TITLE 19, SIGN CODE, AND ORDINANCE 773
AUTHORIZING THE BOARD OF ADJUSTMENT TO
CONSIDER APPEALS FROM AND EXCEPTIONS TO
THE SIGN CODE PROVISIONS.
THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS
FOLLOWS:
Section 1. That Section 19.12.060 of the Tukwila
Municipal Code and Ordinance 773 be amended to read as follows:
19.12.060. Application Rejection Appeal. Rejection
of any application for a sign permit shall be made in writing by
the building official and shall state the reasons therefor. A
copy of the rejection notice shall be mailed by certified mail,
return receipt requested, to the applicant at his designated
address. Within thirty days the applicant may file with the City
building official a notice of appeal and request for review by the
Board of Adjustment at a regular meeting not later than sixty days
from the date the notice of appeal is filed, unless a later date is
requested by the applicant.
After a review hearing, the Board of Adjustment shall
forthwith file with the building official and send to the applicant
a written decision either denying the application or directing the
building official to issue the permit. The decision of the Board of
Adjustment shall be final and conclusive unless the original applicant
or an adverse party makes application to the Superior Court of King
County for a writ of certiorari, a writ of prohibition, or a writ of
mandamus within 30 days of the final decision by the Board of
Adjustment.
Section 2. That Section 19.12.080 of the Tukwila
Municipal Code and Ordinance 773 be amended to read as follows:
19.12.080. Criteria for granting variances. The
Board of Adjustment shall grant a variance to the requirements of
Title 19 of the Tukwila Municipal Code (T.M.C.) only if the applicant
demonstrates compliance with section 18.72.010 of the (T.M.C.), items
(1) (6) and in addition:
(A) All facts are presented and reviewed at an advertised
public hearing, and;
(B) The proposed variance shall not interfere with the
location and identification of adjacent business buildings or activities.

WASHINGTON, And approved by the Mayor, at a regular meeting thereof
