intersection of South
158th Street and South 160th Street, adjacent to 15880 Military Road South. The church seeks to
incorporate this land into its parcel for a future redevelopment concept that includes mixed -use facilities
and airport -related parking -uses that are not currently permitted under the City's Comprehensive Plan
or zoning regulations.
City staff reviewed the request in accordance with Tukwila Municipal Code (TMC) 11.60 and RCW
35.79, which require that more than two-thirds of abutting property owners sign the petition before a
public hearing can be scheduled. The applicant listed only themselves as an abutting owner; however,
multiple additional parcels appear to meet the statutory definition of "abutting," creating uncertainty
about whether the petition is complete.
The unopened ROW has long been preserved to support future access, circulation, and utility needs for
both Tukwila and SeaTac. Sterling Realty Organization (SRO), which is planning a major adjacent
development, has formally opposed the vacation, citing the importance of retaining the ROW for future
transportation improvements. SeaTac staff expressed similar concerns. Vacating the ROW would
eliminate its potential use for public mobility and infrastructure improvements.
Financially, the petitioner's appraisal values the land between $790,000 and $900,000. Because the
ROW has been dedicated for more than 25 years, the City is required to receive fair market value if it is
vacated, with half of the proceeds dedicated to public open space or transportation capital projects.
DISCUSSION
Based on the lack of demonstrated public benefit, the unresolved statutory requirements, and the
potential impact on future transportation and development needs, staff recommends denial of the ROW
vacation request.
Should the Transportation and Infrastructure Services Committee decide to forward the request to the
full council as -is for consideration, staff would prepare the necessary resolution for a meeting in April
and schedule a public hearing for May or June (within 60 days of council adopting the resolution).
Alternatively, the Committee could direct the department to require the petitioner to obtain
additional signatures from adjacent property owners before proceeding.

I. Purpose of Report
The purpose of this report is to provide relevant information and a recommendation to the Council
regarding a request to vacate unopened right-of-way (ROW) located at the northeastern intersection of
South 158th Street and South 160th Street, adjacent to 15880 Military Rd South. Staff is seeking
guidance on whether the council would entertain the request as submitted or if signatures are required
from additional property owners before a resolution is drafted and a public hearing is scheduled.
II. Background
The Redemption Fellowship is located at 15880 Military Rd South near the city boundary between
Tukwila and SeaTac. The church is located on a site consisting of one irregular shaped parcel
measuring 86,068 SF (1.98 acres), zoned Community Residential (CR) by the City of Tukwila. The site
is improved with two structures: a 20,432 SF church building originally constructed in 1933 and a 2,940
SF parsonage (residence) originally constructed in 1951. There is also an asphalt parking lot supporting
the church buildings. A portion of the parking lot extends into the unopened ROW, which was
transferred to the City in 2001.
Redemption Fellowship, Inc. has petitioned the City to vacate a triangular portion of unopened ROW at
the northeastern intersection of South 158th Street and South 160th Street, adjacent to 15880 Military
Rd South at the city boundary between Tukwila and SeaTac.
TMC 11.60.090 requires the Department to:
1. Propose a resolution to the City Council fixing a time, pursuant to RCW 35.79.010, when the
matter will be heard.
2. Forward the petition and resolution to all City departments and all concerned utilities for review
and comment.
3. Post on -site notification of the public hearing per RCW 35.79.020.
4. Provide notification of the public hearing to all property owners within 500 feet of the right-of-
way proposed for vacation.
5. Provide the City Council all relevant information for decision deliberations during the public
hearing.

III. Description of Proposed Vacation
If the ROW is vacated, the property owner will gain access to an additional 12,040 SF of land area
along the western edge of the site. A survey performed by Robert J. Bogdon of Eastside Consultants
Inc. verified that the City's ROW is mostly triangular and roughly 165 feet long on the southern and
western sides, and 230 feet long along the eastern edge. See Exhibit A for a map of the parcel and
ROW location.
IV. Justification for Vacation
City staff have attended multiple meetings and phone conversations with the representative from the
Redemption Fellowship Church, John Benjamin, to discuss the nature of the request. Mr. Benjamin has
stated the justification for the ROW vacation request is to combine it with the Church parcel as part of a
plan to redevelop the site with a multi -use tower that will incorporate housing, retail, food services,
educational services, area of worship, and airport parking. Staff informed Mr. Benjamin several years
ago that establishing these uses is not consistent with the adopted Comprehensive Plan and would
require a rezone and amendment to the Comprehensive Plan, for which the Church has not yet applied.
V. Impact Analysis
Future Development: The site lies adjacent to a planned development of Sterling Realty Organization
(SRO), located in Tukwila and SeaTac. SRO has formally communicated plans to develop (Exhibit B)
and their concerns regarding the potential impacts of the ROW vacation. They have requested that the
City deny the vacation request (Exhibit C). Their position is based on the belief that retaining the ROW
is important to support access, circulation, or future project needs associated with the development of
the corridor.
City staff has also coordinated with SeaTac's public works and planning departments to discuss the
proposed traffic impact of the planned redevelopment by SRO. SeaTac staff expressed general
agreement with the concern about losing the ROW which will likely be needed for future transportation
improvements.
Financial: The petitioner provided an appraisal report from March 2024 which values the land between
$790,000 and $900,000. The property has significant value due to its size, accessibility, topography,
and location near major transportation hub of SeaTac Airport and several major employment centers.
The appraisal appears to meet the requirements of TMC 11.60.050. Since this land has been dedicated
ROW for more than 25 years, the city is required to obtain fair market value if the ROW were to be
vacated (TMC 11.60.050.C). Furthermore, one half of the revenue received by the City as
compensation for the ROW must be dedicated to public open space or transportation capital projects
within the City (TMC 11.60.050.D). Alternatively, the code allows for the petitioner to trade property in
lieu of payment.
Public Benefit: The parcel has been preserved as unopened ROW in order to serve the future growth
and development needs of the cities of Tukwila and SeaTac. If vacated, the potential to use it for
vehicle and pedestrian traffic improvements will be eliminated. Furthermore, the stated purpose for the
land is not consistent with the adopted Comprehensive Plan.

Utilities: This area is served by Highline Water and Valley View Sewer Districts. Highline Water District
noted that the Church would need to provide an easement for the water service line currently in the
unopened ROW if the line remains public infrastructure. Valley View Sewer District stated that the
vacation does not impact their infrastructure. There is no City stormwater infrastructure located in the
unopened ROW except a parking lot storm drain and conveyance system that apparently was deeded
to the city in 2001 with the parking lot.
VI. Statutory Requirements and Public Involvement
Redemption Fellowship, Inc. submitted a Petition for Vacation of Streets application on September 30,
2024 listing only themselves as the abutting property owners (Exhibit D). The applicant has also
reached out to the City for mailing labels for property owners within 500' of the street. There is no
evidence that the applicant has prepared the required mailers and no public hearing has been
scheduled.
Per RCW, when a complete and fully compliant application is submitted, the City Council is required to
issue a resolution to schedule a public hearing, which must be held within 60 days. RCW 35.79.020
adds that "if fifty percent of the abutting property owners file written objection to the proposed vacation
with the clerk, prior to the time of hearing, the city shall be prohibited from proceeding with the
resolution."
There is some uncertainty regarding the definition of "abutting property owners" considering that the
parcel to be vacated is wedged between existing city streets and the petitioner's parcel. Specifically,
RCW 35.79.010 reads "if the petition is signed by the owners of more than two-thirds of the property
abutting upon the part of such street or alley sought to be vacated, legislative authority by resolution
shall fix a time when the petition will be heard and determined by such authority or a committee
thereof...".

VII. Recommendations
Both Sterling Realty Organization (SRO) and Redemption Fellowship Church have informally
approached the City with their respective development proposals. Regarding the use of the portion of
ROW that is being petitioned for vacation, these concepts are in conflict with one another.
Staff recommends that Council require signatures of the adjacent property owners before proceeding
with a resolution or public hearing.

Furthermore, if the petitioner returns with a revised petition, staff recommends that Council carefully
consider the impacts of a permanent loss of ROW before making a final decision on the vacation
request, as the public benefit and potential impacts of either development are unknown at this time. The
purpose of the unopened ROW is to serve long-term access, circulation, and utility needs and vacating
it now could limit future public options or create unintended impacts. It has been City protocol that ROW
vacations should only proceed when there is sufficient evidence that the public will experience equal or
greater benefit from relinquishing the ROW, and staff's opinion is that threshold has not been met
based on the information currently available.
If committee members would like to proceed with the formal process based on the current request, staff
would prepare a resolution for the full Counsil and set a public hearing date. The applicant would need
to provide property owners within 500' of the parcel formal notice of the hearing and the public would
have the opportunity to weigh in on the vacation request before Council makes a final decision.
Vill. Conclusion
The committee is being asked to provide guidance on whether the current petition is valid or if it should
be returned for additional signatures from adjacent property owners.

We are writing on behalf of Sterling Realty Organization ("SRO") in connection with the above -
referenced petition for street vacation (the "Vacation Petition"). SRO is the owner of the property
abutting the unopened Military Road S. right-of-way immediately west of the partial vacation
proposal. The Vacation Petition seeks to acquire 12,040 s.f. of existing street right-of-way from the
City of Tukwila (the "City"). SRO asks the City to deny or defer consideration of the street vacation
petition pending further review of the issues set forth in this letter.
The proposed street vacation does not conform to the requirements of RCW 35.79.010.
RCW 35.79.010, which governs the street vacation proposal in this case, only allows a city to
schedule a hearing on a private proposal for a street vacation petition "if the petition is
signed by the owners of more than two-thirds of the property abutting upon the part of such
street or alley sought to be vacated."
In this case, according to the filed petition, the petitioner owns 162.16 frontage feet on the
portion of the street sought to be vacated. The corresponding frontage owned by SRO on
the west side of the street is approximately 175 feet, or more than 50% of the abutting
property. Therefore, the subject street vacation petition does not include adequate owner
signatures as required under RCW 35.79.010. This requirement is mirrored under TMC
11.60.030.B.
The petitioner may argue that the SRO property does not "abut" on the proposed vacation
area, since the petition only seeks to vacate a portion of the right-of-way immediately

adjacent to the petitioner property. This interpretation would violate the intent of the statute
and would effectively allow a petitioner to avoid the need for the other abutter's consent by
leaving only a strip of right-of-way along the other abutter's frontage. Under this erroneous
interpretation, a petitioner could vacate 95% of the width of a street without the other
owner's consent, as long as no portion of the vacation area actually touched the other
abutter's property.
Obviously, the intent of the statutory requirement is to ensure that the integrity and utility of
a right-of-way is maintained for all abutting users. This requires the frontage of the SRO
property to be considered under the requirements of RCW 35.79.010 even if the portion of
the street sought to be vacated does not technically touch the SRO property. The proposed
vacation will reduce and impair the utility of the street for SRO and the statute requires
SRO's consent to the vacation petition.
2. The proposed vacation conflicts with future transportation plans. SRO has discussed with
the City the possibility of installing a future roundabout at the location of the proposed
vacation, in order to serve the future TOD development in this subarea. The proposed
vacation would interfere with the installation of this future roundabout:

This roundabout is also being considered in the context of the City of SeaTac's future
transportation planning for its municipal street network. The proposed vacation should not
be approved unless it can be demonstrated that the City has no future use for the vacated
area, which is not possible given current planning conditions. This larger TOD Node

subarea is called out in the Comprehensive Plan for high -density mixed use development.
Adequate right-of-way areas will be necessary to serve this future development, including the
proposed vacation area.
Please see the attached memorandum from Transportation Engineering NW regarding this
issue.
3. Consideration of a street vacation must be consolidated with review of planned future
development on the petitioner's property. It is no secret that petitioner is considering future
redevelopment of its property. Given the Comprehensive Plan designation of the site, it is
likely that this redevelopment will involve a rezone and more intensive development than
contemplated under current zoning. Thus, the proposed vacation is a key element of this
future plan, a plan which is not before the city for consideration at this time. It is
inappropriate to piecemeal the review of different elements of this future redevelopment;
instead, the City should be considering all actions necessary to support future redevelopment
at the same time. SEPA requires as much and appropriate planning, both for the site and
the larger area, also requires a comprehensive view of all actions associated with the future
redevelopment of this property.
Regardless of the intensity of the future development plan, the vacation of this right-of-way
should not occur until the City has had an opportunity to review the site layout, access plans
and utility plans for the new development, and to develop mitigation measures for that
project. The area sought to be vacated may play a role in responding to all of these site
planning issues in the future. In addition, there is nothing in the record to identify whether
any utility easements or facilities are located in the vacation area, not whether other agencies
(City of SeaTac, Metro Transit, Metro Sewer, telecom companies, PSE, etc.) have any
interest in the area in question.
4. The petitioner's appraisal substantially understates the value of the vacation area. The
subject property is zoned Low -Density Residential, and though it is not clear, the petitioner
assumes that following vacation the vacated area will also be zoned Low -Density Residential.
However, the petitioner's property is located in the TOD Node at TIB Station under the
Comprehensive Plan, meaning that higher -density mixed use development will be
appropriate on the site. As noted above, it is clear that the petitioner intends to pursue a
redevelopment of the site, so reliance on Low -Density Residential values is inappropriate in
this case.
Yet the petitioner's appraisal only offers comparable sales of other Low -Density Residential
sites in order to justify the land value for vacation compensation. This approach ignores the
intended future use of the property and significantly undervalues the vacation area, meaning
the City would be short-changed in a vacation approval process. This would allow the
petitioner to "buy low" from the City and later "sell high" to future buyers. Consideration
of a vacation should only be in the context of future redevelopment plans and land values
property associated with such plans.

This memorandum summarizes TENW's opinion and observations from a transportation planning and
design perspective regarding the Right -of -Way (ROW) Vacation request by Redemption Fellowship, Inc.

As you know, we have been assisting you and the SRO team over the last 5 years in planning for a Master
Plan for your properties located north and west of the existing S 158th St ROW. The Master Plan would
include a dense, mixed -use urban development consistent with the City's long term goals and policies for
this area. Although the development will take advantage of significant transit opportunities including the
existing light -rail station and future bus rapid transit station along SR 518, vehicular demand will increase
on the surrounding streets under any redevelopment scenario.
As part of our future planning for S 160th St in particular, we have made recommendations for street
widening and/or modifying the intersection of S 1581h Street / S. 1601h Street into a roundabout. The ROW
vacation as it is currently proposed above would seriously hinder the ability to construct a roundabout at
this location. A diagram showing a preliminary roundabout design by KPFF relative to the proposed ROW
vacation is shown on the next page. It should be noted that the dimensions, location, and footprint of the
future roundabout may vary significantly based on transportation analysis and design constraints which

have not yet been identified. A multilane roundabout is a possibility. Therefore a conservative approach
(reserving more ROW area) is recommended.
It should be noted that the S. 160th Street ROW is entirely within the jurisdiction of the City of Seatac. The
City of Seatac has adopted project ST-116 into their Comprehensive Plan and current 6-year 2025-2030
Transportation Improvement Program (TIP). This project would widen S. 160th Street east of International
Blvd (SR 99) and modify the section in the vicinity of S. 1581h Street to include a center turn lane along with
new sidewalks and bike lane on the north side. Although a 3-lane section is planned east of 341h Ave S.,
the ROW vacation as currently proposed would seriously hinder the ability to include the planned bike
and pedestrian facilities.
Regardless of whether a roundabout is constructed, a center turn lane will be needed just east of the
intersection of S. 158th Street / S. 1601h Street to accommodate left -turns onto S 1601h Street east of Military
Road. The proposed ROW vacation as proposed would limit the ability to widen the road to accommodate
this turn lane.
Lastly, maintenance of sight lines for vehicular safety is critical. Much of the proposed vacation area should
be preserved to provide unobstructed sight lines. Further planning and design would be needed to
determine exact limits for sight line setbacks.
In summary:
1) The ROW vacation as it is currently proposed would seriously hinder the ability to construct a
roundabout at this location.
2) The ROW vacation as currently proposed would seriously hinder the ability to widen the roadway
and/or construct the bike and pedestrian facilities planned by the City of Seatac in their
Comprehensive Plan and TIP.
3) The ROW vacation as currently proposed could have a negative impact on sight lines forvehicular
safety.

STREET VACATION
Any owner or owners of 2/3, by length, of the property abutting a City street or alley may
petition for vacation of all or any part of that right of way. Once Public Works receives a
complete petition packet, the City Council sets a date, by resolution, for a Public Hearing.
Public Works then notifies all property owners within 500 feet of the vacation, posts
notification in several places, and notifies all utilities of the upcoming public hearing. The
City Council may decide to hear the petitioners' request and to consider the findings. If the
City Council approves all or part of the vacation request, it passes an ordinance containing
the conditions for vacation. The street vacation is complete once all conditions and
compensation requirements are met and all documents are filed with King County.
To petition for a street vacation, provide a complete application to the Public Works
Department. A complete application contains the following items:
1. Completed petition, signed by owners of z/3 of the property abutting the street or
alley (RCW 35.79.010),
2. Check for $1200.00 made out to City of Tukwila,
3. Vicinity map,
4. Tax assessor's map showing township, range and section and all properties abutting
the street or alley to be vacated,
5. Total assessed value of the land, supporting documentation, and calculations,
6. Fair market appraisal, if required (TMC 11.60.03o and TMC 11.6o.o6o),
7. Legal descriptions of enlarged lots,
8. Mailing labels for property owners within 500' of the street or alley.
