HomeMy WebLinkAboutOrd 1511 - Fire District #1 Annexation - Development Regulations for Specific Permit W1-A Q 1906 CITY OF TUKWILA WASHINGTON ORDINANCE NO. /-s// AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING KING COUNTY DEVELOPMENT REGULATIONS FOR SPECIFIC PERMIT APPLICATIONS FOR REAL PROPERTY COMMONLY KNOWN AS THE FIRE DISTRICT NO. 1 ANNEX- ATION AREA AND AUTHORIZING KING COUNTY TO CON- TINUE TO REVIEW, APPROVE, INSPECT AND FINAL THOSE BUILDING PERMITS, AND DECLARING AN EMERGENCY. WHEREAS, the Fire District No. 1 annexation, with the proposed City of Tukwila zoning and land use regulations, was approved by the voters in an election held pursuant to King County regulations, and WHEREAS, the County Canvassing Board has submitted Statements of Canvass to the King County Council, and the King County Council entered its findings with regard thereto, WHEREAS, Fire District No. 1 became part of the City of Tukwila on March 31, 1989, pursuant to an ordinance adopted by the City Council, and WHEREAS, prior to the effective date of annexation, building permit applica- tions were filed with King County for processing under King County development regulations, and those permits were not completely processed by King County before the date the annexation area became part of the City of Tukwila, WHEREAS, the attached list of permit applications (Exhibit A) substantially conform to the zoning and land use regulations approved by the voters of the annexations, and have been substantially processed by King County staff, and WHEREAS, King County currently has no jurisdiction to continue processing such permits, and it is necessary for the protection of the public health and safety for this situation to be rectified immediately, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Development Res_ ulations. The City of Tukwila adopts King County's development regulations for the permits identified in this agreement. King County's development regulations include the King County road standards, road adequacy standards, and grading ordinance; King County's general provisions for loading areas and off street parking; King County's general provisions for landscaping and screening; the Uniform Building Code, Uniform Mechanical Code, and Uniform Fire Code as modified by King County; the enforcement provisions of Title 23 of the King County Code; and the development permit fees of Title 27 of the King County Code. Section 2. Amendments to Exhibit A. Only those building permit applications filed before March 31, 1989 and inadvertently not included in Exhibit A (Pending Applications at King County, Fire District No. 1 Annexation), or those ancillary permits necessary for the completion of projects listed on Exhibit A, can, under these conditions, be added to Exhibit A, (Pending Applications at King County, Fire District No. 1 Annexation) by mutual agreement of the Manager of King County Building and Land Development Division and the Tukwila Planning Director. Section 3. Building Permit Review Process. King County is authorized to be the agent for the City of Tukwila to review, approve, inspect, finalize and issue certificates of occupancy for the building permits described in Exhibit A. Section 4. Emergency Declared. An emergency exists in that the outstanding permits described in Exhibit A cannot be reviewed until the effective date of this ordinance, thus creating a threat to the public health, safety, property and peace. Section 5. Sunset Provision. As each of the permits described on Exhibit A is completed through issuance of a Certificate of Occupancy, this ordinance shall become null and void as to such permit. Section 6. Effective Date. This ordinance shall be in full force and effect as of the date the interlocal agreement is approved. The full text of this ordinance will be mailed without charge to anyone who submits a written request to the City Clerk of the City of Tukwila for a copy of the text.
