SUBJECT: Finding of Existence of an Emergency

The Council passed Resolution 1689 on September 8, 2009 declaring an emergency
related to conditions at the Howard Hanson Dam. The City is currently working on
contracts for flood prevention purposes to raise the height of the City's levees and
perform other related work.
RCW 39.04.280(2)(b) requires a written finding of the existence of an emergency by the
governing body within two weeks of the award of a contract.
The City is currently working on contracts related to flood prevention efforts. One such
contract is for placement of Super Sacks and HESCO bags on top of the levees, along
with other levee repair and related work. This contract is expected to cost just over $2.1
million. Other contracts are also being worked on at this time for lesser dollar amounts.
Given the timing the work must be completed within, the Interim Public Works Director
and Emergency Management Coordinator identified the company with the technical
capability, as well as availability, to complete work on raising the levees within the
required time frame.
RCW 39.04.280 allows for an exemption of competitive bidding requirements under
emergency conditions as defined within the law, and upon declaration of an emergency
by the municipality.
The Mayor executed an Agreement for Flood Prevention Services on October 15, 2009,
with the King County Flood Control Zone District. The Agreement calls for completion
of the levee work by November 7, 2009. The work will be performed by the City under
the direction and supervision of the County and the District.
Every effort will be made to follow normal Council processes for agenda items.
However, this agenda item and other similar emergency measures will more than likely

require rapid consideration by Council, which may necessitate by- passing the standard
Committee, Committee of the Whole and Regular Meeting process.
RECOMMENDATION
Council is being asked to approve the resolution affirming the existence of an
emergency related to the Howard Hanson Dam and resulting flood control efforts.
This item is scheduled to be discussed at the October 19, 2009 Regular Meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, FINDING THE EXISTENCE OF AN EMERGENCY
REQUIRING PUBLIC WORKS, WITHOUT BID, TO ADDRESS A HAZARD
RESULTING FROM DIMINISHED CAPACITY AT THE HOWARD
HANSON DAM, NECESSITATING LEVEE WORK TO BE COMPLETED BY
NOVEMBER 7, 2009.
WHEREAS, a hazard to the public safety exists resulting from diminished capacity
at the Howard Hanson Dam, resulting in a likely release of higher than normal volumes
of water by the United States Army Corps of Engineers; and
WHEREAS, if these hazardous conditions are not corrected immediately, there is
the likelihood of extensive damage to residential and commercial properties; and
WHEREAS, on October 15, 2009, the City executed an Agreement for Flood
Protection Services with the King County Flood Control District (District) calling for
flood prevention measures to be taken by the City, under the direction of the District, to
be completed by November 7, 2009; and
WHEREAS, on September 8, 2009, the Mayor and City Council declared a state of
emergency pursuant to RCW 39.04.280, RCW 35.23.352, Tukwila Municipal Code
Section 3.32.050 and WAC 197 -11 -880; and
WHEREAS, said emergency requires the immediate execution of certain public
works in order to protect persons and property within the City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Pursuant to RCW 39.04.280, RCW 35.23.352, Tukwila Municipal Code Section
3.32.050 and WAC 197 -11 -880, the City Council of the City of Tukwila hereby finds the
existence of an emergency resulting from diminished capacity at the Howard Hanson
Dam, which has caused conditions that are a hazard to the public safety and require
emergency public works, without formal bid, as described in the Declaration of
Emergency issued by the Mayor and City Council on September 8, 2009. The City
Council hereby affirms said Declaration.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at
a Regular Meeting thereof this day of 2009.
