City of Tukwila <br />Allan Ekberg, Mayor <br />INFORMATIONAL MEMORANDUM <br />TO: Finance and Governance Committee <br />FROM: Laurel Humphrey, Legislative Analyst <br />DATE: April 6, 2021 <br />SUBJECT: City Council Rules of Procedure Update <br />ISSUE <br />Legislation to adopt new Rules of Procedure of the Tukwila City Council <br />DISCUSSION <br />The City Council's procedures for conduct of its business are largely included in TMC 2.04. This Chapter <br />hasn't been updated since 2003 and contains many sections that are confusing and poorly written, or <br />that describe outdated practices that must be addressed. As previously discussed with the Committee, <br />staff has prepared an ordinance to re-enact Tukwila Municipal Code 2.04 by removing much of the <br />current content yet retaining key elements. Staff has also prepared a draft Rules of Procedure document <br />as well as a resolution that would adopt the new Rules. A Rules of Procedure adopted by resolution is in <br />alignment with many other jurisdictions and considered a best practice as recommended by City <br />Attorneys as well as by Ann Macfarlane at a previous City Council Retreat. Adopting the Rules by <br />resolution as well as establishing an expectation for regular review will pave the way to make future <br />updates simpler to accomplish. <br />The proposed Rules of Procedure is organized until the following main sections: <br />City Council Powers and Duties <br />II. City Council Meetings <br />III. Legislative Process <br />IV. Meeting Conduct <br />V. Public Participation <br />VI. City Council Committees <br />VII. Council Vacancies <br />VIII. Public Records Compliance <br />Staff believes this establishes a good framework for this document, and these sections can be expanded <br />or added to in future updates. The City Attorney and City Clerk's Office both provided thorough review <br />and comment on the legislative package before the Council. Attached to this memo is a table that <br />explains the proposed Rules in greater detail, identifying which language is new and which is currently in <br />the TMC and can be retained or should be updated as shown. <br />RECOMMENDATION <br />Staff is seeking a Committee recommendation on the proposed legislation to forward to the Committee <br />of the Whole on April 26, 2021. <br />ATTACHMENTS <br />Draft Ordinance <br />Draft Resolution <br />Draft Rules of Procedure <br />Table explaining proposed Rules <br />TMC 2.04 <br />
