and to inform all successors and assignees of the existence ofthe drainage
control facilities, and of the requirement for its continued maintenance; and
THE UNDERSIGNED agree to permit authorized representatives of the
City of Tukwila to enter onto the property for inspection of the drainage control :
facility or monitoring, correction or abatement of conditions related to the
drainage control plan; and
THE UNDERSIGNED acknowledges that the City is not responsible for
the adequacy or performance of the drainage control plan or the drainage control
facilities and waives any and all claims against the city for any harm, loss or
damage related to the plan or to drainage or erosion on the property except for
claims arising from the City's sole negligence. J ;;ti..;
