AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, VACATING 43RD PLACE SOUTH
WITHIN THE PROPOSED PLAT OF FOSTERVIEW ESTATES,
LOCATED IN THE CITY OF TUKWILA; AMENDING THE
OFFICIAL STREET MAP OF THE CITY; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Tukwila conducted a public hearing on
January 10 and 24, 1994, for the purpose of considering the vacation of certain property located
in the City of Tukwila, as described above; and
WHEREAS, TMC 11.60 identifies street vacation procedure including a public hearing by
resolution, review and comment by the Departments of Community Development and Public
Works, and forwarding all relevant information to City Council, all of which have been done;
and
WHEREAS, utilities and public trail exist within the right -of -way which require ease-
ment; and
WHEREAS, the City Council, by motion, approved the vacation and directed staff to
prepare an ordinance; and
WHEREAS, the City Council has determined that the compensation is due the City in
accordance with Tukwila Municipal Code 11.60.050;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation.
A. The following property located in the City of Tukwila is hereby vacated:
A portion of 43rd Place South lying between 42nd Avenue and
43rd Avenue and more specifically described as the east 20 feet of
Tract 67, Riverside Interurban Tract, according to the plat thereof
recorded in Volume 10 of Plats, Page 74, records of King County,
Washington, except the north 350 feet thereof.
B. This vacation is conditioned upon satisfaction of the following:
1. The granting of easement to ValVue Sewer District.
2. The granting of easement to the Tukwila Parks Department for public trail.
3. Compensation to the City in the amount of $1,954.00, in accordance with TMC
11.60.050.
Section 2. Duties of City Clerk. The City Clerk is hereby directed to record a certified
copy of this ordinance with King County, upon determination by the City Public Works
Director that the conditions referenced above have been satisfied.

Section 3. Amendment of official street map. Upon the recording of a certified copy of
the ordinance, the City Public Works Director shall amend the City's official street map to be
consistent with this ordinance.
Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase
of this ordinance or its application to any person or situation should be held to be invalid or
unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this ordinance or its application to any other person or situation.
Section 5. Effective Date. This ordinance or a summary thereof shall be published in the
official newspaper of the City, and shall take effect and be in full force and effect five (5) days
after passage and publication as provided by law, provided that the vacation specified above
shall not become effective until the conditions contained herein have been fully satisfied.
PASSED BY THE CITY COUNCIL OF THE CIT OF TUKWILA, WASHINGTON, at a
Regular Meeting thereof this day of 2000.

Ordinance No. vacating 43rd Place South within the proposed plat of
Fosterview Estates, conditioned upon the granting of easement to ValVue Sewer
District, the granting of easement to the Tukwila Parks Department for public trail, and
compensation to the City in accordance with TMC 11.60.050; providing for severability;
and establishing an effective date.
