Ll This Covenant for Inspection and Maintenance of Stortnwater Facilities and Best
Management Practices ("Covenant") is made by and between Cowlitz Indian
'f �tbe _, as Grantor, and the City of Tukwila, a Washington Municipal Corporation, a. Grantee. Grantor
and Grantee (also denoted as City herein) are each a Party and collectively the Parties to this Agreement.
2A Grantor applied to City for issuance of M ID22-0171 on 08/02/2024
2.2 Pursuant to TMC 14,30,060, application for and issuance of such permit requires the property
owner to enter, into this Covenant.
2.3 The subject of the Covenant is the real property located in King County, Washington, bearing
King County Tax Parcel No, 0003200004 and legally described in the attached Exhibit A
incorporated herein ("Property").
2.4 The City approved the applications which consist of the following documents, attached and
incorporated herein:
2.4.1 City issued Permit No. ,C22-0 III , Exhibit &
2.4.2 Stormwater Facility/ MP Site Plan, Exhibit C.
2.43 Operations & Maintenance Plan including schedule, Exhibit W
3. Terms of Agreement
NOW THEREFORE, in consideration of the foregoing recitals and other good and valuable
consideration including approval and issuance of City of Tukwila Peit- D22:0171 _, the sufficiency
and receipt of which are acknowledged, Grantor hereby irrevocably covenants as follows:
3.1 TTre foregoing Recitals and references to documents are incorporated as material terms of this
Covenant .
3.2 The Grantor(s) for itself and its successors in interest having any ownership interest in the
Property (collectively Owners) shall at their sole cost and expense retain, uphold, operate, maintain, and repair
the storrnwater facilities and best management practices ("BN[Ps") located on the Properly pursuant to the
schedule within the Operations & Maintenance Plan.
33 The obligations required under Section 3.2 above shall be taken consistent the following:
13.1 The City shall have the right of ingress and egress over those portions of the Property
necessary to perform inspections of the stormwater facilities and BMPs and conduct other activities specified
in this Declaration of Covenant and in accordance with Tukwila Municipal Code ("TMC") 14.30.80. This
right of ingress and egress, right to inspect, and right to perform required maintenance or repair shall be as
provided for in subsection 3.3.2 below,

3.3.2 If the City derearsesthat maintenance or repair work is required to be done to any
of the storniwater facilities or BMPs. the Director of Public Works or designee (the "Director") shall give
notice of the specific maintenance and/or repair work required pursuant to TMC 14,30,080. The Director shall
also set a reasonabic time in which such work is to be completed by the Owner. If the above required
maintenance or repair is not completed within the time set by the Director, the City may perform the required
maintenance or repair, and is hereby granted access to the Property for such purposes. Written notice will be
rnailed to the Owner stating the City's intention to perforin such work. This work will not commence until at
least seven (7) days after such notice is mailed. If, within the sole discretion of the Director, there exists an
imminent or present danger, the seven (7) day notice period will be waived and maintenance and/or repair
work will begin immediately.
3.4 If at any time the City reasonably determines that a storn1water facility or BMP oil the
Property presents an imminent hazard, as identified by TMC 14.30,080 and herein incorporated by reference,
the Director or equivalent municipal successor's official may take measures specified therein.
3.5 The Owner shall assurne all responsibility for the cost of any maintenance or repair, work
completed by the City as described in C.7ovenant. Such responsibility shall include reirnbumernent to the City
within thirty (30) days of the receipt of the invoice for any such work perfonned. Overdue payments will
require payment of interest at the current legal rate as liquidated damages. All such costs and expense shall
constitute a lien against the Property,
16 The Owners shall obtain a Type C Public Works peitfrorn the City prior to filling, piping,
cutting, or removing vegetation (except in routine landscape maintenance such as replacement of plants and
pretreatment mulch) in open vegetated stonnwater facilities (such as swales, channels, ditches, ponds, etc.),
or performing any, alterations or modifications to the stonnwater facilities and Blvd's referenced in this
Covenant, Prior to the final approval and issuance of the new permit, a new Coverkint with upciated exhibits
reflecting the changes to the stomiwater facilities shall be recorded at the Owner's sole cost, and a copy ofthe
new recorded Declaration of Covenant provided to the City.
17 Any notice or consent required to be given or otherwise provided fear by the provisions of this
Declaration of Covenant shall be effective upon personal delivery, or three (3) days after mailing by Certified
Mail, return receipt requested, to the address listed below for that party:

18 With regard to the matters addressed hereiri, this Covenant constitutes the entire agreement
between the parties, and surx-rsedes all prior discussions, negotiations, and all agreements whatsoever whether
oral or written. This Covenant shall be governed by the laws of the State of Washington. Any suit to enforce
or relating to this Covenant shall only be filed in King County Superior Court, King County, Washington, and
the Parties consent to the jurisdiction thereof In the event of any legal action by either Party relating to this
Covenant, the Parties shall pay their own costs or fees.

3.9 This Covenant is intended to protect the valor and desirability of the real property described
in Exhibit A, prornote the efficient and effective management of stormwater drainage, and shall inure to the
benefit of all the citizens of the City and its municipal successors and assigns, References herein to the TMC
shall include subsequent amendments to such statutes and all successor statutes,

All provisions of law and ordinances governing this work will be compiled with, whether specified herein or not.
The granting of this permit does not presume to give authohty to violate or cancel the provisions of any other
state or local laws regulating construction or the performance of work.
This pennit shall become null and void if the work is not commenced within 180 days for the date of issuance, of if
the work is suspended or abandoned for a period of 180 days from the last inspection.
PERMIT CONDITIONS:
1: Condition Notes
2: Work shall be installed in accordance with the approved construction documents, and any changes made
during construction that are not in accordance with the approved construction documents shall be
resubmitted for approval.
1 All permits and approved construction docurnents shall be kept at the site of work and shall be open to
inspection by the Building inspector until final inspection approval is granted,
4: The special inspections and verifications for concrete construction shall be as required by lBC Chapter 17,
Table 1705.3.
5, The special inspections for steel elements of buildings and structures shall be required. Ail welding shall be
done by a Washington Association of Building Official Certified welder.
6: Installatlon of high-strength bolts shall be periodically inspected in accordance with RISC specifications.

8: When special inspection is required, either the owner or the registered design professional in responsible
charge, shall employ a special Inspection agency and notify the Building Official of the appointment prior to
the first building inspection. The special inspector shall furnish inspection reports to the Building Official in
a timely manner,

9: A final report documenting required special inspections and correction of any discrepancies noted in the
inspections shall be submitted to the Building Official, 'The final inspection report shall be prepared by the
approved special inspection agency and shall be mittmitted to the Building Official prior to and as a
condition of final inspection approval,
10: New suspended ceiling grid and Hight fixture installations shall meet the seismic design requirements for
nonstructural components. ASCE 7, Chapter 13.
11: Partition waft shall not be tied to a suspended ceiling grid. All partitions greater than 6 feet in height shall
be laterally braced to the building structure. Such bracing shall be independent of any ceiling splay bracing,
12: Truss shop drawings shall be provided with the shipment of trusses delivered to the job site. Truss shop
drawings shall bear the seal and signature of a Washington State Professional Engineer. Shop drawings
shall be maintained on the site and available to the building inspector for inspection purposes.
11 insulating materials, where exposed as installed in buildings of any type of construction, shall have a flame
spread index of not more than 25 and a smoke development index of not more than 450. Where facings
are installed in concealed spaces in buildings of Type 111, lV, or V construction, the flame spread and smoke -
developed limitations do not apply to facings, that are installed behind and in substantial contact with the
unexposed surface of the ceiiing, wall or floor finish.
14: Subgrade preparation including drainage, excavation, compaction, and fill requirements shall conform
strictly with the recommendations given in the soils report. Special inspection is required.
15: All construction shall be done in conformance with the Washington State Building Code and the
Washington State Energy Code,
16: Structural Observations in accordance with I.D,C. Sectcon 1709 is required. At the conclusion of the work
included in the permit, the structural observer shah submit to the Building Official a written statement that
the site visits have been made and identify any reported deficiencies which, to the best of the structural
observer's knowledge, have not been resolved.
17, Notify the City of rukwila Building Division prior to placing any concrete, 'This procedure is in addition to
any requirements for special inspection.
18: Special inspection for sprayed fire-resistant materials applied to structural elements and decks is required.
Special inspections .shall be based on the fire -resistance design as designated in the approved construction
documents.
19: Masonry construction shall be special inspected.
20: Water heaters shall be anchored or strapped to resist horizontal displacement due to earthquake motion.
Strapping shall be at points within the upper one-third and lower one-third of the water heater's vertical
dimension. A minimum distance of 4- inches shall be maintained above the controls with the strapping,

City of Tukwila Budding Department (206-431-3670).
22: Ali electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila
Permit Center,
23: Prior to final inspection for this building permit, a copy of the roof membrane manufacturer's warranty
certificate shaft be provided to the building inspector.
24: VALIDITY OF PERMI F: The issuance or granting of a permit shall not be construed to be a permit for, or an
approva[ of, any violation of any of the provisions of the building code or of any other ordinances of the City
of Tukwila. Permits presuming to give authority to violate or cancel the provisions of the code or other
ordinances of the City of Tukwila shall not be valid. The issuance of a permit based on construction
documents and other data shall not prevent the Building Official from requiring the correction of errors in
the construction documents and other data.
25: Under RCW 18.106.440 and RCW 18,27.110 the City of Tukwila is required to provide this written notice to
the building permit applicant that there are contractor registration laws and the potential risk and
monetary liability to the homeowner for using an unregistered contractor.
26: All mechanical work shall be inspected and approved under a separate permit issued by the City of Tukwila
Permit Center (206/431-3670),

27: FIRE CONDITIONS
1. Fire sprinklers, for new and existing building, under a separate submittal.
TMC 16,42.050 Where Required
A. A fully aUtOnlatiC sprinkler system designed, installed and tested per NFPA 13 shall be installed in all new
buildings 500 square feet or, greater in total floor area.
B. Without regard to exceptions to the sprinkler system requirements as set forth in this section, a fully
autornatic sprinkler system, per TMC Section 16.42.050.
C. Fire walls, fire barriers, or vertical or horizontal fire barriers as noted in Section 706.1 of the inter -national
Building Code shalt not be considered to separate a building to enable deletion of a required automatic
sprinkler systern
TMC 16.42.090 Existing Buildings
A. Existing fully sprinklered buildings, when remodeled or added on to, shall retain the feature of being
sprinklered in the remodeled or added -on portion,
B. If, by increasing usable or habitable square footage of an existing building, the resulting total structure
falls witMn the cover -age of TMC Section 16.42.050A, the entire structure shall be fully sprinklered. This
provision does not apply to single-family residences.
