HomeMy WebLinkAboutOrd 0592 - 1965 Fire Prevention Code (Repealed by Ord 816)CITY OF TUKWILA WASHINGTON ORDINANCE NO. 592 REPEALED BY 816 AN ORDINANCE adopting a fire prevention code prescribing regulations governing conditions hazardous to life and property from fire or explosion, and establishing a bureau of fire prevention and providing officers thereof and defining their powers and duties and repealing Ordinance No. 516. THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION 1. ADOPTION OF FIRE PREVENTION COTE There is hereby adopted that certain "Fire Prevention Code, 1965 Edition issued and recommended by the American insurance Association, successor of the National Board of Fire Underwriters, of which not less than three (3) printed conies in book form have heretofore been filed in the office of the City Clerk and made available for examination by the public. And the same are hereby adopted and incorporated as fully as if set out in length herein, and from the date on which this ordinance shall take effect the provisions thereof shall be controlling within the limits of the City of Tukwila. SECTION 2. ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION a. The Fire Prevention Code shall be enforced by the Bureau of Fire in the Fire Department of the City of Tukwila which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. b. The Fire Marshal in charge of the Bureau of Fire Prevention shall be appointed by the Fire Chief on the bases of Examination to determine the qualifications. His appointment shall continue during good behavior and satis— factory service. c. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary, in order to carry out and enforce the terms and conditions of the Fire Prevention Code. d. A report of the Bureau of Fire Prevention shall be made annually and transmitted to the Chief executive officer of the municipality; it shall contain all proceedings under the code, with such statistics as the Chief of the Fire Department may wish to include therein; the Chief of the Fire Depart— ment shall also recommend any amendments to the code which, in his judgment shall be desirable. SECTION 3. DEFINITIONS a. Where ever the word "MUNICIPALITY" is used in the Fire Prevention Code, it shall be held to mean the City of Tukwila. b. Where ever the work "CORPORATION COUNSEL" is used in the Fire Prevention Code, it shall be held to mean the Attorney for the City of Tukwila. c. Where ever the words "CHIEF OF THE BUREAU OF FIRE PREVENTION" are used in the Fire Prevention Code, they shall be held to mean the Fire Marshal. SECTION 4. ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF EXPLOSIVES AND BLASTING AGENTS IS TO BE PROHIBITED The limits referred to in Section 12.5 (b) of the Fire Prevention Code, in which storage of explosives and blasting agents is excluded from R- 1 -7.2, R- 1 -9.6, R -1 -12.0, R- 2 -8.4, R3, R- 3 -6.0, R4, R -A, CPR, C -1, Pf, RMH, C -2, Classification as per ordinance no. 251. The Fire Marshal may issue a special permit for such storage where there appears in his iudgment to be no undue danger to persons or property. SECTION 5. ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF FLAMMABLE LIQUIDS IN OUTSIDE ABOVE GROUND TANKS TS TO BE PROHIBITED a. The limits referred to in Section 16.22 (A) of the Fire Prevention Code in which storage of flammable liquids in outside above ground tanks is prohibited, are hereby established, these limits R- 1 -7.2, R- 1 -9.6, R- 2 -8.4, R -3. R 3 6.0, R -h, R -A, CPR, C -1, PF, RMH, C -2. Classifications as per ordinance Nn. 21. How— ever, the Fire Marshal may issue a special permit for above arnnnd storage where, in his judgment, there is no undue danger to persons or property. b. The limits referred to in Section 16.51 of the Fire Prevention Code, in which new bulk plants for flammable or combustible _liquids are prohibited are hereby established as follows: These limits include R- 1 -7.2, R- 1 -9.6, R -1 -12.0, R- 2 -8.4, R -3 R- 3 -6.0, R -4 R -A, CPR. C -1 PF, RMH, C -2, Classifications as ner ordinance No. 251. However, the Fire Marshal may issue a special permit where in his judgment there is no undue danger to persons or property as a result of explosion or fire. SECTION 6. ESTABLISHMENT OF LIMITS IN WHICH BULK STORAGE OF LIQUEFIED PETROLEUM GASES IS TO BE RESTRICTED The limits referred to in Section 21.6 (A) of the Fire Prevention Code, in which bulk storage of liquefied petroleum gas is restricted, are hereby established, these limits include R- 1 -7.2, R- 1 -9.6, R -1 -12.0, R.- 2 -8.4, R -3, R- 3 -6.0, R -4, R -A, CPR, C -1, PF, RMH, C -2, Classification as per ordinance No. 251, The Fire Marshal may issue a special nermi_t for such storage where in his judgment, there is no undue danger to persons or property. SECTION 7. MODIFICATIONS BY THE FIRE CHIEF The Chief of the Fire Department shall have power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner 2 or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the Code, provided, however, that the spirit of the Code shall be observed, public safety secured, and sub- stantial justice done in each such case. All the particulars of such modification, when granted or allowed and the decision of the Chief of the Fire Department thereon shall be entered upon the records of the Department and a signed copy shall be furnished the applicant. SECTION 8. APPLICATION, APPEAL: Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant the permit applied for, or when it is claimed that the pro- visions of the Code do not apply or that the true intent and meaning. of the Code have been misconstrued or wrongly interpreted, such applicant may appeal from such decision of the City Council of the City of Tukwila within ten days from the date of the decision appealed. Any such appeal shall be in writing and after the receipt of any such appeal the City Council ehall set a date of hearing which shall he within thirty (30) days after the rereint of Notice of Appeal. SECTION q. NEW MATERIALS, PROCESSES OR OCCUPANCIES WHICH MAY REQUTRE PERMTTS The Director of the Building Department, the Chief of the Fire Department and the Chief of the Bureau of Fire Prevention shall act aG a committee determine and specify, after giving affected rersons an opportunity f o be heard, any new material, processes or occupancies, which shall renui_re permits in addition to those now enumerated in said code, the Chief of the Bureau of Fire Prevention shall post such list, in a conspicious place in his office, and diG- tribute copies thereof to interested persons. SECTION 10. ADDITIONS, AMENDMENTS: The Fire Prevention Code is amended and changed in the following respect: a. Article 13 entitled "FIREWWORKS" of said "Fire Prevention Code, 1965 Edition" is hereby deleted in it's entirety. b. Article 12 Section 12.4 entitled "Bond Required for Blasting" of said "Fire Prevention Code, 1965 Edition" is hereby deleted in it's entirety. c. Article 16, Division VI, Service Stations is amended to conform to Article 16, Division VI as amended and published by the American Insurance Association in October 1966. d. Section 16.71, Line 2, is amended to read as follows: ...extinguishers have a minimum classification of 12 B,C. located so that an... e. In Section 30.3a, insert the following words: "On or within a building" after "Where such work is taking place f. In Section 30.3a, add the following exceptions: Group I and J Occupancies shall be exempt from the provisions of this section. g. Article 31 list of standards and publications: The following listed editions of the standards listed are to be used for reference in this code in lieu of the edition listed in the Article as published in the 1965 Edition, a copy of each standard is on file with the Chief of the Fire Department. ADOPTION OF SUBSEQUENT STANDARDS, PTTBLICATIONS: By the reference thereto made herei_nahove, said "FIRE PREVENTION CODE, 1965 EDITION" together with any and all amendments. modifications or additions thereto hereafter printed and filed with the City Clerk as hereinabove specified, including the adoption of any subsequent standards and uublications or supplements or amendments to Article '31 of the aforesaid- Code. are in— corporated and made a part of this ordinance as fully and with the same Affect as if set out herein in full. SECTION 12. VIOLATION, PENALTY Any person, firm or corporation who shall violate any of the provisions of the provisions of the Code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement or of specifications or plans submitted and approved thereunder, or any certificate or permit issued there— under, and from which no appeal has been taken or who shall fail to comply with such an order as affirmed or modified by such proper authority, or by Court of competent jurisdiction within the time fixed herein, shall severalty for each and every such violation and non complaince respectively, be guilty, upon conviction thereof, of a misdemeanor, punishable by a fine of not to exceed five hundred dollars ($500.00) or by imprisonment of not more than ninety (90) days, or by both such fine and imprisonment. SECTION 13. VALIDITY The City of Tukwila, Council hereby declares that should any section, paragraph, sentence, or word of this ordinance or of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the City Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 14. REPEALER The following ordinance is hereby repealed: Ordinance No. 516 adopted May 20, 1968 SECTION 15. DATE OF EFFECT This ordinance shall take effect and be in force five (5) days after its adoption and publication as required by law.
