Mayor Haggerton announced the purpose of the Executive Session is to discuss Pending Litigation.
It will last no more than 30 minutes, and no decisions will be made during the Executive Session.

CALL TO ORDER /PLEDGE OF ALLEGIANCE /ROLL CALL
Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:01 p.m. and led the
audience in the Pledge of Allegiance.

AMEND AGENDA
MOVED BY HERNANDEZ, SECONDED BY DUFFIE TO AMEND THE AGENDA TO ADD A
SETTLEMENT AGREEMENT BETWEEN KING COUNTY WATER DISTRICT NO. 125, VALLEY VIEW
SEWER DISTRICT AND THE CITY OF TUKWILA AS NEW BUSINESS ITEM #6.
MOTION CARRIED 6 -0.
SPECIAL PRESENTATIONS
a. Introduction of new employees:
Adam Balcom and Justin Haggins, Police Officers
Mayor Haggerton administered the Oath of Office to Adam Balcom, Badge #183. Officer Balcom has a
Bachelor's Degree in Psychology with a minor in Criminology.

Mayor Haggerton administered the Oath of Office to Justin Haggins, Badge #184. Officer Haggins
previously worked for Fred Meyer in loss prevention.
The Mayor and City Councilmembers welcomed Officers Balcom and Haggins to the City.
Ashley Comar, Tourism Marketing Communications Coordinator
Katherine Kertzman, Tourism Manager, introduced Ashley Comar, Tourism and Marketing
Communications Coordinator, to the City Council. Ms. Comar graduated from the University of Puget
Sound with a degree in communications. She is a welcome addition to the tourism team.
The Mayor and City Councilmembers welcomed Ms. Comar to Tukwila.
b. Tukwila Plein Air Paint Out update, Jacque Carroll, Chairperson
Jacque Carroll, Chairperson of the Tukwila Plein Air Paint Out Committee, provided an overview of the
paint out event that took place in the City of Tukwila. This was a sanctioned Tukwila Centennial event,
where artists came together from throughout the Northwest to paint outdoor scenes of Tukwila locations
that are historically and /or culturally significant. The Paint Out Committee developed a list of suggested
locations, and partnered with the Historical Society, Arts Commission, and City staff to create the final
recommended list of locations.
The paint out was well attended and participants commented on the sense of community it inspired in
Tukwila. The event involved 47 applicants and 93 paintings, and there were 3 monetary prizes awarded:
1 Prize of $1,000 Mike Ferguson
2nd Prize of 500 Ned Mueller
3 Prize of 250 Janice Kirstein
Ms. Carroll conveyed that grant funding will be sought for future paint out events that they hope to
incorporate into the annual Tukwila Days celebration.
The Councilmembers offered appreciation to Ms. Carroll and the committee for the work they did in
bringing this event to the City.
c. Human Services and Multi- Service Center Update Evelyn Boykan, Human Services Manager,
and Manuela Ginnett, Housing Program Director, Multi- Service Center
Evelyn Boykan, Human Services Manager, thanked the Council and Administration for ongoing support
with regard to human services programs. The first 2 quarters of 2009 revealed unprecedented financial,
housing, and utility needs from Tukwila residents. Within 6 months into the year, the Human Services
Office heard from more residents that were laid off than in any other time period. Eighty percent of
emergency assistance funds were expended by the second quarter. Water shut -off notices for the first 6
months of 2009 exceeded the total for the first 6 months of 2008. The Human Services Office responded
to 618 requests for some sort of assistance by the end of June, representing a 25% increase over prior
years. The additional dollars granted in the 2009 budget have allowed the Human Services Office to be
able to serve more households, stretching dollars into the third quarter of the year.
Manuela Ginnett, Housing Program Director for the Multi- Service Center, provided an overview of their
services. The Multi- Service Center helps low- income residents of South King County with more than 30
comprehensive programs, such as housing, food and clothing, education, employment, and advocacy for
the elderly.
Ms. Ginnett indicated this has been a challenging year, and rent assistance funds for the year were
depleted in the first 7 months. Many Tukwila residents are at low- income levels and have temporary jobs.
Many people do not meet the criteria to receive services and have to be referred to other resources. Ms.
Ginnett relayed it is fortunate that federal stimulus funding for human services programs is becoming
available that will provide some relief to those in need.

Ms. Ginnett expressed appreciation to Tukwila's Human Services staff for their openness and flexibility in
dealing with a diversity of issues.
The Councilmembers and Mayor thanked both Ms. Ginnett and Ms. Boykan for their commitment toward
the citizens they serve through human services programs.

WAIVING COMPETITIVE BIDDING REQUIREMENTS AND AUTHORIZING THE SOLE
SOURCE PURCHASE OF LIFT STATION CONTROL SYTEMS THROUGH CALVERT
TECHNICAL SERVICES, INC.
MOVED BY HOUGARDY, SECONDED BY HERNANDEZ THAT THE PROPOSED RESOLUTION BE
READ BY TITLE ONLY. MOTION CARRIED 6 -0.

MOVED BY DUFFIE, SECONDED BY QUINN THAT THE PROPOSED RESOLUTION BE ADOPTED
AS READ. MOTION CARRIED 6 -0 TO ADOPT RESOLUTION NUMBER 1688.
b. Authorize the Mayor to sign a reclaimed water service and use area agreement with Starfire
Sports and King County
MOVED BY HOUGARDY, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO SIGN A
RECLAIMED WATER SERVICE AND USE AREA AGREEMENT WITH STARFIRE SPORTS AND
KING COUNTY. MOTION CARRIED 6 -0.
Mayor Haggerton indicated that Tukwila is a leader in the use of reclaimed water.
c. Authorize the Mayor to sign an Interlocal Agreement with the cities of Auburn, Federal Way,
Kent, Renton and the Port of Seattle to form the Valley Narcotics Enforcement Team (VNET)

INTERLOCAL AGREEMENT WITH THE CITIES OF AUBURN, FEDERAL WAY, KENT, RENTON AND
PORT OF SEATTLE TO FORM THE VALLEY NARCOTICS ENFORCEMENT TEAM (VNET).*
Council President Hernandez referenced a question raised by Councilmember Robertson at last week's
Council meeting regarding the termination clause.
Mike Villa, Assistant Police Chief, explained that the Chief of Police from any of the agencies could step
out of the agreement. There is concern about the entity of VNET still being in place even if member
agencies step out. They are still discussing that issue, and since the Police Chiefs have good working
relationships, no problems are anticipated.

Ms. Hernandez indicated that Councilmember Robertson had also inquired about the Port of Seattle
being referred to as a "city" in the agreement.
Assistant Chief Villa stated that Chief Haynes intends to bring this up at the VNET Board Meeting.
Shelley Kerslake, City Attorney, explained this would not be a substantive change and would not affect
the legality of the agreement.
*MOTION CARRIED 6 -0.
d. Briefing on Sign Code update process
Jack Pace, Community Development Director, and Brandon Miles, Senior Planner, provided an update of
the Sign Code process and offered information regarding next steps.
In 2007, the Council identified the need to update the City's Sign Code, which was adopted in 1982.
Since signs impact residents, businesses, and property owners, it was determined that public involvement
was essential. A Sign Code Advisory Committee was formed and comprised of Councilmembers, a
Planning Commissioner, business owners, and residents. The committee met on 6 occasions to provide
input on issues related to regulating signage within the City. The topics included permanent signage,
temporary signage, billboards, and freeway interchange signs. The meetings were open to the public,
and interested parties were invited to attend and provide input. Additional public outreach included
putting pertinent documents and contact information on the City's website; use of email to provide
updates; briefings to local community groups and organizations; notices in the City's Hazelnut newsletter;
and notification in the newspaper.
Now that the Sign Code Committee's work is completed, the next step in the process involves review by
the Planning Commission and then the City Council. Staff is proposing 4 to 5 meetings of the Planning
Commission in the fall to discuss the recommendations of the Sign Code Committee. A draft code will be
prepared for review by the Council. All meetings will be open to the public, and a public hearing will also
be conducted by the Planning Commission. Public outreach will continue throughout the duration of the
process. Once the new Sign Code is adopted, staff will continue to educate and work with the public to
provide assistance with the new provisions.
The Councilmembers thanked Mr. Pace and Mr. Miles for their work on the Sign Code and for the
assistance that was provided to the Committee members.

Approval of a settlement agreement between King County Water District No. 125, Valley View
Sewer District and the City of Tukwila
MOVED BY HOUGARDY, SECONDED BY LINDER TO APPROVE, IN SUBSTANTIAL FORM, A
SETTLEMENT AGREEMENT BETWEEN KING COUNTY WATER DISTRICT NO. 125, VALLEY VIEW
SEWER DISTRICT, AND THE CITY OF TUKWILA WITH THE FOLLOWING CHANGES:
Page 3, Number 3. Delete all words after "construction within the right -of- way."
Page 3, Number 3.2. Delete the words "in their discretion" in the second line.
Page 4, Number 3.3. Delete all words after the words "said fee" in the last line.
Page 4, Number 3.4. Measurement of width for PMF calculation. Any references to "area
of the final patch" should reflect that the City does not measure and calculate the size of
the restoration from the patch. The City measures from the asphalt restoration cut line.

REPORTS
a. Mayor
The Mayor indicated the City website now has information regarding the Sound Transit Link Light Rail
noise impact study.
b. City Council
Councilmember Duffie attended the Tukwila Days event on August 15, 2009. He hopes to see the
Tukwila Days Parade return in 2010.
Councilmember Linder reported that she will be involved with City staff members in reviewing and
interviewing consultants regarding the location for the new Fire Station associated with the Tukwila South
project. The applicants are very qualified, and there will be more to come on this issue.
Council President Hernandez referenced a press release she received recently regarding a group that
made a pilgrimage from Bellingham to Tacoma in support of immigration reform. They had
complimentary comments regarding their involvement with Tukwila. She also attended the Tukwila Days
event on August 15 and thanked Kimberly Matej, Council Analyst, for her work on the Council booth.
Councilmember Griffin also attended the Tukwila Days event and found it to be fabulous.
Councilmember Hougardy attended the Tukwila Days event. She also distributed brochures featuring
information about the Historic Homes Tour.
Councilmember Quinn also attended the Tukwila Days event and expressed appreciation toward the work
of the Council Analyst. He indicated that information will be forthcoming at the next Council meeting
regarding the proposed schedule for a Local Improvement District (LID) for the Tukwila Urban Center
Access Project (Klickitat).
c. Staff

There was no report.
e. Intergovernmental
Kimberly Matej, Council Analyst, indicated the next Shoreline Master Program (SMP) work session is
August 25, 2009. A budget workshop has also been scheduled for September 29, 2009 at 6:00 p.m. in
the Council Chambers.
