AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO BUILDING SETBACKS FOR LEGALLY NON CONFORMING SINGLE FAMILY RESIDENCES, AMENDING TUKWILA MUNICIPAL CODE 18.70. WHEREAS, approximately 80% of Tukwila detached single family homes were built according to King County standards, and WHEREAS, King County requires less building setback area than the City of Tukwila, and WHEREAS, remodels of these homes using Tukwila setbacks would result in oddly shaped houses of poor design, and WHEREAS, changing the setback areas for logical extensions of these legally non conforming homes would make remodeling easier for residents and would result in better quality home design, and WHEREAS, the Planning Commission held a public hearing on this change on March 26, 1992 and recommended adoption of the amendment, and WHEREAS, the City Council concurs with the Planning Commission's findings, conclusions and recommendations, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Setbacks for legally non conforming detached single family residences. A new Section (6) of Tukwila Municipal Code 18.70.050 is hereby added to read as follows: (6) Single family structures in single or multiple family residential zone districts, which have legally non conforming building setbacks, shall be allowed to expand along the existing building line(s) if the existing distance from the nearest point of the structure to the property line is not reduced. Section 2. Severability. Should any section, subsection, sentence, clause or phrase of this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. Section 3. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after passage and publication as provided by law. On 222/ -7 the City Council of the City of Tukwila passed Ordinance No. ZS 0 adding a new section to the Tukwila Municipal Chapter 18.70, allowing remodels of legally non conforming single family residences to be expanded along the existing building line(s); and establishing an effective date.
