HomeMy WebLinkAboutOrd 1879 - Curfew for Minors (Repealed by Ord 1973) J!A: Repealed by 1973 of 4►1, City of Washington Ordinance No. a79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NO. 1771, AS AMENDED, AND AS CODIFIED AT TUKWILA MUNICIPAL CODE 8.75.060, "CURFEW FOR MINORS," TO EXTEND THE EXPIRATION DATE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, in 1996 in response to the 897 juvenile arrests for crime, with approximately 10% of those between 10:00 PM and 6 AM, the City Council passed Ordinance No. 1771, the minor curfew ordinance, as codified at Tukwila Municipal Code 8.75; and WHEREAS, TMC 8.75.060 requires the Police Department to prepare a report that includes, among other things, information on the practicality of performance, placement of violators and the impact of a curfew on juvenile crime and juvenile victimization; and WHEREAS, after considering the Police Department's report issued pursuant to TMC 8.75.060, the Court of Appeals decision in State v. TD. 86 Wn App. 501 (1997), and after considering amendments to Ordinance No. 1771 made in response to the Court's directives in State v. TD the City Council extended the effect of Ordinance No. 1711 by passing Ordinance Nos. 1811 and 1849; and WHEREAS, as measured in three months in both 1998 and 1999, juvenile crime in Tukwila has risen, and as the teen population grows, can be expected to rise, requiring an extra effort to prevent teen crime; and WHEREAS, since passage of the first curfew ordinance in 1996, and continuing through 1999, juvenile victimization has fallen; and WHEREAS, the Police Department supports having the curfew ordinance because it is an effective tool for its use in reducing crime; and WHEREAS, the City Council has now considered the Police Department's report pursuant to TMC 8.75.060 for 1999, as well as the previous years' experience; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Amendment. Ordinance No. 1771, Section 6, "Expiration," as amended by Ordinance No. 1811, Section 4, "Expiration," and Ordinance No. 1849, Section 1, "Expiration," as codified at TMC 8.75.060, are hereby amended to read as follows: 8.75.060 Expiration. A. The results of this ordinance shall be reviewed by the City Council twenty -two months after its enactment. The Police Department and administration will consider the effectiveness of the continuing need for these sections. The report should include, but not be limited to, reporting on the practicality of enforcing the ordinance and any problems with Curfew Extension 99 9/1/99 1 enforcement; what types of placement of curfew violators were made; the impact on juvenile crime statistics and juveniles victimization; the public perception of juvenile crime, number of minors cited for a curfew violation; and any official citizen complaints about these sections. B. The ordinance shall expire two years after its effective date of passage (9- 10 -01) unless prior to that time the City Council shall provide for its extension by ordinance. Section 2. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 3. Effective Date. This ordinance or a summary thereof shall be published in th official newspaper of the City, and shall take effect and be in full force and effect s� after passage and publication as provided by law.
