HomeMy WebLinkAboutOrd 1746 - Tree Clearing and Planting (Repealed by Ord 1758) N11LA JF s 'y O;' 2 o a; City of Tukwila )i 5V Washington Ordinance No. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING INTERIM STANDARDS FOR TREE CLEARING AND PLANTING; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council adopted Ordinance No. 1726, providing for the implementation of interim tree clearing and planting standards as necessary to protect the health and welfare of the City's residents; and WHEREAS, the standards and procedures contained in Ordinance No. 1726 reflect the minimum desired standards, and could be used by the City in evaluation and approval of vegetation clearing activities until a comprehensive tree ordinance is adopted; and WHEREAS, the City Council held a public hearing on the extension of Ordinance No. 1726, the Interim Tree Ordinance on July 17,1995; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Findings of Fact. The City Council of the City of Tukwila, Washington, hereby adopts the following :Findings of Fact: A. Standards for vegetation clearing and planting are necessary to mitigate environmental consequences of land development, and to maintain and improve the quality of Tukwila's urban environment. B. The City is in the process of reviewing its existing Comprehensive Plan policies and development regulations, including a comprehensive review of policies and regulations related to vegetation clearing and planting. C. Significant additional time will be required to complete and adopt new Comprehensive Plan policies and standards for vegetation clearing and planting. D. The limited amount of vacant land remaining in Tukwila may be cleared of vegetation in a manner which produces adverse aesthetic and environmental impacts not envisioned in new Comprehensive Plan policies or new vegetation clearing and planting standards. E. Implementation of interim tree clearing and planting standards is necessary to protect the health and welfare of the City's residents. F. The standards and procedures contained in the Interim Tree Ordinance reflect the minimum desired standards, and could be used by the City in evaluation and approval of vegetation clearing activities until a comprehensive tree ordinance is adopted. -1- G. After due public notice per TMC 2.04.150(9) and RCW 35A.63.220, the City Council held a public hearing on July 17,1995 to receive public testimony related to the interim tree clearing and planting standards. Section 2. Partial Repealer. Section III of Ordinance No. 1726, Future Adoption of Codified Tree Ordinance, is hereby repealed. Section 3. Effective I'eriod. Ordinance No. 1726 shall otherwise remain in effect for a period of six months from the effective date of this ordinance, unless subsequently repealed, modified, or extended after a public hearing and entry of appropriate findings of fact. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. Section 5. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. On QL 7 LY ST the City Council of the City of Tukwila passed Ordinance No. /75'6 (/establishing interim minimum desired standards for vegetation clearing and planting until a comprehensive tree ordinance is adopted, providing for severability, and setting an effective date.
